Staff or th, City Court,ii woo would tii, an i/am r~movad from th, Consent Calendar for purposes of public input may toques/the 18a¥or to r, move th~ item. 4.1 Minutes of Special Meeting (Joint City Council/Commissions Workshop) of March 20th, Special Meeting (SEMS Training) of April 6th and Regular Meeting of April 6, 2004 STAFF RECOMMENDATION: Approve 4.2 Approval of Improvement Agreements for the Tassajara Creek North (Somerset Lane) and Tassajara Creek South (Maymont Lane) Bridges associated with Tract 7414 (Tassajara Creek Phase 3 - GHC Roxbury, LLC) (File # 600-60) Greenbriar Homes Communities (dba GHC Roxbury, LLC) is required by the Conditions of Approval for Tract 74.14 (Tassajara Creek Phase 3) to construct two vehicle bridges over Tassajara Creek to serve their future subdivision. Tract 7414 is located in Eastern Dublin on the west side of Tassajara Creek, immediately west of Greenbriar's Phase 1 and 2 subdivisions. Greenbrier intends to begin construction of the two new bridges in advance of other required subdivision improvements to provide access to the project site. STAFF RECOMMENDATION: Adopt Resolution approving Improvement Agreements. 4.3 Acceptance of Improvements for a Portion of Searlett Drive (Sonic Development, LLC) (File # 600-30) The street improvements associated with the portion of Scarlett Drive that extends across the vacant Corrie Development property, south of Dublin Boulevard and east of Chabot Canal, have been constructed pursuant to the Improvement Agreement, and should now be accepted by the City for permanent maintenance. STAFF RECOMMENDATION: Adopt Resolution accepting improvements and approving traffic control devices. 4.4 Award of Bid - Contract 04-02, Traffic Signal Upgrade - Dublin Boulevard and Scarlett Drive (File # 600-35) This project will modify the traffic signal system at the intersection of Dublin Boulevard and Scarlett Drive by installing new components and modifying existing pavement striping to incorporate the new Scarlett Drive northbound lanes along the east side of the Chabot Channel. STAFF RECOMMENDATION: Approve $7,500 Budget Change from Category 2 Eastern Dublin Traffic Impact Fees and adopt Resolution awarding bid to Steiny & Co. ($38,636). 4.5 Second Amendment to Tract Developer Agreement, Tract 7075 (Tassajara Creek, Phase I - GHC Investments, LLC) (File # 600-60) The developer of Tassajara Creek phaSe I - Greenbrier Tract 7075, has asked that the governing Tract Developer Agreement be amended to allow until October 16, 2004 to complete the remaining subdivision improvements and landscaping. STAFF RECOMMENDATION: Adopt Res.o. lutipn extending completion date for Tract 7075 an additional 6 months or until October 16, 2004. 4.6 Second Amendment to Tract Developer Agreement, Tract 7279 (Tassajara Creek, Phase II - GHC Investments, LLC) (File # 600-60) The developer of Tassajara Creek Phase II- Greenbrier Tract 7279, has requested that the governing Tract Developer Agreement be amended to allow extension of the deadline to complete the remaining subdivision improvements and landscaping until October 16, 2004. STAFF RECOMMENDATION: Adopt Resolution extending completion date for Tract 7279 an additional 6 months or until October 16, 2004. STAFF RECOMMENDATION: 4.7 Authorization to Solicit Bids - Contract 04-01, Traffic Signal at Dublin Boulevard and Inspiration Drive (File # 600-35) This project will construct a traffic signal at the intersection of Dublin Boulevard and Inspiration Drive. Traffic volumes have escalated over time at this intersection due to increased traffic on Inspiration Drive from the Valley Christian Center schools and nearby housing developments (Hansen Ranch and Clifden Parc). It is anticipated that traffic volumes will further escalate if the Schaefer Ranch development is constructed to the west of the existing terminus of Dublin Boulevard. STAFF RECOMMENDATION: Authorize Staff to solicit bids. 4.8 Authorization to Solicit Bids - Contract 04-06, 2003-04 Annual Street Overlay Program (File # 60035) This program will remove and replace failed aSphalt concrete pavement and resurface entire street with 1 ½" of asphalt concrete, and restripe pavement markings on various City streets. STAFF RECOMMENDATION: Authorize Staff to advertise for bids. 4.9 City Treasurer's Investment Report for 3rd Quarter of FY 2003-04 (File # 320-30) The City's investment portfolio totals $95,648,248 (market value). As of March 31, 2004, funds were invested at an average yield of 2.133%. STAFF RECOMMENDATION: Receive Report. 4.10Financial Reports for the Month of March 2004 (File # 330-50) STAFF RECOMMENDATION: Receive Reports. 4.11 Acceptance of Work- Contract 03-08, Alamo Creek Bike Path - Amador Valley Boulevard to North City Limits (File # 600-35) This project constructed a 12-foot wide pedestrian and bicycle path along Alamo Creek between Amador Valley Boulevard and the north City limits. In addition to paving an existing Zone 7 Water Agency maintenance road along the west side of Alamo Creek, a raised pedestrian crosswalk was constructed on Willow Creek Drive at Alamo Creek Park, and 200 linear feet of 4-foot high chain link fence was installed along the creek. STAFF RECOMMENDATION: Accept improvements and authorize the release of retention after 35 days if there are no subcontractor claims. 4.12 Acceptance of Work - Contract 01-12,1-580FFassajara Road Interchange Improvement Project (File # 600-35) DeSilva Gates Construction has completed the construction of the 1-580/Tassajara Road Interchange Improvement project. The City Council will consider approval of three Contract Change Orders and acceptance of the project as complete. STAFF RECOMMENDATION: Approve Contract Change Orders 35, 38 and 39; accept improvement and approve release of retention after 35 days if there are no subcontractor claims; and approve Budget Change in the amount of $55,630.14. 4.13 Consultant Services for Building Evaluations, Painting and Construction Management for the Shannon Community Center Improvements (File # 600-30) The City is entering into a new agreement with the Zalm Group to complete work on the Shannon Community Center originally described under a contract that has expired. STAFF RECOMMENDATION: Adopt Resolution approving Agreement and approve Budget Change. 4,14Warrant Register ($908,435.06) dated April 20, 2004 (File # 30040) STAFF RECOMMENDATION: Approve 5. ~TEN COMNIUNICATIONS- None 6. PUBLIC HEARI. N.G 6.1 AMB Properties, West Dublin Transit Village- Appeal of Planning Commission approval of Tentative Parcel Map and Site Development Review (SDR) and Planning Commission's recommendation that Council approve Mitigated Negative Declaration, Planned Development Rezoning and Stage 2 Development Plan and Development Agreement (DA) PA 02-003 (File # 410-30/600-60) The City Council will consider an appeal of the Planning Commission decision to approve Tentative Parcel Map and Site Development Review for a transit village at 6700 Golden Gate Drive, proposed by AMB Property, and to appeal the Planning Commission's recommendation to Council to approve a Mitigated Negative Declaration, Planned Development Rezoning and Stage 2 Development Plan and Development Agreement for the transit village. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution denying appeal and affirming Planning Commission Resolution No. 04-12 Approving a Tentative Parcel Map and SDR and Finding that Resolution No's 04-08, 04-09, 04-11 Recommending Council Approval of a Mitigated Negative Declaration, PD Rezoning and Stage 2 Development Plan and DA for the West Dublin Transit Village are Not Appealable - OR - by Consensus, indicate intent to afl.mn Planning Commission's actions in part and reverse in part - OR - reverse Planning Commission's approval of Tentative Parcel Map and SDR and continue appeal to May 4, 2004 for adoption of Resolution Resolving Appeal. 6.2 AMB Properties, West Dublin Transit ¥iHage - Mitigated Negative Declaration, Planned Development Rezoning and Stage 2 Development Plan and Development Agreement PA 02- 003 (File # 450-30/600-60) The City Council will consider a Planned Development Rezoning and Stage 2 Development Plan, Vesting Tentative Parcel Map, Site Development Review and a Development Agreement for a mixed- use project transit village containing a maximum of 304 multi-family residences, neighborhood retail uses, and an approximately 150,500 square foot office building at 6700 Golden Gate Drive on 9.06 acres located in the West Dublin BART Specific Plan Area. STAFF RECOMMENDATION: Conduct public heating; deliberate; adopt Resolution approving the Mitigated Negative Declaration; waive reading and INTRODUCE Ordinance approving the Planned Development Rezoning and Stage 2 Development Plan; waive reading and INTRODUCE Ordinance approving a Development Agreement between the City and AMB Properties. 6.3 Dublin Transit Center Site A-2 0gAit, Inc.) Planned Development Zoning and Development Agreement for the Project Area PA 03-061 (File # 600-60) This is the second reading of two Ordinances. The proposed project is a Stage 2 Planned Development Zoning and Development Agreement for the construction of a 112-unit affordable apartment community located on a portion of Dublin Transit Center Site A at the southwest corner of Dublin Boulevard and DeMarcus Boulevard. The project is proposed to be 3 stories of residential over one level of parking. All units will be affordable to very low and low income households. The property is zoned PD, Planned Development and is located within the Eastern Dublin Specific Plan area. The General Plan and Eastern Dublin Specific Plan land use designation for the property is High Density Residential. STAFF RECOMMENDATION: Conduct public heating; deliberate; waive reading and adopt Ordinanc, e{,s). 6.4 Tassajara Creek Phase III (Greenbriar Homes Communities Residential Development) Development Agreement PA 02-048 (File # 600-60) This is the second reading of an Ordinance approving a Development Agreement for the Tassajara Creek Phase III (Greenbriar Homes Communities Residential Development). The proposed Tassajara Creek Phase III project is part of a larger 5-phase project for the Tassajara Creek-G-reenbriar project that has been approved in phases since March 2000. This phase of the project consists of an approximate 20.3-acre site divided into 100 single-family detached and 8 attached residential lots on 20.3 acres with eight open space parcels that total approximately 11.5 acres. STAFF RECOMMENDATION: Conduct public heating; deliberate; waive reading and adopt Ordinance. 6.5 Site Development Review (SDR) and Master Sign Program (MSP) for the Trumark Commercial Retail Center PA 03-068 (File # 410-30/400-30) This proposed project consists of a SDR permit and MSP for the development of a 46,200 square foot retail shopping center on a 4.55-acre site on the southwest corner of Dublin Boulevard and Myrtle Drive, immediately east of the Hacienda Crossings Shopping Center, north ofF#rd of Dublin and west of the Extended Stay America hotel. STAFF RECOMMENDATION: Conduct public heating; deliberate; adopt Res,olufion approving SDR and MSP. 6.6 Amendments to the Dublin Municipal Code (Zoning Ordinance) PA 04-004 - Amendments to Title 8, Chapter 8.12, Zoning Districts and Permitted Uses of Land and Chapter 8.108, Temporary Use Permit regarding Automobile/Vehicle Storage Lots (File # 450-20) This is the second reading of an Ordinance which would make the establishment of automobile/vehicle storage lots in C-2, General Commercial zoning districts, subject to a Temporary Use Permit and which would establiSh development review standards for more effective regulation of automobile/vehicle storage lots. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt Qr,dinance, amending Title 8 of the Dublin Municipal Code (Zoning Ordinance). 7. UNFIniSHED BUSINESS 7.1 Continuation of Emergency Action, Progress Report on Remediation Work, and Request for Additional Fund. s for Remediation at Dublin Civic Center (File # 530-10/600-30) The Civic Center ~ncurred water damage from rain in early March. At the March 16th City Council meeting, the Council approved a declaration of emergency in order to allow a waiver of competitive bid to obtain a contractor for environmental remediation work related to the water intrusion and authorized a budget of up to $220,000 for the work. This item would approve a continuation of the declaration of emergency and increase necessary funding to complete the remediation work. STAFF RECOMMENDATION: Adopt Resolution approving continuation of emergency action and approve recommended increase from current budget allocation of $220,000 by $371,200, and. approve Budget Change. 7.2 Agreement Amendment with the Zahn Group for Design of Building Remediatlon and Restoration for Water Intrusion and Management of Building Remediation and Restoration Project (File # 600-30) On March 16, 2004, the City Council approved a contract with the Zahn Group, Inc., for Water Intrusion Investigation and Management of the Environmental Remediation Project. Preliminary investigation'of the water intrusion to date indicates that additional funds for consultant services will be necessary to complete the remediation. STAFF RECOMMENDATION: Approve Budget Change in the amount of $46,760 and adopt Resolution approving amendment to Agreement with the Zahn Group. 8.
