City of Dublin et al., U.S. District Court, Northern District of California, Case C 07-05794 MHP 1. CALL TO ORDER & PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT OF CLOSED SESSION ACTION 3. ORAL COMMUNICATIONS 3.1 Presentation by the Community Development Department on Housing Opportunities in the City of Dublin and Proclamation for Housing Opportunities Week (610-50) The City Council will receive a presentation from Staff on Housing Opportunities in Dublin and be presented with a proclamation regarding Housing Opportunities Week. STAFF RECOMMENDATION: Receive presentation. 3.2 2009 Bike to Work Day Presentation (585-95) Bike to Work Day is an annual regional event organized by the East Bay Bicycle Coalition to promote the use of alternative modes of transit. This presentation is intended to update the City Council on the City's involvement in Bike to Work Day events taking place in Dublin. STAFF RECOMMENDATION: Receive presentation. 3.3 National Public Works Week Proclamation (610-50) 3.4 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (31 MINUTES, In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda, The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action, Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes -None. 4.2 Extension of the First Responder Advanced Life Support Agreement with the County of Alameda (600-40) This item would approve atwo-year extension of the First Responder Advanced Life Support (FRALS) agreement with the County of Alameda. The agreement reimburses the City of Dublin for providing four (4) first responder units, which supplies an enhancement to the emergency medical services within the City of Dublin. STAFF RECOMMENDATION: Adopt Resolution Authorizing aTwo-Year Extension (July 1, 2009 -June 30, 2011) to the First Responder Advanced Life Support (FRALS) Agreement with the County of Alameda. 4.3 Delta Dental Contract Renewal and Amendment (720-40) The City Council will consider authorizing the City Manager to execute a contract renewal and amendment with Delta Dental of California. STAFF RECOMMENDATION: Adopt Resolution Authorizing City Manager to Execute Contract Renewal and Amendment with Delta Dental of California. 4.4 California Public Employees Retirement System Delegation of Authority (720-60) The City Council will consider adopting a resolution that authorizes the Human Resources Director, as its delegate, to file disability retirement applications on behalf of the City of Dublin. STAFF RECOMMENDATION: Adopt Resolution Authorizing California Public Employees Retirement System Delegation of Authority. May 5, 2009 Dublin City Council Agenda Page 2 of 5 4.5 City Treasurer's Investment Report for 3rd Quarter 2008-2009 (320-30) The City's investment portfolio totals $103,789,958 (par value). As of March 31, 2009, funds were invested at an average yield of 3.483%. Staff will provide a background report on the City investment portfolio as well as the investment results as of March 31, 2009. STAFF RECOMMENDATION: Receive the report. 4.6 Consultant Services for New Dublin Maintenance Yard Facility Improvements (600-30) The consultant services will provide for the detailed design and construction documents necessary to bid and build the proposed improvements at the City's new Dublin Maintenance Yard. STAFF RECOMMENDATION: Adopt Resolution Approving an Agreement with Dahlin Group Architecture Planning for Architectural Design Services for the Maintenance Yard Facility Improvements. 4.7 Preliminary Financial Reports for the Month of March 2009 (330-50) This item provides the report of the financial statements for the month of March 2009. STAFF RECOMMENDATION: Receive the reports as authorized by Section 41004 of the California Government Code. 4.8 Resolution Rescinding and Directing the Rescission of the Various Approvals for the Parcel s of the Promenade at Dublin Ranch Project (410-30/450-20) The City Council will consider the rescission of their approval for Parcel 5 of the Promenade at Dublin Ranch project and the request of the Planning Commission and Community Development Director to rescind their respective approvals. STAFF RECOMMENDATION: Adopt Resolution Rescinding Its Approval for and Requesting that the Planning Commission and Community Development Director Rescind their Respective Approvals for the Parcel 5 of the Promenade at Dublin Ranch Project and Directing Staff to Reschedule Future Public Hearings on the Project in the Manner Required by Law. 4.9 Warrant Register ($2,034,412.39) dated May 5, 2009 (300-40) STAFF RECOMMENDATION: Review and authorize the issuance of payments. 5. WRITTEN COMMUNICATIONS 5.1 Employer Partnership Initiative between the City of Dublin and United States Army Reserve (600-50) The City Council will consider signing an Employer Partnership Initiative with the United States Army Reserve to explore mutually beneficial initiatives that support the missions of both organizations and will encourage Army Soldiers to pursue careers with employer partners. STAFF RECOMMENDATION: Receive oral communication from Richard P. (Phil) Stage, Program Support Manager and consider signing Employer Partnership Initiative statement with United States Army Reserve. 6. PUBLIC HEARINGS -None. 7. UNFINISHED BUSINESS 7.1 General Fund Expense Reduction (330-20) The City Council will consider adopting a resolution that authorizes the City Manager to propose the implementation of necessary general fund expenses reductions to achieve a balanced Fiscal Year 2009-2010 Budget no later than June 30, 2009. STAFF RECOMMENDATION: Adopt Resolution Authorizing the City Manager to Propose the Implementation of Necessary General Fund Expense Reductions to Achieve a Balanced Fiscal Year 2009-2010 Budget No Later than June 30, 2009. May 5, 2009 Dublin City Council Agenda Page 3 of 5 7.2 Revisions to the Personnel System (700-20) The City Council will consider amending the City's Classification and Salary Plans to adopt two new classifications entitled Environmental Specialist and Environmental Technician. STAFF RECOMMENDATION: Adopt Resolution Amending the Classification Plan; and adopt Resolution Amending the Salary Plan for Full-Time Personnel. 7.3 City of Dublin Greenhouse Gas Emissions Inventory (530-50) The City Council will receive a report on the Fiscal Year 2008-2009 high priority objective to conduct a greenhouse gas community and municipal operations inventory. The report presents an estimated amount of greenhouse gases emitted by the City's various sectors for Calendar Year 2005. STAFF RECOMMENDATION: Accept report and direct Staff to develop a proposal for a greenhouse gas emissions reduction target and a proposed work outline to develop a Climate Action Plan as part of the Fiscal Year 2009-2010 Green Initiatives Taskforce proceedings, which would include evaluating the preparation of an Environment Impact Report (EIR) as an economic stimulus measure for the development community. 7.4 Follow-Up Presentation of the Livermore Amador Valley Transit Authority's Bus Rapid Transit (BRT) Project (1060-20) This presentation will re-introduce the City Council to the Livermore Amador Valley Transit Authority's (LAVTA's) Bus Rapid Transit (BRT) project and present several issues that need to be addressed by the City Council. STAFF RECOMMENDATION: Receive the presentation from Staff and LAVTA's consultant and direct Staff to: 1) Coordinate with LAVTA to relocate the Art Bus Shelters from Dublin Boulevard to Village Parkway (Preferred Option) or Amador Valley Boulevard/Regional Street (Second Option); 2) Discontinue or defer the Downtown Public Art/Bus Shelter Project CIP No. 94252; and 3) Grant LAVTA a variance for the bench and receptacle color from the green identified in the Streetscape Master Plan to silver to maintain consistency with the RAPID branding. 8. NEW BUSINESS 8.1 Proposed Modifications Designed to Provide Assistance to Businesses and Property Owners in the City During the Economic Downturn (450-20/400-30/410-30) At the request of the City Council, Staff has been reviewing the Zoning Ordinance for ways to assist the business community during the current economic downturn. The Planning Division has identified several alternatives to streamline the entitlement process for development applications and to promote businesses in Dublin. These alternatives include modifications to the Site Development Review Chapter (Chapter 8.104), regarding the level of review required for projects and modifications to the Sign Regulations (Chapter 8.84), to facilitate the use of banner signs and balloon signs. The proposed modifications to the sign regulations include: a temporary elimination of fees for promotional banners and balloons and other minor modifications to the Sign Ordinance. STAFF RECOMMENDATION: Receive presentation, receive public comment and provide Staff with direction. 8.2 Sales Tax Reimbursement Program Agreement with Ring Properties (600-30) The City Council will consider a Sales Tax Reimbursement Agreement between the City and Ring Properties for improvements made to 11501 Dublin Boulevard. This is being considered as an economic stimulus measure. STAFF RECOMMENDATION: Adopt Resolution Approving an Agreement for Reimbursement of Sales and Use Tax Revenue with Ring Properties relating to Improvements to be Performed on a Property located at 11501 Dublin Boulevard. May 5, 2009 Dublin City Council Agenda Page 4 of 5 8.3 Approve Letters of Support for Assembly Bill (AB)1358 (Hill) -Safe & Sustainable Takeout Food Packaging Act; AB 68 (Brownley) and AB 87 (Davis) -Fee for Single Use Bags (660-40) AB 1358 would ban the use of polystyrene takeout food containers within the State of California. AB 68 and AB 87 would require a 25 cent fee per bag for single use bags from grocery and retail stores. These bills will likely result in a reduction of litter and debris from unrecycled and discarded bags and containers, and may result in less costly trash abatement programs by municipalities. A portion of the single-use bag fee would be distributed to local agencies for use in trash abatement and water quality programs. STAFF RECOMMENDATION: Accept report and authorize the Mayor to sign the letters of support to Assemblymember Jerry Hill (AB 1358), Assemblymember Julia Brownley (AB 68), Assemblymember Mike Davis (AB 87), and to Assemblymember Mary Hayashi (all three bills). 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
