REGULAR MEETING - May 13, 1991 DUBLIN CIVIC CENTER Monday - 7:30 p.m. 100 CIVIC PLAZA A complete packet of information containing all Staff Reports and exhibits related to each agenda item is available for public information and perusal several days prior to a council meeting at the Dublin Library and also in the city Clerk's Office at the Civic Center. 1. CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 Adoption of a Military Unit Serving or Having Served in the Gulf Theater Operation The City has received a letter from a representative of the citizen's Committee for "America supporting Americans". The Committee is requesting that the City Council take the following actions: 1) Adopt a Resolution establishing the City'S own "adopted sons and daughters"; 2) Establish a citizen committee which will function as liaison between the community and the adopted unit; and 3) Donate a symbolic gift from the City to each member of the adopted unit (i.e., key to the City, medallion of City seal, etc.) STAFF RECOMMENDATION: Receive Presentation. At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City Counci l Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Clerk to have their particular concern placed on the agenda for a future meeting. The City Council CANNOT deliberate or take action on a non-agenda item UNLESS there is factual evidence presented to the Counci l indicating that the subject brought up falls into one of the exceptions under Government Code Section 54954.2. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the Consent Calendar for purpose of public input may request the City Council to remove the item. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes: Regular Meeting of April 22, 1991 STAFF RECOMMENDATION: Approve 4.2 City Treasurer's Investment Report for Period Ending April 30, 1991 STAFF RECOMMENDATION: Accept Report 4.3 Amendment to Agreement for Legal Services Following a review of legal services provided to the City by the firm of Meyers, Nave, Riback & West, an amendment to the agreement will be considered by the City Council. The amendment will increase the hourly billing rate for those services rendered by a partner in the firm of MNRW in connection with: 1) eminent domain actions; and 2) actions concerning the City'S compliance with the California Environmental Quality Act in which the City is a defendant. STAFF RECOMMENDATION: Approve Amendment to Agreement and authorize Mayor to execute same. 4.4 Acceptance of Work - Contract 90-10A - Pedestrian Signal Handicap Modification Total expenditures for this project exceeded funds budgeted by $347.50. Work performed included relocating or installing additional pedestrian signal push buttons for handicap accessibility. STAFF RECOMMENDATION: 1) Accept improvements; 2) authorize $347.50 budget transfer from Contingent Reserve; and 3) authorize $18,592 payment to Richard Heaps, Electrical Contractor. 4.5 Acceptance of Work - Contract 90-11 - Frederiksen School Play Area Improvements This project provided new play equipment and an improved play area for the Frederiksen School Kindergarten. The work was completed within funds budgeted. STAFF RECOMMENDATION: 1) Accept improvements; 2) authorize $3,442.31 budget transfer from Contingent Reserve; and 3) authorize $4,947 retention payment to Munkdale Bros. 4.6 Proposed Amendments to Personnel System Resulting from the Clerical Classification Study The City recently completed a clerical classification study encompassing three classifications (13 positions). As a result of the study, several changes to the City's Personnel System are being proposed. STAFF RECOMMENDATION: Accept clerical classification study and adopt Resolutions and revised position Allocation Plan 4.7 Agreement between City of Dublin and County of Alameda for Community Development Block Grant Programs for Fiscal Year 1991-92 The City of Dublin has participated in the Alameda County Urban County Housing and Community Development Block Grant Program since 1982. This year's agreement would provide $46,803 in funding to be allocated: 1) Minor home repair program ($8,797); 2) Dublin Senior Center renovation ($9,225); 3) Dublin Housing Authority/Arroyo vista playground equipment installation project ($23,781); and 4) Kaleidoscope Activity Center ($5,000). STAFF RECOMMENDATION: Adopt Resolution approving agreement and authorize Mayor to execute same. 4.8 Finance Report for Period Ending April 30, 1991 STAFF RECOMMENDATION: Receive Report. 4.9 Warrant Register Dated May 13, 1991 STAFF RECOMMENDATION: Approve 4.10 Renegotiation of the Santa Rita Property Tax Exchange Agreement Alameda County representatives have expressed a willingness to renegotiate the Santa Rita Property Tax Exchange Agreement, provided that the City consider a mixed use development on the Santa Rita property. In order for the City to evaluate the accuracy of a cost analysis being prepared by an Economic Consultant hired by the County, the services of an Economic Consulting Firm may be required by the City. STAFF RECOMMENDATION: Receive report from Staff and authorize Staff to secure the services of an Economic Consulting Firm with a cost not to exceed $5,000, if necessary. 5. WRITTEN COMMUNICATION - None 6. PUBLIC HEARING 6.1 1990 Edition of National Electrical Code state Law requires the City to adopt the latest edition of the National Electrical Code within 6 months after the state has adopted the Code. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance; schedule public hearing for May 28, 1991 for adoption of Code. 6.2 American city Truck stop Appeal of Conditional Use Permit, 6310 Houston Place PA 91-005 The Applicant is appealing Condition 5 of Planning Commission Resolution No. 91-022 which relates to repair and replacement of A.C. pavement and concrete gutter at Houston Place and Dougherty Road. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution approving Conditional Use Permit -OR- give Staff and Applicant direction and continue the matter. 6.3 Ordinance Providing for Revisions to the Dublin Municipal Code The Council will consider an Ordinance which incorporates several deletions, additions and amendments to various chapters of the Municipal Code, in order that the changes can all be made at the time of the first update to the City Code which has been in effect since July, 1990. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance. 6.4 Ordinance Increasing City Council Salaries Section 2.08.020 of the Dublin Municipal Code allows for a 5% annual increase to City Council Salaries. Incumbent Councilmembers would not, however, be eligible to receive the increase until after the November, 1992 election. The City Council's present monthly salary is $382.88. This Ordinance was introduced at the April 22, 1991 City Council meeting. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.5 Development Agreement Ordinance At the request of the Bren Company, Staff has prepared a draft development agreement enabling ordinance. The ordinance establishes procedures and requirements for consideration of development agreements for specific projects. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance. 7. UNFINISHED BUSINESS 7.1 Downtown Specific Plan Review Task Force - Update In January of 1991, the City Council developed a Task Force to review issues of interest to the business community. This included programs identified in the Downtown Specific Plan. Two members of the city Council have met with business representatives to discuss the structure of the Task Force. STAFF RECOMMENDATION: Receive report on the status of the Task Force and authority Task Force to seek additional participation from the business community. 7.2 status Report on Drought Restrictions This item is an update of drought related actions by the Dublin San Ramon Services District and City Staff since the last report to the Council on April, 1991. STAFF RECOMMENDATION: ' 1) Accept report and authorize Staff to prepare a counter proposal to DSRSD's proposal for use of recycled water at the Dublin Sports Grounds; and 2) authorize Staff to advertise for bids for test bore, drilling and hook- up of a well at Shannon Park, if water rights can be obtained. 8. NEW BUSINESS 8.1 School Facility Improvement Priorities The City Council will review the revised priorities for school improvement projects as recommended by the Park & Recreation Commission and approved by the Dublin Unified School District Board. STAFF RECOMMENDATION: Approve revised priorities. 9. OTHER BUSINESS 10. CLOSED SESSION 10.1 Pending Litigation, City of Dublin v.
