CALL TO ORDER & PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT OF CLOSED SESSION ACTION 3. ORAL COMMUNICATIONS 3.1 Youth Advisory Committee Appointments (110-30) The Mayor is recommending the appointment of three middle school and ten high school youth, along with three alternates, to the Youth Advisory Committee for the term of June 2010 through May 2011. STAFF RECOMMENDATION: Confirm the Mayor's appointments to the Youth Advisory Committee. 3.2 Mayor's Appointment of Student Representative to Parks and Community Services Commission (110-30) Four applications were received for the Student Representative to the Parks and Community Services Commission and the Mayor is recommending the appointment of Dublin High School Senior Matthew Reinemann. STAFF RECOMMENDATION: Confirm the Mayor's appointment of Matthew Reinemann as the Student Representative to the Parks and Community Services Commission for the term of July 2010 through June 2011. May 18, 2010 Dublin City Council Agenda Page 1 of 6 3.3 Mayor's Appointment of Poet Laureate and City Historian (110-30) The City Council will receive a report on the accomplishments of the Dublin Poet Laureate and City Historian during their two-year terms which expire on May 19, 2010. In addition, the City Council will be asked to confirm the Mayor's appointment of Jonnie McCoy-Howell as Poet Laureate and re-appointment of Georgean Vonheeder-Leopold as City Historian. STAFF RECOMMENDATION: Confirm the Mayor's appointment of Jonnie McCoy-Howell as Poet Laureate and re-appointment of Georgean Vonheeder-Leopold as City Historian. 3.4 "National Public Works Week" Proclamation (610-50) 3.5 Update on All America City Fundraising Efforts (110-30) On April 6, 2010, the City of Dublin was named a finalist by the National Civic League for the 2010 All America City Award Competition. In order to be selected as an All America City Award winner, a delegation from the City of Dublin must travel to Kansas City, Missouri in June 2010 to compete for the prestigious award. Private funding must be raised to send the delegation. The City Council established a Delegation Committee comprised of Mayor Sbranti and Vice Mayor Hildenbrand. The Committee will provide an update to the City Council on its efforts. STAFF RECOMMENDATION: Receive update on All America City fundraising efforts. 3.6 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda, The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meetings of March 16, 2010 and Apri16, 2010. STAFF RECOMMENDATION: Approve minutes. 4.2 Delta Dental Contract Renewal and Amendment (600-30) The City Council will consider authorizing the City Manager to execute the contract renewal and amendment with Delta Dental California. STAFF RECOMMENDATION: Adopt Resolution Authorizing the City Manager to Execute Contract Renewal and Amendment with Delta Dental of California. 4.3 City Treasurer's Investment Report for 3rd Quarter 2009-2010 (320-30) The City's investment portfolio totals $94,406,103 (par value). As of March 31, 2010, funds were invested at an average yield of 2.232%. The portfolio includes both discretionary and restricted funds and the balance will fluctuate throughout the year. The report presented provides background on the City investment portfolio as well as the investment results as of March 31, 2010. STAFF RECOMMENDATION: Receive the Quarterly Investment Report. 4.4 Renewal of the Tri-Valley Tourism Business Improvement District (TVTBID) (470-50) Lodging business owners throughout Tri-Valley came together in 2005 to form the Tri-Valley Tourism Business Improvement District (TVTBID). Lodging business owners now wish to renew the TVTBID, modify the assessment rate, and include the Town of Danville in the TVTBID. The renewed TVTBID will continue to provide funding for much needed marketing efforts for Tri-Valley. By adopting this Resolution, the City Council will grant permission to the City of Pleasanton to renew the TVTBID. STAFF RECOMMENDATION: Adopt Resolution Granting Consent to the City of Pleasanton to Renew the Tri-Valley Tourism Business Improvement District (TVTBID). May 18, 2010 Dublin City Council Agenda Page 2 of 6 4.5 Amendment to Agreement with TruGreen LandCare - Extension of Agreement (600-30) The City Council will consider a one-year extension to the current agreement with TruGreen LandCare for landscape maintenance services in the Dougherty and Stagecoach assessment districts. STAFF RECOMMENDATION: Adopt Resolution Approving Amendment to Consulting Services Agreement between City of Dublin and TruGreen LandCare for Landscape Maintenance Services in the Dougherty Landscape Assessment District and the Stagecoach Landscape Assessment District. 4.6 Revisions to the Personnel System (700-20/700-40/720-10) The City Council will consider several revisions to the City's Personnel System including adding the Principal Planner job classification, amending the Public Works Director/Assistant City Engineer classification, and designating three (3) city holidays for use by City employees during the 2010 holiday season. STAFF RECOMMENDATION: Review the proposed modifications to the City's Classification, Salary, Benefit Plans, and Personnel System Rules and adopt five (5) Resolutions: 1) Amending the Classification Plan; 2) Amending the Salary Plan for Positions Exempt from Fair Labor Standards Act (FLSA) Overtime Provisions; 3) Amending the Management Positions Exempt from Competitive Service Resolution and Prescribing Leave Benefits for the Designated Positions; 4) Amending the Benefit Plan; and, 5) Amending the Personnel System Rules. 4.7 Approving Preliminary Engineer's Reports and Setting Hearings: Citywide Street Lighting Maintenance Assessment District 83-1; Landscaping and Lighting Maintenance Assessment District 83-2 (Stagecoach Road); Landscaping and Lighting Maintenance Assessment District 86-1 (Villages at Willow Creek); Landscaping and Lighting Maintenance Assessment District 97-1 (Santa Rita Area); Street Lighting Maintenance Assessment District 99-1 (Dublin Ranch and Tract 7067) (360-20) This action approves the Preliminary Engineer's Report for the 2010-11 assessment and sets a public hearing date of June 15, 2010 or as soon thereafter as feasible. Citywide Street Lighting Maintenance District 83-1 pays the cost of energy and maintenance for the City's street light system, except for the lights included in Street Lighting Maintenance Assessment District 99-1 (Dublin Ranch and Tract 7067). Landscaping and Lighting Maintenance Assessment District 83-2 (Stagecoach Road) pays the cost of utilities and maintenance for landscaping improvements along Stagecoach Road and on the "interior slopes" of the Dublin Hills Estates development. Landscaping and Lighting Maintenance Assessment District No. 86-1 (Villages at Willow Creek) pays the cost of utilities and maintenance for certain landscaping improvements associated with the Villages at Willow Creek development. Landscaping and Lighting Maintenance Assessment District 97-1 (Santa Rita Area) pays the cost of utilities and maintenance for certain landscaping improvements within the Santa Rita development area. . STAFF RECOMMENDATION: Adopt ten (10) Resolutions: 1) Approving Preliminary Engineer's Report, Conf'irming Diagram and Assessment, City of Dublin Street Lighting Maintenance Assessment District 1983-1; 2) Appointing Time and Place of Hearing Protests in Relation to Proposed Assessments, City of Dublin Street Lighting Maintenance Assessment District 1983-1; 3) Approving Preliminary Engineer's Report, Confirming Diagram and Assessment Landscaping and Lighting Maintenance Assessment District 1983-2; 4) Appointing Time and Place of Hearing Protests in Relation to Proposed Assessments, Landscaping and Lighting Maintenance Assessment District 1983-2; 5) Approving Preliminaxy Engineer's Report, Confirming Diagram and Assessment, Landscaping and Lighting Maintenance Assessment District 1986-1 (Tract 5511); 6) Appointing Time and Place of Hearing Protests in Relation to Proposed Assessments, Landscaping and Lighting Maintenance Assessment District 1986-1; 7) Approving Preliminary Engineer's Report, Landscaping Maintenance Assessment District 1997- May 18, 2010 Dublin City Council Agenda Page 3 of 6 1(Santa Rita Area); 8) Appointing Time and Place of Hearing Protests in Relation to Proposed Assessments, Landscaping Maintenance Assessment District 1997-1 (Santa Rita Area); 9) Approving Preliminary Engineer's Report, Confirming Diagram and Assessment, City of Dublin Street Lighting Maintenance Assessment District 1999-1; and 10) Appointing Time and Place of Hearing Protests in Relation to Proposed Assessments, Street Lighting Maintenance Assessment District 1999-1. 4.8 Urban Greening for Sustainable Communities Project Application (210-30) On April 30, 2010 an application was submitted to the State of California seeking funding through the State of California - Urban Greening Grant Program to re-construct the parking lot at the Shannon Community Center and Park. As part of the application process a resolution is required from the City Council approving the application submission. The project will be included in the proposed Five Year Capital Improvement Program for Fiscal Year 2010-11, but work on the project would be contingent on being awarded the grant and entering into an agreement with Zone 7 to provide their services. STAFF RECOMMENDATION: Adopt Resolution Approving the Application for Grant Funds for the Urban Greening Grant Program Under the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006 (Proposition 84). 4.9 Issuance Reports and Electronic Funds Transfers (300-40) STAFF RECOMMENDATION: Review and authorize the issuance of payments. 4.10 Extension of a Temporary Policy for the Rental of Below Market Rate Ownership Units (430-80) Due to the slow down in the housing market, for-sale Below Market Rate (BMR) owners desiring to sell their BMR unit are having difficulty finding qualified buyers willing to purchase the units at the restricted resale price. Qualified buyers would rather purchase market rate homes free of resale restrictions rather than BMR units that are priced close to or above market rate prices. To assist BMR owners with the difficulty of finding qualified buyers, Staff is requesting that the City Council extend the Temporary Policy for the Rental of Below Market Rate Ownership Units by Owners Unable to Sell Their Units at the Restricted Resale Price that was adopted by the City Council on August 19, 2008 for an additional two years ending August 19, 2012. STAFF RECOMMENDATION: Adopt Resolution Extending a Temporary Policy for the Rental of Below Market Rate Ownership Units by Owners Unable to Sell Their Units at the Restricted Resale Price. 5. WRITTEN COMMUNICATIONS - None. 6. PUBLIC HEARINGS 6.1 Review of Engineering Survey Results and Establishment of Speed Limit for Amador Valley Boulevard, Martinelli Way and Arnold Road (820-80) This is the first reading of a proposed ordinance which would establish, based on the findings of engineering and traffic surveys, new speed limits of 30 mph on Amador Valley Boulevard between Village Parkway and Stagecoach Road, 40 mph on Martinelli Way between Iron Horse Parkway and Hacienda Drive, and 35 mph on Arnold Road between Dublin Boulevard and Altamirano Road. STAFF RECOMMENDATION: Conduct public hearing, deliberate, waive the reading and INTRODUCE the Ordinance Amending the Dublin Traffic Code to Establish a New Speed Limit on Certain Portions of Amador Valley Boulevard (Village Parkway to Stagecoach Road), Martinelli Way (Iron Horse Parkway to Hacienda Drive), and Arnold Road (Dublin Boulevard to Altamirano Road). May 18, 2010 Dublin City Council Agenda Page 4 of 6 6.2 Nielsen Property Residential Project - Planned Development Rezone with a related Stage 1 Development Plan Amendment and Stage 2 Development Plan, and a Supplemental Environmental Impact Report (400-20/450-30) The Nielsen project site is 10.9 gross acres located at 6407 Tassajara Road within the Eastern Dublin Specific Plan Area. The proposed Project includes a request to amend the General Plan and Eastern Dublin Specific Plan. The proposed General Plan and Eastern Dublin Specific Plan amendments would modify the existing land use designations from Rural Residential/Agricultural to Single Family Residential (EDSP) and allow a reduction in the width of on-site streets. Approval of a Planned Development Rezone with a related Stage 1 Development Plan Amendment and Stage 2 Development Plan would expand the allowable uses on the site and permit up to 36 residential units. Site Development Review for the project will happen at a later date. STAFF RECOMMENDATION: Conduct public hearing, deliberate, adopt Resolution Certifying Final Supplemental Environmental Impact Report, Adopting Environmental Findings, a Statement of Overriding Considerations, and Mitigation Monitoring and Reporting Program Under CEQA for the Nielsen Property Residential Project (6407 Tassajara Road - APN 985- 0002-009-02) PA 07-057; and waive the reading and INTRODUCE an Ordinance Approving a Planned Development Rezone with a Related Stage 1 Development Plan Amendment and Stage 2 Development Plan for the Nielsen Property Residential Project (6407 TAssajara road - APN 985-0002-009-02) PA 07-057. 6.3 Grafton Plaza: Planned Development Rezone with a related Stage 1 Development Plan, and Mitigated Negative Declaration (400-20/450-30) Grafton Plaza is 25.33 acres located within the Eastern Dublin Specific Plan Area. The proposed project includes a request to amend the General Plan and Eastern Dublin Specific Plan. The proposed General Plan and Eastern Dublin Specific Plan amendments would modify the existing land use designations from Campus Office to a new Mixed Use 2/Campus Office flexible land use designation. Approval of a Planned Development Rezone with a related Stage 1 Development Plan would expand the allowable uses on the site. Development of the site could include one of two options: Option 1 would allow a mixed use development and permit up to 50% of the development area be comprised of residential uses and Option 2 would allow a campus office development. The southern portion of the site (approximately 11 acres) is improved with an existing Water Quality Control Basin and no further development or modifications are proposed to this portion of the project site. STAFF RECOMMENDATION: Conduct public hearing, deliberate, adopt Resolution Adopting a Mitigated Negative Declaration, Statement of Overriding Considerations, and Mitigation Monitoring and Reporting Program for the Grafton Plaza Project, PA 07-006; and waive the reading and INTRODUCE an Ordinance Approving a PD-Planned Development Rezone and Related Stage 1 Development Plan for the Grafton Plaza Project (APN 985-0061- O10 & 985-0061-004 (PA 07-006). 6.4 Grafton Plaza and Nielsen Property Residential Project: General Plan and Eastern Dublin Specific Plan Amendments (420-30/410-55) The proposed Grafton Plaza General Plan and Eastern Dublin Specific Plan amendments would modify the existing land use designations from Campus Office to a new Mixed Use 2/Campus Office flexible land use designation. The proposed Nielsen Property General Plan and Eastern Dublin Specific Plan amendments would modify the existing land use designation from Rural Residential/Agricultural to Single Family Residential and allow a reduction in the width of on-site streets. STAFF RECOMMENDATION: Conduct public hearing, deliberate and adopt Resolution Approving Amendments to the General Plan and Eastern Dublin Specific Plan for Grafton Plaza (PA 07-006) and the Nielsen Property Residential Project (PA 07-057). ~ May 18, 2010 Dublin Ciry Council Agenda Page 5 of 6 7. UNFINISHED BUSINESS 7.1 Approval of Combined Grant Process and Related Documents (480-30) During the Fiscal Year 2009-2010 Goals and Objectives process, the City Council established a high priority objective to develop a procedure to combine the Community Development Block Grant (CDBG) and the Community Support Grant processes into one. On October 6, 2009, the City Council created the Community Development Block Grant and Community Support Grant Committee ("Committee") to provide policy guidance and direction to assist Staff on meeting this objective. The Committee has met several times and provided input on the process and necessary documents. Upon full City Council acceptance of the Committee's recommendations, the objective of combining the Community Development Block Grant and the Community Support Grant processes into one process will be complete. STAFF RECOMMENDATION: Receive Staff presentation; accept the Committee's recommendations on the new grant process, the Universal Grant Application and Universal Rating Criteria; not establish grant funding priorities so as to maintain flexibility in the grant award process; and authorize the City Manager or her designee the ability to make changes to the related documents as appropriate. 8. NEW BUSINESS 8.1 Discussion Regarding the City's Use of Social Media (150-30) The City Council adopted a City Communications Plan that included an objective to explore the use of social media. Staff has reviewed the legal and policy considerations in using social media tools, such as Facebook, and is bringing these considerations to the City Council for discussion and direction. STAFF RECOMMENDATION: Provide direction to Staff on whether to proceed with a City Facebook page. 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
