PLEDGE OF ALLEGIANCE TO THE FLAG DUBLIN LIBRARY Meeting Room 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is not on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Hanager to have their particular concern placed on the agenda for a future meeting. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public input may request the Ci ty Counci 1 to remove the i tern from the consent calendar. The request may be made at the time that the Hayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Hinutes of Regular rvleeting of Hay 11, 1987 STAFF RECOMMENDATION: Approve 4.2 Appointment of Tenant Commissioners: Dublin Housing Authority State law requires the inclusion of two tenant Commissioners on the Housing Authority Board of Commissioners. A subcommittee of the City Council has interviewed interested applicants, and presented a recommendation for the appointments to the vacant Commissioner openings. STAFF RECOMMENDATION: Confirm Appointment 4.3 Authorization to Utilize the City of Dublin Logo on the Alameda County Fair Flag The Alameda County Fair is developing a flag in commemoration of the 75th Anniversary. Representatives of the Fair have requested authorization to utilize the City Logo on a flag. They are intending to have City flags from each of the cities in Alameda County on display. STAFF RECOMMENDATION: Authorize Use 4.4 Establishment of Insurance Reserve Fund The City currently has insurance coverage provided by ABAG Plan Corporation. agreement requires each agency to reserve adequate funding to cover possible Staff has prepared a resolution which would authorize the establishment of a insurance fund. STAFF RECOMMENDATION: Adopt Resolution The coverage adjustments. reserve 4.5 Alameda County Fair Fine Arts Preview In the past, the City Council has authorized participation in the Alameda County Fine Arts Program. Patrons are given an opportunity to bid on art works displayed at the Fair. The City currently has two paintings which are on display in the City Offices. STAFF RECO~lMENDATION: Authorize a Representative to attend Preview and purchase art work for the City offices not to exceed $500. 4.6 Warrant Register dated May 26, 1987 STAFF RECOMMENDATION: Approve 4.7 Garbage Franchise with Oakland Scavenger Company The City currently provides garbage service through a franchise agreement with Oakland Scavenger Company. In late 1986 the conlpany was restructured with the ownership being transferred to Waste Management, Inc. A legal opinion has been obtained indicating that no action by the City Council is required. This report is provided for information only. STAFF RECON~'1ENDATION: Rece i ve report. 4.8 Financial Report for Period Ending April 30, 1987 STAFF RECO~'lI\lENDATION: Approve 5. WRITTEN COMMUNICATIONS 5.1 Administrative Charges for Engineering Services The City Manager received a request from a representative of Kaufman & Broad to refund administrative overhead fees collected on engineering work performed by contractors on behalf of the City of Dublin. The existing City Resolution establishing fees states that the construction inspection fee shall be the actual cost of inspection. In accordance with this policy, Staff has collected an administrative fee which reflects overhead items, i.e., rental expense, utilities, insurance, supervision, etc. STAFF RECOMMENDATION: Accept City Attorney's Statement and take no action. 6. PUBLIC HEARING 6.1 Sale of Excess Right-of-Way to the Fishery Restaurant The Fishery Restaurant has requested to purchase 3,671 sq. ft. of the City's excess right- of-way on San Ramon Road. The City is required to hold a public hearing prior to sale of public property. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt resolution approving sale and authorizing Mayor to consummate agreement. 6.2 Ordinance Related to Fly Control This ordinance, which was introduced at the City Council meeting of April 27, 1987, would make it unlawful for a person to create, allow or maintain a fly nuisance, allow waste to become a harborage or food source for rodents, or result in the unreasonable production of odors. STAFF RECOtvlt1ENDATION: Conduct public hearing; deliberate; waive reading and adopt ordinance. 6.3 Animal Fancier's Permit An Animal Fancier's Permit is required whenever more than two dogs or two cats are kept in a residential area. An applicant has requested to maintain four dogs at 7725 Hillrose Drive. The permit request was denied by the City Manager and is now being appealed by the applicant. STAFF RECOMMENDATION: Conduct public hearing and uphold denial. 6.4 Dublin Downtown Specific Plan and Associated General Plan Amendment The Dublin Downtown Specific Plan has been prepared to help maintain the downtown as the commercial center of the Tri-Valley area. The Plan contains a number of policies, various implementation strategies and several minor changes to the General Plan. STAFF RECOMMENDATION: Conduct public hearing; hear Staff and Consultant presentations and Downtown Improvement Study Committee/public comments on each issue; provide conceptual guidance; continue until staffing and cost implications are resolved as part of the 1987-88 budget review. 6.5 San Ramon Road Improvements, Phase III and Phase IV (Alcosta Boulevard to Silvergate Drive) Environmental Assessment This hearing is a prerequisite for submittal of an application for FAU funding. Testimony received at the hearing, as well as written comments received within 10 days thereafter, will be addressed after the close of the hearing period. The complete hearing record is then submitted to the State for review. STAFF RECOMMENDATION: Open public hearing; receive Staff presentation and public comments; question Staff and the public; close public hearing. No City Council action is required at this time; however, the hearing record will remain open for written comment for an additional 10 days. 6.6 Firearm Ordinance As part of the Hunicipal Code reV1Slon, the City Attorney's Office has prepared an ordinance which regulates the shooting of firearms. The focus of this revision is to update the language of existing ordinances to eliminate references to the County of Alameda. STAFF RECOM~1ENDATION: Conduct public hearing; waive the reading; and introduce the ordinance. 6.7 PA 87-018 Enea Plaza - Planned Development Rezoning Request The applicant, Richard Enea, has requested that the City Council continue this item to the June 8, 1987, City Council meeting. STAFF RECOtlHENDATION: Hear any comments from the audience on the matter, then continue it to the June 8, 1987, City Council meeting. 7. UNFINISHED BUSINESS 7.1 Ci ty of Dubli n r'Iembershi p: Dubli n Si ster Ci ty Associ ati on At the regular City Council meeting of April 27, 1987, Cm. Snyder suggested that the City consider membership in the newly formed Sister City Association. This group has extended an invitation to a delegation from Bray, Ireland, to attend the Shamrock Festival in July. STAFF RECOHMENDATION: Consider membership for the City of Dublin in the Sister City Association. 7.2 Tri-Valley Transportation Entity The City has received a request from William Fraley, Alameda County Planning Director, for $1,500 for several computer runs for a tri-valley-wide transportation plan. The letter from Mr. Fraley also indicates a request for endorsement of a Tri-Valley Transportation Entity. STAFF RECOMNENDATION: Review and comment, and direct Staff to transmit comments to Alameda County. 7.3 Potential expansion of Dublin Ranch General Plan Amendment Study and Specific Plan Study. The City Council previously authorized the Dublin Ranch General Plan Amendment Study and Specific Plan Study. The City Council requested input from surrounding property owners. Five (5) property owners are willing to further discuss participation in the study and sharing in the costs. STAFF RECOMr1ENDATION: 1) Define General Plan Amendment study area; 2) define Specific Plan study area; 3) determine the general land uses to be studied; and 4) authorize Staff to select consultant team. 8. NE\J BUSINESS 8.1 LAVTA Short Range Transportation Plan Fiscal Year 1987-88 to Fiscal Year 1991-92 Consultants for the Livermore/Amador Valley Transit Authority have prepared a Short Range Transportation Plan for the LAVTA service area, including three Alternative Service Plans and a five year financial plan and implementation program. The LAVTA General Manager is recommending the Council approve the LAVTA Five Year Operating/Capital Plan and Alternative 3 of the SRTP draft report. STAFF RECOMMENDATION: Consider the LAVTA General Manager's recommendation for Alternative 3 and the Five Year Operating/Capital Plan. 9. OTHER BUSINESS 10.
