DUBLIN CITY COUNCILDUBLIN CITY COUNCIL
REGULAR MEETING - Tuesday, May 28, 1996, 7:00 p.m.

A complete packet of information containing Staff Reports and exhibits related to each
item is available for public review several days prior to a Council meeting in the City
Clerk’s Office and also at the Dublin Library.

3.ORAL COMMUNICATIONS
3.1Recognition of Awards to City for Excellence in Financial Reporting
The City has received an Outstanding Financial Reporting Award for Fiscal Year 1994-95 and
a Certificate of Achievement for Excellence in Financial Reporting for its Comprehensive
Annual Financial Report for FY ending June 30, 1995 from the Government Finance Officers
Association of the United States and Canada
STAFF RECOMMENDATION: Receive awards.
3.2Presentation of Special Recognition/Appreciation Plaque to Dublin Police Services by
Dublin High School Student Body President Ryan Schrader
At this time, the public is permitted to address the City Council on non-agendized items. The
Council must, however, comply with all State Laws in regard to items not appearing on the
posted agenda. The Council may respond to statements made or questions asked, or may request
Staff to report back at a future meeting concerning the matter. Any member of the public may
contact the City Clerk’s Office related to the proper procedure to place an item on a future City
Council agenda. The exceptions under which the City Council MAY discuss and/or take action on
items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3).
4.CONSENT CALENDAR
Consent Calendar items are typically non-controversial in nature and are considered for
approval by the City Council with one single action. Members of the audience, Staff or
the City Council who would like an item removed from the Consent Calendar for purposes
of public input may request the Mayor to remove the item.
4.1Minutes of Regular Meeting of May 14, 1996
STAFF RECOMMENDATION: Approve
4.2State-Local Transportation Partnership Program, State-Local Entity Agreement
Supplement 006 (Cycle 6)
Adoption of this Resolution would enable the City to receive State Funds (SB 300) for the
annual overlay program. The City's street repair and overlay program is typically partially
funded by an SB 300 matching grant. This year's grant is in the amount of $23,536.
STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute supplement.
4.3Quitclaim of Easement on Unocal Site - Northwest corner of Dougherty Road and Dublin
Boulevard
The property owners representative is requesting that the City quitclaim its rights to this utility
easement. The City has no facilities within this area and does not need it.
STAFF RECOMMENDATION: Adopt Resolution approving quitclaim deed and authorize
Mayor to execute the deed.
4.4Amendment to Agreement for Legal Services
Since 1982, the City has contracted with the law firm of Meyers, Nave, Riback, Silver &
Wilson (or its predecessors) for legal services. This contract amendment would provide for an
increase in the hourly rate from $125 to $140 (or 12%) for General Legal Services. The $125
hourly rate was established in April of 1988, and the CPI has increased approximately 28%
since April of 1988.
STAFF RECOMMENDATION: Approve Third Amendment to Agreement and authorize Mayor
to execute same.
4.5Acceptance of Gift to City
The City has received a gift in the amount of $2,000 from Soroptimist International of Dublin,
Inc. to be used to develop and implement curriculum for the Pioneer Day Program for third
graders at the Dublin Heritage Center.
STAFF RECOMMENDATION: Accept gift; direct Staff to prepare formal acknowledgment to
the donor; and approve Budget Change Form
4.6Agreement between the County of Alameda and the City of Dublin regarding the
Community Development Block Grant Program for Fiscal Year 1996-97
The City must enter into an annual agreement which outlines the City’s and the County’s
responsibilities regarding participation in the CDBG Program and governing the activities
approved for CDBG funding. Projects approved for 1996-97 funds include: 1) Housing
Rehabilitation - $18,113; 2) Mape Park Handicapped Accessible Playground - $51,750; 3)
Arroyo Vista Accessibility Renovations - $21,910; General Administration - $2,097
STAFF RECOMMENDATION: Adopt resolution and authorize the Mayor to execute
agreement.
4.7Shannon Community Center Window Replacement - Contract 96-05
Three bids were received for the Shannon Community Center Window Replacement project.
All of the bids submitted included exceptions to the scope of work as presented in the bid
specifications, so the City Council will consider rejecting the bids.
STAFF RECOMMENDATION: Adopt resolution rejecting all bids and authorize Staff to
readvertise the project with a modified scope of work..
4.8Agreement between the City of Dublin and Kaufman and Broad regarding Rental
Availability In-Lieu Fee (Donlan Canyon/California High
This agreement requires the City to refund $24,656 Rental Availability In-Lieu Fees (with 5%
interest) required for the approval of the Donlan Canyon Project when and if the General Plan
and Municipal Code are amended to delete the rental availability requirement.
STAFF RECOMMENDATION: Receive Staff presentation and authorize Mayor to sign
agreement.
4.9Award of Bid for Evidence Tracking System and Fixed Asset Inventory System
On March 6, 1996 the City Council authorized Staff to distribute an RFP for an Evidence
Tracking system and a Fixed Asset Inventory System. This item is to consider responses to the
RFP and to award the bids for each system.
STAFF RECOMMENDATION: Award bids and authorize budget change and additional
appropriation to complete the Evidence System purchase.
4.10Report on Village Parkway Speeding at Wineberry Way
Through resident request, the City Council directed Staff to investigate speeding problems on
Village Parkway at Wineberry Way. The problem is the difficulty in turning left out of
Wineberry onto southbound Village Parkway
STAFF RECOMMENDATION: Direct Staff to investigate speeding concerns on Village
Parkway and to work with the City of San Ramon regarding future improvements.
4.11Pole Attachment Agreement with PG&E (Related to City-Owned Street Lights)
This agreement provides parameters for the City relating to City-owned street lights that are
attached to PG&E distribution poles.
STAFF RECOMMENDATION: Adopt resolution approving agreement and authorize Mayor to
execute agreement.
4.12Art in the Park - Stagecoach Park Agreement
At the May 22, 1996 meeting of the Dublin City Council, the Council authorized the release of
funds for the “Art in the Park” Program sponsored by the Dublin Fine Arts Foundation. The
funds were designated for the artworks to be placed at Stagecoach Park and Alamo Creek
Park. In order to proceed with the commission for the artwork for Stagecoach Park, it is
necessary to execute an agreement between the City of Dublin, the Dublin Fine Arts
Foundation and the artist for the project.
STAFF RECOMMENDATION: Authorize the mayor to execute the agreement.
4.13Warrant Register ($319,866.06) dated May 28, 1996
STAFF RECOMMENDATION: Approve
5.WRITTEN COMMUNICATIONS - None
6.PUBLIC HEARING
6.1Bus Stop on West Side of Village Parkway at Lewis Avenue
This is the second reading of a proposed ordinance to establish a new bus stop on Village
Parkway. The bus stop was requested by an elderly resident who uses the bus to travel to the
post office.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT
Ordinance.
6.2Rental Availability Ordinance Repeal
The City’s Rental Availability Ordinance requires that a minimum percentage of the units in
new multi-family development projects be rented for a period of 5 years, in order to insure the
adequate supply of rental housing in Dublin. Recent surveys show that the City’s objective for
rental units is being met by the housing market and the Ordinance is not necessary. The Rental
Availability ordinance is proposed to be repealed and the reference to this program in the
Housing Element will be deleted.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and
INTRODUCE Ordinance.
6.3Adoption of Ordinance Amending Section 2.12.120 of the Dublin Municipal Code
Authorizing Referral of CUP Revocations to Planning Commission
Ordinance giving Community Development Director authority to refer any administrative
actions to Planning Commission; any controversial items directly to Planning Commission
rather than the Zoning Administrator.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT
Ordinance.
6.4Inclusionary Zoning Ordinance
The Dublin General Plan and Eastern Dublin Specific Plan require that the City adopt an
Inclusionary Zoning Ordinance requiring a minimum percentage of the units in new residential
projects to be affordable to lower and moderate income families. The proposed Ordinance is
the result of the direction provided by the Planning Commission and City Council at two joint
Study sessions, held in February and March of this year.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and
INTRODUCE Ordinance.
6.5California Creekside Planned Development and Development Agreement
Second reading for Planned Development Rezone to change zoning on property from PD
Business Park Industrial to PD Single Family Residential and PD Medium - High Density
Residential to allow 154 single family dwellings and 123 townhouses on 35.4 acres. The
Development Agreement establishes the rights and responsibilities of the City, Kaufman and
Broad, and Alameda County with respect to this development.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; and adopt resolution
approving findings; waive reading and ADOPT Ordinance approving PD Rezone and Ordinance
approving Development Agreement.
6.6Amendment of Dublin Municipal Code Chapter 2.28 Relating to Campaign Contribution
Limitations
Following discussion at the may 14, 1996 City Council meeting, the Council directed Staff to
prepare an ordinance limiting campaign contributions to $300 per “election period” (120 days
prior and 120 days following an election) and requiring disclosure of contributions in excess of
$25. The Council will consider amendments to the Municipal Code to revise the current
restrictions regarding campaign contributions.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; and take appropriate action.
7.UNFINISHED BUSINESS -
7.1Term Limits
Following discussion at the May 14, 1996 City Council meeting, the Council directed Staff to
prepare language for an initiative ordinance to submit to the electorate at the November 1996
election to impose term limits on the offices of Mayor and Councilmembers so that, in general,
an individual would be limited to serving no more than 8 consecutive years as Mayor and/or
Councilmember. The Council will consider the form of a proposed initiative ordinance.
STAFF RECOMMENDATION: Consider motion directing City Clerk to prepare appropriate
resolutions to place proposed initiative ordinance imposing term limits for Mayor and
Councilmembers on November 1996 ballot or provide direction to Staff.
8.NEW BUSINESS
8.1Mape Park Renovation
The City Council will review the proposed master plan for the renovation of Mape Park which
reflects the design goals and elements expressed by the neighbors of the park at two previous
neighborhood meetings.
STAFF RECOMMENDATION: 1) Approve master plan in concept and direct Consultant to
begin work on construction documents for the base improvements and include the sand volleyball
court, restroom building and pedestrian bridge as additive alternates to the construction
documents; 2) Direct the Parks & Community Services Commission to reevaluate the Mape Park
project against the other park projects and the available funds as part of the 1996-97 Budget
process and recommend to the City Council the park priorities for FY 1996-97.
8.2Report on Alamilla Spring - San Ramon Road near Dublin Boulevard
There is an historical spring just west of San Ramon Road at Dublin Boulevard (the Springs
Apartments). Due to apparent lack of maintenance of the spring, the City Council has
requested a report on the ownership and maintenance responsibility of the spring.
STAFF RECOMMENDATION: Receive report and provide direction, if warranted.
