ORAL COMMUNICATIONS 3.1 Report On 2004 Dublin Pride Week ACtivities and Recognition of Poster Contest Winners and Dublin Pride Parmers (File # 150-80) The City Council will formally recognize the contributions made by various individuals and organizations making 2004 Dublin Pride Week a successful community event. STAFF RECOMMENDATION: Formally recognize poster contest winners and Dublin Pride Partners. 3.2 Presentation Related to Affordable Housing Week (File # 430-80) A slide show called "Housing Ch#ices Equals Healthy Communities" is being presented in honor of Affordable Housing Week. STAFF RECOMMENDATION: Receive Presentation 3.3 Proclamation declaring June 5-13, 2004 "Affordable Housing Week" (File # 610-50) 3.4 Proclamation congratulating Dublin High School Winterguard for placing fourth out of 140 schools in the Winterguard International World Championships in San Diego 3.5 Appointment of Tenant Commissioners to the Dublin Housing Authority (File # 110-30) The Dublin Housing Authority (DHA) was created by the City to oversee the operation of the Arroyo Vista housing project. In accordance with State Law, the DHA Board is comprised of the City Council and 2 tenant commissioners, one of whom must be over the age of 62. Mayor Lockhart recommends the reappointment of Shawn Costello and Ramona Frydendal to 2 year terms expiring in May 2006. Consent Calendar items are typically non.controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of May 18, 2004 STAFF RECOMMENDATION: Approve 4.2 Consultant Agreement to Update Eastern Dublin Fiscal Impact Analysis (File # 600-30) The proposed update to the Eastern Dublin Fiscal Impact Analysis is intended to determine the amount of deficit (if any) in eastern Dublin that would need to be funded by DR Acquisitions, L.L.C. for Fiscal Year 2003-04. STAFF RECOMMENDATION: Adopt ..Resolution selecting MuniFinaneial for the Fiscal Study and authorize Mayor to execute agreement not-to-exceed $25,000. 4.3 Improvement Agreement with the Lin Family and Sierra Land Development Corporation for the construction of Grafton Street from Central Parkway to Gleason Drive, Dublin Ranch Area F (File # 600-60) This Improvement Agreement will govern the construction of Grai~on Street from Central Parkway to Gleason Drive in Dublin Ranch Area F. The construction will include full street improvements, curb to curb, along with all underground imprOvements for this two-lane roadway with median. Traffic signals will be installed where Grafton Street intersects with Central Parkway and Gleason Drive. Sidewalks, frontage landscaping and median landscaping are not included with this Agreement, but will be installed with the fronting developments. STAFF RECOMMENDATION: Adopt Resolution approving Agreement 4.4 Acceptance of Improvements for Tract 6925 (Dublin Ranch Phase I) and Tassajara Road Off-Site Improvements for Tract 6960 (MSSH Dublin Development LLC) (File # 600-60) The street improvements for Tassajara Road, North and South Dublin Ranch Drive, and Ant#nc Way have been constructed pursuant to the Tract Developer Agreement and Improvement Agreement and to the satisfaction of the Public Works Director, and should now be accepted by the City for permanent maintenance. Maintenance Bonds have been provided to gtmrantee against defects for one year. STAFF RECOMMENDATION: Adopt R~solntion accepting improvements and approving the traffic control devices installed. 4.5 Amendment to Consulting Services Agreement with S&C Engineers, Inc. (S&C) for the 1-580/Tassajara Road Interchange Improvement (Modification to Scope of Work and Additional Compensation) (File # 600-30) During the construction of the I-$80/Tassajara Road Interchange Improvement project, Caltrans and thc City initiated extra work with required additional inspection and contract administration tasks from S&C Engineers, Inc. The amendment to S&C's contract will include these additional tasks and provide additional compensation. STAFF RECOMMENDATION: Adopt ResoluO0n approving Amendment 2 to Agreement. 4.6 Extension of East County Animal Shelter Memorandum of Understanding (File # 600-40) The Shelter Advisory Committee is recommending that thc participating entities (Cities of Dublin, Livcrmorc and Pleasanton and thc County of Alameda) accept the option to extend the existing East County Animal Shelter Memorandum of Understanding with the Alameda County Sheriff's Office, for an additional two years. STAFF RECOMMENDATION: Adopt Resolution approving extension of Agreement. 4.7 Approval of Amendment No. 1 to the Cooperative Agreement with Caltrans for the Improvement of the 1-580]Tassajara Road and 1-580/Fallon Road Interchanges (File # 600-50) Thc City of Dublin entered into a cooperative agreement with Caltrans in July 2000 for the improvement of the 1-580/Tassajara Road and 1-580/Fallon Road interchanges. Thc agreement will expire on june 30, 2004 and it is necessary to amend the agreement to extend the termination date of thc original agreement to December 31, 2010. STAFF RECOMMENDATION: Adopt R.esolutiop approving Amendment to Agreement with Caltrans. 4.8 Warrant Register ($2,887,726.36) dated June 1, 2004 (File # 300-40) STAFF RECOMMENDATION: Approve 5. WRITTEN, COM~CATiONS - None 6. pUBLIC ~ARING 6.1 Baneor San Ramon Village Plaza PD Rezone with Stage 2 and 2 Development Plan PA 02-063 (File # 450-30) This is the second reading of an Ordinance which would approve a Planned Development Rezoning and Stage 2 Development Plan for a pedestrian-oriented mixed-use project including 56 townhouse-style residential units and the remodel of a 14,377 square feet existing commercial building. The project site consists of a 4.62 acre irregular property on San Ramon Road that consists of three parcels and is currently developed with a neighborhood shopping center known as San Ramon Village Plaza. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt 6.2 Ordinance Repealing Section 6.64.020 of the Dublin Municipal Code regarding Weight Limits for Commerclal Vehicles in Residential Districts (File # 570-20) This item repeals Section 6.64.020, Commercial Vehicles in Residential Districts, of the Dublin Municipal Code to provide for consistency with the recently adopted Ordinance No. 10-03 prohibiting operation of any commercial vehicle having a gross weight, including load, in excess of 5 tons on any street within any residential district in the City. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance; schedule second reading of Ordinance at June 15, 2004 City Council meeting. 7.1 Emerald Glen Phase II, Contract 03-05 - Change Order (File # 600-35) At the June 3, 2003 City Council meeting, the Council awarded the contract for Emerald Glen Park, phase II to Valley Crest Landscape Development. At the meeting, the Council discussed the need for a temporary, restroom facility to serve the south side of the park. Since construction of Phase H improvements are nearly complete and there are sufficient funds available within the construction budget, Staff is seeking Council approval for the installation of a restroom as part of this contract. STAFF RECOMMENDATION: Approve Change Order. 7.2 Award of Bid - Contract 04-01, Traffic Signal at Dublin BouleVard and Inspiration Drive (File # 600-35) This project will construct a traffic signal at the intersection of Dublin Boulevard and Inspiration Drive. A total of 6 bids were received. STAFF RECOMMENDATION: Adopt Resolution awarding contract to Richard A. Heaps Electrical Contractor, Inc. ($183,844.50). 7.3 Continuation of Emergency Action and Progress Report on Remediation Work at Dublin Civic Center (File # 600-30) The Civic Center incurred water damage from rain in early March. At the March 16~ meeting, the City Council approved a declaration of emergency in order to allow a waiver of competitive bid to obtain a contractor for environmental remediation work related to the water intrusion. This item would approve a continuation of the declaration of emergency while the remediation WOrk cOntinues and provide an update on the progress of the project to date. STAFF RECOMMENDATION: Adopt Resolution,. s. I WBtlSI S,S 8.1 Consultant Services for a strategic Community Visioning process for future private development at Camp Parks (File # 600-30) City Staffhas interviewed and is recommending a contract award to RTKL Associates, Inc., for work on a Community Strategic Visioning process to determine future land uses for private development at Camp Parks. STAFF RECOMMENDATION: Adopt Resolution approving and authorizing Mayor to execute Agreement with RTKL Associates, Inc. ($125,000); and provide direction to Staff on the preferred method of involving the community in the proposed charrette planning process by selecting one of the following alternatives: a) Create a Camp Parks Master Planning Task Force; b) Invite Key Stakeholders; c) Invite City Council and Commissions; or d) Another method as determined by City Council. 8.2 Guidelines for Implementing the Inclusionary Zoning Ordinance Regulations (File # 430-20) The City Council will consider guidelines for implementing the Inclusionary Zoning Ordinance. The Regulations make it mandatory, in most cases, to provide a certain number of price or rent restricted residential units as part of any residential development (in excess of 20 units) proposed for construction in the City of Dublin. STAFF RECOMMENDATION: Adopt Resolution approving Layperson's Guide to the Inclusionary Zoning Ordinance Regulations. 8.3 Annual Rate Review for Garbage Collection, Disposal and Recycling Services provided by Waste Management (File # 810-30) Current garbage rates became effective July 1, 2003. In accordance with the Agreement with Waste Management (WM) the adopted rates are required to be reviewed prior to July 1, 2004. The current rates are projected to generate the annual revenue required by the Agreement; therefore, no rate increase is required for Fiscal Year 2004-05. STAFF RECOMMENDATION: Receive Report. 8.4 Designation of Two CouncilmemberS as City Representatives to discuss Compensation with City Attorney (File # 600-30) This item provides for the designation of two members of the City Council to discuss terms of the City Attorney's contract, including compensation, with the City Attorney pursuant to the Government Code. The two members would report their recommendation to the full Council in open session following meetings with the City Attomey, STAFF RECOMMENDATION: Designate two members of the City Council. 8.5 Dublin Sports Grounds Phase III - Authorization to Bid Contract 04-07 (File # 600-35) The installation of athletic field lights for the Dublin Sports Grounds was approved in the 2002-2007 Capital Improvement Program. Electrical engineering of the athletic field lights have been completed in Fiscal Year 2003-04 with construction scheduled for FY 2004-05.
