STAFF RECOMMENDATION: Receive report and formally recognize poster contest winners and Dublin Pride Partners. 3.4 Presentation from Alameda County on the County-Wide Homeless Continuum of Care Councils (HMIS) (430-20) The City Council will hear a presentation from Alameda County for the County-Wide Homeless Continuum of Care Council. STAFF RECOMMENDATION: Receive presentation. 3.5 Proclamation Declaring June 1-10,2007 "Mfordable Housing Week" (610-50) 3.6 Presentation by the Dublin Housing Division on Affordable Housing in Dublin (430-80) Staff will make a presentation related to the City's accomplishments in providing affordable rental and homeownership housing. STAFF RECOMMENDATION: Receive presentation and provide comments. 3.7 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Adjourned Regular Meeting (G&O) of March 28, 2007, and Regular Meetings of May 1 and May 15, 2007 STAFF RECOMMENDATION: Approve. 4.2 PA 06-013 Alcosta Shell Service Station Rezone from C-N, Neighborhood Commercial to C-2, General Commercial (450-30) The City Council will consider adopting an Ordinance which would Rezone property at 8999 San Ramon Road to allow for the construction/expansion of the existing A1costa Shell Service Station. This Ordinance was introduced following a public hearing at the May 15, 2007 Council meeting. STAFF RECOMMENDATION: Waive reading and adopt Ordinance approving Rezone. 4.3 Award of Bid - Contract 07-07, Dublin Boulevard Bridge Resurfacing at Alamo Canal (600-35) This project will resurface the bridge on Dublin Boulevard just west of the Civic Center with a protective chemical treatment to block moisture from reaching the steel reinforcing in the deck. The City Council will consider awarding this contract to the low bidder, Bay Line Cutting & Coring, Inc. ($21,957.20). STAFF RECOMMENDATION: Adopt Resolution awarding contract. 4.4 Approval of Improvement Agreement for Fallon Road Offsite Backbone Utilities for Tract 7586, Fallon Village (600-30) Braddock and Logan Services, Inc. (dba Dublin RE Investors, LLC), is seeking City Council approval of an improvement agreement for storm drain improvements in Fallon Road between Positano Parkway and 1-580, which are needed to serve the Fallon Village development (Tract 7586). A performance bond and payment bond have been provided by the developer to assure construction ofthe improvements. STAFF RECOMMENDATION: Adopt Resolution approving Improvement Agreement. 4.5 P A 06-026, Dublin Gateway Medical Center Building 3 Hospital and Garage, 2nd Reading - Planned Development Rezone and Stage 1 and 2 Development Plan and Development Agreement (600-60) The City Council will consider a Planned Development Rezone with Stage 1 and 2 Development Plan and a Development Agreement for the Dublin Gateway Medical Center Building 3 Hospital and Garage project. The project includes the construction of a 6-story, 168,000 square foot, 100-bed hospital building and a 5-level parking structure (4 levels above grade, 1 level below grade) on approximately 3.13 acres ofland within the Dublin Gateway Medical Center (also a portion of the Koll Dublin Corporate Center) at the southeast comer of Dublin Boulevard and Glynnis Rose Drive. STAFF RECOMMENDATION: Waive reading and adopt Ordinance for a Planned Development Rezone with a Stage 1 and 2 Development Plan for the Dublin Gateway Medical Center Building 3 Hospital and Garage Project, with Stage 1 and 2 Development Plan attached as Exhibit A; and waive reading and adopt Ordinance for a Development Agreement for the Dublin Gateway Medical Center Building 3 Hospital and Garage Project, with Development Agreement attached as Exhibit A. June 5, 2007, Dublin City Council Meeting Page 3 of6 4.6 Consultant Services Agreement for 2007-2008 with Associated Engineering Services, Inc., for Construction Inspection Services (600-30) The Public Works Department is in need of a temporary contract inspector to assist with the City's current inspection workload. The engineering consulting firm of Associated Engineering Consultants, Inc., will provide a contract inspector for up to 2,000 hours in Fiscal Year 2007-2008. STAFF RECOMMENDATION: Adopt Resolution approving the consulting services agreement with Associated Engineering Consultants, Inc. 4.7 Approval of "Agreement Regarding Financing of Acquisition of Land for Construction of Positano Parkway (aka Upper Loop Road) and Storm Drains and Sewer Lines Between City of Dublin and Dublin RE Investors, LLC (aka Braddock & Logan)" (600-30) Dublin RE Investors, LLC (dba Braddock & Logan) is seeking City Council approval of an agreement to finance acquisition of land needed for construction of a portion of Positano Parkway and for storm drains and sewer lines in Fallon Road, which are needed to serve the Fallon Village development (Tract 7586). Dublin RE Investors, LLC will pay all the costs of acquisition, including by eminent domain. STAFF RECOMMENDATION: Approve Agreement and authorize the Mayor to sign agreement. 4.8 Warrant Register ($1,356,193.70) dated June 5, 2007 (300-40) STAFF RECOMMENDATION: Approve. 5. WRITTEN COMMUNICATIONS - None 6. PUBLIC HEARINGS 6.1 Amendment of Dublin Municipal Code Chapter 2.40 Relating to Unclaimed Property and Addition of Definition for the Term "County" to Dublin Municipal Code Section 1.04.020 (610-20) A comprehensive update of the Dublin Municipal Code (DMC) is currently underway. This will be the first review of Chapter 2.40 which establishes regulations relating to unclaimed property; clarifying procedures for retention and disposition of property whose ownership is unknown or unclaimed and that has been delivered to the City to be held and disposed of by the City. These proposed revisions provide clarification and ensure compliance with state law. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE the Ordinance Amending Chapter 2.40 of the Dublin Municipal Code Relating to Unclaimed Property and Adding a Definition to Section 1.04.020 of the Dublin Municipal Code. June 5, 2007, Dublin City Council Meeting Page 4 of6 6.2 Adoption of Rates for Garbage Collection, Disposal, and Recycling Services Provided by Amador Valley Industries (A VI) and Establishing the 2007-2008 Annual Assessment (810-30) The Agreement for solid waste services between the City and A VI requires the City to adopt a rate schedule which is estimated to produce a specified revenue amount as identified in the Agreement. The City has also adopted an Ordinance, which requires all parcels in the City to subscribe to weekly minimum garbage service. For residential properties that are serviced with individual containers, the City collects the annual cost of minimum service with the property tax bill. The Council will consider adopting two separate resolutions establishing the garbage rates effective July 1, 2007, and establishing the Fiscal Year 2007-2008 refuse related property tax assessment. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution Amending the Schedule of Service Rates for Integrated Solid Waste Services; and adopt Resolution Approving and Establishing the Collection of Minimum Residential Garbage and Recycling Service Fees for Fiscal Year 2007-2008. 7. UNFINISHED BUSINESS 7.1 Mfordable Housing Agreement for the First Phase of the Positano Development (247 Lots) Located in Fallon Village (430-80/600-30/450-30) The City Council will review the revised affordable housing proposal by Braddock & Logan to address the Inclusionary Zoning Regulations for the 1,043 unite Positano development in Fallon Village and review the proposed Affordable Housing Agreement for the First Phase of the Positano development which consists of247 units. STAFF RECOMMENDATION: Adopt Resolution Approving Affordable Housing Agreement between the City of Dublin and Dublin RE Investors, LLC for the First Phase of the Positano development and authorizing the City Manager to execute the Agreement, with the Affordable Housing Agreement attached as Exhibit A; and direct Staff to prepare a minor administrative amendment to the Fallon Village Stage 1 and Stage 2 PD to allow secondary units on the 3,200 lots within the Positano development. 8. NEW BUSINESS 8.1 PA 06-009 Windstar: Request to Initiate a West Dublin BART Specific Plan Amendment Study to Increase the Residential Density at 6600 Golden Gate Drive, Commonly Referred to as the Windstar Project (APN 941-1500-046) (410-55) The City Council will consider the initiation of a West Dublin BART Specific Plan Amendment for the Windstar project to determine whether a Specific Plan Amendment Study should be authorized to increase the residential density on the site. STAFF RECOMMENDATION: Adopt Resolution approving the West Dublin BART Specific Plan Amendment Study request or adopt Resolution denying the West Dublin BART Specific Plan Amendment Study request. 8.2 Resolution of Intention to Establish Right-of-Way Lines for the Extension of Scarlett Drive and the Iron Horse Trail between Dublin Boulevard and Dougherty Road (820-90) Proposed right-of-way lines for Scarlett Drive and the Iron Horse Trail will establish a right- of-way alignment to accommodate the extension of Scarlett Drive and relocate and enhance a portion of the Iron Horse Trail. This roadway will provide a connection between Dougherty Road and Dublin Boulevard within the former Southern Pacific Railroad Right-of-Way. STAFF RECOMMENDATION: Adopt Resolution of Intention to establish Right-of-Way Lines for the Extension of Scarlett Drive and the Iron Horse Trail between Dublin Boulevard and Dougherty Road; and set a Public Hearing for protests, on June 19, 2007, at 7:00 p.m., in the Dublin City Council Chambers. June 5, 2007, Dublin City Council Meeting Page 5 of6 8.3 Letter of Intent to Participate in the East Bay Regional Communications System (EBRCS) (600-40) This item proposes the City signing a Letter of Intent to participate in the East Bay Regional Communications System (EBRCS), and also allows for a good faith payment of $10,800 signifying the City's intent to join the EBRCS. In the wake of past emergencies, there is regional interest in creating a radio system that will allow all of the jurisdictions in the East Bay to communicate during emergencies. It has been proposed that the EBRCS Joint Powers Authority be formed that will, in turn purchase, install and oversee a new comprehensive radio system that will serve jurisdictions in Alameda County and Contra Costa County. STAFF RECOMMENDATION: Approve the Letter of Intent and Authorize the City Manager to sign on behalf of the City; and approve the Budget Change for $10,800 for a good faith payment. 9.
