ORAL COM:MUNICA TIONS 3.1 Proclamation Declaring June 4-12, 2005 "Affordable Housing Week" (File # 610-50) 3.2 Introduction of New Employees: Dublin Police Services Sergeant Ellis Craft, Officer Peggy Cervantez, Officer Craig Cedegreu and Officer Craig Evans (File # 700-10) 3.3 Amador Valley Industries (A VI) Collection Services Transition Update (File # 600-30) A VI will make a presentation to the City Council regarding the programs and services offered to the community as part of the new solid waste collection services agreement, which is effective July 1, 2005, STAFF RECOMMENDATION: Receive presentation. 3.4 Public Comments At this time, the public Is permitted to address the City Council on non-agendlzed Itams. CONSENT CALENDAR Consent Calendar items are typically non-controWl'Slalln nature and are considered for approval by tile City Council with one single action. Members of the audience, Staff or the City Council who would like an Item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of May 17, 2005. STAFF RECOMMENDATION: Approve 4.2 Agreement for Participation in the Alameda County Operational Area Emergency Management Organization (File # 600-40) This agreement would renew the City's participation in the Alameda County Operational Organization, which facilitates disaster related inter-agency coordination and training, STAFF RECOMMENDATION: Adopt Resolution adopting Agreement for participation in Alameda County OperationaJ Area Emergency Management Organization. 4.3 Acceptance of Work - Contract No. 04-12, Street Light Pole Replacement Project, Phase 3 (File # 600...35) This was the third year of a proposed four-year project to replace deteriorated street light poles in older neighborhoods, The 2004-2005 project replaced 154 street light poles, and was completed within funds budgeted, STAFF RECOMMENDATION: Accept improvements constrocted under Contract No. 04-12, and authorize finaJ payment to St. Francis Electric, Inc" less retention to be paid in 3 5 days if no subcontractor or supplier claims are received, 4.4 Acceptance of Donation from GFWC Dublin/San Ramon Women's Club (File # 150-70) A donation of $4,300 was presented to the City Council at its May 17,2005 meeting by the Dublin San Ramon Women's Club, a member of the CaJifomia Federation of Women's Clubs (GFWC). These funds are to be allocated for the Murray Schoolhouse Renovation Project, STAFF RECOMMENDATION: Approved Budget Change in the amount of $4,300 and direct Staff to prepare formal acknowledge in writing to donor. 4.S Acceptance of OfT-Site Improvements on Tassajara Road for Tract 7441, Phase I - Silvera Ranch (File # 600-60) Pfeiffer Ranch Investors n, Inc., (dba Pinn Brothers Fine Homes, Inc.) has constructed off- site utilities on Tassajara Road to serve Tract 7441. The off-site utilities included storm drain, sanitary sewer, and water infrastructure, including necessary road reconstruction extending ftom the northern boundary of Dublin Raneh, Phase I, to the intersection of Silvera Ranch Drive. It is now appropriate for the City to accept these improvements. STAFF RECOMMENDATION: Adopt Resolution accepting off-site improvemems on Tassajara Road for Tract 7441, Phase I - Silvera Ranch (pfeiffer Ranch Investors II, Inc.) 4.6 Approval of Amendment No.3 to the Agreement between Jennifer Lin and the City of Dnblin for Design of the I-S80lFallon Road Interchange Improvement Project (File # 600- 30) The City of Dublin plans to improve the I-580/FaIlon Road fteeway imerchange to mitigate the Dublin Ranch area development. The proposed amendment to the agreement between Jennifer Lin and the City of Dublin would provide additional funds for the design of other improvements mandated by CaItrans_ STAFF RECOMMEND A TION: Adopt Resolution approving Amendment No.3 to the Agreement between Jennifer Lin and the City of Dublin for design of the I-580/Fallon Road Interchange Improvements_ 4.7 Amendment No.5 to the Consulting Services Agreement with TY Lin InternationalfCCS for the I·S80lFallon Road Interchange Improvements Project (Modification to Scope of Work and Additional Compensation) (Flle # 600-30) The City contracted with TV Lin InternationaIlCCS in 2003 for design of the I-580/Fallon Road Interchange Improvements project. Amendment NO.5 revises the scope of work to include changes required by Caltrans, additional design and right-of-way mapping effort, and incorporation of a PG&E gas line in the proposed fteeway overcrossing structure. STAFF RECOMMENDATION: Adopt Resolntion approving Amendment No.5 to the Agreement with TV Lin InternationaVCCS. 4.8 Review of Services and Amendment to Agreement with MCE Corporation for Maintenance Services (File # 600-30) MCE Corporation provides street, park, and building maintenance services to the City of Dublin_ This amendment provides for an adjustment of rates for Fiscal Year 2005-2006 as allowed under the terms ofMCE's current agreement with the City. The proposed 2005~2006 Operating Budget includes approximately $2,995,908 for the cost of various services provided by MCE Corporation. STAFF RECOMMENDATION: Adopt Resolution approving amendmem to the agreement. 4.9 Interim Agreement between City of Dublin and Pulte Homes for Issuance of Bnilding Penn its for Homes in Dublin Ranch Area F2 Pending Development Agreement Effectiveness (File # 600-60) The City Council will consider the approval of an Interim Agreement with Pulte Homes which will allow Pulte to move forward on the construction of up to 60 homes at their own risk prior to the approval of a Development Agreement with the City of Dublin. STAFF RECOMMENDATION: Authorize Mayor to execute Interim Agreement. 4.10 Warrant Register ($4,298,710.09) dated Jnne 7, 2005 (File # 300-40) STAFF RECOMMENDATION: Approve S. WRITTEN COMMUNICATIONS 5.1 Request to Consider a Resolntion to Oppose a Statewide Special Election in November 2005 (File #630-50) The City ofEI Cerrito has requested the City of Dublin to prepare a resolution opposing the Special Election in November proposed by Governor Schwarzenegger_ ST AFF RECOMMENDATION: Adopt Resolution or provide Staff with additional direction. 6. PUBLIC HEARING 6.1 Appeal of Planning Commission Reversal of Zoning Administrator's Approval of a ConditionaJ Use Permit Authorizing a Parking Reduction for Enea Properties/Starbucks Coffee, PA 04-057 (File #410-30) Applicant Robert Enea, Enea Properties, is appealing the Planning Commission's denial of a Conditional Use Permit for a reduction in parking for a 1,886 square foot coffee retailer and café (Starbucks) in the future Enea Village Parkway Center, located at 7197 Village Parkway. The Zoning Administrator's previous approval of the Conditional Use Permit was appealed to the Planning Commission by Bobbi Cauchi in March 2004. At its April 26, 2005 meeting, the Planning Commission reversed the Zoning Administrator's decision and denied the Conditional Use Permit. STAFF RECOMMENDATION: Conduct public hearing; deliberate; and direct Staff to EITHER: a) Prepare a Resolution denying the appea~ thereby afÍrrming the Planning Commission denial of the Conditional Use Permit, - OR - b) Prepare a Resolution granting the appeal, thereby reversing the Planning Commission denial and upholding the Zoning Administrator's approval of the Conditional Use Permit; - OR - c) Prepare a Resolution granting the appeal in part, thereby reversing the Planning Commission denial and modifying the Zoning Administrator approval of the Conditional Use Permit. 6.2 Amendment to the Master Development Agreement for the Dublin Ranch Project (Areas A through H), PA 04-023 (File # 600-60) The City Council will consider adopting an Ordinance approving an amendment to the Master Development Agreement for the Dublin Ranch Project Areas A, B, C, D, E, F, G and II, whieh was suboùtted by James Tong on behalf of the Lin Family. The proposed amendments would involve compliance with allocation of credit for affordable housing units, the Commercial Linkage Fee/Non-Residential Affordable Housing Fee, and park land STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive first reading and INTRODUCE Ordinance approving an amendment to the Master Development Agreement for the Dublin Ranch Project (Areas A, B, C, D, E, F, G and H) between the City of Dublin and the Lin Family. 6.3 Ordinance Amending Chapter 7.36 of the Dublin Municipal Code, Adopting by Reference and Amending the 2002 Edition ofthe National Electrical Code (File # 440-10) Pursuant to Government Code Section 36937, the 2002 National Electrical Code win become effective on August 1,2005. In order to ensure continuity of the City's building standards, the City Council win consider amending Chapter 7.36 of the Dublin Municipal Code, adopting by reference the 2002 edition of the National Electrical Code. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution approving the findings of necessity for amendments to the 2002 edition of the National Electrical Code as amended by Staff; and waive first reading and INTRODUCE Ordinance amending Chapter 7.36 of the Dublin Municipal Code, which adopts by reference the 2002 edition of the National Electrical Code. 6.4 Fallon Sports Park Master Plan - Environmental Review and Adoption of Master Plan (File # 920-30) The 2000-2005 Capital Improvement Program includes funding for development of a Master Plan for the 6o± Fallon Sports Park. The park is bordered by the future Lockhart Street to the west, Gleason Drive to the north, Fallon Road to the east and Central Parkway to the south. The City Council will consider the Final Draft Sports Park Master Plan developed with the assistance of the Fallon Sports Park Task Force. The Master Plan outlines the proposed uses for the site. The City Council win also consider the adoption of a Mitigated Negative Declaration and the Mitigation Monitoring Program. STAFF RECOMMENDA nON: Conduct public hearing; deliberate; adopt Resolution adopting the Mitigated Negative Declaration and the Mitigation Monitoring Program; direct Staff to prepare and file a Certificate of Fee Exemption for California Department ofFish and Game Filing Fees; and approve Final Draft Fallon Sports Park Master Plan. 7. UNFINISHED BUSINESS 7.1 Dates for Senior Center Grand Opening Events (File # 240-10) Construction of the new Dublin Senior Center is nearing completion. The Council will consider dates for the grand opening events. ST AFF RECOMMENDATION: Schedule Gala Banquet for August 4th and Ribbon Cutting! Open House for August 6th, or provide Staff with alternate dates. 8. NEW BUSINESS 8. t Designation of Two ConnciImembers as City Representatives to Discuss Compensation with City Attorney (File # 600-30) This item provides for the designation of two members of the City Council to discuss tenus of the City Attorney's contract, including compensation, with the City Attorney pursuant to the Government Code. The two members would report their recommendation to the full Council in open session following meetings with the City Attorney STAFF RECOMMENDATION: Designate two members of the City Council. 8.2 Proposed "Sentinels of Freedom - Operation WeJcome Home" Program (File # 150-85) Longtime Dublin resident Millie Wasik has requested the City Council to consider the establishment of the "Sentinels of Freedom - Operation Welcome Home" Program, which would honor the returning and graduating military personnel form each local community. STAFF RECOMMENDATION: Adopt Resolution and appoint a City liaison from the community to implement this program in the City of Dublin. 8.3 Review and Consideration of the Streetscape Master Plan (File # 600-30/820-20) The City Council will review and consider the proposed S1reetscape Master Plan, developed to help better coordinate S!ree!scape design throughout the City. STAFF RECOMMENDATION: Adopt Resolution approving S1reetscape Master Plan. 8.4 Annual Review and Fee Adjustments for Building Bnd Safety Consultants (File # 600-30) The City of Dublin has utilized the firms of 4Leaf, Inc., Berry¡nan & Hennigar, CSG Consultants, Inc., Linhart Petersen and Powers (LP2A), and Precision Inspection Company, Inc., to provide building inspection, plan checking and building code enforcement on a contract basis. The City Council will conduct an annual review of the contracts, These amendments will provide for an adjustment of rates for Fiscal Year 2005-2006.
