HomeMy WebLinkAbout*CC Agenda 06-11-1996A G E N D A DUBLIN CITY COUNCILDUBLIN CITY COUNCIL REGULAR MEETING - Tuesday, June 11, 1996, 7:00 p.m. DUBLIN CIVIC CENTER, 100 Civic Plaza A complete packet of information containing Staff Reports and exhibits related to each item is available for public review several days prior to a Council meeting in the City Clerk’s Office and also at the Dublin Library. 1.CALL TO ORDER 2.PLEDGE OF ALLEGIANCE TO THE FLAG 3.ORAL COMMUNICATIONS At this time, the public is permitted to address the City Council on non-agendized items. The Council must, however, comply with all State Laws in regard to items not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4.CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1Minutes of Regular Meeting of May 28, 1996 STAFF RECOMMENDATION: Approve 4.2Agreement for Dublin Swim Center Pool Maintenance Services Pool maintenance services for the Dublin Swim Center are provided to the City under contract. The present contract began on July 1, 1993 and will expire on June 30, 1996. Requests for Proposals were circulated to 18 local firms specializing in pool maintenance and one firm, Oceanside Pool Supply, responded to the proposal. Staff has reviewed the proposal and the credentials of Oceanside Pool Supply and finds that the cost of said service is reasonable for the scope of services provided. STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute agreement 4.3Acceptance of Gift to City The City has received a $405 grant from the Northern California Grantmakers for the Junior Aquatic Water Safety Volunteer Program (JAWS). The grant money will be used to offset the costs of training the volunteers. Supplies such as training manuals and uniforms will be purchased with the grant money. STAFF RECOMMENDATION: Accept gift; direct Staff to prepare formal acknowledgment to donor; and approve Budget Change Form 4.4Inclusionary Zoning Ordinance/Housing Element Programs - CGMS Inc. - Contract Amendment, Budget Amendment and Operating Transfer The City Council will consider a contract amendment to the contract between the City and CGMS Inc., for providing extra housing consulting services. The amendment would increase the contract amount from $8,000 to $15,000. The Council will also consider a budget amendment for an additional appropriation of $7,000 to the Planning Department Professional Services account for completing extra housing consultant services. STAFF RECOMMENDATION: Adopt Resolution approving contract amendment; authorize City Manager to execute amendment; authorize $7,000 Budget Change Form 4.5Acceptance of Work - Contract 96-03, Annual Street Slurry Seal As part of the City's street maintenance program, City streets are slurry sealed approximately every 7 years. This surfacing prolongs the life of the asphalt surfacing by retarding water from !~.. Warrant Register ($519,144.72) dated June 11, 1996 STAFF RECOMMENDATION: Approve . 5.WRITTEN COMMUNICATIONS 5.1Correspondence from City of San Ramon requesting an Amendment to the Dougherty Regional Fire Authority (DRFA) Bylaws allowing a modification to the termination provisions The Cities of Dublin and San Ramon are parties to a joint powers agreement for the provision of fire prevention and suppression services which forms the Dougherty Regional Fire Authority. The current agreement provides that notice of termination be given by June 30, and shall not be effective for 12 months following the notice. The City of San Ramon is currently considering alternatives to the provision of fire service and has requested an amendment to the agreement to provide additional time to explore fire service options. STAFF RECOMMENDATION: Consider request and adoption of a Resolution amending the Agreement to allow for notice of termination to be given at any time prior to September 30, 1996. Such an amendment would continue to require a minimum of 12 months written notice of termination. 6.PUBLIC HEARING 6.1Inclusionary Zoning Ordinance PA 96-018 This is the second reading of an ordinance which would require a minimum percentage of units in new residential projects to be affordable to lower and moderate income families. A Resolution is also proposed to adopt a Negative Declaration of Environmental Impact, and to establish the formula for determining the calculation of in-lieu fees, as an option for developments which do not provide the inclusionary units on the project site. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution; waive second reading and ADOPT Inclusionary Zoning Ordinance 6.2Rental Availability Ordinance Repeal PA 96-019 This is the second reading of an ordinance repealing Chapter 8.04 of the Dublin Municipal Code, known as the Rental Availability Ordinance. A Resolution approving a Negative Declaration of Environmental Impact and amending the General Plan Housing Element relating to the Rental Availability Ordinance repeal is also proposed for adoption, to delete the reference to this Ordinance. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution approving Negative Declaration and adopting General Plan Amendment; and waive reading and ADOPT Ordinance repealing Rental Availability Ordinance 6.3Trumark Homes PD Rezone PA 96-014 The City Council will review and take action on a Planned Development Rezone on 8.9 acres of land. The PD Rezone would change the zoning district from M-1 (light industrial) to Planned Development (residential). The project is located west of Dougherty Road on the Southern Pacific Right-of-Way and the rezone would allow development of a 92 single-family subdivision at this location. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance; continue Public Hearing to June 25, 1996 6.4Flood Control Ordinance The City's current Flood Control Ordinance contains language of the state model ordinance that needs to be updated to comply with current minimum standards of the National Flood Insurance Program. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance amending Chapter 7.24 of the Dublin Municipal Code 6.5Amendment to Dublin Municipal Code Chapter 2.28 Relating to Campaign Contribution Limitations Following discussion at the last 3 Council meetings, the Council directed Staff to prepare an Ordinance amending the City's Campaign Contribution Regulations. These amendments would: 1) Change contribution limitation from $1,000 to $300; and 2) Change the itemized reporting amount of contributions received from $100 to $25. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance to take effect immediately -OR- take other appropriate action 7.UNFINISHED BUSINESS - None 8.NEW BUSINESS 8.1Crossing Guard Services The City of Dublin currently funds the provision of adult crossing guard services. It has been determined that providing crossing guard services under contract is the most cost effective method. All City Management Services, Inc., the current service provider, has submitted a proposal to continue to provide crossing guard services to the City of Dublin the 1996-97 school year. STAFF RECOMMENDATION: Adopt Resolution and authorize City Manager to execute amendment to the Agreement with All City Management Services, Inc. 8.2Local Regulation of Firearms Dealers At the May 14, 1996 meeting, Cm. Moffatt asked Staff to prepare a report outlining the City's options with regard to adopting local regulations of firearms sales. The City Council will review the report prepared by the City Attorney. STAFF RECOMMENDATION: Consider report and provide direction to Staff 8.3Request from Sherry & Kenneth Hill to address the City Council on a Sulfur Odor Emanating from Bordeaux Estates Subdrain on Rolling Hills Drive (Tract 5073) Mr. & Mrs. Hill, 11210 Rolling Hills Drive have requested that this item be placed on the agenda and that the City of Dublin find a solution to the hydrogen sulfide odor emanating from a drain inlet in an open space parcel owned by their Homeowners Association. The odor comes from an underground spring which passes through a sulfur deposit.
