PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is not on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not suffi ci ent ti me to address thei r concern, that person should arrange wi th the Ci ty Clerk to have thei r particular concern placed on the agenda for a future meeting. The City Council cannot deliberate or take action on a non-agenda item unless there is factual evidence presented to the Counci I i ndi cati ng that the subject brought up falls into one of the excepti ons under Government Code Section 54954.2 in that a) there is an emergency situation, or b) the need to take action on the item arose subsequent to the agenda being posted. 3.1 Request from Business Owner to Address the City Council regarding the Sign Ordinance 4. CONSENT CALENDAR Consent Calendar items are typi cally of a non-controversi a1 nature and are consi dered for approval by the City Council with one single action. Members of the audi ence who would 1 i ke an item removed from the consent calendar for purpose of pub1i c input may request the Ci ty Counci 1 to remove the item from the consent calendar. The request may be made at the ti me that the Mayor asks the audi ence members if there i s anyone interested in removi ng an item from the Consent Calendar. 4.1 Minutes of Regular Meeting of May 22, 1989 STAFF RECOMMENDATION: Approve 4.2 City Treasurer's Investment Report for Period Ending May 31, 1989 STAFF RECOMMENDATION: Approve 4.3 Closure of Burton Street for 4th of July Block Party The residents of Burton Street will be holding their 9th annual fourth of July event this year and have requested an Encroachment Permit to close off Burton Street from Tamarack Drive to Amador Valley Boulevard. They request that the street be closed to through traffic from 10:00 a.m. to 10:00 p.m. STAFF RECOMMENDATION: Waive the Encroachment Permit Fee and authorize the City Engineer to issue the Permit. 4.4 Acceptance of Work - Pool Pump Replacement - Contract 89-5 The City Council authorized Staff to purchase new pumps for the Swim Center and contract with the Martin Company for installation of the pumps. Work was completed within the funds authorized. STAFF RECOMMENDATION: Accept improvements constructed under Contract 89-5 and authorize the retention payment to John Martin in the amount of $795. 4.5 Acceptance of Work - Annual Street Overlay and Repair - Contract 89-3 Work on this project was completed within funds budgeted. STAFF RECOMMENDATION: Accept improvements constructed under Contract 89-3 and authorize Staff to pay final payment and retention in the amount of $118,901.13 to Bay Cities Paving & Grading. 4.6 PA 88-133 Ashcroft Fence Height Variance Appeal Request, 11452 Winding Trail Lane This item relates to consideration of a Draft Resolution reversing the Planning Commission's action denying a Variance Request to allow a 7'7" high fence (now existing), where a maximum height of 6' if permitted. STAFF RECOMMENDATION: Review and adopt Resolution reversing the Planning Commission's action denying Variance and approving the request. 4.7 PA 89-001 Petray Fence Height Variance Appeal Request, 11450 Winding Trail Lane This item relates to consideration of a Draft Resolution reversing the Planning Commission's action denying a Variance Request to allow an 8' high fence (now existing), where a maximum height of 6' if permitted. STAFF RECOMMENDATION: Review and adopt Resolution reversing the Planning Commission's action denying Variance and approving the request. 4.8 Tract 5511, Landscaping & Lighting Assessment District No. 1986-1 This action approves the Preliminary Engineer's Report and sets a public hearing date of July 10, 1989 for the Tract 5511 (Villages) Landscape Maintenance Assessment District. Estimated assessment per single family lot is $120 and per townhouse/condominium lot is $60. STAFF RECOMMENDATION: Adopt Resolutions 4.09 Warrant Register dated June 12, 1989 STAFF RECOMMENDATION: Approve 4.10 Financial Report for Period Ending May 31, 1989 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS 5.1 Letter from Assemblywoman Delaine Eastin requesting Support of Assembly Bill 1611 Legislation has been introduced by Assemblywoman Eastin and others in the State Legislature which would revise the composition of the Metropolitan Transportation Commission. The intent is to have the Board made up of officials from the member counties according to the population of the county. The current structure allows counties with populations less than Alameda County to have more representatives. STAFF RECOMMENDATION: Consider supporting the measure and, if appropriate, provide input on the Draft Letter of Support and authorize the Mayor to send the letter. 6. PUBLIC HEARING 6.1 Request of Mrs. Judi Schroeder, 7254 Tina Place, for an interpretation of Section 12.1, Item 10 of Ordinance No. 58-87 The Applicant is requesting that measurement of the height of a deck be made at a point along the exterior boundaries of the deck. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution 6.2 Citywide Street Lighting Maintenance Assessment District 83-1: 1989-90 Levy of Assessments This assessment district provides funds for maintenance of street lighting throughout the City. The estimated assessment for 1989-90 is $20.00 per year per single-family house. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution approving Engineer's Report, Confirming Diagram and Assessment and ordering levy of assessment. 6.3 Villages Planned Development Rezoning request to modify Condition #47 of the Planned Development approving the Villages, PA 89-041 This item is a request to modify Condition #47 which relates to the construction of improvements at the Dougherty Road/Dublin Boulevard intersection. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution regarding the PD Planned Development Rezoning request for PA 89-041 and waive the reading and introduce an Ordinance amending Condition #47 of City Council Resolution No. 31-86. 7. UNFINISHED BUSINESS - None 8. NEW BUSINESS 8.1 Agreement with CalTrans regarding Freeway Improvements, I-580 from Tassajara Road to .1 Mile West of Dougherty Road This agreement pertains to improvements proposed to be constructed along I-58D between Tassajara Road and just west of Dougherty Road. First phase improvements are to be funded by the North Pleasanton Improvement District. STAFF RECOMMENDATION: Adopt Resolution approving agreement with State of California Department of Transportation regarding I-580 from Tassajara Road to .1 mile west of Dougherty Road 8.2 Dublin Unified School District Liaison Committee In order to facilitate the review of a draft Joint Use Recreation Facilities Agreement, it has been suggested that both agencies designate Liaison Committee representatives to work with Staff in refining the draft agreement prior to presenting the agreement to the full Board of each agency. STAFF RECOMNENDATION: Designate two representatives from the Council to function in a Liaison Committee capacity with the Dublin Unified School District. 9. OTHER BUSINESS 10.
