C.OMMUNICAT!ON.S 3.1 Proelamation Declaring June 21-27, 2004 "RelaY for Life" Week (File #610-$0) 3.2 Appointment of Dublin Representatives to the Livermore Airport Master Plan Update Advisory Committee (File #110-30/420-50) The City of Livermore is requesting the Dublin City Council to appoint three (3) representatives to the Livermore Airport Master Plan Update Advisory Committee. The appointments to the Committee should include one Dublin City Councilmember, one member of the Dublin business community and one atqarge Dublin resident, The Committee will discuss, take public testimony, consider and make recommendations to the Livermore City Council regarding the Draft Airport Mater Plan Update and the Initial Study/Mitigated Negative Declaration_ May°r Lockhart recommends the appointment of Vice Mayor (]eorge Zika as City Council Representative; Sybase Security Director (]abe Navarrette as Business Community RePresentative; and David Froio as the Citizen'at-Large Representative. CONSENT CALENDAR Consent Calendar items are typically non.controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of June 1, 2004 STAFF RECOMMENDATION: Approve 4.2 Project Acceptance, "Dreams of Longing After Nothing" Art in the Parks - Dolan Park (File # 600-30) In January 2004, the City Council approved an agreement with artist Bryan Tedrick and the Dublin Fine Arts Foundation to complete artwork for Dolan Park as part of the Art in the Parks program. The artist has completed the project and fulfilled the requirements of the agreement. STAFF RECOMMENDATION: Accept improvements. 4.3 Amendment to Agreement for Lease of Fallon School Multipurpose Facility (File fl600-40) The Current agreement with the Dublin Unified School District for lease of the Fallon School Multipurpose Facility for the Dublin Senior Center will expire on June 30, 2004. As the new Senior Center will not be complete until spring 2005, it is necessary to extend the term of the agreement for one additional year to June 30, 2005. STAFF RECOMMENDATION: Authorize Mayor to execute Amendment to Agreement. 4.4 Approval of the Final Map and Improvement Agreement for Tract 7414, and Acceptance of Parkland Dedication In-Lieu Fee (GHC Roxbury, LLC) (File # 600-60) GHC Roxbm% LLC, is seeking City Council approval of the Final Map and Improvement Agreement for Tract 7414, and acceptance of Parkland Dedication In-Lieu Fees. The project will create 109 single-family residential lots and one single-family estate lot on the west side of Tassajara Creek between Maymont Lane and Somerset Lane. STAFF RECOMMENDATION: Adopt Re$01ufi.on(s), 4.5 Acceptance of Landscape Improvements Associated with Tract 7141, Dnblin Ranch Area A, Neighborhood A-6 (Toll CA H, L.P.) (File # 600-60) As part of the development of Tract 7141 (Dublin Ranch Area A, Neighborhood A-6), the Developer completed landscape improvements for Bent Tree Drive and Fallon Road. The improvements have been completed, and it is appropriate to accept landscaping and release the bonds that guarantee the work. STAFF RECOMMENDATION: Adopt Resolution. 4.6 Adoption of Resolutions Amending the City's Salary Plan and Classification Plan for Fiscal Year 2004-2005 (File # 700-20) The City Council will consider adjusting the salary range values for upcoming Fiscal Year 2004-2005. The recommended salary ranges were derived l~om a comprehensive salary survey of other municipal agencies conducted by the Personnel Division. In addition, the City Council will consider adding the classification of Information Systems Technician I/II to the Classification Plan. STAFF RECOMMENDATION: Adopt R~0[ution(s). 4.7 Citywide Street Lighting Maintenance Assessment District 83-1: Preliminary Engineer's Report (File # 360-20) This assessment district funds thc maintenance of the City's street lighting system, except for lights in Dublin Ranch and Tract 7067 (Clifden Parc). This action would approve the Preliminary Engineer's Report and set a public hearing date for levy of assessments for 2004- 05. The assessment for this District is not proposed to increase above the 2003-04 level. STAFF RECOMMENDATION: Adopt Resoluti0n(s.) approving Preliminary Engineer's Report and setting a Public Hearing date of July 20, 2004, at 7:00 p.m., for the purpose of hearing protests to the proposed 2004-05 assessment. 4.8 Landscaping and Lighting Maintenance Assessment District 83-2 (Stagecoach Road): Preliminary Engineer's Report (File 0360-20) This assessment district funds the maintenance of street-side landscaping along Stagecoach Road and on the "interior slopes" of the Dublin Hills Estates development. This action would approve the Preliminary Engineer's Report and set a public hearing date for levy of assessments for 2004-05. The assessment for this district is proposed to increase 0.5% above the 2004-04 level in accordance with the Consumer Price Index. STAFF RECOMMENDATION: Adopt Res,01ution(s) approving Preliminary Engineer's Report and setting a Public Hearing date of July 20, 2004, at 7:00 p.m., for the purpose of hearing protests to the proposed 2004-05 assessmem. 4.9 Landscaping and Lighting Maintenance Assessment District 86-1 (Dougherty Road): Preliminary Engineer's Report (File #360=20) This assessment district funds the maintenance of street-side landscaping along portions of Dougherty Road and Amador Valley Boulevard and certain common area landscaping within the Villages at Willow Creek development. This action would approve the Preliminary Engineer's Report and set a public hearing for levy of assessments for 2004-05. The assessment for this district is proposed to increase 0.5% above the 2003-04 level based on the Consumer Price Index. STAFF RECOMMENDATION: Adopt Resolutionfs) approving Preliminary Engineer's Report and setting a Public Hearing date of July 20, 2004, at 7:00 p.m., for the purpose of hearing protests to the proposed 2004-05 assessment. 4.10 Street Lighting Maintenance Assessment District 99-1 (Dublin Ranch and Tract 7067): Preliminary Engineer's Report (File # 360-20) This assessment district fimds the maintenance of the City's street lighting system in Dublin Ranch and Tract 7067 (Clifden Parc). This action would approve the Preliminary Engineer's Report and set a public hearing date for levy of assessment for 2004-05. The assessment for this district is not proposed to increase above the 2003-04 level. STAFF RECOMMENDATION: Adopt Resolufi, on(s) approving Preliminary Engineer's Report and setting a Public Hearing date of July 20, 2004, at 7:00 p.m., for the purpose of hearing protests to the proposed 2004-05 assessment. 4.11 Landscaping Maintenance Assessment District 97-1 (Santa Rita Area): Preliminary Engineer's Report (File #360-20) This assessmem district funds the maintenance of street-side landscaping within the Santa Rita development area, which is generally bounded by 1-580, Gleason Drive, Arnold Road, and Tassajara Road. This action would approve the Preliminary Engineer's Report and set a public hearing date for levy of assessments for 2004-05. The assessment for this District is not proposed to increase above the 2003-04 level. STAFF RECOMMENDATION: : Adopt R.es01utionCs) approving Preliminary Engineer's Report and setting a Public Hearing date of July 20, 2004, at 7:00 p.m., for the purpose of hearing protests to the proposed 2004-05 assessment. 4.12 Warrant Register ($1,165,333.97) dated June 15, 2004 (File # 300-40) STAFF RECOMMENDATION: Approve 5. WRITTEN COMM,UNICATIONS - NONE 6. ,P,t BL!C 6.1 Amendment of Eastern Dublin Traffic Impact Fee and Area of Benefit Fee Resolution (File # 390-20) This item is to update the current Eastern Dublin Tra~c Impact Fee (EDTIF) program which collects fees to finance transportation improvements and facilities needed to reduce the traffic-related impacts caused by development in Eastern Dublin. The EDTIF needs to be updated to reflect the current cost of acquiring land and constructing improvements. Also, additional territory (shown as the Transit Center) was added to the Eastern Dublin Specific Plan and that territory will be added to the EDTIF. The revised EDTIF will reflect the addition of the transit Center area and additional improvements related to the newly added territory. STAFF RECOMMENDATION: Conduct public hearing; determine value of protests to Area of Benefit Fee only; deliberate; and adopt Resolution revising the Traffic Impact Fee and Area of Benefit Fee for Future Developments within the Eastern Dublin Area, as Previously Established by Resolution 1-95 and Revised by Resolutions 41-96 and 225-99. 6.2 Consideration of Appeal of Planning Commission Approval of PA 02-040, Loukianoff Site Development Review (File # 410-30) The City Council will hold a public hearing to consider an appeal filed by Councilmember Claudia McCormick regarding the Planning Commission's approval of a new 2,954 square foot, single-family residence on an existing lot (Lot 1 of Tract Map 5073) located at 11299 Rolling Hills Drive. STAFF RECOMMENDATION: Conduct public hearing; deliberate; and adopt R~,olut. io.n. denying the appeal and a~ing the Planning Commission approval of May 11, 2004. 6.3 Ordinance Repealing Section 6.64.020 of the Dublin Municipal Code regarding Weight Limits for Commercial Vehicles in Residential Districts (File # 570-20) This is the second reading of an Ordinance repealing Section 6.64.020, Commercial Vehicles in Residential Districts, of the Dublin Municipal Code to maintain consistency with the recently adopted Ordinance 10-03, prohibiting operation of any commercial vehicle having a gross weight, including load, in excess of 5 tons on any street within any residential district in the City of Dublin. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt Ordimanee. 6.4 Proposed Amendment to the Fee Schedule for Fire Prevention Services (Fire Permits, Plan Review, Inspection and Fire Services)(File # 540-20) In an effort to recover the reasonable costs of providing fire department plan reviews and building inspection services, Staff conducted a review of current fees and the actual time spent on the provision of services associated with these fees. Upon completion of the review, it was determined that the fees need to be increased to compensate for the City's costs. The fee scheduled has not been updated since October 1999. STAFF RECOMMENDATION: Conduct public hearing, deliberate; and adopt Re~olution amending fees for Fire Prevention Services. 7. ,UNFINISHED BUSINESS. 7.1 "Art at the Crossings" Art Festival- Dublin Fine Arts Foundation (DFAF) (File # 900-50) In Fiscal Year 2001-2002, DFAF received funding of $5,000 from the City of Dublin to plan an ar~ festival. As part of the funding approval City Council had required that the plan for the art festival be brought back to City Council. DFAF Consulting Director Lynn Baer will make a presentation regarding the planned six-week art festival at Hacienda Crossings. STAFF RECOMMENDATION: Receive report. 7.2 Continuation of Emergency Action and Progress Report on Remediation Work at Dublin. Civic Center (File # 600-30) The Civic Center incurred water damage from rain in early-March 2004. At its March 16~ meeting, the City Council approved a declaration of emergency in order to allow a waiver of competitive bid to obtain a contractor for environmental remediation work related to the water intrusion. This item would approve a continuation of the declaration of emergency, while the remediation work continues and provide an update on the progress of the project to-date. STAFF RECOMMENDATION: Adopt Resolution continuing the emergency action to the City Council meeting of July 6, 2004. 7.3 Second Amendment to Construction Truck Access Agreement with Windemere BLC Land Company, LLC (File 0600-30) This item is to approve a second amendment to the current agreement between the City of Dublin and Windemere BLC Land Company, LLC, to allow this developer to continue using Dougherty Road within the City limits to haul concrete and paving materials to the Windemere Ranch Development site in Contra Costa County through June 30, 2004. The Developer is agreeing, in return, to mitigate prior impacts to Dougherty Road pavement conditions from truck deliveries under the current agreement and guarantee fair STAFF RECOMMENDATION: Adopt Resolution approving the second Amendment to the Agreement with Windemere BLC Land Company; and approve Budget Change in the total amount of $13,966 to the General Fund. 8. BUSINESS 8.1 General Municipal Election - November 2, 2004 (File # 630-20) In November 2004, voters in Dublin will elect a Mayor (2-year term of#ffice) and two Councilmembers (4-year terms of office). It is necessary to make a formal request to the Alameda County Board of Supervisors that Dublin's election be consolidated with the Statewide General Election and that the Registrar of Voters perform certain services associated with the election. Also, the Council must determine whether candidates or the'City pays for publishing costs associated with candidate statements in the sample ballots and whether 200 or 400 words will he allowed in the candidate statements ofqualification. STAFF RECOMMENDATION: Adopt Resolution(s) calling the election and adopting regulations for candidates and costs of the candidate statements. 8.2 Expansion of the Credit Card Payment Program for Selected City Services (File # 350-20) As Phase II of the E-Commerce Program, the City Council will consider accepting credit cards to pay for a broader range of City Services beyond Parks and Community Services as additional convenience for the public. STAFF RECOMMENDATION: Authorize Staff to implement Phase H of the E-Commerce Program that would allow for Visa and MasterCard credit card acceptance to pay for City Services, with a minimum threshold of $10.00 and a maximum transaction amount not to exceed $1,000.00. 8.3 Review of Services and Amendment to Agreement with MCE Corporation for Public Works Maintenance Services (File #600-30) MCE Corporation provides street, park, and building maintenance services to the City of Dublin. This amendment provides for an adjustment of rates for Fiscal Year 2004-05 as allowed under the terms of their current agreement with the City. The proposed 2004-05 Operating Budget includes approximately $2,7I 4,662 for the cost of various services provided by MCE Corporation. STAFF RECOMMENDATION: Adopt Resol#.tion. approving the Amendment to Agreement. 9. .OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports 10. ADJOURNMENT On Monday, June 28, 2004, beginning at 6:00 p.m., an Adjourned Regular Meeting will be held, including public hearings for consideration and adoption of the City's Fiscal Year 2004-05 Budget and the FY 2004-05 Update to the 2002-07 Five-Year Capital Improvement Program.
