3.1 Acceptance of Improvements - Dublin Sports Grounds Batting Cages (600-30)
In August 2003, the City of Dublin and the Dublin Little League entered into an agreement
regarding construction of batting cages at the Dublin Sports Grounds. As per the agreement,
Dublin Little League was granted permission to construct two batting cages at the Dublin
Sports Grounds and, upon completion, transfer ownership of the improvements to the City.
Construction of the batting cages by Dublin Little League is now complete and the ownership
will be transferred to the City.
STAFF RECOMMENDATION: Accept ownership of Dublin Sports Grounds Batting Cages.
3.2 Mayor's Appointment of Student Member to Parks and Community Services Commission
(110-30)
The City Council will consider the Mayor's appointment of Joey Von Loon to the Parks and
Community Services Commission.
STAFF RECOMMENDATION: Confirm the Mayor's appointment to the Parks and
Community Services Commission and direct Staff to notify the applicants, or provide other
appropriate direction.

4.1 Minutes of Adjourned Regular Meeting of March 31, 2008.
STAFF RECOMMENDATION: Approve.
4.2 Amendment to Agreement with BSK Associates for General Geotechnical Services (600-30)
BSK Associates has provided the City with General geotechnical services since 1995,
performing tasks associated with private development and the City's Capital Improvement
Program projects. The City Council will consider granting a rate increase for Fiscal Year
2008-2009.
STAFF RECOMMENDATION: Adopt Resolution Approving Amendment to Agreement with
BSK Associates for Geotechnical Engineering Services.
4.3 Amendment to Agreement with SNG & Associates, Inc., for Engineering Services (600-30)
SNG & Associates, Inc., has provided the City with engineering services since 2002,
performing tasks associated with private development projects. The City Council will
consider granting a rate increase for Fiscal Year 2008-2009.
STAFF RECOMMENDATION: Adopt Resolution Approving Amendment to Agreement with
SNG & Associates, Inc., for Engineering Services.
4.4 Amendment to Agreement with Kimley-Horn and Associates, Inc., for Traffic Engineering
Services (600-30)
Kimley-Hom and Associates, Inc., has provided the City with traffic engineering services
since 2001. These services include transportation planning, preparation of traffic studies, and
other traffic-related services associated with private development, and the City's Capital
Improvement Program projects. The City Council will consider granting a rate increase for
Fiscal Year 2008-2009.
STAFF RECOMMENDATION: Adopt Resolution Approving Amendment to Agreement with
Kimley-Hom and Associates, Inc., for Traffic Engineering Services.
4.5 Amendment to Agreement with Kleinfelder, Inc., for Geotechnical Engineering Services
(600-30)
Kleinfelder, Inc., has provided general geotechnical services to the City since 1996, primarily
in the area of peer review for private development projects, and Staff support and testing
services for Capital Improvement Program projects. The City Council will consider
extending the term of the Agreement to June 30, 2010, and granting a rate increase for Fiscal
Year 2008-2009.
STAFF RECOMMENDATION: Adopt Resolution Approving Amendment to Agreement with
Kleinfelder, Inc., for General Geotechnical Services.
4.6 Amendment to Agreement with Omni-Means, L TD, for Traffic Engineering Services
(600-30)
Omni-Means, L TD, has provided the City with traffic engineering services since 1996,
performing tasks associated with private development projects. The City Council will
consider granting a rate increase for Fiscal Year 2008-2009.
STAFF RECOMMENDATION: Adopt Resolution Approving Amendment to Agreement with
Omni-Means, L TD, for Traffic Engineering Services.
4.7 Acceptance of Work - Contract No. 08-02,2007-2008 Annual Sidewalk Safety Repair
Program and Curb Ramp Installation (600-35)
This project removed and replaced damaged sidewalk with offsets of %" or more that may
pose a tripping hazard and constructed 17 new pedestrian curb ramps.
STAFF RECOMMENDATION: Accept the improvements under Contract No. 08-02, 2007-
2008 Annual Sidewalk Safety Repair Program and Curb Ramp Installation and authorize the
release of retention after 35 days ifthere are not subcontractor claims.

4.8 Proposed Ordinance Establishing Bus Stops and Repealing Bus Stop Designations at
Various Locations Citywide (1060-20)
This item presents various locations Citywide that operated as active bus stops but were never
adopted by ordinance. In addition, two locations are proposed for repeal of bus stop
designation and three new locations are proposed for bus stop designation. This is the second
reading of this Ordinance. Staff seeks City Council adoption of an ordinance to formalize
these changes.
STAFF RECOMMENDATION: Waive reading and adopt Ordinance Repealing Ordinance
Nos. 13-90 and 16-97 and Establishing Bus Stops at Various Locations Citywide.
4.9 Amendment No.1 to the Consulting Services Agreement with Associated Right of Way
Services, Inc., for the Acquisition of Right-of-Way for the Saint Patrick Way - Regional
Street to Golden Gate Project (600-30)
It has been determined that additional services will be required in the areas of negotiation and
acquisition of right-of-way for the Saint Patrick Way -Regional Street to Golden Gate Drive
Project. The City Council will consider approving an amendment to the consultant contract
with Associated Right of Way Services, Inc., to perform these additional services. Funding
for these services is derived from the Downtown Traffic Impact Fee, and voluntary traffic
mitigation contributions.
STAFF RECOMMENDATION: Adopt Resolution Approving Amendment No. 1 to the
Agreement with Associated Right of Way Services, Inc., for Consulting Services for the Saint
Patrick Way - Regional Street to Golden Gate Drive Project.
4.10 Amendment to Agreement with TJKM Transportation Consultants for Traffic
Engineering Services (600-30)
TJKM Transportation Consultants has provided the City with traffic engineering services
since 1983, performing tasks associated with private development and the City's Capital
Improvement Program projects. The City Council will consider granting a rate increase for
Fiscal Year 2008-2009.
STAFF RECOMMENDATION: Adopt Resolution Approving Amendment to Agreement with
TJKM Transportation Consultants for Traffic Engineering Services.
4.11 Adoption of Ordinance Amending Dublin Municipal Code Chapter 5.56 (Smoking
Pollution Control) (560-90)
The proposed ordinance was introduced at the June 3, 2008, City Council meeting regarding
Dublin Municipal Code Chapter 5.56 entitled Smoking Pollution Control. This is the second
reading of this ordinance, and if the ordinance is adopted, it would increase the prohibition of
smoking within a reasonable distance of entrances into areas in which smoking is prohibited
and around unenclosed areas in which smoking is prohibited from 15 to 20 feet.
STAFF RECOMMENDATION: Waive reading and adopt Ordinance Amending Chapter 5.56
of the Dublin Municipal Code Relating to Smoking Pollution Control.
4.12 Approval of Partial Release of Securities for Tracts 7643 and 7645 - Sorrento at Dublin
Ranch (Neighborhoods 2 and 4) (600-60)
The developer of Sorrento at Dublin Ranch, Neighborhoods 2 and 4, has now completed more
than 80% of the improvements for Tracts 7643 and 7645. The City Council will consider
approving a reduction in the bonds guaranteeing the construction of these improvements.
STAFF RECOMMENDATION: Adopt Resolution Approving Partial Release of Security for
Tract 7643, Sorrento at Dublin Ranch, Neighborhood 2; and adopt Resolution Approving
Partial Release of Security for Tract 7645, Sorrento at Dublin Ranch, Neighborhood 4.

4.13 Acceptance of Improvements and Approval of Regulatory Traffic Control Devices for
Traffic Signals at Grafton Street/Central Parkway and at Montalcino Street/Central
Parkway Traffic Signal, and Approval of Partial Release of Security for Tract 7644 -
Sorrento at Dublin Ranch, Neighborhood 3 (600-60)
As part of the Grafton Street improvements between Gleason Drive and Central Parkway, the
developer has completed traffic signal improvements at Grafton Street and Central Parkway.
The City proposes to accept this traffic signal prior to accepting the full Grafton Street
improvements. As part of the Tract 7644 improvements, the developer has completed the
traffic signal improvements at Montalcino Street and Central Parkway. The City proposes to
accept this traffic signal prior to accepting the full Tract 7644 improvements.
STAFF RECOMMENDATION: Adopt Resolution Accepting Improvements and Approving
Regulatory Traffic Control Device for the Grafton Street and Central Parkway Traffic Signal,
and adopt Resolution Accepting Improvements and Approving Regulatory Traffic Control
Device for the Montalcino Street and Central Parkway Traffic Signal, and Partial Release of
Security for Tract 7644, Sorrento at Dublin Ranch, Neighborhood 3.
4.14 Award of Contract for Stagecoach Park Play Area Renovation Contract No. 08-08 (600-35)
On February 5, 2008, the City Council authorized Staff to issue a purchase order for play
equipment at Stagecoach Park and to solicit bids for installation. With the bid period
complete, Staff recommends that the City Council award the contract to M.A.K. Associates
Incorporated.
STAFF RECOMMENDATION: Adopt Resolution Awarding Contract No. 08-08 Stagecoach
Park Play Area Renovation to M.A.K. Associates Incorporated.
4.15 Landscaping and Lighting Maintenance Assessment District 83-2 (Stagecoach Road):
Preliminary Engineer's Report (360-20)
This assessment district pays the cost of landscape maintenance and utilities along Stagecoach
Road and the "interior slopes" of the Dublin Hills Estates development. This action approves
the Preliminary Engineer's Report for the 2008-09 assessment and sets a public hearing date
of July 15, 2008. The proposed rate increase is 3.18% higher than the 2007-08 assessment,
which is the Consumer Price Index rate of inflation for April 2008, as allowed by the terms of
the engineer's report approved in 2003-04. The public hearing will be held prior to the levy
of assessments.
STAFF RECOMMENDATION: Adopt Resolution Approving Preliminary Engineer's Report,
Confirming Diagram and Assessment Landscaping and Lighting Maintenance Assessment
District 1983-8, and adopt Resolution Appointing Time and Place of Hearing Protests in
Relation to Proposed Assessments Landscaping and Lighting Maintenance Assessment District
1983-2.
4.16 Preliminary Financial Reports for the Month of April 2008 (330-50)
This item provides the report ofthe financial statements for the month of April 2008.
STAFF RECOMMENDATION: Receive reports.
4.17 Revisions to the Personnel System for Fiscal Year 2008-2009 (700-20/720-10)
The City Council will consider adding three new job classifications to the City's
Classification Plan and amending the City's Salary Plan for Full-Time and Management
Personnel based on a salary market survey effective July 1, 2008.
STAFF RECOMMENDATION: Adopt Resolution Amending the Classification Plan; adopt
Resolution Establishing a Salary Plan for Full-Time Personnel in Accordance with the
Personnel Rules; adopt Resolution Establishing a Salary Plan for Management Positions Exempt
from Competitive Service; and adopt Resolution Amending the Benefit Plan for Management
Positions Exempt from Competitive Service.

4.18 Landscaping and Lighting Maintenance Assessment District 86-1 (Villages at Willow
Creek): Preliminary Engineer's Report (360-20)
This assessment district pays the cost of landscape maintenance and utilities for certain
landscaped areas associated with the Villages at Willow Creek development. This action
approves the Preliminary Engineer's Report for the 2008-09 assessment and sets a public
hearing date of July 15,2008. The proposed rate increase is 3.18% higher than the 2007-2008
assessment, which is the April Consumer Price Index rate of inflation, as allowed by the terms
of the engineer's report approved in 2001. The public hearing will be held prior to the levy of
assessments.
STAFF RECOMMENDATION: Adopt Resolution Approving Preliminary Engineer's Report,
Confirming Diagram and Assessment Landscaping and Lighting Maintenance Assessment
District 1986-1, and adopt Resolution Appointing Time and Place of Hearing Protests in

4.19 Landscaping Maintenance Assessment District 97-1 (Santa Rita Area): Preliminary
Engineer's Report (360-20)
This assessment district pays the cost of landscape maintenance and utilities for certain
landscaped areas in the area bounded by 1-580, Tassajara Road, Gleason Drive, and Arnold
Road. This action approves the Preliminary Engineer's Report for the 2008-2009 assessment
and sets a public hearing date of July 15,2008. The proposed assessment is the same as the
2007-2008 assessment. The public hearing will be held prior to the levy of assessments.
STAFF RECOMMENDATION: Adopt Resolution Approving Preliminary Engineer's Report,
Landscaping Maintenance Assessment District 1997-1 (Santa Rita Area), and adopt Resolution
Appointing Time and Place of Hearing Protests in Relation to Proposed Assessments
Landscaping Maintenance Assessment District 1997-1.
4.20 Adoption of Ordinance Amending Dublin Municipal Code Chapter 2.20 (Personnel
System) (700-10)
This is the second reading of an ordinance amending the Dublin Municipal Code Chapter 2.20
which establishes a uniform system for dealing with City personnel matters. The Council will
also adopt a resolution that clarifies the list of management positions that are currently exempt
from Chapter 2.20.
STAFF RECOMMENDATION: Waive reading and adopt Ordinance Amending Chapter 2.20
of the Dublin Municipal Code Relating to the Personnel System; and adopt Resolution
Amending Chapter 2.20 of the Dublin Municipal Code Relating to the Personnel System.
4.21 Warrant Register ($3,582.447.79) dated June 17,2008,2008 (300-40)
STAFF RECOMMENDATION: Approve.
4.22 Citywide Street Lighting Maintenance Assessment District 83-1: Preliminary Engineer's
Report (360-20)
This assessment. district pays the cost of energy and maintenance for the City's street light
system except the lights that are included in Dublin Ranch Street Light Maintenance
Assessment District 83-1. This action approves the Preliminary Engineer's Report for the
2008-09 assessment and sets a public hearing date of July 15,2008. The proposed assessment
is $19.34, which is the same as the 2007-2008 assessment. The public hearing will be held
prior to the levy of assessments.
STAFF RECOMMENDATION: Adopt Resolution Approving Preliminary Engineer's Report,
Confirming Diagram and Assessment City of Dublin Street Lighting Maintenance Assessment
District 1983-1, and adopt Resolution Appointing Time and Place of Hearing Protests in
Relation to Proposed Assessments City of Dublin Street Lighting Maintenance Assessment
District 83-1.

4.23 Street Lighting Maintenance Assessment District 99-1 (Dublin Ranch and Tract 7067):
Preliminary Engineer's Report (360-20)
This assessment district pays the cost of energy and maintenance for the street light system in
Dublin Ranch and Tract 7067. This action approves the Preliminary Engineer's Report for
the 2008-2009 assessment and sets a public hearing date and time of July 15,2008, 7:00 p.m.
The proposed assessment is $38.90 per single-family home, $1.18 higher than the 2007-2008
assessment, but is within the maximum assessment allowed by the Engineer's Report. The
public hearing will be held prior to the levy of assessments.
STAFF RECOMMENDATION: Adopt Resolution Approving Preliminary Engineer's Report,
Confirming Diagram & Assessment City of Dublin Street Lighting Maintenance Assessment
District 1999-1 (Dublin Ranch and Tract 7067), and Adopt Resolution Appointing Time and
Place of Hearing Protests in Relation to Proposed Assessments Street Lighting Maintenance
Assessment District 1999-1.
5. WRITTEN COMMUNICATIONS - None.
6. PUBLIC HEARINGS
6.1 Amendment to Chapter 8.104, Site Development Review of the Dublin Zoning Ordinance-
ZOA 07-002 (Legislative) (410-30)
The City Council, as a high priority goal for Fiscal Year 2007-2008, requested that Staff and
the Planning Commission review Chapter 8.104, Site Development Review (SDR), of the
Dublin Zoning Ordinance, and determine if any changes should be made to increase the
effectiveness of the Chapter. The review of the SDR chapter is separate from the
Comprehensive update of the Zoning Ordinance.
A significant number of modifications are proposed to the existing Site Development Review
chapter that will improve the clarity of the chapter, ensure its effectiveness, ensure that the
SDR chapter is consistent with current practices and create a more user-friendly ordinance
which will benefit the community.
STAFF RECOMMENDATION: Conduct public hearing, waive reading and INTRODUCE an
Ordinance Approving Amendments to Chapter 8.04, Title, Purpose and Authority, Chapter 8.36,
Development Regulations, Chapter 8.40, Accessory Structures and Uses Regulations and
Chapter 8.104, Site Development Review; and direct Staff regarding the application fee for
residential improvements.
6.2 Ordinance Adding Section 1.04.061 (Recovery of Nuisance Abatement Costs Incurred by
the City) to Dublin Municipal Code (530-20)
This is the first reading of a proposed ordinance that contains the procedures governing steps
for the levying of nuisance abatement special assessments.
STAFF RECOMMENDATION: Conduct public hearing, waive reading and INTRODUCE an
Ordinance Adding Section 1.04.061 to the Dublin Municipal Code, Relating to Nuisance
Abatement Cost Recovery.
6.3 Amendment to Dublin Municipal Code (DMC) Chapter 5.72 (Rodent and Fly Control)
(560-40)
This is the first reading of an amendment to DMC Chapter 5.72 relating to Rodent and Fly
Control that requires owners of property on which a nuisance is maintained, to abate it. It also
recommends substantive changes be made to this chapter to ensure the DMC contains
procedures for the collection of costs incurred by the City in the abatement of nuisances.
STAFF RECOMMENDATION: Conduct public hearing, waive reading and INTRODUCE an
Ordinance Amending Chapter 5.72 of the Dublin Municipal Code Relating to Rodent and Fly
Control.

6.4 Amendment of Dublin Municipal Code (DMC) Chapter 5.68 (Graffiti) (530-20)
This is the first reading of an amendment to DMC Chapter 5.68 relating to graffiti. In
addition to a number of minor changes intended to improve the chapter's clarity and ensure
uniformity with the rest of the DMC, it also provides certain substantive changes be made to
ensure the DMC contains uniform procedures for the collection of costs incurred by the City
in the abatement of nuisances.
STAFF RECOMMENDATION: Conduct public hearing, waive reading and INTRODUCE an
Ordinance Amending Chapter 5.68 of the Dublin Municipal Code Relating to Graffiti.
6.5 Amendment of Dublin Municipal Code (DMC) Chapter 5.64 (Property Maintenance)

This is the first reading of an amendment to DMC Chapter 5.64 relating to property

Ordinance Amending Chapter 5.70 of the Dublin Municipal Code Relating to Weeds and Refuse.
7. UNFINISHED BUSINESS
7.1 Second Amendment to Collection Service Agreement between the City of Dublin and
Amador Valley Industries, LLC (600-30)
The City Council will consider approving an amendment to the Collection Services
Agreement between the City of Dublin and Amador Valley Industries. The amendment
includes the creation of a Commercial Recycling Compensation Element in the annual rate
adjustment, which will provide revenue for the commercial recycling program and create an
economic incentive for increased commercial recycling efforts.
STAFF RECOMMENDATION: Adopt Resolution Approving a Second Amendment to the
Collection Service Agreement Between the City of Dublin and Amador Valley Industries, LLC,
and authorizing the City Manager to execute the amendment.
8. NEW BUSINESS
8.1 General Municipal Election - November 4, 2008 (630-20)
The next Municipal Election in the City of Dublin will be on Tuesday, November 4, 2008.
Offices to be voted on shall be one (l) Mayor and two (2) Councilmembers. The Mayor
serves a 2-year term and Councilmembers serve a 4-year term. The City Councilmembers
will determine whether the statement of qualifications which each candidate is allowed to
place in the sample ballot should be a maximum of 200 or 400 words and whether the City or
each candidate should pay the costs associated with printing hislher candidate statement.
STAFF RECOMMENDATION: Adopt Resolution Calling for a General Municipal Election to
be Held in the City of Dublin on November 4, 2008; Requesting the Alameda County Board of
Supervisors to Consolidate the City of Dublin General Municipal Election with the Statewide
General Election; and Authorizing Certain Procedural Matters; and adopt Resolution Adopting

Regulations for Candidates for Elective Office Pertaining to Candidate's Statement and the Costs
Thereof for the General Municipal Election to be Consolidated with the Statewide General
Election to be Held on Tuesday, November 4,2008.
8.2 Amendment to the Affordable Housing Agreement for the First Phase of Positano to
Provide Four Additional Secondary Units, Affordable to Very-Low Income Households In-
Place of Four Single-Family Detached Homes, Affordable to Very-Low Income Households
(430-80)
The first phase (247 units) of Braddock & Logan's Positano Development is subject to an
Affordable Housing Agreement with a requirement to provide 13 single-family detached
homes and 13 secondary units affordable to very-low, low, and moderate income households.
Braddock & Logan is requesting an amendment to the Affordable Housing Agreement to
eliminate the requirement to provide four single-family detached homes affordable for very-
low income households and instead provide four additional secondary units affordable for
very-low income households. The proposal would result in a total of eight secondary units for
very-low income households.
STAFF RECOMMENDATION: Adopt Resolution Approving Amendment No. 1 to the
Affordable Housing Agreement for First Phase (247 Units) of Positano to Provide Four
Additional Secondary Units Affordable to Very-Low Income Households in Place of Four Single
Detached Homes, Affordable to Very-Low Income Households (PA 05-038 and PA 07-005);

direct the Community Development Director to approve an SDR Waiver, in accordance with the
Dublin Municipal Code, to ensure consistency between the approved Site Development Review
and the amended Affordable Housing Agreement.
