ORAL COMMUNlCATIONS 3.1 Mayor's Appointment of Student Member to Parks & Community Services Commission (11 0-30) The term of the student member to the Parks & Community Services Commission will expire on June 30, 2006. The opening was advertised and nine applications were received. Mayor Lockhart recommends the appointment of Alex Deering to a term expiring in June of 2007 on the Parks and & Community Services Commission. STAFF RECOMMENDATION Confirm Mayor's appointment of Alex Deering to the Parks & Community Services Commission. 3.2 Acceptance of Donation from DublinlSan Ramon Women's Club - Monetary Donation for AutoPulse Supplies (150-70) The GFWC Dublin/San Ramon Women's Club donated two AutoPulse Resuscitation Systems in January of tbis year These systems are a non-invasive cardiac support pump that automatically pumps the patients' chest in order to circulate blood to the heart and brain during a cardiac arrest situation. One system is located at Fire Station No. 16 and the other at Fire Station No. 17 The Women's Club has now made a $500 cash donation to the City's General Fund to be used by the Fire Stations for AutoPulse supplies. ST AFF RECOMMENDATION Recognize the Dublin/San Ramon Women's Club and tormally accept donation of $500 for Auto-Pulse Resuscitation Systems supplies. 3.3 Alameda County Public Health Department - Partners 2006 Award (150-20) The City will receive an award from the Alameda County Public Health Department for its efforts in addressing tobacco oonsumption among youth. M~ 01 the eU<ience, SIlIff ot the Cily Council who woukt nile an item ramMd from the Consent Calendllr lor purpoees 01 public input may request the Maya- to remove the Item. 4.1 Minutes of Regular Meeting of June 6, 2006 STAFF RECOMMENDATION Approve 4.2 Acceptance of Work, Street Light Pole Replacement Phase 4, Contract No. 05-09 (600-35) This project was the final phase of a four-year project to replace deteriorated painted steel street light poles. A total of 112 poles were replaced in this year's project. The work was completed within funds budgeted. STAFF RECOMMENDATION Accept the improvements constructed under Contract No 05- 09 and authorize final payment to John D Baker Construction, less retention to be paid in 35 days if no subcontractor or supplier claims are received. 4.3 Amendment to Agreement with Kleinfelder, Inc., for Engineering Services (600-30) Kleinfelder, Inc., has provided general geotechnical services to the City since 1996, primarily in the area of peer review for private development projects, and Staff support and testing services for Capital Improvement Program projects. The City Council will consider extending the contract for an additional two-year term and granting a rate increase for Fiscal Year 2006-2007 STAFF RECOMMENDATION Adopt Resolution approving the Amendment to the Agreement with Kleinfelder, Inc. 4.4 Amendment to the Agreement with Omni-Means, L Tn, for Traffic Engineering Services (600-30) Omni-Means, L TD, has provided the City Engineer with traffic engineering services since 1996, performing tasks associated with private development projects. As provided by the current two-year Agreement with the City, a rate increase is being requested for Fiscal Year 2006-2007, which is the second year of the Agreement. STAFF RECOMMENDATION Adopt Resolution approving the Amendment to the Agreement with Omni-Means, LTD 4.5 Park Furniture Replacement - Contract No. 06-06, Change Order (600-35) The 2006-2007 Capital Improvement Program included funds to complete the furniture replacement for Alamo Creek Park and Stagecoach Park. Staff has prepared Change Order # 1 to increase the scope of work for the Park Furniture Replacement Project - Contract No. 06- 06 STAFF RECOMMENDATION: Approve Change Order #1 with Ross Recreation Equipment Company, Inc., in the amount of $72,613 4.6 Citywide Street Lighting Maintenance Assessment District 83-1: Preliminary Engineer's Report (360-20) This assessment district pays the cost of energy and maintenance for the City's street light system except the lights that are included in Dublin Ranch Street Light Maintenance Assessment District 99-1 This action approves the Preliminary Engineer's Report for the 2006-07 assessment and sets a public hearing date of July 18, 2006. The proposed assessment is the same as the 2005-06 assessment. The public hearing will be held prior to the levy of assessments. Pa~e 2 of7 4.7 Landscaping and Lighting Maintenance Assessment District 83-2 (Stagecoach Road): Preliminary Engineer's Report (360-20) This assessment district pays the cost of landscape maintenance and utilities along Stagecoach Road and the "interior slopes" of the Dublin Hills Estates development. This action approves the Preliminary Engineer's Report for the 2006-07 assessment and sets a public hearing date of July 18, 2006. The proposed assessment is 2.8% higher than the 2005-06 assessment, which is commensurate with the Consumer Price Index rate of inflation, as allowed by the terms of the engineer's report approved in 2003-04 The public hearing will be held prior to the levy of assessments. STAFF RECOMMENDATION. Adopt Resolution(s) approving preliminary engineer's report and setting hearing date and time (July 18, 2006, 7'00 p.m.) for the purpose of hearing protests to the proposed 2006-2007 assessment. 4.8 Landscaping and Lighting Maintenance Assessment District 86-1 (Dougherty Road): Preliminary Engineer's Report (360-20) This assessment district pays the cost of landscape maintenance and utilities for certain landscaped areas associated with the Villages at Willow Creek development. This action approves the Preliminary Engineer's Report for the 2006-07 assessment and sets a public hearing date of July 18, 2006. The proposed assessment is 2.8% higher than the 2005-06 assessment, which is commensurate with the Consumer Price Index rate of inflation, as allowed by the terms of the engineer's report approved in 2001 The public hearing will be held prior to the levy of assessments. STAFF RECOMMENDATION Adopt Resolution(s) approving the preliminary Engineer's Report and setting a public hearing date and time (July 18,2006, 7.00 p.m.) for the purpose of hearing protests to the proposed 2006-2007 assessment. 4.9 Landscaping Maintenance Assessment District 97-1 (Santa Rita Area): Preliminary Engineer's Report (360-20) This assessment district pays the cost of landscape maintenance and utilities for certain landscaped areas in the area bounded by 1.580, Tassajara Road, Gleason Drive, and Arnold Road. This action approves the Preliminary Engineer's Report for the 2006-07 assessment and sets a public hearing date of July 18,2006 The proposed assessment is the same as the 2005-06 asseSSment. The public hearing will be held prior to the levy of assessments. STAFF RECOMMENDATION. Adopt Resolutlonts) approving the preliminary Engineer's Report and setting a public hearing date and time (July 18, 2006, 7:00 p.m.) for the purpose of hearing protests to the proposed 2006-2007 assessment. 4.10 Street Lighting Maintenance Assessment District 99-1 (Dublin Ranch and Tract 7067): Preliminary Engineer's Report (360-20) This assessment district pays the cost of energy and maintenance for street light system in Dublin Ranch and Tract 7067 This action approves the Preliminary Engineer's Report for the 2006.07 assessment and sets a public hearing date and time of July 18, 2006, 7.00 p.m. The proposed assessment is approximately 74% ($15 70 per lot) higher than the 2005-2006 assessment, but is below the maximum assessment allowed by the Engineer's Report. The public hearing will be held prior to the levy of assessments. STAFF RECOMMENDATION Adopt Resolution(s) approving the preliminary Engineer's Report and setting a public hearing date and time (July 18,2006, 7'00 p.m.) for the purpose of hearing protests to the proposed 2006.2007 assessment. Pajl;e 3 of7 4.11 Dublin Heritage Center Exhibit Restoration Project - Project Aeeeptance, Contraet No. 06-03 (600-35) The City Council awarded the bid for the Heritage Center Exhibit Restoration to Rosa Construction. The contractual requirements of the Heritage Center Exhibit Restoration bid have now been completed and the project is ready to be accepted. STAFF RECOMMENDATION Authorize Staff to accept a maintenance bond in the amount of $11,055 at a future date, and adopt Resolution to accept the final improvements for Contract No. 06-03, 4.12 Amendment to Agreement with TJl(M Transportation Consultants for Traffic Engineering Services (600-30) TJKM Transportation Consultants has provided the City with traffic engineering services since 1983, performing tasks associated with private development and the City's Capital Improvement Program projects. As provided by the current two-year Agreement with the City, a rate increase is being requested for Fiscal Year 2006-2007, which is the second year of the Agreement. STAFF RECOMMENDATION Adopt Resolution approving the Amendment to the Agreement with TJKM. 4.13 Ordinance Prohibiting the Operation of Medical Marijuana Dispensaries (560-60) At its June 6, 2006 meeting, the City Council conducted a public hearing, waived the first reading and introduced an Ordinance prohibiting the operation of medical marijuana dispensaries. The City Council voted unanimously to approve the Ordinance, which adds Chapter 5.58 to the Dublin Municipal Code to prohibit the operation of medical marijuana dispensaries within the City of Dublin. A violation of this prohibition would constitute a misdemeanor, pursuant to Dublin Municipal Code Section 1 04 030 STAFF RECOMMENDATION Waive second reading and adopt Ordinance to prohibit the operation of medical marijuana dispensaries. 4.14 Amendment to Agreement with Tri-Valley Janitorial Services (600-30) Tri-Valley Janitorial provides janitorial services for City facmties. This amendment allows for a one-year term extension, a 2.8% Consumer Price Index rate increase, and minor modifications to the scope of services provided. STAFF RECOMMENDATION Adopt Resolution approving the Amendment to the Agreement with Tri-Valley Janitorial Service. 4.15 Amendment to Agreement with SNG & Associates, Inc., for Engineering Services (600-30) SNG & Associates, Inc., has provided the City with engineering services since 2002, performing tasks associated with private development projects. As provided by the current two-year Agreement with the City, a rate increase is being requested for Fiscal Year 2006- 2007, which is the second year of the Agreement STAFF RECOMMENDATION Adopt Resolution approving the Amendment to the Agreement with SNG & Associates, Inc. 4.16 Amendment to Agreement for Legal Services (600-30) The proposed amendment to the Agreement with Meyers Nave Riback Silver & Wilson for legal services would increase the hourly rate by 2.71 % and increase the rate charged for litigation and work performed by the City Attorney for which the City is reimbursed by third parties by 4 44% commencing July I, 2006 STAFF RECOMMENDATION Approve Eighth Amendment to Agreement for Legal Services with Meyers Nave Riback Silver & Wilson and authorize Mayor to execute the Amendment. 4.17 Preliminary Financial Reports for the Month of May 2006 (330-50) This item provides the report of the financial statements for the month of May 2006 STAFF RECOMMENDATION Receive reports. Pap;e 4 of7 4.18 Cooperative Agreement with Dnblin San Ramon Services District in Connection with the Dougherty Road Improvements - Houston Place to 1-580 Project (600-40) As part of thc Doughcrty Road Improvements - Houston Place to 1-580 Projcct, thc City will bc widcning and improving the intersection of Duhlin Boulevard and Dougherty Road. The utility facilities owned and maintained hy the Duhlin San Ramon Scrviccs District (Distnct) will also nccd to be adjusted and relocated and are proposed to bc included in the City's project. This Agrccment will establish the City's responsihihty to perform thc work and the Dlstnct's responsibility to rcimburse the City for the work and attendant ovcrhead, management and admmistration costs. STAFF RECOMMENDATION Adopt Resolution approving thc Cooperative Agreement WIth Duhhn San Ramon Services District in connection with the Dougherty Road Improvemcnts Houston Place to 1-580 Project. 4.19 Amendment No.1 to Collection Service Agreemeut Between City of Dublin and Amador Valley Industries, LLC - Correcting Discrepancy (600-30) The agreement for solid waste servH;es between the City and A V I has a discrepancy The reference to a fonnu.la IS stated differently on two ofthc pagcs of Exhibit 2 to the Agreement. STAFF RECOMMENDATION Adopt Resolution approving Amcndmcnt No I to Agreement with Amador Vallcy Industries, LLC, and authorize City Manager to execute Amcndmcnt #1 4.20 Amendment to Agreement with MCE Corporation - Extension of Time and Adjustment of Rates (600-30) MCE CorporatIon provides Public Works Maintenance Services to the City. The currcnt MCE agreement expires June 30, 2006. This amendment allows for an extension of the current agreement for up to one year and a 3% adjustment of ratcs for Fiscal Year 2006-2007 STAFF RECOMMENDATION Adopt Resolution approving thc Amendment to the Agreement with MCE. 4.21 Revisions to the Personuel System (700-20) Thc City Council will consider amendmg the City's Salary Plan for Full-Time and Managcment Personnel in accordance with the adopted Fiscal Year 2006-2007 Budget. Additionally, the Council will consider updatmg several job dcscriptions to bring them into conformancc with laws and current responsibilitIes. STAFF RECOMMENDATION Adopt Resolutionlsl amendmg the City's Salary Plan. 4.22 Extension of Completion Date - Undergrouud Utility District 2003-01, Dougherty Road from Sierra Lanc to Dublin Boulevard, Dubllu Boulevard from Dublin Court to Dougherty Road, and Scarlett Court from Dublin Boulevard to a Point 700 Feet South of Dublin Bou levard (t 020-30) Due to weathcr and utility conflicts, which have caused unantIcipated delays in the undergrounding of utili tics, it is necessary to extend the completion dates for Undcrground Utility District 2003-01 STAFF RECOMMENDATION Adopt Resolution extending the completion dates by 6 months. 4.23 Warrant Register ($1,572,001.08) dated June 20, 2006 (300-40) STAFF RECOMMENDATION Approve. 5. PUBLIC HEARING 6.1 Dougherty Hills Park, Dog Park - Environmental Review and Authorb:atioo to Bid (920-30/600-35) As approved in the 2004-2009 Capital Improvement Program, the construction of the Dougherty Hills, Park Dog Park is scheduled to commence in Fiscal Year 2006-2007 Staifis seeking City Council approval to advertise the Dougherty Hills Park, Dog Park for bids and to approve the environmental report for the proposed project. STAFF RECOMMENDATION Conduct public hearing; deliberate; adopt Resolution approving Initial Study and Mitigated Negative Declaration and Mitigation Monitoring Program for Dougherty Hills Park, Dog Park; and authorize Staff to advertise contract. 6.2 Amendment to an Adopted Planned Development Zoning District (PA 02--063) for Willows at San Ramon Village (formerly known as Bancor Alcosta), PA 06-034 (450..20) The request is for an amendment to an adopted Planned Development Zoning District (PA- 063) to modify the approved phasing plan for the mixed-use development project at San Ramon Village Plaza which includes the construction of 56 townhomes and the remodeling of '" J 4,000 square feet of an existing commercial building. The amendment also includes minor clean-up items. STAFF RECOMMENDATION. Conduct public hearing; deliberate; waive reading; and INTRODUCE Ordinance approving an amendment to an adopted Phasing Plan for Planned Development Zoning District (PA 02-063) for Willows at San Ramon Village and approving minor revisions to the Development Plan for Planned Development Zoning Ordinance (P A 02- 063) or provide Staff direction on a different option. 6.3 Adoption of Rates for Garbage Collection, Disposal, and Recycling Services Provided by Amador Valley Industries and Establishing the 2006-2007 Anoual Assessment (600..30) The Agreement for solid waste services between the City and Amador Valley Industries (A VI) requires the City to adopt a rate schedule, which is estimated to produce a specified revenue amount as identified in the Agreement. The City has also adopted an Ordinance, which requires all parcels in the City to subscribe to weekly minimum garbage service. For residential properties that are serviced with individual containers, the City collects the annual cost of minimum service with the property tax bill. The Council will consider adopting two separate Resolutions establishing the garbage rates effective July 1, 2006, and establishing the Fiscal Year 2006-2007 refuse related property tax assessment. STAFF RECOMMENDATION Conduct public hearing; deliberate; adopt Resolution(sl amending the Schedule of Services Rates, and approving and establishing the Annual Rate levied for Basic Service. 7. UNFINISHED BUSlNESS 7.1 Scarlett Court Specific Plan Study, PA 03-063 (410-55) In the Fiscal Year 2002-2003 Goals & Objectives program, the City Council ranked, as a high priority, the initiation of a Specific Plan for the Scarlett Court area. The Scarlett Court area is approximately 52 acres and is bounded by Dougherty Road, Dublin Boulevard, 1-580 and the Iron Horse Trail right-of-way At the time, the City Council was concerned about potential development/redevelopment of several large and undefUtilized parcels. The City Council will discuss the Scarlett Court Specific Plan and provide direction on how Staff should move forward with the preparation of the Plan. STAFF RECOMMENDATION: Direct Staff to prepare Phase I of Scarlett Court Specific Plan to include design, landscape and signage guidelines. Pal/:e 6 of7 8, NEW BUSINESS 8.1 Fourth Amendment to Construction Truck Access Agreement with Windemere BLC Land Company, LLC, a California Limited Liability Company (600-30) The proposed amendment would allow the developer of the Windemere project in Contra Costa County to continue using Dougherty Road within the City of Dublin to haul heavy equipment and materials to the project site in Fiscal Year 2006-2007 The amendment also specifies the developer's obligations to perform certain pavement repairs on Dougherty Road in 2006 to mitigate its fair-share of pavement impacts due to truck traffic from the project in Fiscal Year 2005-2006. STAFF RECOMMENDATION Adopt Resolution approving the proposed Fourth Amendment to the Construction Truck Access Agreement with Windemere BLC Land Company, LLC, and approve Budget Change in the total amount of$I,632 to the General Fund. 8.2 Approval of 2006 Americans witb Disabilities Act (ADA) Transition Plan Update (700-70) In order to meet the requirements of the Americans with Disabilities Act (ADA), the City adopted Resolution No. 28-93 on February 2, 1993, adopting an ADA Transition Plan to bring City facilities into ADA conformance. The proposed 2006 ADA Transition Plan Update, if adopted, would replace the 1993 plan to include coverage of the City's expanded infrastructure and assess facilities against current ADA standards, as well as prioritize any necessary improvements and provide a funding plan and schedule for implementation. STAFF RECOMMENDATION Adopt Resolution approving the 2006 Americans with Disabilities (ADA) Transition Plan Update. 8.3 Approval of 1-580 HOV Transportation Management Plan and Intelligent Transportation Systemrrrallic Operations System (TMP & ITSrrOS) Cooperative Agreement for Design, Construction and Administration (600-40) The proposed Cooperative Agreement between the City and the Alameda County Congestion Management Agency (CMA) is to define implementation responsibilities for the initial phase (Phase IA) of the "Phase I" High Occupancy Vehicle (HOV) Lane Project. This project will install an interim HOV lane on eastbound 1-580 from Hacienda Drive to east of Greenville Road to help reduce freeway congestion during the evening commute period. The CMA will cover the full cost of this project through multiple sources, including Federal, State and regional funds. The Phase I A project associated with the proposed Cooperative Agreement will install advanced traffic management and monitoring devices in Dublin. The CMA anticipates starting construction of the Phase lA project in fall 2006 and completing construction by spring 2007 STAFF RECOMMENDATION. Adopt Resolution approving the proposed 1-580 HOV TMP & ITSITOS Cooperative Agreement for Design, Construction and Administration, and authorize the City Manager to execute the Agreement. 9.
