PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is not on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Manager to have their particular concern placed on the agenda for a future meeting. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public input may request the City Council to remove the item from the consent calendar. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes of Regular Meeting of June 8, 1987 STAFF RECOMMENDATION: Approve 4.2 Financial Report for Period Ending May 31, 1987 STAFF RECOMMENDATION: Approve 4.3 Spring 1987 Recreation Report The Recreation Director has prepared a report highlighting the activities sponsored by the City's Recreation Department during the Spring Quarter of 1986-87. STAFF RECOMMENDATION: Receive Report 4.4 Dolan Park Improvements, Phase I, Contract 87-7 This action authorizes Staff to advertise for bids for the construction of Dolan Park. The estimated costs for Dolan Park improvements are within the $403,070 budgeted for the project. STAFF RECOMMENDATION: Authorize Staff to advertise Contract 87-7 for bids. 4.5 1986-87 Budget Modifications with regard to Article XIII B of the State Constitution State Law requires the appropriation of all funds received by the City. Based on current estimates, the revenues in specific funds may exceed estimated expenditures. This action will accrue revenues in excess of appropriations to reserves. STAFF RECOMMENDATION: Appropriate 1986-87 unappropriated revenues to each fund's reserve for authorized projects. 4.6 Final Acceptance of Contract 86-4, Dublin Boulevard @ Sierra Court Street Reconstruction, Traffic Signal, Street Lighting and Landscaping The City Engineer has reviewed the work and determined that it is complete and in accordance with the approved plans, specifications and modifications. This project is within budget. STAFF RECOMMENDATION: Accept improvements under Contract 86-4, authorize retention payment to Steiny & Co., Inc., in the amount of $20,918.80 and authorize a budget transfer of $3,757 for costs over budget for Fiscal Year 1986-87. 4.7 Final Acceptance of Contract 87-3, Street Slurry Seal Program The City Engineer has reviewed the work on the project and determined that it is complete and in accordance with the approved plans and specifications. This project is under budget. STAFF RECOMMENDATION: Accept improvements under Contract 87-3 and authorize payment to McReynolds Paving, Inc., in the amount of $24,402. 4.8 Acceptance of Work - Contract 87-2, Annual Street Overlay The City Engineer has reviewed the work on the project and determined that it is complete and in accordance with the approved plans and specifications. This project is under budget. STAFF RECOMMENDATION: Accept improvements under Contract 87-2 and authorize payment in the amount of $226,890.40 to Teichert Construction. 4.9 Senior Citizen Center The preliminary design and cost estimate for the renovation of Fallon School for a Senior Center has been prepared by the architect. The project is approximately $33,600 - $46,650 over the funds available from the Senior Center Bond Act. STAFF RECOMMENDATION: Approve Option I and direct Staff to include an additional $46,650 from the General Reserve in the CIP and authorize architect to prepare construction documents. 4.10 Acceptance of Contract 86-7 - Sierra Court Southerly Extension The City Engineer has reviewed the work on the project and determined that it is complete and in accordance with the approved plans and specifications. This project is under budget. STAFF RECOMMENDATION: Accept improvements under Contract 86-7 and release letter of credit. 4.11 Warrant Register dated June 22, 1987 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS 5.1 Letter from Jeanne Landreth requesting permission to close Burton Street for 4th of July block party Residents of Burton Street are requesting permission to close their street for a 4th of July block party. The City requires participants to provide a certificate of insurance indicating liability coverage in the amount of $500,000. STAFF RECOMMENDATION: Authorize Staff to issue encroachment permit for closure of Burton Street on July 4th, provided the applicant is able to meet insurance criteria. 6. PUBLIC HEARING 6.1 Enea Plaza PA 87-018 - Planned Development Rezoning Request to Rezone approximately 5 acres to allow a range of retail shopper, office, personal service and financial uses. A request to rezone the northwesterly portion of the Enea Plaza holding from a PD District allowing c-o Administrative Office District uses with limited ancillary retail uses to a new PD District which would allow for a range of retail shopper, office, personal service and financial uses. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt resolution regarding Negative Declaration; adopt resolution regarding the PD Planned Development Rezoning request; waive reading and introduce ordinance amending Zoning Ordinance. 6.2 Kentucky Fried Chicken - V-8422 Keith Holmes Sign Variance Appeal Appeal of Zoning Administrator's action denying variance request to locate a 17 foot tall freestanding sign within the required 30 foot front yard set back and not within the middle 1/3 of the lot. This item was continued from the June 8, 1987 City Council meeting. STAFF RECOMMENDATION: Conduct public hearing; deliberate; establish date for zoning compliance; adopt resolution upholding Zoning Administrator's action denying Variance reuest, or give Staff direction and continue the item. 6.3 Spark Arrestors After the public hearing at the April 27, 1987, the City Council meeting regarding the Fire Safe Roofing Ordinance & Spark Arrestors, the matter of spark arrestors was referred to Staff to investigate the feasibility of requiring spark arrestors to be installed within a specified time and to review the standards for spark arrestors. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and introduce an ordinance requiring spark arrestors upon sale of property, or when building permit authorizing alterations or repairs over $1,000 is issued -or- an ordinance requiring spark arrestors within a specified time. Adopt resolution relating to findings of necessity. 6.4 Fireworks Ordinance - Regulation of the Sale and Use At the meeting of May 11, 1987, the City Council directed the City Attorney to prepare an ordinance which would prohibit the sale and use of fireworks in the City of Dublin. Due to the public hearing process, the proposed ordinance would not be effective until after the upcoming July 4th celebration. STAFF RECOMMENDATION: Conduct public hearing; deliberate; determine appropriate course of action 6.5 Bus Stops on Dublin Boulevard @ Sierra Court This ordinance was introduced at the June 8th City Council meeting and would establish bus stops on Dublin Boulevard at Sierra Court. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt ordinance 6.6 Ordinance Relating to the Operation of Taxicabs This ordinance, which is part of the comprehensive Municipal Code revision, relates to the operation of taxicabs within the incorporated limits of the City of Dublin. The ordinance sets forth the minimum insurance coverage as required by state law, use of a taximeter, schedule of rates, permit application procedures for both owners and operators, and the City recommended insurance coverage which is higher than the minimum state requirement. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and introduc~ ordinance. 6.7 Revenue Sharing Budget Amendment During the preparation of the 1986-87 Budget, the receipt of Federal Revenue Sharing Funds were not anticipated. This was due to a termination of the program. Subsequent to the adoption of the Budget, the City received one payment. In addition to the funds received, the City has interest earnings which have accrued to the fund. A public hearing is required to obtain input on the appropriation of Revenue Sharing Funds. STAFF RECOMMENDATION: Conduct public hearing; adopt resolution amending the 1986-87 Budget. 7. UNFINISHED BUSINESS - None 8. NEW BUSINESS - None 9. OTHER BUSINESS 10. ADJOURNMENT - Adjourn to Adjourned Regular Meeting, Tuesday, June 23, 1987, 6:00 p.m., Shannon Community Center West Room, for adoption of 1987-88 Update to Five-Year Capital Improvement Program and 1987-88 Budget and Financial Plan.
