DUBLIN CITY COUNCILDUBLIN CITY COUNCIL
REGULAR MEETING - Tuesday, June 25, 1996, 7:00 p.m.

A complete packet of information containing Staff Reports and exhibits related to each
item is available for public review several days prior to a Council meeting in the City
Clerk’s Office and also at the Dublin Library.

3.1Introduction of new employee - Dublin Police Services Sergeant Mike Pecoraro
3.2Appointment of Student Member to Parks & Community Services Commission
In accordance with the Bylaws and Rules of Procedure for the Parks & Community Services
Commission, a Student Member shall be appointed to the Commission to serve for a one-year
term. The P&CS Commission have recommended that Wanjiku Kamau be appointed as the
Student Member of the Commission.
STAFF RECOMMENDATION: Confirm appointment of Wanjiku Kamau to the P&CS
Commission.
3.3Presentation of Certificate of Appreciation and Quill Pen to Gabriela Nasar for her service
on the City's Parks & Community Services Commission
3.4Presentation by San Joaquin Regional Rail Commission on the Altamont Express
Commuter Rail Service
Robert Cabral, Chairman of the San Joaquin Regional Rail Commission will present a status
report on the proposed Altamont Express Commuter Rail Service which will include an
overview of the service proposed and the latest capital and operating cost estimates available.
The intent of the report is to better inform cities in Alameda County about the potential for
implementation of the new service since it is anticipated that a majority of the total ridership
will begin or end their commute rail trip in Alameda County.
STAFF RECOMMENDATION: Receive Report.
3.5Proclamation commending the Livermore/Amador Valley Transit Authority (LAVTA) on
their 10th Anniversary
At this time, the public is permitted to address the City Council on non-agendized items. The
Council must, however, comply with all State Laws in regard to items not appearing on the
posted agenda. The Council may respond to statements made or questions asked, or may request
Staff to report back at a future meeting concerning the matter. Any member of the public may
contact the City Clerk’s Office related to the proper procedure to place an item on a future City
Council agenda. The exceptions under which the City Council MAY discuss and/or take action on
items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3).
4.CONSENT CALENDAR
Consent Calendar items are typically non-controversial in nature and are considered for
approval by the City Council with one single action. Members of the audience, Staff or
the City Council who would like an item removed from the Consent Calendar for purposes
of public input may request the Mayor to remove the item.
4.1Minutes of Joint Study Session w/DUSD of May 28, 1996 (Prepared by School District) &
Regular Meeting of June 11, 1996
STAFF RECOMMENDATION: Approve
4.2Acceptance of Improvements for Dublin Meadows, Tract 5883
The improvements on this tract were not completed by the developer, but were built by the
bonding company providing security for the improvements. The work has now been
completed to the approved plans.
STAFF RECOMMENDATION: Accept improvements as being completed.
4.3Amendment to Agreement with TJKM for Traffic Engineering Services (Adjustment of
Rates)
TJKM provides traffic engineering services to the City. This amendment proposes rate
adjustments which would have a net effect of less than 1% increase over current rates.
STAFF RECOMMENDATION: Adopt Resolution approving amendment to agreement.
4.41995-96 Budget Modification with regard to Article XIII B of the State Constitution
A report has been prepared requesting authorization for all revenues received in excess of
expenditures to be appropriated. The actual amounts involved will be determined at the close
of the Fiscal Year. The City Council takes this action each year in order to protect the ability
to utilize these reserves in future years without the possibility of exceeding the State mandated
Appropriations Limit.
STAFF RECOMMENDATION: Authorize Staff to appropriate to Reserves, any Revenues in
excess of Budgeted Expenditures as of June 30, 1996
4.5Report on Recycling Services at Amador Lakes
As a result of a request by San Ramon resident Mark Dorazio, City Staff was directed to
review the status of recycling services being conducted at the Amador Lakes Apartments.
Staff determined that at the present time, Amador Lakes is fully participating in the City's
recycling program.
STAFF RECOMMENDATION: Receive Report.

6.PUBLIC HEARING
6.1Trumark Homes PD Rezone PA 96-014
This proposal is for a Planned Development Rezone on 8.9 acres of land located west of
Dougherty Road on the Southern Pacific Right-of-Way. The PD Rezone would change the
zoning district from M-1 (light industrial) to PD (residential) and would allow development of
a 92 single-family subdivision at this location.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT
Ordinance amending the Zoning Ordinance; adopt Resolution approving and establishing findings
and general provisions and Conditions of Approval for a PD Planned Development Rezoning.
6.2Flood Control Ordinance
The current Flood Control Ordinance contains language of the state model ordinance that
needs to be updated to comply with current minimum standards of the National Flood
Insurance Program. This ordinance was introduced at the City Council meeting on June 11,
1996.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT
Ordinance.
6.3Adoption of Animal Shelter Fees
Alameda County and the Cities of Dublin, Livermore and Pleasanton have entered into an
agreement to provide for sharing costs associated with the new East County Animal Shelter.
The shared costs include both construction and ongoing operating costs. The ongoing
operating costs are offset by revenue collected at the Shelter, and operation costs for each
agency are based on the percentage of live animals brought to the shelter in the prior calendar
year. Dublin's share will be equal to 15.54%.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution
6.4Inclusionary Zoning Ordinance
The Dublin General Plan and Eastern Dublin Specific Plan require that the City adopt an
Inclusionary Zoning Ordinance requiring a minimum percentage of the units in new residential
projects to be affordable to lower and moderate income families. The proposed Ordinance is
the result of the direction provided by the Planning Commission and City Council at 2 joint
study sessions, held in February and March of this year.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution; waive
reading and INTRODUCE Ordinance; schedule second reading for July 9, 1996 City Council
meeting.
6.5Local Regulation of Firearms Dealers
In accordance with Council direction, the City Attorney has drafted an ordinance which would
require a Conditional Use Permit for firearms sales in residential district and which would
require all persons engaged in firearms sales to obtain a permit from the Chief of Police. A
second ordinance has been drafted which would require persons selling firearms at retail to
obtain a permit from the Chief of Police. This ordinance is patterned after the Lafayette
Ordinance.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; refer Ordinance Amending
Zoning Ordinance to Planning Commission; and waive reading and INTRODUCE Ordinance
requiring permit - OR - provide direction to Staff.
7.UNFINISHED BUSINESS
7.1Report on Crossridge Slope Failure Study
Several soil slides have appeared along the cut slopes of the Dougherty Hills Open Space Park
as a result of two very wet winters. The City Council authorized studies to be undertaken to
determine the causes of and repairs to these slopes. The reports are now complete.
STAFF RECOMMENDATION: Accept Report and direct Staff to complete the design
documents and put the project out to bid.
7.2Median and Roadside Weed Maintenance
At its May 28 meeting, the City Council directed Staff to report back on the status of weed
maintenance in the street roadside areas and medians as there appeared to be an unusually large
amount of weeds lately. The weeds appearing from the late rains have now been removed.
STAFF RECOMMENDATION: Receive Report and provide direction.
8.NEW BUSINESS
8.1Tri-Valley Community Television (CTV 30) Operating Subsidy
The CTV Board of Directors was contacted to inform them of the City Council's stated goal of
eliminating the CTV subsidy. The City Council will consider the Board's response.
STAFF RECOMMENDATION: Receive Report and direct Staff as appropriate.
8.2Review of services and new Agreement with MCE Corporation for Public Works
Maintenance Services
MCE Corporation has provided Public Works Maintenance Services to the City since 1984.
The proposed agreement is for a period of 1 year with renewal options up to 3 years.
STAFF RECOMMENDATION: Review services provided by MCE; adopt Resolution; authorize
Mayor to execute agreement.
8.3Tri-Valley Convention and Visitors Bureau (CVB)
Pleasanton and Livermore are funding the newly established Tri-Valley Convention and
Visitors Bureau, and are requesting $9,000 from Dublin as part of their $295,650 budget for
Fiscal Year 1996-97. CVB hopes to consolidate resources of the Valley's cities into a focused
marketing plan that will benefit each of the participating cities via increased convention
activities and tourist trade. Staff anticipates that the $9,000 membership fee could potentially
double or triple in subsequent years.
STAFF RECOMMENDATION: Receive Report and provide appropriate direction to Staff.

11ADJOURNMENT
. - On Thursday, June 27, 1996, beginning at 6:00 p.m., in the Council Chambers,
the Dublin City Council will hold an Adjourned Regular Meeting to conduct public hearings for consideration
and adoption of the 1996-97 Budget and the 1996-2001 Five-Year Capital Improvement Program.
