place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request
Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the
proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take
action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3).
4. CONSENT CALENDAR
Consent Calendar items are typically noncontroversial in nature and are considered for approval by the City Council with one single action. Members
of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the
Mayor to remove the item.
4.1 Minutes of Regular Meeting of May 5, 2009
STAFF RECOMMENDATION: Approve minutes.
4.2 2009-2010 Contract for Services with the Alameda County Library (600-40)
On an annual basis, the City of Dublin provides funding for additional hours of service at the
Dublin Branch of the Alameda County Library System. The City Council will consider
adoption of an agreement for 31 additional hours of services for Fiscal Year 2009-2010.
STAFF RECOMMENDATION: Adopt Resolution Approving Agreement with County of
Alameda for Additional Library Services for Fiscal Year 2009-2010.

4.3 Alameda County Altamont Landfill Open Space Fund -Application for Grant Funding
(530-40)
The Altamont Landfill Open Space Committee, of which the City of Dublin is anon-voting
member, is considering a grant application from the East Bay Regional Park District. The
City of Dublin's approval of the application is needed before the Committee can formally
approve the application.
STAFF RECOMMENDATION: Approve application for funding from East Bay Regional Park
District and direct Staff to notify the City of Pleasanton and the County of Alameda of the City
of Dublin's action.
4.4 Consortium Agreement with the County of Alameda and Cities within the County for the
Purpose of Submitting an Application to the Department of Housing and Urban
Development for the Neighborhood Stabilization Program, Phase 2 (600-40)
The City Council will consider authorizing the City Manager to enter into a Consortium
Agreement with the County of Alameda and cities within the County to apply for funding
through the Neighborhood Stabilization Program, Phase 2 which was created through the
American Recovery and Reinvestment Act of 2009.
STAFF RECOMMENDATION: Adopt Resolution Authorizing the City Manager to Enter Into
a Consortium Agreement with the County of Alameda and Cities within the County for the
Purpose of Submitting an Application to the Department of Housing and Urban Development for
the Neighborhood Stabilization Program -Phase 2, Created Through the American Recovery and
Reinvestment Act of 2009.
4.5 Review of Planning Commission Chapter in Municipal Code (420-20)
The City Council will review the Planning Commission's request for Amendments to
Chapter 2.12 of the Municipal Code in relation to Duties and Rules and Records of the
Planning Commission. This is the second reading of this ordinance.
STAFF RECOMMENDATION: Waive reading and adopt Ordinance Amending Chapter 2.12
of Title 2 (Administrative/Personnel) of the Dublin Municipal Code Relating to Duties and Rules
and Records of the Planning Commission.
4.6 Waiver of Bid Requirement as Authorized by Municipal Code and Authorization to
Purchase Desk-Top Computers from Dell, Inc. (350-20)
Based on annual replacement cycles, in Fiscal Year 2009-2010, 37 computer units are
proposed for replacement. The Western State Contracting Alliance allows public agencies to
purchase using cooperative public bid process. The City Code requires the City Council to
authorize purchases in excess of $20,000. The cost of 37 units is not to exceed $42,500.
STAFF RECOMMENDATION: Adopt Resolution Authorizing Staff to Procure Desk-Top
Computers from Dell, Inc.
4.7 Acceptance of Work -Contract No. 09-05, San Ramon Road Trail Improvements -
Asphalt Path Repair and Sealing (600-35)
This project repaired and constructed improvements to the bicycle/pedestrian path along the
west side of San Ramon Road from Alcosta Boulevard to Silvergate Drive. This phase of the
project repaired the damaged asphalt within the path, and placed a seal coat over the entire
path. The City Council will consider accepting the work performed on this contract.
STAFF RECOMMENDATION: Accept the improvements under Contract No. 09-05, San
Ramon Road Trail Improvements -Asphalt Path Repair and Sealing, and authorize the release of
retention after 35 days if there are no subcontractor claims.

4.8 Update of Procedures for Check Signing and Administration of Special Police Investigation
Account (320-10)
As part of the implementation of a new Finance System, Staff is evaluating current business
practices and opportunities to complete work more efficiently. A resolution adopted in 1997
(No. 91-99), established the protocol for signatures on City payments. Staff is proposing to
revise the process and utilize security features in the new finance system software. Staff is
also proposing a change in the handling of the Police Investigations Account, which had been
defined in a 1997 Resolution (No. 32-97).
STAFF RECOMMENDATION: Adopt Resolution Rescinding Resolution No. 91-99 and
Adopting a Listing of City Officials and Procedures for the Processing of Payments Requiring a
Signature; and adopt Resolution Rescinding Resolution No. 32-97 and Authorizing the
Establishment of an Internal Police Special Investigations Account.
4.9 Waiver of Bid Requirement as Authorized by Municipal Code and Authorization to
Purchase Three Ricoh Copiers from Shamrock Office Solutions Under the U.S.
Communities Purchasing Agreement (350-20)
In Fiscal Year 2009-2010 the City will replace three copy machines. The U.S. Communities
Government Purchasing Alliance allows public agencies to purchase using cooperative public
bid process. The City Council will consider authorizing purchase of the three replacement
copiers at a total cost of $33,856.
STAFF RECOMMENDATION: Adopt Resolution Authorizing Staff to Procure Digital Copiers
from Shamrock Office Solutions Pursuant to the U. S. Communities Purchasing Agreement.
4.10 Warrant Register ($2,524,669.98) dated July 7, 2009 (300-40)
STAFF RECOMMENDATION: Review and authorize the issuance of payments.
5. WRITTEN COMMUNICATIONS -None.
6. PUBLIC HEARINGS
6.1 Zoning Ordinance Amendment and Site Development Review Permit Fee -Amendment to
the Sign Regulations and the Permit Procedures Chapters (Chapter 8.84 and Chapter 8.96)
of the Zoning Ordinance to be Effective for aOne-Year Period, and Amendment to the Site
Development Review Chapter (Chapter 8.104) of the Zoning Ordinance and a Site
Development Review Fee for Residential Additions and Residential Tear Downs, ZOA 09-
001 (400-30/410-30/450-20)
At the request of the City Council, the Planning Division has identified several alternatives to
streamline the entitlement process for development applications and to promote businesses in
Dublin. These alternatives include permanent modifications to the Site Development Review
Chapter (Chapter 8.104) regarding the level of review required for projects, and temporary
modifications to the Sign Regulations (Chapter 8.84) to facilitate the use of banner signs and
balloon signs and Permit Procedures (Chapter 8.96) to extend the effective period for permits.
The City Council will also consider adopting a $500 fee for Site Development Review of all
residential additions and residential demolition and construction where Site Development
Review is required pursuant to Chapter 8.104, Site Development Review, of the Dublin
Zoning Ordinance.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and
INTRODUCE Ordinance Amending the Dublin Municipal Code Chapter 8.84 relating to Sign
Regulations and Chapter 8.96 relating to Permit Procedures for aOne-Year Period, ZOA 09-001;
waive reading and INTRODUCE Ordinance Amending the Dublin Municipal Code Chapter
8.104 relating to Site Development Review, ZOA 09-001; and adopt Resolution Amending
Resolution No. 49-06 to Revise the Adopted Fee Schedule for Residential Additions Over
500 Square Feet in Size and Residential Demolition and Construction Projects which Require
Site Development Review.

6.2 Bright Horizons Day Care Center -Appeal of the Planning Commission's Approval of a
Conditional Use Permit and Site Development Review PA 09-005 (410-30)
The City Council will consider an appeal of the Planning Commission's approval of a
Conditional Use Permit to operate a Day Care Center at 7035 Dublin Boulevard and to allow
Off-Site Parking at 7051 Dublin Boulevard and approval of a Site Development Review to
modify an existing parking lot to accommodate an outdoor play area and make associated site
and exterior building improvements related to the operation of the Day Care Center at 7035
Dublin Boulevard.
STAFF RECOMMENDATION: 1) Receive Staff presentation; 2) Open the public hearing; 3)
Take testimony from the Appellants, Applicant and the Public; 4) Close the public hearing and
deliberate; and 5) By motion affirm the Planning Commission's adoption of Resolution 09-22
approving a Conditional Use Permit to operate a Day Care Center at 7035 Dublin Boulevard
with the addition of Condition of Approval 8a as set forth in the Findings of Fact and to allow
Off-Site Parking at 7051 Dublin Boulevard; affirm the Planning Commission's adoption of
Resolution 09-23 approving a Site Development Review to modify an existing parking lot to
accommodate an outdoor play area and make associated site and exterior building improvements
related to the operation of the Day Care Center at 7035 Dublin Boulevard; and, adopt the
Findings of Fact set forth in Attachment 8; OR 6) By "straw vote" direct the City Attorney to
prepare findings for the City Council to adopt by motion no later than August 17, 2009 to affirm
the Planning Commission's action in part with or without additional conditions of approval or to
reverse such action.

8. NEW BUSINESS
8.1 Template Emergency Plan for Businesses (520-30)
The City Council will receive a report on the Fiscal Year 2009-2010 high priority goal to
create a template emergency plan for facilities that serve vulnerable populations within the
City of Dublin. The plan provides a simple method for developing an emergency plan at no
cost to the organization.
STAFF RECOMMENDATION: Receive the report.
8.2 Report on the Diversion Efforts of the City's Jurisdictional Partners (810-60)
The City Council will receive a report on the Fiscal Year 2009-2010 high priority goal to
analyze the diversion efforts of the City's jurisdictional partners. The report reviews and
analyzes the City's 17 jurisdictional partners, which include the Dublin Unified School
District (DUSD), Camp Parks, California Highway Patrol, Alameda County Public Works,
Santa Rita Jail, the Federal Correctional Institution and Dublin San Ramon Services District.
STAFF RECOMMENDATION: Receive the report.
8.3 Resolution Authorizing the City Manager to Enter Into aCost-Sharing Agreement with
StopWaste.Org for the Proposed Green Packages Program (600-40)
The City Council will consider participation in the development of StopWaste.Org's "Green
Packages" program which will establish standardized countywide building retrofit measures
and specifications for energy efficiency, water and resource conservation and indoor air
quality/health. Stopwaste.Org is seeking the support and participation of Alameda County
cities with the proposed Green Packages program.
STAFF RECOMMENDATION: Adopt Resolution Authorizing the City Manager to Enter Into
a Cost-Sharing Agreement with Stopwaste.Org for the Proposed Green Packages Project.
