Any member of the public may contac{ the City Clerk's Office related to the proper procedUre to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non.controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Adjourned Regular Meeting of June 24, 2002 STAFF RECOMMENDATION: Approve 4.2 Request to Waive Competitive Bid Process and authorize Staff to purchase Police Patrol Vehicles directly from Vendor (File # 350-20) Staff is requesting that the City Council waive the competitive bid process in accordance with Dublin Municipal Code 2.36.050(a)(11), and authorize Staffto purchase three replacement vehicles directly from the least costly vendor. STAFF RECOMMENDATION: Adopt Resolution. 4.3 ACceptance of Work, Contract 02-05, 2001-02 Annual Slurry Seal Program (File # 600-35) This project resurfaced several City streets with a slurry seal that will prolong the life of existing pavement surface. STAFF RECOMMENDATION: Accept improvements and authorize release ofretenti°n after 35 days if there are no subcontractor claims. 4.4 Agreement with Alameda County Surplus Property Authority (ACSPA) for Local fund Exchange for the 1-580/Tassajara Road Interchange Improvements Project (File # 600-40) This agreement would provide £or the ACSPA to transfer up to $3,000,000 in Federal TEA-21 transportation funds to Dublin for up to $2,700,000 in reimbursement from Dublin's Eastern Dublin Traffic Impact Fees. STAFF RECOMMENDATION: Adopt Resolution. 4.5 Agreement with LAFCO to Indemnify LAFCO for the costs of litigation arising from LAFCO's approval of the East Dublin Property Owners' Reorganization (File # 600-40) When LAFCO approved the East Dublin Property Owners' Annexation in May, LAFCO imposed a condition that required thc City to enter into an agreement with LAFCO to indemnify LAFCO against any expenses arising from any legal actions challenging the Reorganization. The East Dublin Property Owners' have agreed to cover the City's costs in defending any lawsuit arising from the annexation, including challenges to the LAFCO action. STAFF RECOMMENDATION: Approve Agreement and authorize Mayor to execute. 4.6 Amendment to Consulting Services Agreement with Washington Infrastructure Services (formerly MK Centennial) for the widening of Dublin Boulevard from Village Parkway to Sierra Court (Modification to Scope of Work and Additional Compensation) (File # 600-30) This amendment to the design contract would extend Washington Infrastructure Services scope of services to include the provision for construction support services for the subject project. STAFF RECOMMENDATION: Adopt .Resolution. 4.7 Amendment to Agreement with Fehr & Peers Associates, Inc., for General Traffic Engineering Services (File # 600-30) This amendment to a traffic consulting agreement provides for a rate increase as allowed by the agreement. STAFF RECOMMENDATION: Adopt Resolution. 4.8 Amendment to Agreement with TJKM Transportation Consultants for Traffic Engineering Services (File # 600-30) This amendment would approve TYKM's new hourly rate in the existing cOnsultant agreement. STAFF RECOMMENDATION: Adopt Resolution. 4.9 Warrant Register ($1,481,940.67) dated July 16, 2002 (File # 300-40) STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS - None 6. PUBLIC HEARING 6.1 Repeal of No Parking Zone and Establishment of Passenger Loading Zone on Village Parkway (File # 570-20) The City Council will consider establishing a passenger loading zone on Village Parkway adjacent to Dublin High School to enable parents who drop off/pick up children at the school to avoid blocking the bus stop. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution(s). 6.2 Approval of Engineer's Report for Dublin Ranch West Side Storm Drain Benefit District and Adoption of Ordinance Creating District (File # 360-40) This is the second reading of an Ordinance which would establish a Storm Drain Benefit District generally including the Dublin Land Company property east of Tassajara Road and a portion of the Dublin Ranch property between the Dublin Land Company property and a line approximately halfway between Tassajara Road and Fallon Road. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt Ordinance. 6.3 Citywide Street Lighting Maintenance Assessment District 8:}-1 (File # 360-50) This assessment district funds the cost of maintenance and energy for the City's street lighting system, except for Dublin Ranch and Tract 7067. The assessment in this District is proposed to be $16.84 per single-family residential lot, which is 27% higher than the 2001-02 assessment, but is less than the 1995-96 assessment. This item would approve the levy of assessments for the 2002-03 fiscal year. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution approving Engineer's Report, Confirming Diagram and Assessment, and ordering levy of' assessment. 6.4 Landscaping & Lighting Maintenance Assessment District 8:}-2 (Tract 4719 - Stagecoach Road) (File # 360-20) This assessment district funds the cost of maintenance for landscaping improvements along Stagecoach Road and the interior slopes of Tract 4719. The assessment in this District is proposed to be the same as the 2001-02 assessment. This item would approve the levy of assessments for the 2002-03 fiscal year. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution approving Engineer's Report, Confirming Diagram and Assessment, and ordering levy of' assessment. 6.5 Landscaping & Lighting Maintenance Assessment District 86-1 (Villages ~ Willow Creek) (File # :}60-20) This assessment district funds the cost of maintenance for landscaping improvements along portions of Doughe~;y Road and Amador Valley Boulevard and within the Villages ~ Willow Creek development. The assessment in this District is proposed to be 2% higher than the 2001-02 assessment. This increase is allowable under the terms of the Engineer's Report that was approved in 2001. This item would approve the levy of assessments for the 2002-03 fiscal year. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution approving Engineer's Report, Confirming Diagram and Assessment, and ordering levy of assessment. 6.6 Landscaping Maintenance Assessment district 97-1 (Santa Rita Area) (File # :}60-20) This assessment district funds the cost of maintenance for landscaping improvements in the Santa Rita (Emerald Park) development area. The assessment in this District is proposed to be approximately 19% higher than the 2001-02 assessment. This increase is allowable under the terms of the Engineer's Report that was approved when the District was formed and is below the maximum allowable assessment. This item would approve the levy of assessments for the 2002-03 fiscal year. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution approving Engineer's Report, Confirming Diagram and Assessment, and ordering levy of assessment. 6.7 Dublin Ranch Street Lighting Maintenance Assessment District 99-1 (File # 360-20) This assessment district funds the cost of energy and maintenance for street lighting in Dublin Ranch and in the Clifden Parc (Tract 7067) development. The assessment in this District is proposed to be the same as the 2001-02 assessment, This item would approve the levy of assessments for the 2002-03 fiscal year. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution approving Engineer's Report, Confirming Diagram and Assessment, and ordering levy of assessment. 7. UNFINISHED BUSINESS 7.1 Transfer Agreement for Shannon Park Artwork, Sirius (File # 600-30) In June of 2001, the City Council approved the request from the Dublin Fine Arts (DFA) Foundation to permanently install Sirius at Shannon Park. The installation is now complete and DFA has prepared a Title to Artwork Transfer. STAFF RECOMMENDATION: Authorize Mayor to execute Agreement. 7.2Evaluation of Traffic Circulation and Safety in the Vicinity of Dublin High School (File # 590-40) This item reports the findings of a recent traffic safety study on Village Parkway and seeks Council approval to install "No Right Turn on Red" signs prohibiting the right turn movement on red from Davona Drive onto Village Parkway. STAFF RECOMMENDATION: Approve installation of'SNo Right Turn on Red" signs. 7.3 Award of Contract for Murray School Bell Tower Project (File # 600-30) On June 4, 2002, the City Council authorized Staffto solicit bids to complete the design and construction of the Murray School Bell Tower. A low bid of $99,500 was received from TGI( Contracting. STAFF RECOMMENDATION: Adopt Resolution and approve Budget Change of $8,100 from Unappropriated Reserves. 8. NEW BUSINESS 8.1 Request to Amend Smoking Pollution Control Ordinance (File # 560-90) The City has received a request to amend the City's Smoking Pollution Control Ordinance to prohibit smoking within a certain distance of a business entrance. Other potential changes aimed at strengthening the Ordinance will also be discussed. STAFF RECOMMENDATION: Determine whether to proceed with introducing an amendment to the Ordinance, and if the Council so desires to amend the Ordinance, provide direction to Staff regarding the desired changes. 9.
