DUBLIN CITY COUNCIL
REGULAR MEETING - July 26, 1993 DUBLIN CIVIC CENTER

A complete packet of information containing all Staff Reports and exhibits related to each agenda item is available
for pubLic information and perusal several days prior to a Council meeting in the City Clerk's Office and also at
the Dublin Library.

3. ORAL COMMUNICATIONS
3.1 Presentation of savings Bonds to Recycling Rewards Contest
Winners for the month of June, 1993: Phyllis Kencke, Neil
McLean, Larry Cauble, Kurt Freund, Ellen Johnson.
3.2 Presentation by Bruce Kern, Director of Economic Development
for Alameda County regarding activities of the Alameda County
Economic Development Advisory Board, including the 1993-94
Draft Annual Report and Work Plan.
At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City
Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to
address their concern, that person should arrange with the City Clerk to have their particular concern placed on the
agenda for a future meeting. The City Council CANNOT deliberate or take action on a non-agenda item UNLESS there is
factual evidence presented to the Counei 1 indicating that the subject brought up falls into one of the exceptions
under Government Code Section 54954.2.
4. CONSENT CALENDAR
Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council
with one singLe action. Members of the audience who wouLd like an item removed from the Consent Calendar for purpose
of public input may request the City Council to remove the item. The request may be made at the time that the Mayor
asks the audience members if there is anyone interested in removing an item from the Consent Calendar.
4.1 Minutes: Regular Meeting of July 12, 1993
STAFF RECOMMENDATION: Approve
4.2 Resolution Authorizing Director of Public Works to Sign Right-
of-Way certifications in Connection with State and Federally
Funded Road Projects
Adoption of this resolution would delegate the
responsibility for right-of-way certification for Federally
funded projects from the city Council to the Public Works
Director to reduce the paperwork and time needed to go to
the City Council at this project stage. The Council will
still review and approve the project at budget stage, at
approval to go to bid, and at award of bid.
STAFF RECOMMENDATION: Adopt Resolution.
4.3 Authorization to Solicit Bids for the Annual Slurry Seal
Program, Contract 93-10
Slurry seal is a mixture of oil and sand used in the
maintenance of streets to fill cracks and to provide an
extended wearing surface. Dublin's program attempts to
slurry all streets on a 7-year cycle.
STAFF RECOMMENDATION: Authorize Staff to advertise for bids.
4.4 Agreement with Alameda County regarding Mortgage Credit
certificate Program (MCC)
This program provides assistance to first time homebuyers
of new and existing dwelling units.
STAFF RECOMMENDATION: Authorize city Manager to sign
agreement.
4.5 Accounts Receivable - Collection Agency Services and Account
Write-Off Procedures
At the direction of the city Council, Staff solicited
proposals from firms which provide collection agency
services. The purpose of this process is to follow-up on
accounts which city Staff have previously been unsuccessful
in collecting. Staff has also prepared procedures to
write-off uncollectible amounts, in the event that
collection efforts are unsuccessful.
STAFF RECOMMENDATION: Adopt Resolutions 1) approving
agreement with Commerce COllection, Ltd., for collection
agency services; and 2) establishing procedures for write-off
of uncollectible accounts receivable.

STAFF RECOMMENDATION: Approve
5. WRITTEN COMMUNICATION
5.1 Request from Valley Volunteer Center for Use of the Regional
Meeting Room
The Valley Volunteer Center is requesting free use of the
Regional Meeting Room for their management assistance
workshop series for the non-profit community. The
estimated lost fee revenue would be $1,450.
STAFF RECOMMENDATION: Consider Request.
5.2 stop sign Request - village Parkway @ wineberry Way
Staff received a request from the Parkway Terrace
Homeowners Association to install stop signs on Village
Parkway @ Wineberry Way. No funds have been budgeted in
FY 1993-94 for this type of traffic study.
STAFF RECOMMENDATION: Provide direction regarding requested
traffic study.
5.3 Letter from Senator Daniel Boatwright regarding Senate Bill
1234 (Bergeson)
The objective of SB 1234 would be to force the State
Legislature to address the repeated annual State Budget
crisis and would create a 12-member committee to make
recommendations on changes in the existing state-local
alignment. If the Legislature and Governor fail to act
upon the committee's recommendations by July 1, 1994, SB
1234 specifically requires that all property taxes, local
sales taxes, vehicle license fees and state sales taxes be
sequestered as of that date. This could have serious
operating consequences in terms of jeopardizing the City's
ability to provide even basic services.
STAFF RECOMMENDATION: Direct Staff to prepare a letter to
local State Legislators expressing the city's opposition to SB
1234.
6. PUBLIC HEARING
6.1 Citywide Street Lighting Maintenance Assessment District 83-1
This is the first of 2 public hearings regarding the street
light maintenance district, which funds energy and
maintenance costs for the City's street lighting system.
The proposed assessment per single-family home is $19.70.
STAFF RECOMMENDATION: Open public hearing; receive Staff
Report and public comments; question Staff and the public;
continue public hearing to meeting of August 9, 1993
6.2 Landscaping and Lighting District No. 86-1 (Villages @ willow
Creek) Tract 5511
This is the first of 2 public hearings regarding this
assessment district, which funds maintenance of common
landscaping improvements in the villages @ Willow Creek.
The proposed assessment is $84.72 per single-family and
$42.36 per condominium or apartment unit.
STAFF RECOMMENDATION: Open public hearing; receive Staff
Report and public comments; question Staff and the public;
continue public hearing to meeting of August 9, 1993
6.3 Landscaping and Lighting District No. 83-2 (Tract 4719)
This is the first of 2 public hearings regarding this
assessment district which funds maintenance and utility
costs for landscaping improvements along Stagecoach Road
and on the Dublin Hills Estates interior slopes. The
proposed assessment is $228.72 per single-family lot and
$38.68 per mUlti-family lot. Some property owners have
requested an increased assessment to fund additional
landscaping work.
STAFF RECOMMENDATION: Open public hearing; receive Staff
Report and public comment; question Staff and the public;
continue public hearing to meeting of August 9, 1993; provide
Staff with additional direction as appropriate.
6.4 Revisions to Chapter 5.100 of the Dublin Municipal Code
related to Parks and Recreation Areas and Facilities
Adoption of this Ordinance, which was introduced at the
July 12th Council meeting, would amend the Dublin Municipal
Code Chapter dealing with Parks and Recreation Areas and
Facilities. The amended sections include: clarifying the
language prohibiting unauthorized private use of parks for
a profit; use of skates and skateboards in the parks; and
prohibiting consumption of alcoholic beverages at the
Dublin Senior Center.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
waive reading and ADOPT Ordinance.

certification of Referendum Petition as Being Sufficient
The City Clerk has completed the signature checking on a
referendum petition which was filed against the City
Council's approval of the Eastern Dublin General Plan
Amendment and Specific Plan, and has certified the petition
as sufficient. The Council will be presented with a report
outlining their legal options.
STAFF RECOMMENDATION: Consider alternatives presented and
provide Staff with direction. If a special election is called
for November 2, 1993, the Council should: 1) Review and
approve ballot language; 2) adopt Resolution; 3) approve
additional appropriation of $12,500 to the Elections Budget;
and 4) appoint member or members of city Council to write
ballot and rebuttal arguments for or against measure, if so
desired.
Report on Tri-Valley Affordable Housing Committee and Draft
Letter Regarding AB 51
A report has been prepared on the Tri-valley Affordable
Housing Committee history, goals and objectives and
activities during 1993 and on a draft letter regarding
proposed changes to AB 51 which would adversely impact
local planning.
STAFF RECOMMENDATION: Receive report and review drafted
letter; provide direction on content of letter and direct that
it be sent out over the signature of Chairman Tom Vargas to
Senator Boatwright, Tom Cook and the Southern Alameda County
Association of Realtors.
Comments on North Livermore Draft General Plan Amendment and
Draft Environmental Impact Report
The North Livermore Draft General Plan Amendment and Draft
EIR propose a community of 12,780 dwelling units and a
population of 30,000.
STAFF RECOMMENDATION: Receive Report and authorize Staff to
send comments to the city of Livermore
Comments on East County Area Plan Draft General Plan Amendment
and Draft Environmental Impact Report
The East County Area Plan Draft General Plan Amendment and
Draft EIR were prepared to update the Livermore Amador
Valley Planning unit General Plan and Open Space Element.
STAFF RECOMMENDATION: Receive Report and authorize Staff to
send comments to Alameda County
