PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is not on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Manager to have their particular concern placed on the agenda for a future meeting. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public input may request the City Council to remove the item from the consent calendar. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes of Regular Meeting of July 14, 1986 STAFF RECOMMENDATION: Approve 4.2 Contract Agreement with the County of Alameda for 1986-87 Library Services This agreement provides for the funding of 11 hours of Library service over and above what has historically been provided by the County of Alameda. Additional Sunday Library service which was approved in concept by the City Council during its budget hearing are not includec in this contract. As soon as the County Librarian has cost information available, the County will prepare an addendum to the agreement. STAFF RECOMMENDATION: Adopt Resolution approving contract and authorize Mayor to execute said agreement~ 4.3 Designation of New Bank Pursuant to City Council direction, after review of proposals submitted, Staff has selected Hibernia Bank which will begin providing banking services to the City effective August 1, 1986. STAFF RECOMMENDATION: Adopt Resolution designating Hibernia Bank as the City's bank. 4.4 Camp Parks Annexation Property Tax Exchange Agreement PA 85-018 The City of Dublin has a pending application for the annexation of government lands east of the existing City limits. The City and County are required to agree on an exchnage of property tax revenues before an annexation can be completed. Pursuant to City Council direction Staff has negotiated a proposed tax exchange agreement. STAFF RECOMMENDATION: Adopt Resolutions and authorize Mayor to execute agreement; Direct Staff to negotiate a fire service agreement with DSRSD for the annexation area 4.5 Report from Recreation Director - Spring Quarter Recreation Program Staff has prepared a report illustrating the activities of the Recreation Department for the Spring 1986 Quarter. STAFF RECOMMENDATION: Receive Report 4.6 Addition of Personnel & Establishment of Salary Range A full-time Clerk Typist/Receptionist position was approved with the 1986-87 Budget for the City Manager/City Clerk Department. This addition of personnel was approved contingent on acquiring additional office space. Staff anticipates completion of a sublease on Suite 205 no later than August 1, 1986. Resolutions establishing a job description and salary range are required pursuant to the adopted Personnel Rules and Regulations. STAFF RECOMMENDATION: Adopt Resolutions 4.7 Budget Transfer - Lapel Pins The City has received delivery of laple pins which will be used for special recognition. A budget transfer is required to meet the total project cost. STAFF RECOMMENDATION: Authorize Mayor to execute Budget Change Form 4.8 Warrant Register dated July 28, 1986 STAFF RECOMMENDATION: Approve ~ 5. WRITTEN COMMUNICATIONS 5.1 Regarding Amended Alameda County Transportation Expenditure Plan The Countywide Transportation Commission amended the proposed tax expenditure plan subsequent to the City Council action taken on July 14, 1986. Therefore, it is necessary for the City Council to review the amended plan and determine whether they support the proposal. STAFF RECOMMENDATION: Consider request to approve the amended Expenditure Plan 6. PUBLIC HEARING 6.1 Fortunetelling Ordinance Zoning Ordinance Amendment PA 86-035 In response to a recent court decision, the City Council initiated an amendment to the Zoning Ordinance to permit fortunetelling in the C-l Retail Business District with a Conditional Use Permit and to prohibit fortunetelling as a home occupation. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution for Negative Declaration; waive reading and introduce Ordinance 6.2 Citywide Street Lighting Maintenance Assessment District 83-1; 1986-87 Levy of Assessments The recommended District budget for Fiscal Year 1986-87 is $156,710, to be financed by a carryover of $17,710 from last year and assessments to property owners in the amount of $139,000. STAFF RECOMMENDATION: - Conduct public hearing; deliberate; adopt Resolution approving Engineer's Report, Confirming Diagram and Assessment, and Ordering Levy of Assessment 6.3 Landscaping and Lighting District No. 1983-2 (Tract 4719) - Levy of Assessments for Fiscal Year 1986-87 This District provides for the maintenance of landscaping within Tract 4719 and includes Amador Lakes Mini-Park, the Dougherty Hills Open Space and the Beck Development interior roadway slopes. Recommended assessment is $24,100. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution approving Engineer's Report, Confirming Diagram and Assessment, and Ordering Levy of Assessment 6.4 Smoking Pollution Control Ordinance Public Hearings on the proposed Smoking Pollution Control Ordinance were conducted on May 27 and July 14, 1986. At the July 14th meeting, the Council continued the public hearing until July 28th, due to the absence of Councilmember Moffatt. - STAFF RECOMMENDATION: Conduct public hearing; deliberate; consider introduction of Ordinance 6.5 Ordinance Amending Ordinance No. 11-84 Consolidating the City Municipal Election with the Statewide General Election This Ordinance extended the terms of Councilmembers until the Tuesday after the day of the general municipal election. Government Code Section 36503.5 requires that when a City normally holds municipal elections in April of an even numbered year and consolidates its election with a statewide general election, City officers "shall continue in their offices until no later than the fourth Tuesday after the day of the general municipal election and until their successors are elected and qualified". Section 17088 of the Election Code requires the Clerk to certify the results of the election ,and submit it to the governing body within 28 days of the election. STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance; authorize budget transfer of $1,800 from Contingent Reserve. 7. OTHER BUSINESS 8.
