CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG ORAL COMMUNICATIONS 3.1 Youth Advisory Committee (YAC) Appointments (File 110-30) The City Council will consider the recommendations of the Mayor for appointments to the YAC. STAFF RECOMMENDATION: Confirm appointments. 3.2 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name and address for the record. COMMENTS SHOOLD NOT EXCEED THREE (3) MIN~ITES. In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes: Adjourned Regular Meeting of June 21; Regular Meeting of July 3; Special Meeting of July 17; Regular Meeting of July 17; and Special Meeting of July 18, 2001 STAFF RECOMMENDATION: Approve 4.2 Acceptance of Improvements, Tract 7067 "Clifden Parc" (File 410-$0) The improvements within this 17-lot subdivision, located just west of the Hansen Hill development, are now complete and it is appropriate to accept the improvements for maintenance. STAFF RECOMMENDATION: Adopt Resolution and authorize Staffto accept maintenance bond. 4.3 Fiscal Year 2001-02 Contract for Services with Alameda County Library (File 600-40) The City Council will consider the contract agreement with Alameda County for 21 additional hours per week of library services at the Dublin Library, as well as additional library materials. STAFF RECOMMENDATION: Authorize Mayor to execute agreement. 4.4 Contract Agreement with Parsons Harland Bartholomew & Associates, Inc. to Prepare the 2001-2006 Housing Element Update for the City of Dublin (File 600-30) The City Council will consider entering into an agreement ($37,400) with Parsons Harland Bartholomew & Associates for purposes of preparing Dublin's Housing Element Update. STAFF RECOMMENDATION: Adopt Resolution and authorize the City Manager to execute the contract agreement. 4.10 4.11 4.5 Request for Award of Bid for Purchase of One (1) Crime Prevention Van (File 350-20) On July 17, 2001, the City Council authorized Staffto distribute bid requests for one (1) Crime Prevention van. One response was received frOm Hayward Ford, Inc. in the amount of $25,788 for the van ($25,000 was budgeted in Fiscal Year 2001-02 for a fully equipped van). Staff is requesting that the anticipated shortfall of $3,500 for the fully equipped van be offset by California Law Enforcement Equipment funds. STAFF RECOMMENDATION: Adopt Resolution and approve Budget Change. 4.6 Request for authorization to distribute a Request for Proposals for the purchase of one (1) replacement unmarked Police Vehicle (File 350-20) Staff is requesting that the City Council authorize distribution of a RFP for the purchase of one replacement unmarked Police Vehicle. One of the vehicles in the existing fleet currently requires mechanical repairs that exceed the value of the vehicle. Staffis also requesting that the existing inoperable vehicle be declared surplus and sent to auction. STAFF RECOMMENDATION: Authorize Staffto distribute RFPs to qualified dealers and adopt Resolution declaring 1993 Ford Taurus as surplus and authorizing the City Manager to dispose of it at auction. 4.7 Consultant Services Agreement for Engineering Testing, Civic Center Library (File 600-30) In June of 2001, the City Council contracted for the construction of the new Dublin Library. As part of the construction process, the City budgeted for Engineering Testing Services. Four firms submitted proposals. RES Engineering provided the City with the qualifications that were most closely suited to the City's requirements. The proposed fee for services is $48,624. STAFF RECOMMENDATION: Approve Agreement and authorize Mayor to execute. 4.8 Acceptance of Improvements, Tract 6308 (Hansen Hill, Phase H) (File 600-60) The improvements within this 108 single-family lot subdivision, located generally north of Dublin Boulevard and west of Silvergate Drive, are now complete and it is appropriate to accept the improvements for maintenance. STAFF RECOMMENDATION: Adopt Resolution and authorize Staffto accept $655,000 maintenance bond. 4.9 Acceptance of Work, Contract 01-04, Shannon Center Parking Lot, Hansen Drive & Bedford Court Improvements (File 600-35) This project repaved the Shannon Community Center parking lot and Hansen Drive (west end to Silvergate Drive), as well as installed subdrains on Hansen Drive and Bedford Court. STAFF RECOMMENDATION: Accept improvements; authorize release of retention after 35 days if there are no subcontractor claims; authorize a Budget change for an additional appropriation of $1,711 in FY 2001-02; and approve transfer of $670 from the Shannon Parking Lot project to the Bedford Court Subdrain project. Approval of Summary Vacation for Portions of Public Service Easement (P.S.E.) in Tract 6956, Dublin Ranch, Neighborhood L-1 (File 670-40) This item will eliminate a portion of a Public Service Easement on Lots 14 and 85 of the Chantemar Subdivision (Tract 6956) in Dublin Ranch. STAFF RECOMMENDATION: Adopt Resolution. Used Oil Recycling Block Grant (File 810-60) The Used Oil Recycling Grant is distributed on a non-competitive basis to all qualified local California jurisdictions based on population for the implementation and maintenance of used oil recycling programs. The Resolution authorizes the submittal of the grant application. STAFF RECOMMENDATION: Adopt Resolution and approve allocation of grant funds to a regional project administered by the Alameda County Waste Management Authority (ACWMA). 4.12 Acceptance of Improvements for Central Parkway, Keegan Street (Collector B) and Dublin Boulevard (File 600-30) The improvements to three major streets in eastern Dublin have now been completed and it is appropriate to accept these improvements for maintenance. STAFF RECOMMENDATION: Adopt Resolution. 4.13 Approval of Parcel Map 7537 and Acceptance of In-Lieu Park Dedication Fees (File 600-60) This development is located on the east side of Dougherty Road just north of Houston Place and contains 177 apartment units on 6.38 acres of land. STAFF RECOMMENDATION: Adopt Resolution(s). 4.14 Update on National Fire Protection Association Standard 1710, "Organization and Deployment of Fire Suppression Operations, Emergency Medical Operations and special Operations to the Public by Career Fire Departments" (File $40-20) At a previous' Council meeting, the Council voted to oppose NFPA 1710 and to appropriate $2,000 to assist with legal fees associated with the appeal process. An additional $3,000 is now needed to continue this legal challenge. STAFF RECOMMENDATION: Approve $3,000 Budget Change for contract legal services. 4.15 City Treasurer's Investment Report for 4th Quarter of FY 2000-01 (File 320-30)' The City's investment portfolio totals $76,248,328 (cost basis), and funds during the 4~ quarter were invested at an average yield of 5.187%. STAFF RECOMMENDATION: Receive Report. 4.16 Warrant Register ($2,491,581.01) dated August 7, 2001 (File 300-40) STAFF RECOMMENDATION: Approve WRITTEN COMMUNICATIONS 5.1 Adoption of Resolution supporting the proposed tBART Rail Service in the Tri-Valley Region (File 1060-30) The Council will consider a request from Alameda County and BART to support the further study and implementation of the tBART project as a rapid, integrated, cost-effective and reliable transit option for the Tri-Valley. STAFF RECOMMENDATION: Adopt Resolution. PUBLIC HEARING 6.1 Landscaping & Lighting Assessment District 86-1 (Villages ~ Willow Creek) (File 360-20) This assessment district funds the cost of landscaping maintenance and utilities for certain landscaping improvements associated with the Villages ~ Willow Creek development. This is the second and final public heating regarding the proposed levy of assessments for fiscal Year 2001-02. The assessment in this district is proposed to increase by 54%. Following the close of the public hearing, ballots submitted by property owners will be tabulated and the results announced. The City Council will take action as appropriate based on the results of the vote. STAFF RECOMMENDATION: Open public heating; receive Staff Report and public comment; question Staff and the public; dose public hearing and continue item until ballots have been tabulated; once tabulation of ballots has been completed, City Clerk will announce the results: a) If ballot results are 51% or more for YES, adopt Resolution approving engineer's report, confirming diagram and assessment, and ordering levy of assessment at the proposed new rate. b) If ballot results are 51% or more for NO, adopt Resolution approving engineer's report, confirming diagram and assessment, and ordering levy of assessment at the 2000-01 rate and provide direction by choosing one of the following options: 1. Reduce level of service to match the anticipated revenue. 2. Continue maintenance at the budgeted level of service, using reserve funds to make up the difference. 3. Cut back level of service to some designated percentage, and match level of service with a portion of reserve. StatTwould propose to return to the 2000-01 level of service through the voting process again next year. 7e ge 6.2 Citywide Street Lighting Maintenance Assessment District 83-1 (File 360-50) The street lighting assessment district funds the energy and maintenance costs for the City's street lighting system, excluding the Dublin Ranch area. This item would approve the levy of assessments for FY 2001-02. The assessment is not proposed to increase above the 2000-01 level of $13.26 per single-family residence. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution. 6.3 Landscaping & Lighting Maintenance Assessment District 83-2 (Tract 4719 - Stagecoach Road) (File 360-20) This assessment district maintains landscaping along Stagecoach Road and on the interior slopes of Agate Way and Coral Way. This item would approve the levy of assessments for Fiscal Year 2001-02. The assessment is not proposed to increase above the 2000-01 level of $228.72 per single-family home and $38.68 per Amador Lakes unit. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution. 6.4 Dublin Ranch Street Lighting Maintenance Assessment District 99-1 (File 360-20) This assessment district pays the cost of street lighting power and maintenance for Dublin Ranch Phase I, Area A (not including golf course), Area G and Tract 7067, Clifden Park. This action would approve the levy of assessments for Fiscal Year 2001-02. The proposed assessment is $15.10 per lot, which is less than the maximum established for this assessment district. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution. 6.5 Landscaping Maintenance Assessment District 97-1 (Santa Rita Area) (File 360-20) This assessment district funds maintenance of certain landscaping improvements in the City's Santa Rita development area. This item would approve the levy of assessments for Fiscal Year 2001-02. The assessment is not proposed to increase above the maximum approved for this district and will be less than last year's assessment. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution. 6.6 Vacate Excess Right-of-Way on Houston Place (File 670-40 It is proposed to extend the existing Houston Place cul-de-sac to the east to connect with the extension of Scarlett Drive. This vacation ofpt~blic right-of-way will eliminate the now unnecessary edge of the cul-de-sac bulb. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt Resolution. UNFINISHED BUSINESS 7.1 City Volunteer Recognition Event (Citizen/Organization of the Year) (File 610-50) The City Council appointed Sub-Committee will report back regarding the City's first annual volunteer Recognition Event (October 5, 2001) and request a Budget Change of $4, 000 to cover an increase in associated event costs. STAFF RECOMMENDATION: Provide comment on proposed event and approve Budget Change. NEW BUSINESS 8.1 Agreement with Tri-Valley Convention & Visitors Bureau (TVCVB) (File 600-30) The City CounCil will consider a proposed agreement which outlines the services provided by the TVCVB to the City of Dublin in return for the City's Fiscal Year 2001-02 financial contribution of $65,024. STAFF RECOMMENDATION: Approve agreement and authorize City Manager to execute. e 10. 8.2 Advertising Proposal from Livermore Valley Winegrowers Association (File 150-30) The Livermore Valley Winegrowers Association has embarked on an aggressive marketing campaign to attract visitors to the Tri-Valley area. The Association is proposing to rent advertising space at the Oakland International Airport (Terminal One) and is recruiting the City of Dublin to co-sponsor the ad at a cost of $4,400 per year ($370 per month). STAFF RECOMMENDATION: Consider proposal and provide appropriate direction to Staff.
