DUBLIN CITY COUNCIL
REGULAR MEETING - August 9, 1993 DUBLIN CIVIC CENTER

A complete packet of information containing all Staff Reports and exhibits related to each agenda item is available
for public information and perusal several days prior to a Council meeting in the City Clerk's Office and also at
the Dublin Library.

3. ORAL COMMUNICATIONS
At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City
Council Agenda. Cooments should not exceed 5 MINUTES. If any person feels that this is not sufficient time to
address their concern, that person should arrange with the City Clerk to have their particular concern placed on the
agenda for a future meeting. The City Council CANNOT deliberate or take action on a non-agenda item UNLESS there is
factual evidence presented to the Counci l indicating that the subject brought up falls into one of the exceptions
under Government Code Section 54954.2.
4. CONSENT CALENDAR
Consent calendar items are typicaLly of a non-controversial nature and are considered for approval by the City Council
with one single action. Members of the audience who wouLd Like an item removed from the Consent Calendar for purpose
of public input may request the City Council to remove the item. The request may be made at the time that the Mayor
asks the audience members if there is anyone interested in removing an item from the Consent Calendar.
4.1 Minutes: Regular Meeting of July 26, 1993
STAFF RECOMMENDATION: Approve
4.2 Participation in Alameda County Community Block Grant Program
for the 1994, 1995 & 1996 Program Years
Participation in this program enables the City to use
federal funding for housing rehabilitation and
jurisdictional improvements such as the Swim Center
Bathhouse Renovation.
STAFF RECOMMENDATION: Adopt Resolution.
4.3 1992-93 Alameda County Grand Jury Final Report
The Grand Jury annually issues a report with recommenda-
tions for various governmental entities. Pursuant to State
Law, agencies subject to the reviewing authority of the
Grand Jury must respond to the Presiding Judge of the
Superior Court within 90 days of the issuance of the
report. Those portions of the report which require a
response from the City of Dublin relate to disaster
preparedness and cover the areas of training, mutual aid
and communications equipment.
STAFF RECOMMENDATION: Authorize Mayor to execute response
letter.
4.4 Agreement with Alameda County for Additional Hours of Library
Service
This agreement provides for City of Dublin funding for
13.75 additional hours of library service per week at the
Dublin Branch Library.
STAFF RECOMMENDATION: Adopt Resolution approving Agreement.
4.5 Authorization to Advertise Contract 93-09 for Bids - Dublin
Swim Center Bathhouse Renovation
The plans and specifications for the Swim Center Bathhouse
Renovation have been prepared and are ready for review and
approval by the City Council.
STAFF REcor~~ENDATION: Authorize Staff to advertise for bids.
4.6 Authorization to Solicit Bids for Pervious Concrete Project,
Contract 93-11
As part of the countywide Clean Water Program and local
permitting process which requires the clean up of storm
drain water to the San Francisco Bay, Dublin has applied
for and been given a grant to construct a pilot project to
filter storm water runoff from asphalt surfaces. This
project is proposed for the Shannon community Center
parking lot.
STAFF RECOMMENDATION: Authorize Staff to advertise for bids.
4.7 Contract Change Order for the Dublin Boulevard Extension
Project
This change order encompasses 8 extra work items which were
not included in the original plans & specifications or in
the bid quantities. Since the accumulated change orders
with this one exceeds 5% of the bid price, this change
order must be approved by the city Council.
STAFF RECOMMENDATION: Approve Change Order.
4.8 city Treasurer's Investment Report as of July 31, 1993
The city's Investment Portfolio totals $18,587,135.34.
STAFF RECOMMENDATION: Receive Report.

5. WRITTEN COMMUNICATION
5.1 Request from Bracy H. Elton, Ph.D. to discuss the City's
Smoking Pollution Control Ordinance No. 13-86
A resident of the Amador Lakes apartment complex has
requested that the City Council consider changes to the
City's Smoking Pollution Control Ordinance and expand it to
private residences. Dr. Elton requests that the city place
a higher priority on the need of non-smokers to breathe
smoke-free air.
STAFF RECOMMENDATION: Consider Dr. Elton's concerns and
provide appropriate direction.
5.2 Request from Alameda County Library for city support of SB 566
(Roberti) relating to Library Services Assessments
SB 566 would allow a local agency that provides public
library services to establish a benefit assessment district
by providing notice to affected property owners and
conducting a public hearing. SB 566 is being proposed as
an urgency bill and would take effect immediately upon
enactment.
STAFF RECOMMENDATION: Adopt Resolution in support of SB 566
and direct Staff to send copy to Assemblyman Rainey.
6. PUBLIC HEARING
6.1 Citywide Street Lighting Maintenance Assessment District 83-1
This is the second of two public hearings regarding the
proposed assessment for Fiscal Year 1993-94. This
assessment district funds energy and maintenance costs for
the city's street lighting system. The proposed 1993-94
assessment per single-family home is $19.70.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
adopt Resolution approving Engineer's Report, Confirming
Diagram and Assessment, and ordering levy of assessment.
6.2 Landscaping & Lighting Assessment District 86-1 (Villages @
willow Creek Tract 5511)
This is the second of two public hearings regarding the
proposed assessment for Fiscal Year 1993-94. This
assessment district funds maintenance and utility costs for
certain common landscaping improvements in the Villages @
willow Creek. The proposed 1993-94 assessment is $84.72
per single-family lot and $42.36 per condominium lot.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
adopt Resolution.
6.3 Landscaping & Lighting Assessment District 83-2 (Tract 4719)
This is the second of two public hearings regarding this
assessment district. Based on testimony given at an
informational meeting and the first public hearing, Staff
is recommending approval of the revised "Alternate B"
Engineer's Report.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
adopt Resolution with Alternate A (assessment for maintenance
and utility costs only at $228.72 per single-family home) -OR-
Alternate B (maintenance and utility costs plus funds for
additional planting on interior slopes at $265.36 per single-
family home) .
6.4 Proposed Ordinance Establishing Bus stop on Dougherty Road @
Camp Parks Entrance
LAVTA (Wheels) has requested permission to establish a bus
stop on the east side of Dougherty Road @ Camp Parks'
entrance gate. The City's Municipal Code requires adoption
of an ordinance to establish a bus stop.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
waive reading and INTRODUCE Ordinance.

Dublin Cemetery Operation
The City is currently in the process of acquiring the
Dublin Cemetery. Staff has prepared a report on the
current operation of the Dublin Cemetery and the Council
will determine how future burials should be handled.
STAFF RECOMMENDATION: Direct Staff to prepare a Request for
Proposal for management of burials at the Dublin Cemetery.
8.2 campaign contribution Limitation Ordinance - Request for
Policy Clarification
Dublin's Ordinance states that no person shall, during an
election period, make any contribution to a candidate or
committee which exceeds the cumulative amount of $300
during an election period. The election period is defined
as that period of time beginning July 1st of a November
election year and ending on June 30th following an
election. The code is silent, however, on whether or not
contributions can be received during an off-election year,
and if so, whether Dublin's $300 limit applies or if the
state's $1,000 limit would apply.
STAFF RECOMMENDATION: Provide policy direction in order for
Staff to appropriately administer the provisions of the
campaign Contribution Limitation Ordinance. If Ordinance is
amended, direct staff to schedule a public hearing at a future
Council meeting.
8.3 Tri-Valley Community Televison (CTV) Board of Directors
Request for Prioritization of Services
The CTV Board of Directors is polling the city Councils
from Pleasanton, Dublin, Livermore and San Ramon in order
to obtain information to assist the Board in determining a
programming plan for the upcoming year. The request stems
from a reduced funding level for Fiscal Year 1993-94.
STAFF RECOMMENDATION: Prioritize the CTV programs using the
ranking form which lists 14 current or potential programs.
8.4 Time Frame for Report on Business Commission
The City Council requested that the City Manager prepare a
report regarding the amount of Staff time required to
investigate and prepare a report to the Council on the
concept of forming a Business Commission. Given the recent
reductions in staffing, the city Manager estimates that a
report could be presented to the Council in October.
STAFF RECOMMENDATION: Receive Report.
