The existing facts and circumstances are: Kenneth and Sherry Hill have suggested that it is the City's responsi- bility to take actions to eliminate a sulfur odor which they allege emanates from vents in front of their house. REPORT OF CLOSED SESSION ACTION 1.CALL TO ORDER 2.PLEDGE OF ALLEGIANCE TO THE FLAG 3.ORAL COMMUNICATIONS 3.1Proclamation recognizing Dublin Little League Team "White Sox" on their District Title 3.2Introduction of Desi Reno, Livermore Dublin Disposal General Manager At this time, the public is permitted to address the City Council on non-agendized items. The Council must, however, comply with all State Laws in regard to items not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4.CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1Minutes of Regular Meeting of July 23, 1996 STAFF RECOMMENDATION: Approve 4.2Acceptance of Gift to City The City has received an additional $64 grant from the Northern California Grantmakers for the Junior Aquatic Water Safety Volunteer Program (JAWS). The additional grant money will be used to offset the costs of recognizing the volunteers at the end of the season. STAFF RECOMMENDATION: Accept gift; direct Staff to prepare formal acknowledgment to donor; approve Budget Change Form 4.3Participation in the Alameda County Community Development Block Grant (CDBG) and HOME Program Cooperation Agreements for Fiscal Years 1997, 1998 and 1999 The City Council will consider participating in the Alameda County CDBG and HOME Programs for the next 3 fiscal years. The existing cooperation agreement with Alameda County expires in 1996. STAFF RECOMMENDATION: Adopt Resolution and authorize City Manager to execute agreement 4.4Library Contract Review On an annual basis, contract evaluations are performed on certain City contracts to ensure that the contract service levels are appropriate and continue to be cost effective. Staff has prepared a review of the contract with the County of Alameda for additional library services. The Dublin Library is open to the public 31 hours per week. The County provides funding for 17 hours and the City funds 14 hours. STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute agreement 4.5Informational Report regarding Citizens Option for Public Safety (COPS) Program Under the COPS Program, the City of Dublin will receive a funding allocation from the State of California of approximately $61,000 for the 1996-97 fiscal Year, to be used for supplemental front line municipal police services. This report describes some of the specific requirements and constraints of the COPS program and outlines the process by which local funding is allocated and appropriated for local programs. STAFF RECOMMENDATION: Receive Report 4.6Approval of Agreement with PG&E to perform work under Contract 95-01 Dublin Boulevard Widening An electrical transformer was required to be relocated in front of the Clothestime building on Dublin Boulevard as part of the widening of Dublin Boulevard. Since the transformer was in an easement and not in the public right-of-way, it is the City's responsibility to pay for the cost of relocation. STAFF RECOMMENDATION: Adopt Resolution 4.7Agreement with William Cotton and Associates, Inc., for Geotechnical Services - Dougherty Hills Slope Repair This agreement provides for review of previous, existing and future slope conditions relative to the City's potential litigation with the developer of this area. The agreement provides for costs on a time and materials basis, not to exceed $9,000. STAFF RECOMMENDATION: Adopt Resolution approving agreement 4.8Shannon Community Center Window Replacement Contract 96-05A The Shannon Center Window Replacement project provides for the replacement and installation of 45 windows and 5 bathroom mirrors which were graffiti etched. Three bids were received for the project: Team Glass, Inc. - $11,300; South Valley Glass - $12,887; and Bob Smith Glass & Aluminum - $14,920. STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute agreement with Team Glass, Inc. 4.9Approval of Freeway Agreement with the State of California for the I-580/I-680 Interchange Modifications This agreement will allow Caltrans to connect off and on-ramps from I-680 to Dublin's public streets at Amador Plaza Road and at Village Parkway. STAFF RECOMMENDATION: Adopt Resolution approving Freeway Agreement between the State of California and the City of Dublin and authorize Mayor to execute agreement 4.10Formation of Landscape Maintenance Assessment District 97-1 (Santa Rita Area) This assessment district would fund maintenance and utility costs for public landscaping improvements in the Santa Rita development area. Resolutions proposed to be adopted would approve the preliminary engineer's report, confirm the Council's intention to form the district, and set dates for 2 public hearings. STAFF RECOMMENDATION: Adopt Resolutions 4.11Award of Bid, Contract 96-04, Dougherty Hills Slope Repair This item will award a construction project to Gordon N. Ball, Inc. The project is the landslide repair located in the Dougherty Hills open space. There were 5 bidders for this work. The low bid was below the amount budgeted for the construction. STAFF RECOMMENDATION: Adopt Resolution awarding bid to Gordon N. Ball Inc., for $258,300. 4.12Request for Proposal for Automated Recreation Management System (ARMS) The City's existing recreation registration software has ceased to function reliably and is scheduled for replacement during Fiscal Year 1996-97. This item is to obtain authorization from the City Council to request proposals for a replacement system. STAFF RECOMMENDATION: Authorize Staff to distribute the RFP for an Automated Recreation Management System 4.13Warrant Register ($1,308,752.17) dated August 13, 1996 STAFF RECOMMENDATION: Approve 5.WRITTEN COMMUNICATIONS - None 6.PUBLIC HEARING 6.1A Creative Playschool Modification to Conditional Use Permit Request A Creative Playschool has requested modifications to their CUP which was approved in July of 1995 by the City Council. Modifications would increase the maximum enrollment at the Playschool from 20 to 30 children; permit the installation of two 1 1/2' x 2' identification signs on the house and a vehicle sign on a car to be parked at the site; permit children to play in the rear yard after 8:00 a.m., rather than 9:00 a.m.; and increase the number of children permitted in the rear yard at one time from 10 to 30 children. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution EITHER approving or denying modifications; -OR- give Staff other direction 6.2Alameda County Hazardous Waste Management Plan Zoning Ordinance Amendment PA 96-024 This is the second reading of a Zoning Ordinance Amendment which would adopt definitions, standards and procedures to process conditional use permits for facilities under the Alameda County Hazardous Waste Management Plan, adopt local siting criteria consistent with the County Plan, and amend the M-1 (Light Industrial) and M-2 (Heavy Industrial) zoning districts to allow the location of Small-Scale Transfer and Storage Facilities and Industrial Transfer/Storage Facilities as conditional uses subject to the procedures and siting criteria. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance 6.3Local Regulation of Firearms Dealers The issue of firearms regulation was discussed and continued from the June 25, 1996 City Council meeting, with direction that the City Attorney clarify several issues/definitions. In accordance with Council direction, an ordinance has been drafted which would require a Conditional Use Permit for firearms sales in a residential district and which would require all persons engaged in firearms sales to obtain a permit from the Chief of Police. A second ordinance has been drafted which would require persons selling firearms at retail to obtain a permit from the Chief of Police. STAFF RECOMMENDATION: Conduct public hearing; deliberate; refer Ordinance Amending Zoning Ordinance to Planning Commission; and waive reading and INTRODUCE Ordinance requiring permit - OR - provide other direction to Staff 7.UNFINISHED BUSINESS 7.1Regulation of Junk Guns Councilmember Moffatt requested that Staff provide information regarding the regulation of junk guns (Saturday Night Specials), in response to comments from the public at the July 9th City Council meeting. STAFF RECOMMENDATION: Consider report and provide Staff with direction, if appropriate. 7.2Request from Mr. & Mrs. Hill for aid in solution to hydrogen sulfide odor issue At the June 11th meeting, the City Council requested that Staff meet with the Hills to answer questions regarding their tract development and City policies. This report identifies the responses to the questions. STAFF RECOMMENDATION: Receive Staff Report and comments from the Hills and deny request that the city participate in studies or physical attempts to eliminate the odor 7.3Televising of City Council Meetings In accordance with Council direction, Staff has prepared a report reviewing the options in order to begin televising City Council meetings on CTV 30. The report reviews the use of tripods versus fixed cameras, costs, camera angles, disruption, aesthetics and schedule. STAFF RECOMMENDATION: Provide Staff with direction as to the desired method of televising City Council meetings 8.NEW BUSINESS 8.1Eastern Dublin Comprehensive Stream Restoration Program In compliance with Action Program 6F of the Eastern Dublin Specific Plan and Mitigation Measure 3.7/12.0 of the Eastern Dublin General Plan Amendment/Specific Plan EIR, the City has prepared a comprehensive Stream Corridor Restoration Program for the Eastern Dublin area. STAFF RECOMMENDATION: Adopt Resolution -OR- give Staff direction and continue the matter 2 8.2Building & Safety Contract Services Review - Linhart, Petersen, Powers Associates (LPA) The City of Dublin has utilized the firm of Linhart, Petersen, Powers Associates since July, 1995 to provide building inspection, plan checking and building code enforcement. Their contract is up for annual review. 2 STAFF RECOMMENDATION: Continue to utilize contract arrangement with LPA for Fiscal Year 1996-97. No rate increases are proposed. 8.3Pilot Commercial Recycling Program This item is the second amendment to the Integrated Solid Waste Management Services agreement between Waste Management of Alameda County and the City of Dublin. This amendment will establish a Pilot Commercial Recycling Program using Measure D funds. The purpose of the program is to reduce commercial waste deposited into the landfill to assist the City in meeting AB 939 diversion goals. STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute agreement 8.4Agreement between the Cities of Dublin, Livermore and Pleasanton to develop a Joint Exercise of Powers Agreement for Fire Services In accordance with City Council direction, Staff is continuing to work with the Cities of Pleasanton and Livermore to develop an interim Joint Exercise of Powers Agreement which would provide a framework for the Cities to develop a JPA to provide consolidated fire management of Valley fire operations. Adoption of this interim agreement will enable the City to keep its options open with respect to further evaluation of a 3-city fire JPA in the future. STAFF RECOMMENDATION: Approve Interim Agreement and authorize Mayor to execute; authorize City Manager's continued participation in the development of a Joint Exercise of Powers Agreement for Fire Services; appoint one Councilmember as the City's representative and two Councilmembers as alternates to the Policy Committee to represent the City of Dublin as provided for in the Interim Agreement 8.5Joint meeting with City Council, Heritage Center Advisory Committee, Parks & Community Services Commission and Dublin Historical Preservation Association At the request of Mayor Houston, a special meeting will be scheduled to discuss the direction of the Heritage Center. STAFF RECOMMENDATION: Establish meeting date and time; provide input on potential agenda items; and identify additional agenda items as appropriate 8.6Report on Dougherty Road Weed and Litter Maintenance At the City Council meeting of July 23rd, Ms. Patricia Bias requested a clean up of weeds along Dougherty Road. The Council directed Staff to report back on this request. The weeds have since been removed and alternatives developed for higher levels of service along the road. STAFF RECOMMENDATION: Provide direction to Staff with regard to desired level of service on Dougherty Road 8.7Concerns regarding Temporary and Portable Signs Because of concerns expressed related to the proliferation of temporary and portable signs in the community, Staff was directed to prepare a report for Council review. The City Council will discuss options for enforcement. The current City Council policy established by Resolution No. 104-95, requires that enforcement be done on a complaint only basis and does not provide for any pro-active enforcement on signs.
