3.1 Acceptance of Gifts to City for the Family Sports Fest and Dublin Community Golf
Tournament (150-70)
The City Council will recognize the sponsors and formally accept the contributions for these
community events.
STAFF RECOMMENDATION: Recognize the sponsors and formally accept the contributions.
3.2 Recognition of City Team by the East Bay Bicycle Coalition (585-95)
The East Bay Bicycle Coalition sponsored the Team Bike Challenge that took place this past
May. The "Rec Riders," a team comprised of Staff from the City's Parks and Community
Services Department, accumulated the most points for Alameda County, for which the City
Council would like to join the East Bay Bicycle Coalition in recognizing this noteworthy
accomplishment.
STAFF RECOMMENDATION: Join the East Bay Bicycle Coalition in recognizing the
accomplishment ofthe City ofDuhlin's "Rec Riders" in the Team Bike Challenge.
3.3 Public Comments
At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name
for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take
place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request
Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the
proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take
action on items not appearing on the agenda are contained in Government Code Section 54954.2(b}(1}(2}(3).
4. CONSENT CALENDAR
Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members
of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the
Mayor to remove the item.

4.2 Stage 2 Planned Development Rezone for a 305,000 Square Foot Retail Center on the
Southwest Corner of Martinelli Way and Hacienda Drive, PA 07-019 The Green on Park
Place (410-30/450-30)
The proposed project includes review of the Stage 2 Planned Development Rezone for a
305,000 square foot commercial shopping center known as The Green on Park Place. The
Retail Center consists of twelve individual buildings - most of them oriented around the
projects central public space. A Stage 1 Planned Development Rezone was approved by the
City Council in November 2007.
STAFF RECOMMENDATION: Waive reading and adopt Ordinance Amending the Zoning
Map to Rezone Property to the PD Planned Development Zoning District and Approving a
Related Stage 2 Development Plan for the Green on Park Place Retail Center, P A 07-019.
4.3 Designation of No Parking Zone on Dougherty Road (820-80)
This item seeks City Council approval for a 120-foot no parking zone on the east side of
Dougherty Road north of Sierra Lane. The purpose of this zone is to accommodate a third
travel lane installed as part of the Dougherty Road Improvements - Houston Place to 1-580
CIP project.
STAFF RECOMMENDATION: Adopt Resolution Approving No Parking Zone on Dougherty
Road.
4.4 Acceptance of Improvements Associated with Parcel Map 9185, Dublin Honda (KBH
Investments, LLC) (600-60)
KBH Investments, LLC, recently completed street improvements associated with Parcel Map
9185. The project, known as Dublin Honda, is located on the southeast comer of Dublin
Boulevard and Scarlett Court. The work consisted of on-site improvements, and of off-site
improvements to widen the south side of Dublin Boulevard from Scarlett Court to a point
345 feet easterly along the Dublin Honda frontage. Since the improvements have now been
completed, it is appropriate to accept the improvements and release the bonds that guaranteed
the work.
STAFF RECOMMENDATION: Adopt Resolution for Acceptance of Improvements
Associated with Parcel Map 9185 (KBH Investments, LLC) and Approving Regulatory Traffic
Control Devices.
4.5 Approve Memorandum of Agreement with Alameda County Transportation Improvement
Authority and the UC Berkeley Traffic Safety Center for the Installation, Operation and
Maintenance of an Automated Bicycle Counter (600-40)
The Alameda County Transportation Improvement Authority is partnering with the DC
Berkeley Traffic Safety Center to perform pedestrian and bicycle counts throughout Alameda
County and has requested that Dublin install a bicycle counter on one of the City's bicycle
lanes. The Memorandum of Agreement will formalize the general roles and responsibilities
of the three agencies in the installation, operation and maintenance of the bicycle counter.
STAFF RECOMMENDATION: Adopt Resolution Approving Memorandum of Agreement
Among the Alameda County Transportation Improvement Authority, DC Berkeley Traffic
Safety Center and the City of Dublin for the Installation, Operation and Maintenance of an
Automated Bicycle Counter.
4.6 Approval of Accessibility Exception - Veterinary Specialty Hospital (VSA Dublin) (820-40)
The owner of Veterinary Specialty Hospital is requesting an exception to requirements
necessary to comply with the Americans with Disabilities Act of 1990. The City Council will
consider authorizing the approval of a legal hardship application for this project as the owner
is unable to construct improvements without impacting an adjoining property.
STAFF RECOMMENDATION: Authorize the Public Works Director to sign and approve the
legal hardship application from Mr. Gaudet in accordance with State Regulation CBC, Title 24,
Chapter 11, Section 1127B-Exception #2.

4.7 The City of Dublin and the Tri- Valley Housing Opportunity Center Master Agreement for
Services (600-30)
The City Council will consider approving a resolution adopting the Tri-Valley Housing
Opportunity Center Master Agreement for Services.
STAFF RECOMMENDATION: Adopt Resolution Authorizing an Agreement between the City
of Dublin and the Tri-Valley Housing Opportunity Center and authorize the City Manager to
execute the Agreement.
4.8 Tri-Valley Safety Challenge, Traffic Safety Project (600-50)
The Department of California Highway Patrol (CHP) has obtained funding for the Tri- Valley
Safety Challenge project. This is a collaborative program between CHP and Dublin Police
Services (DPS) aimed at combating traffic safety issues that are common factors in fatal and
injury collisions. The program operational period is August 1, 2008, through December 21,
2008. Per the agreement, CHP would reimburse the City of Dublin for overtime costs
associated with implementing the various operations, up to $12,000.
STAFF RECOMMENDATION: Adopt Resolution Approving Agreement with the Department
of California Highway Patrol for Participation in the Tri-Valley Challenge Traffic Safety Project.
4.9 Agreement to Employ Joni Pattillo as City Manager (600-30)
The City's Agency Negotiation Team is recommending that the City Council approve an
agreement with Joni Pattillo for her employment as City Manager, as of September 2, 2008.
STAFF RECOMMENDATION: Approve and authorize the Mayor to execute the agreement
with Joni Pattillo for Employment as City Manager as recommended by Negotiating Team; and
adopt Resolution Amending the Salary Plan.
4.10 Warrant Register ($4,295,794.52) dated August 19,2008 (300-40)
STAFF RECOMMENDATION: Approve.
5. WRITTEN COMMUNICATIONS None
6. PUBLIC HEARINGS
6.1 Introduction of Ordinance Amending Dublin Municipal Code Chapter 5.100 (Parks and
Recreation Areas) (660-60/920-20)
The City Council has initiated a comprehensive update to certain chapters of the Dublin
Municipal Code (DMC). One chapter proposed for review is DMC Chapter 5.100 which
regulates the use of parks and recreation areas and facilities. The City Council will consider a
number of minor changes intended to clarify the Chapter.
STAFF RECOMMENDATION: Conduct public hearing, deliberate, waive reading and
INTRODUCE Ordinance Amending Chapter 5.100 of the Dublin Municipal Code Relating to
the Regulations of Parks and Recreation Areas.
6.2 Ordinance Adding Chapter 5.116 (Filming) to the Dublin Municipal Code (600-60)
The City Council will consider this first reading of an ordinance adding Chapter 5.116 to the
Dublin Municipal Code relating to Filming.
STAFF RECOMMENDATION: Conduct public hearing, deliberate, waive reading and

7. UNFINISHED BUSINESS
7.1 Amended and Restated Joint Exercise of Powers Agreement with the Livermore/Amador
Valley Transit Authority (LA VTA) (600~40)
The Livermore/Amador Valley Transit Authority ("the Authority") was formed in 1985 by
means of a Joint Exercise of Powers Agreement (JEP A) between the County of Alameda and
the Cities of Dublin, Livermore and Pleasanton. The Agreement provided for the creation of
the Transit Authority as a separate and distinct public entity empowered to own, develop,
operate and administer a public transportation system.
On May 20, 2008, the Dublin City Council adopted a resolution authorizing the execution of
the Amended and Restated JEP A. Subsequent to that action, the Authority has made a
revision to Section 3.11 (b) regarding Route Changes and would like the City Council to
approve the JEP A with the revision.
STAFF RECOMMENDATION: Adopt Resolution Authorizing Execution of the Amended and
Restated Joint Exercise of Power Agreement with the Livermore/Amador Valley Transit
Authority (LA VT A).
7.2 Proposed Resolution Establishing a Temporary Policy for the Rental of Below Market Rate
Ownership Units by Owners Unable to Sell their Units at the Restricted Resale Price
(430-80)
The City Council will consider adopting a resolution on a temporary policy to permit the
rental of for-sale Below Market Rate (BMR) units.
STAFF RECOMMENDATION: Adopt Resolution Establishing a Temporary Policy for the
Rental of Below-Market Rate Ownership Units by Owners Unable to Sell their Units at the
Restricted Resale Price.
7.3 Parks and Community Services Needs Assessment Results (950-10)
The City Council has a high priority objective to conduct an in-depth needs assessment and
opinion survey of the Parks and Community Services Department, and develop a Strategic
Plan for department programs and services. The primary purpose of the needs assessment
was to provide a community based appraisal of the current recreation programs and
recommendations for future programs and services. The City Council will receive a report
summarizing the results of the multi-component needs assessment.
STAFF RECOMMENDATION: Receive Staff report, receive the presentation by National
Research Center, and direct Staff to utilize the results of the Needs Assessment to prepare a Ten-
Year Strategic Plan for Parks and Community Services.
8. NEW BUSINESS
8.1 Dedication of Piazza Sorrento and Devany Square (920-60)
The dedication of Piazza Sorrento and Devany Square will take place on October 4, 2008.
The City Council will receive an update on the event plan.
STAFF RECOMMENDATION: Receive report.
8.2 Dublin Transit Center Art Project (600-30/110-30)
The City Council will be asked to approve an agreement to contract with an Art Consultant to
coordinate the selection of art for the Dublin Transit Center as well as approve the formation
of a Selection Committee to assist with the recommendation of art designs for the project.
STAFF RECOMMENDATION: Adopt Resolution Approving an Agreement with Chandra
Cerrito for Art Consultant Services for the Dublin Transit Center Public Art Project; and
approve formation of an Art Selection Committee and authorize Staff to solicit representatives.

8.3 Presentation of the Livermore Amador Valley Transit Authority's Bus Rapid Transit
(BRT) Project (1060-20)
This presentation will introduce the City Council to the concept of a Bus Rapid Transit (BRT)
project and provide an overview ofthe BRT project that is slated to commence service within
the Tri-Valley in late 2009.
STAFF RECOMMENDATION: Receive the presentation and provide comments as appropriate.
8.4 Designation by City Council of an Ad Hoc Audit Review Committee (110-30)
The independent auditors from the firm of Caporicci and Larson will begin in September
work necessary to complete the Comprehensive Annual Financial Report (CAFR) for the year
ending June 30, 2008. City Council action will establish and Ad Hoc Committee to review
the audit process and final report with the auditors.
STAFF RECOMMENDATION: Confirm the Mayor's recommendation to appoint Vice Mayor
Sbranti and Councilmember Scholz to meet with the City Auditors to review and discuss the
report for the period ending June 30, 2008.
8.5 Request to Initiate a West Dublin BART Specific Plan Amendment Study to Change the
Specific Plan Land Use Designation from Office to Retail/Office and Lodging to Allow for
the Establishment of Retail and Lodging Uses at 7950 Dublin Boulevard (APN 941-1500-
037) (410-55)
The Pegasus Group, on behalf of the Corrie Development Corporation, would like to
withdraw their request that the City Council initiate a West Dublin BART Specific Plan
Amendment Study to change the Specific Plan Land Use Designation for the property at '7950
Dublin Boulevard from "Office" to Retail/Office" and "Lodging" to allow for the future
development of retail commercial and lodging uses. The Applicant has expressed interest in
proceeding with a potential land use amendment as part of the preparation of the Downtown
Dublin Specific Plan.
STAFF RECOMMENDATION: Accept the withdrawal request.
9. OTHER BUSINESS
9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee
Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234).
