CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 Introduction of new personnel - Susan Thomas, Office Assistant H in the Planning Department (File 700-10) 3.2 Observance of Moment of Silence in Memory of Earl Anthony 3.3 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name and address for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting conceming the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Govemment Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENI)AR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes: Special Meeting of July 24 and Special Meeting of August 7, 2001 STAFF RECOMMENDATION: Approve 4.2 Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000 (File 920-90) The Safe neighborhood Parks, Clean Water, Clean air, and Coastal Protection Bond Act of · 2000 was passed by the voters in March 2000, and provided funds for local assistance grants. The City of Dublin qualifies for funding under two of the grant programs funded by the Bond Act; the Per Capita Program and the Roberti-Z'Berg-Harris Program. In order to initiate the grant process, it is necessary for the governing body to submit a resolution indicating the City's intent to apply for funds. STAFF RECOMMENDATION: Adopt Resolution(s). 4.3 Consultant Services Agreement - Bus Shelter Art Project (File 600-30/110-30) The bus Shelter CIP provides for the services of an art consultant. The City Council will consider a contract with art consultant Lynne Baer to manage the process from selection of artwork to final installation. In addition, the Council will consider Staffs recommendation for an Art Selection Committee. STAFF RECOMMENDATION: Approve and authorize Mayor to execute Agreement; approve formation of an Art Selection Committee; and authorize Staffto solicit representatives. 4.10 4.4 Request for authorization to advertise Contract 01-11, City Facilities Lighting Retrofit (Civic Center, Shannon Center, and Fire Station) for Bids (File 600-35) This project would retrofit existing lighting fixtures in three City buildings with bulbs and ballasts that are more energy efficient. The estimated construction cost for the project is $41,860. The payback period for recovering the cost, after PG&E rebate, is estimated at 1.6 years. STAFF RECOMMENDATION: Authorize Staffto advertise for bids. 4.5 License Agreement with Alameda County Transportation Authority (ACTA) for use of City-owned property at Broder Boulevard and Madigan Drive (File 600-40) The proposed License Agreement between the City of Dublin and ACTA allows ACTA to retain their construction trailers for the 1-580/I-680 Direct Connector project on the City's future fire station site at the southwest comer 0fBroder Boulevard and Madigan Drive. The proposed term of the license agreement is from September 17, 2001 to March 1, 2002 at a lease rate of $100 per month. STAFF RECOMMENDATION: Authorize Mayor to execute Agreement. 4.6 Consultant Services for Senior Center Feasibility Study (File 600-30) In May of 2001, City Staff solicited a Request for Proposals for a feasibility study to determine the possibility of reusing the existing Dublin Library building as a Senior Center. The proposed study will examine the program in relationship to the existing structure and determine if the proposed renovation changes can be made to the existing structure in a cost-effective manner. STAFF RECOMMENDATION: Approve and authorize Mayor to execute Agreement with Noll & Tam, Architects ($32,000). 4.7 Legislation (SB 1069) to establish a 50% recycling goal for all plastic containers effective January 1, 2005 (File 660-40) The City has been asked to support SB 1069, establishing a 50% recycling goal for rigid plastic containers. STAFF RECOMMENDATION: Authorize Mayor to execute letter expressing the City's support. 4.8 Award of Bid, Contract 01-05, Shannon Community Center Heating/Ventilating/Air Conditioning (HVAC) Systems (File 600-35) This project will replace 7 existing heating systems at the Shannon Community Center with new energy-efficient HVAC units. Breeze Air Systems, Inc., submitted the low bid of $49,000. STAFF RECOMMENDATION: Adopt Resolution. 4.9 Amendment to Improvement Developer Agreement for Ted Fairfield Park (File 600-60) The City and MSSH Dublin Development are party to an Improvement Developer Agreement for the construction of Ted Fairfield Park. The Park includes the Dublin San Ramon Services District (DSRSD) recycled water pump station and park restroom building. The construction of the DSRSD facility is currently impacting the timely completion of approximately 20% of the park. The Developer has completed the remainder of the park facilities, which include the ball fields, walkways, basketball court, volleyball court, plaza and planting to the satisfaction of City Staff. In order to gain access and use of the park for the residents, Staff is recommending an amendment to the Improvement Developer Agreement. STAFF RECOMMENDATION: Approve and authorize Mayor to execute Amendment to Agreement. Amendment to Agreement with Zumwalt Engineering Group for Engineering Services - Addition of Project Management Assistant Position (File 600-30) This contract amendment would add the position of Project Management Assistant to the existing list of available consultant personnel. STAFF RECOMMENDATION: AdoPt Resolution and authorize Mayor to execute Amendment to Agreement. 4.11 4.12 4.13 4.14 4.15 4.16 4.17 4.18 4.19 Award of Bid, Contract 01-09, 2000-01 Annual Street Overlay Project (File 600-35) This project will repair and resurface various City streets with 1 ~/~" overlay of asphalt concrete. The project also includes median landscaping on Dougherty Road between Sierra Lane and Dublin Boulevard. McGuire & Hester was the low bidder ($1,065,755.54). STAFF RECOMMENDATION: Adopt Resolution. Approval of Summary Vacation for Portions of Public Service Easement (P.S.E.) that encumber lots 14, 15, 38, 39, 45, 58, 59 and 69 of Tract 6957 (Dublin Ranch, Neighborhood L-2) (File 670-40) The City is vacating portions of easements across the side and rear yards of residential lots within Dublin Ranch. STAFF RECOMMENDATION: Adopt Resolution. Approval of Summary Vacation for Portions of Public Service Easement (P.S.E.) that encumber lots 3, 4, 37, 44, 46, 56, 67, 77, 79 and 86 of Tract 6958 (Dublin Ranch, Neighborhood L-3) (File 670-40) The City is vacating portions of easements across the side and rear yards ofi-esidential lots within Dublin Ranch. STAFF RECOMMENDATION: Adopt Resolution. Approval of Summary Vacation for Portions of Public Service Easement (P.S.E.) that encumber lots 9, 10 and 47 of Tract 6959 (Dublin Ranch, Neighborhood L-4) (File 670-40) The City is vacating portions of easements across the side and rear yards of residential lots within Dublin Ranch. STAFF RECOMMENDATION; Adopt Resolution. Recycling Grants (File 810-60) At the Council's request, Staffhas provided a list of recycling grants available to the City, School District, and local businesses through the Alameda County Waste Management Authority and the State of California. STAFF RECOMMENDATION: Receive Report. Change in Council Appointment to Livermore Amador Valley Transit Authority (LAVTA) Board (File 110-30) Mayor Houston has proposed that the City's representation on LAVTA be changed to have Vice Mayor Lockhart and Cm. Zika be the representatives and that he serve as alternate. STAFF RECOMMENDATION: Confirm change in appointment and direct Staffto notify LAVTA. Approval of Final Map for Tract 7181 and Acceptance of In-Lieu Park Dedication Fees (File 600-60) This project is a 60 lot residential subdivision on 4 acres of land located on Dougherty Road at Scarlett Drive. STAFF RECOMMENDATION: Adopt Resolution(s). Contract Agreement with Cotton/Bridges/Associates to prepare the Non-Residential Affordable Housing Fee Study for the City of Dublin (File 600-30) The City Council will consider awarding a contract ($25,000) for the preparation of a Non- Residential Housing Fee Study. STAFF RECOMMENDATION: Adopt Resolution: authorize City Manager to execute Agreement; and direct Staffto return on September 18, 2001 with a recommended list of participants for the Housing Resource Team. Resolution Establishing Rules of Conduct for Meetings of the City Council (File 610-20) In accordance with Council direction, Staff has revised the Resolution establishing rules of conduct for meetings of the City Council to provide that beginning in September, 2001, Closed Sessions will be held at 6:30 p.m., prior to the 7:00 p.m. starting time for City Council meetings. STAFF RECOMMENDATION: Adopt Resolution. 4.20 4.21 4.22 Approval of Letter of Agreement with the Oakland Museum of California for the production and distribution of the Creek and Watershed Map for Pleasanton, Dublin and Vicinity (File 600-30) This map will be used for educational and emergency response purposes. It is proposed to be funded (equally) by Dublin, Pleasanton, Alameda County Flood Control and Zone 7. The map is an element within the National Pollution Discharge Elimination System Program (NPDES) STAFF RECOMMENDATION: Adopt Resolution approving Letter of Agreement. Revisions to the Personnel System related to the position of Assistant City Manager (File 700-20) The City Council will consider amending the City's Classification and Salary Plans to adopt a job description for this new classification approved as part of the City's Fiscal Year 2001-02 Budget. STAFF RECOMMENDATION: Adopt Resolution(s) Warrant Register ($2,608,238.31) dated August 21, 2001 (File 300-40) STAFF RECOMMENDATION: Approve WRITTEN COMMUNICATIONS 5.1 Agreement with Eden Council for Hope and Opportunity (ECHO Housing) and Allied HOusing, Inc., for use of City In-Lieu Funds for Rental Assistance Programs (File 600-30) The Dublin City Council will consider entering into an agreement with ECHO Housing and Allied Housing, Inc.~ for the use o£housing in-lieu funds for FY 2001-01. These funds will be used for implementing and administering rental assistance programs in Dublin. STAFF RECOMMENDATION: Adopt Resolution and authorize the City Manager to execute Agreements with ECHO Housing ($20,000) and with Allied Housing~ Inc. ($36,000) e PUBLIC HEARING 6.1 2001 Local Law Enforcement Block Grant (File 580-40) The Local Law Enforcement Block Grant requires that a public hearing be held regarding recommendations £or the expenditure o£ grant funds. Police Services Staff and the Block Grant Community Advisory Board have met and are recommending the $20~195 funding be used to partially offset the salary ora crime trends officer. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution. 6.2 Tassajara Creek Phase H (Greenbriar Property Residential Development) Development Agreement PA 00-036 (File 600-60) The City Council will consider an Ordinan'ce approving a Development Agreement between the City o£Dublin and GHC Investments LLC £or Greenbriar Homes Communities. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance. 7. UNFINISHED BUSINESS - None Se NEW BUSINESS 8.1 Heritage and Cultural Arts Long-Range Plan (File 910-80) The Heritage & Cultural Arts Commission is recommending approval of the Heritage and Cultural Arts Long-Range Plan. The Plan is the result of a yearlong process and reflects recurrent themes that manifested themselves throughout the information-gathering phase of the process. STAFF RECOMMENDATION: Keview and approve Plan - OK - provide alternate direction. 8.2 Production of 2002 St. Patrick's Day Festival (File 950-40) Bright Moments Event Production, which has produced the past 3 St. Patrick's Day Festivals, has ceased operations. It is proposed that the 2002 Festival be produced in-house Using a combination of staff and specialty contractors. STAFF RECOMMENDATION: Approve concept of producing St. Patrick's Day Festival in- house and direct Staff to prepare an event plan and budget for the Council's approval. e 10. 8.3 Consideration of Energy Feasibility Study (File 1020-40) At the August 7, 2001 City Council meeting, Mayor Houston requested that Staff agendize an Energy Feasibility Study for Council consideration. STAFF RECOMMENDATION: Review the issues described in the Staff Report and provide direction: a) Is the City Council interested in exploring the financial and logistical issues associated with a range of opportunities in the provision of municipal energy services? b) If so, is the City Council specifically interested in evaluating the potential/desirability of soliciting proposals to locate a 49.5 MW generation facility in Dublin or elsewhere to meet the City's current and future energy needs? c) Are there any other energy-related issues the City Council would be interested in exploring? If the Council is interested in a) b) or c), authorize Staffto prepare an RFP to hire an independent energy consultant to assist City Staff in developing an RFP to evaluate the financial and logistical issues associated with those options and appoint a City Council committee to assist Staffin intervieWing consultants.
