ORAL COMMUNICATIONS 3.1 Recognition of Participation in Northern California Lifeguard Games (File # 610-50) In July, several employees from the Dublin Swim Center participated in the 2002 Northern California Lifeguard Games. Thirty-four teams from throughout Northern California attended the competition. The th nd City of Dublin sent two teams that placed 11 and 22 in the overall competition. It should also be noted that Dublin Lifeguards Vincent Garcia and Kerry Pereira finished in fast place for the CPR event. STAFF RECOMMENDATION: Recognize employees who participated and recognize East Bay Pool Service for sponsoring the teams. 3.2 Introduction of new Public Works contract employees: Bob Cantrell, Maintenance Superintendent and John Smither, Building Maintenance Foreman (700-10) 3.3Public Comments 54954.2(b)(1)(2)(3). At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 4. CONSENT CALENDAR Consent Calendar items are tyPically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of August 6, 2002 STAFF RECOMMENDATION: Approve 4.2 Revisions to the Personnel System (File # 700-20) The City Council will consider amending the City's Classification and Salary Plans to adopt a job description for the new Geographic Information System Coordinator classification approved as part of the 2002-03 Budget. STAFF RECOMMENDATION: Adopt Resolution{s). 4.3 Amendment to Agreement for the Temporary Display of Sculpture at the Dublin Civic Center (File # 600-30) The agreement for the artwork "Sisyphus" on loan to the City by Bay Area Artist Roger Berry and located at the Civic Center has expired. In order to extend the loan, an amendment to the agreement is needed. STAFF RECOMMENDATION: Authorize Mayor to execute second Amendment to Agreement. 4.4 Authorization to Advertise for Bids - Dublin Council Chambers Broadcast Lighting and Electrical Modifications (File # 200-30/600-30) The 2002-07 Capital Improvement Program includes the installation of broadcast lighting in the Council Chambers as part of the City Cablecast System project. Plans and specifications have been completed and the project is ready to be bid. STAFF RECOMMENDATION: Authorize Staff to advertise for bids. 4.5 Approval of Final Tract Map 7325, Tract Developer Agreement, Private Street Names and In-Lieu Parkland Dedication Fees for Dublin Ranch Development Area G, Neighborhood MH-2 (Toll-Dublin, LLC) (File # 600-60) This tract is being subdivided for condominium purposes. It contains 26 lots for 281 multi-family units and 47 parcels for common areas. It is located just south of Central Parkway and west of Keegan Street in the Dublin Ranch Area G development. STAFF RECOMMENDATION: Adopt Resolution{s). 4.6 Approval of Final Tract Map 7324, Tract Developer Agreement, Private Street Names, and In-Lieu Parkland Dedication Fees for Dublin Ranch Development Area G, Neighborhood MIt-1 (Toll-Dublin, LLC) (File # 600-60) This tract is being subdivided for condominium purposes. It contains 19 lots for 200 multi-family units and 28 parcels for common areas. It is located just south of Central Parkway and east of Brannigan Street in the Dublin Ranch Area G development. STAFF RECOMMENDATION: Adopt Resolution{s). 4.7 Approval of Final Tract Map 7326, Tract Developer Agreement, Private Street Names, and In-Lieu Parkland Dedication Fees for Dublin Ranch Development Area G, Neighborhood H-1 (Toll-Dublin, LLC) (File # 600-60) This tract is being subdivided for condominium purposes. It contains 13 lots for 289 multi-family units and 9 parcels for common areas. It is located just north of Dublin Boulevard and east of Brannigan Street in the Dublin Ranch Area G development. STAFF RECOMMENDATION: Adopt Resolution(s). 4.8 Preliminary Financial Reports for the Month of July 2002 (File # 330-50) STAFF RECOMMENDATION: Receive Reports. 4.9 Disposal of Property - Unclaimed and Surplus Property (File # 350-40) Staff is requesting that the City Council declare certain items as unclaimed and surplus property and authorize Staff to send the items to Nationwide Auction Systems for auction. STAFF RECOMMENDATION: Adopt Resolution and authorize Staff to proceed with transfer of property to Nationwide Auction Systems pursuant to the current agreement with the City. 4.10 Approval of Amendment to Existing Consulting Engineering Services Agreement with Fehr & Peers Associates, Inc., for FY 2002-03 (File # 600-30) This item requests the City Council to approve an amendment to the current consultant traffic 'engineering services agreement with Fehr & Peers Associates, Inc., to increase the not-to-exceed amount for FY 2002-03 to $125,000 due to anticipated development work remaining for this fiscal year. STAFF RECOMMENDATION: Adopt Resolution and approve Budget Change. 4.11 Dublin Swim Center Roof Replacement Project, Contract 02-13 (File # 600-35) The City received two bids for the Dublin Swim Center Roof Replacement Project. The company providing the lowest bid has requested to withdraw the bid due to an error. The second bid exceeds the improvement budget by over $29,000. STAFF RECOMMENDATION: Adopt Resolution(s) approving the withdrawal of the bid from Western Roofing Services and rejecting the bid from J. D. General, and direct Staff to re- advertise Contract for bids. 4.12 Extension of the Abandoned Vehicle Abatement Program (File # 580-40) Legislation for the current Abandoned Vehicle Abatement Program is set to expire in May 2003. The City of Dublin receives funding from this program to support Staff efforts to abate abandoned vehicles. New legislation allows participating agencies to extend the existing program for 10 years. STAFF RECOMMENDATION: Adopt Resolution authorizing the extension of the Abandoned Vehicle Abatement Program. 4.13 Acceptance of Work, 2001-02 Annual Street Overlay Project, Contract 02-03 (File # 600-35) This project repaired failed pavement and resurfaced various streets with a 1 ½" overlay of asphalt concrete. STAFF RECOMMENDATION: Accept improvements and release $41,288.48 retention after 35 days if there are no subcontractor claims. 4.14 Warrant Register ($7,371,128.24) dated August 20 and September 3, 2002 (File # 300-40) STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS - None 6. PUBLIC HEARING 6.1 Ordinance amending Chapters 5.08, 7.32, 7.36, 7.40 and 7,-44 of the Dublin Municipal Code which adopts by reference and amends the 2000 Edition of the Uniform Fire Code (UFC), the 1997 Edition of the Uniform Building Code (UBC), the 1999 Edition of the National Electrical Code (NEC), the 2000 Editions of the Uniform Plumbing Code (UPC) and the Uniform Mechanical Code (UMC), and amend Chapter 7.28 of the Dublin Municipal Code (Building Regulation Administration) (File # 440-10) Uniform Codes are adopted and published by the California State Building Standards and by the California Department of Housing and Community Development on a 3-year cycle. The provisions of the Ordinance must take effect on November 1, 2002 pursuant to the State of California. STAFF RECOMMENDATION: Conduct public heating; deliberate; adopt Resolution approving Findings of Necessity for Amendments to the 2000 edition of the UFC, 1997 edition of the UBC, the 1999 edition of the NEC, the 2000 editions of the UPC and UMC as recommended by Staff; waive reading and INTRODUCE Ordinance amending Chapters 5.08, 7.32, 7.36, 7.40 and 7.44 of the Dublin Municipal Code which adopts by reference the Uniform Codes. 6.2 Armstrong Garden Center - Specific Plan Amendment, Planned Development Rezoning, Conditional Use Permit, Site Development Review and Sign/Site Development Review PA 02-009 (File # 410-55/410-30) This amendment to the San Ramon Road Specific Plan would allow retail garden centers in conjunction with a Planned Development (PD) Rezoning, Conditional use Permit, Site Development Review and Sign/Site Development Review for an approximate 6,400 square foot retail garden center with approximately 24,410 square foot outdoor storage and landscaped area on 1.162 acres located at 7360 San Ramon Road (northwesterly comer of San Ramon Road and Amador Valley Boulevard). STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution adopting the San Ramon Road Specific Plan Amendment; waive the reading and INTRODUCE the Ordinance approving a Planned Developme. nt Rezoning and Development Plan; and adopt Resolution approving the Conditional Use Permit, Site Development Review and Sign/Site Development Review. 6.3 Consideration of Urgency Ordinance Establishing a Moratorium in Scarlett Court Area (File # 410-20) Thc City Council continued this item from the August 6, 2002 meeting and directed Staffto evaluate additional alternatives to the proposed moratorium. The Council will consider three alternatives to: 1) Modify Zoning Ordinance to require CUPs; 2) Prohibit certain use types; or 3) Limit modifications of properties over 2.5 acres. STAFF RECOMMENDATION: Conduct public hearing; deliberate; determine if ministerial and discretionary actions could negatively impact the outcome of thc desired SP; and a) if thc scope and exceptions proposed in draft Ordinance are determined to be appropriate, waive the reading and on an urgency basis, ADOPT Ordinance which will impose a moratorium on any ministerial and discretionary actions (subject to the exceptions listed in thc Agenda Statement); - OR - b) if the scope and exceptions proposed by Staff are not appropriate, then provide direction to Staff on the 4 remaining options listed in the Agenda Statement. 6.4 Amendments to the Smoking Pollution Control Ordinance (File # 560-90) The purpose of this Ordinance is to bring the existing provisions of Chapter 5.56 of thc Dublin Municipal Code regulating smoking into conformity with recent changes in state law and to add additional permissible restrictions on smoking in enclosed and unenclosed public places and places of employment. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance. 7. UNFINISHED BUSINESS 7.1 Conceptual Design for Intersection improvements at Village Parkway and Lewis Avenue (Downtown Streetscape Improvement Implementation Plan) (File # 820-20) This report addresses the conceptual design for thc intersection improvements at Village Parkway and Lewis Avenue. Staff is requesting approval by thc City Council for the Conceptual Design for the improvement project to begin preparation of construction and bid documents. STAFF RECOMMENDATION: Approve Conceptual Design for Intersection Improvements and authorize preparation of construction/bid documents. 7.2 Civic Center Library Modular Furnitnre Bid Award (File # 600-30/350-20) One bid was received from Advanced Installation Services ($294,703.73) for the Library Modular Furniture bid package. The package consists of the workstations, filing systems, shelving, etc., for the library's staff areas and public spaces. Additional funding in the amount of $26,129.73 is needed to award the bid.. STAFF RECOMMENDATION: Adopt Resolution and approve Budget Change. 7.3 Selection of Consultant for the Fiscal Analysis of the proposed IKEA (File # 600-30) The City Council will consider selection of a fiscal and economic consultant to evaluate the fiscal and economic impacts from the proposed IKEA home store. STAFF RECOMMENDATION: Adopt Resolution selecting Economic and Planning Systems, Inc., for Fiscal Analysis and authorize Mayor to execute agreement in an amount not to exceed $29,760. 7.4 Senior Housing Proposals Update (File # 430-10) The City Council will discuss and determine the appropriate process to be used in the selection of a developer to provide Senior Housing at 7606 Amador Valley Boulevard. STAFF RECOMMENDATION: Receive report and determine the preferred option for selecting the Developer. 8. NEW BUSINESS 8.1 Initiation of a General Plan (GP) and Eastern Dublin Specific Plan Amendment (EDSPA) Study for the Eastern Dublin Properties Project Area (File # 420-30) A GP and EDSPA study is requested for the Eastern Dublin Properties project area to address several issues, including: 1) Land use map consistency between project area boundaries, Specific Plan Land Use Map boundaries, and the GP Eastern Extended Planning Area Land Use Map; 2) clarifying Livermore Airport Protection Area requirements; and 3) studying land use changes that will likely result from the findings o£the Resource Management Plan. STAFF RECOMMENDATION: Adopt Resolution either approving or denying request. 8.2 Agreement for Maintenance and Operation of the Dublin Library (File # 600-40) Construction of the new Dublin Library is underway and the library is scheduled to open in January 2003. Upon completion, the City will own the library building and related improvements and the Alameda County Library will operate library-related activities in the building and provide equipment related to the general operation of the library. The City Council will review the agreement that outlines the responsibilities of both the City and the County in the maintenance and operation of the library. STAFF RECOMMENDATION: Authorize Mayor to execute Agreement. 8.3 Parks & Recreation Master Plan Update (File # 600-30/920-30) The 2002-07 Capital Improvement Program includes a project to update the 1994 Parks & Recreation Master Plan. Staff solicited proposals from architectural and planning consultants to prepare the master plan update and recommends entering into an agreement with Singer Fukushima Evans, Inc. STAFF RECOMMENDATION: Authorize Mayor to execute Agreement and approve Budget Change. 8.4 Public Art for Senior Center (File # 900-50/240-30) The City Council will consider the process for selecting the artist for the Senior Center Public Art component. As proposed, this will consist of appointing an Artist Selection Committee, identifying locations and parameters for the art in/at the new Senior Center and a Request for Qualifications to the artist community. STAFF RECOMMENDATION: Approve formation of a Selection Committee and authorize Staff to solicit representatives and authorize Staff to proceed with Request for Qualifications to artist community. 8.5 Revisions to Parks & Community Services Commission Bylaws and Rules of Procedure (File # 610-20) The City Council will consider a revision to the Bylaws and Rules of Procedure pertaining to the election of officers for the Parks & Community Services COmmission. STAFF RECOMMENDATION: Adopt Resolution. 8.6 Approval of Master Project Funding Agreement with Alameda County Transportation Improvement Authority for ACTIA Project No. 9 - Iron Horse Bicycle, Pedestrian and Transit Route Proje/:t (File # 600-40/1060-90) This project would construct a four-lane roadway along the abandoned railroad right-of-way between Dougherty Road and Dublin Boulevard, would facilitate transit service (bus) in this corridor, and woUld relocate and enhance the Iron Home Trail. STAFF RECOMMENDATION: Adopt Resolution. 8.7 Ceremony Commemorating One-Year Anniversary of 9/11/01 (File # 610-50) The City will hold a commemorative event on September 11, 2002 in front of the Civic Center at the Flag Poles. The program will be highlighted by a flag ceremony during which time the Alameda County Fire Department Color Guard will retire the World Trade Center flag which was presented as a gift to the City by FDNY Firefighter Richard Dore, for placement in the time capsule. The program will also feature songs, poetry and inspirational readings by several young people in our community, as well as commentary by Mayor Lockhart, ACFD Chief William McCammon and Parks RFTA Commander DawnLee DeYoung. STAFF RECOMMENDATION: Receive Report and provide input as appropriate. 8.8 Update on Pending Changes to the City's Stormwater Permit under the Alameda Countywide Clean Water Program (File # 1000-20) This report outlines thc key elements of thc proposed changes to thc National Pollutant Discharge Elimination SYstem (NPDES) permit. The NPDES permit is issued to thc Alameda Countywide Clean Water Program (ACCWP), which is a consortium of 17 public agencies, which the City of Dublin is a member agency. Thc most significant permit changes are in the area of new development and redevelopment. STAFF RECOMMENDATION: Authorize Mayor to sign letter to Regional Water Quality ~ Control Board outlining City's concerns. 9.
