ANTICIPATED LITIGATION Government Code Section 54956.9(b)(1) Facts and Circumstances: Government Code Section 54956.9(b)(3)(B) East Dublin Properties Stage I Development Plan, Annexation and Draft Supplemental Environmental Impact Report 2. EXISTING LITIGATION Government Code Section 54956.9(a) Name of Case: City of Dublin v. Dublin Land Company, Alameda Superior Court No. V-018100-2 3. ANTICIPATED LITIGATION Initiation of litigation pursuant to Government Code Section 54956.9(c) One potential case. 1. CALL TO ORDER & PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT OF CLOSED SESSION ACTION 3. ORAL COMMUNICATIONS 3.1 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULB NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made er questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2{b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes: NONE 4.2 Request for Award of Bid for One (1) Replacement Unmarked Police Vehicle (File 350-20) On August 7, 2001, the City Council authorized Staff to distribute bid requests for one (1) replacement unmarked vehicle. Two responses were received, for four vehicles, by the deadline. Based upon evaluation of the vehicles available, Staff recommends purchase of the 2000 Ford Taurus SES - Silver, offered by Hayward Ford, Inc. in the mount of $15,250. $13,549 currently exists in the Internal Service Fund for replacement of the vehicle. Staff is requesting additional funding in the amount of $2,500. for purchase of the vehicle and installation of existing undercover emergency equipment. STAFF RECOMMENDATION: Adopt Resolution and approved Budget Change. a 4.3 Financial Reports for the Month of July 2001 (File 330-50) STAFF RECOMMENDATION: Receive Reports. 4.4 2001-2002 Goals & Objectives Status Report (File 100-80) Staff has prepared a report apprising the Council of the status of the 2001-2002 Goals & Objectives as of July 31, 2001. STAFF RECOMMENDATION: Receive Report. 4.5 Warrant Register ($1,022,279.04) dated September 4, 2001 (File 300-40) STAFF RECOMMENDATION: Approve WRITTEN COMMUNICATIONS 5.1 Request from Bay Area Alliance for Sustainable Development to Give a Presentation to the City Council on the Draft Compact for a Sustainable Bay Area (File 420-50) The City Council will determine if they want to receive a presentation on the Draft Compact for a Sustainable Bay Area prepared by the Bay Area Alliance for Sustainable Development. STAFF RECOMMENDATION: Consider request and provide appropriate direction to Staff. PUBLIC HEARING 6.1 Tassajara Creek Phase II (Greenbriar Property Residential Development) Development Agreement PA 00-36 (File 600-60) This is the second reading of an Ordinance approving a Development Agreement between the City of Dublin and GHC Investments LLC for Greenbriar Homes Communities. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. UNFINISHED BUSINESS None NEW BUSINESS 8.1 Ted Fairfield Park Dedication (File 920-60) Ted Fairfield Park is the City's newest neighborhood park and is located in the Dublin Ranch Development on North Dublin Ranch Road between Antone Way and Oak Bluff Lane. The City Council will consider the proposed event components for the park dedication, which will take place in the fall. STAFF RECOMMENDATION: Provide direction to Staff.
