ORAL COMMUNICATIONS 3.1 Ready Set Recycle Contest Report (810-60) The City Council will receive a report on the Ready, Set, Recycle Contest. The contest was for single family residences and rewarded the residents with the least amount of recyclable and compostable materials in their garbage cart. STAFF RECOMMENDATION: Receive the report and formally recognize the contest winner. 3.2 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearfy state your name for the recortl, COMMENTS SHOULD NOT EXCEED THREE !31 MINUTES. In accordance with State Law, no action or discussion may take piace on any item not appearing on the posted agenda, The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of August 17, 2010 STAFF RECOMMENDATION: Approve minutes. 4.2 Sierra Trinity Busine~s Park Planned Development Rezone - Amendments to Planned Development (PD) Zoning District (PA 85-032) to Modify the Allowable Uses within the Zoning District, PLPA-2010-00023 (450-30) The City Council will hold a second reading of City-initiated amendments to the Sierra Trinity Business Park Planned Development (PD) zoning. The proposed amendments would expand the allowable uses on the site consistent with the M-P (Industrial Park) Zoning District. STAFF RECOMMENDATION: Waive the reading and adopt Ordinance Approving a PD (Planned Development) Rezone and Related Stage 1/Stage 2 Development Plan for the Sierra Trinity Business Park located at 6701 Sierra Court (APN 941-0205-001-46), PLPA-2010-00023. 4.3 Award of Bid - Contract No. 10-05, 2010 Annual Slurry Seal Program (600-35) The Annual Slurry Seal Program (CIP No. 969202) will resurface several City streets with a slurry seal that will prolong the life of the existing pavement surface. As streets begin showing wear and stress cracking, it is important to seal the cracks to keep water from getting under the roadway pavement. STAFF RECOMMENDATION: Adopt Resolution Awarding Contract No. 10-05, 2010 Annual Slurry Seal Program, to Valley Slurry Seal. 4.4 Annual Review of City Investment Policy and Delegation of Authority to Complete Investment Transactions (320-30) The adopted Investment Policy for the City of Dublin includes a provision for an annual review of the policy to be presented at a public meeting. The City Council is also required to annually designate positions authorized to complete investment transactions. As part of the review Staff is recommending a minor clarification to the section addressing reporting. In accordance with State Law the City Council can only delegate for a one year period the responsibility to complete investment transactions. The City Council has authorized in the past the City Treasurer (Administrative Services Director) and Deputy City Treasurers (City Manager and / or Finance Manager). STAFF RECOMMENDATION: Adopt Resolution Adopting the 2010 Annual Review of Investment Policy and Delegation of Authority to Complete Investment Transactions. 4.5 Governor Veto Request for AB 155 - Municipal Bankruptcy Bill (660-40) The City Council will consider authorizing the Mayor to send a letter, on behalf of the City Council, to Governor Schwarzenegger requesting his veto of AB 155 (Mendoza), the Municipal Bankruptcy Bill. STAFF RECOMMENDATION: Authorize the Mayor to send a letter, on behalf of the City Council, to Governor Schwarzenegger requesting a veto of AB 155. 4.6 Approval of Agreement for Local Agency Participation in Grant-Funded Bay Area-Wide Trash Capture Demonstration Project with Association of Bay Area Governments (600-40) The City of Dublin is eligible for funding through the Association of Bay Area Governments (ABAG) for the cost of both purchase and installation of storm drain trash-capture devices. City Council approval of an Agreement for Local Agency Participation in Grant-Funded Bay Area-wide Trash Capture Demonstration Project with ABAG is required in order for the City to receive any funding. STAFF RECOMMENDATION: Adopt Resolution Approving Agreement for Local Agency Participation in Grant-Funded Bay Area-Wide Trash Capture Demonstration Project with the Association of Bay Area Governments. September 7, 2010 Dublin City Council Agenda Page 2 of 4 4.7 Resolution of Local Support - Surface Transportation Program (STP) and Congestion Mitigation and Air Quality (CMAQ) Funding (600-50) The City of Dublin has applied for a Surface Transportation Program and Congestion Mitigation and Air Quality grant from the Congestion Management Agency (CMA). If the City is awarded the grant, the funds will be used for the resurfacing of Silvergate Drive between San Ramon Road and Dublin Boulevard, Clark Avenue between Village Parkway and Maple Drive, and Tassajara Road between the northern City limits and Shadow Hill Drive. This work would be incorporated as additional work in the Fiscal Year 2011-2012 Annual Overlay Project (CIP #969103). STAFF RECOMMENDATION: Adopt Resolution regarding Local Support Authorizing the Filing of an Application for Federal Surface Transportation Program (STP) andlor Congestion Mitigation and Air Quality Improvement (CMAQ) Funding and Committing the Necessary Non- Federal Match and Stating the Assurance to Complete the Project; and authorize Staff to incorporate the project costs and funding in a future update to the Five Year Capital Improvement Program provided the City is awarded the grant. 4.8 Check Issuance Reports and Electronic Funds Transfers (300-40) STAFF RECOMMENDATION: Review and authorize the issuance of payments. 5. WRITTEN COMMUNICATIONS - None. 6. PUBLIC HEARINGS 6.1 Fallon Gateway Commercial Center, Development Agreement for Fallon Gateway, PA 08-034 (600-60) The Fallon Gateway Project is a commercial center which includes 379,053 square feet of retail development, with the first three phases totaling 311,553 square feet of development. The project site is located at the southwest corner of Dublin Boulevard and Fallon Road. The item before the City Council for approval is the Project Development Agreement. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive the reading and INTRODUCE an Ordinance Approving a Development Agreement for Fallon Gateway between the City of Dublin and Stanforth Holding Company. L.L.C., APN: 985-0027-009-03, PA 08- 034. 7. UNFINISHED BUSINESS 7.1 Adoption of Resolution Approving a Policy Statement by the County of Alameda and the Cities of Dublin, Livermore and Pleasanton Regarding Transportation Priorities and Commitments in the Tri-Valley Area (1060-40) The Policy Statement creates a regional framework for the construction of local arterial roadways and support for regional improvements. The document describes a policy approach for relieving traffic congestion in the Tri-Valley by prioritizing improvements to I-580, I-680 and State Route 84, and requiring the phased completion of a regional arterial network that includes Dublin Boulevard in the City of Dublin, Jack London Boulevard in the City of Livermore, and North Canyons Parkway in the City of Livermore and Alameda County, and Stoneridge Drive in the City of Pleasanton. This item seeks City Council adoption of a Resolution approving the Policy Statement. STAFF RECOMMENDATION: Adopt Resolution Approving the Policy Statement by the County of Alameda and the Cities of Dublin, Livermore and Pleasanton regarding Transportation Priorities and Commitments in the Tri-Valley; and authorizing the Mayor to sign said Policy Statement. NEW BUSINESS 8.1 Report on Dublin's Creek Cleanup Day 2010 Activities (530-20) The City Council will receive a report on the planned activities for the Creek Cleanup Day, scheduled for Saturday, September 25, 2010. STAFF RECOMMENDATION: Receive the Creek Cleanup Day 2010 activities report. 8.2 Commercial Recycling Template Plan (810-60) The template plan encourages Dublin's commercial businesses to take the initiative in developing a recycling program and to incorporate waste reduction into their daily routine. The aim of this template plan is to give commercial businesses a resource to implement their own recycling program. With this plan as a resource, commercial businesses can create a successful recycling program by following an outlined step-by-step process. STAFF RECOMMENDATION: Approve the template plan. 8.3 Consideration of Cancellation of Specific City Council Meetings (610-20) The City Council will consider the cancellation of specific City Council meetings in 2011, and every year thereafter, until determined otherwise. STAFF RECOMMENDATION: Direct Staff to cancel the first City Council meeting in January, July and August of 2011 and every year thereafter, until determined otherwise; or provide Staff alternate direction. 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
