REGULAR MEETING - September 9, 1991 DUBLIN CIVIC CENTER

A complete packet of information containing all Staff Reports and exhibits related to each agenda item is available
for public information and perusal several days prior to a Council meeting at the Dublin Library and also in the
City Clerk's Office at the Civic Center.

3. ORAL COMMUNICATIONS
3.1 Proclamation Declaring September 22-28, 1991 as "California
Rideshare Week"
At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City
Counci l Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to
address their concern, that person should arrange with the City Clerk to have their particular concern placed on the
agenda for a future meeting. The City Council CANNOT deliberate or take action on a non-agenda item UNLESS there is
factual evidence presented to the Counci l indicating that the subject brought up falls into one of the exceptions
under Government Code Section 54954.2.
4. CONSENT CALENDAR
Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council
with one single action. Members of the audience who would like an item removed from the Consent Calendar for purpose
of public input may request the City Council to remove the item. The request may be made at the time that the Mayor
asks the audience members if there is anyone interested in removing an item from the Consent Calendar.

STAFF RECOMMENDATION: Approve
4.2 Award of Bid - Downtown Promotional Banners
The City Council included the addition of a Fall Season
banner in its 1991 Goals & Objectives, as well as funding
in the 1991-92 Capital Improvement Program. The acceptance
of this bid for banners will purchase those authorized
banners.
STAFF RECOMMENDATION: Adopt Resolution rejecting bids from
Kelley Display and Vaughn Display and awarding purchase order
for December, Fall, and st. Patrick's Day banners to Sierra
Display ($11,383.86) and purchase order for Flag banners
($1,480.00) to Street Scenes.

4.5 Award of Bid Contract 91-03A - Construction of Irrigation Well
@ Shannon Park
Award of this contract will allow a well to be installed
near Shannon Park for irrigation of the Shannon Park
landscaping. The well, if successful, would pay for itself
in approximately 4 - 5 years and has the additional benefit
of reducing the demand on DSRSD potable water services
during drought conditions.
STAFF RECOMMENDATION: Adopt Resolution rejecting bid from
Maggiora Brothers Drilling, Inc., and awarding bid to A.S.E.
Drilling, Inc., and authorize the Mayor to execute Agreement.
4.6 Status of Congestion Management Program (CMP)
The Congestion Management Program is a requirement as a
part of the new gas tax funding from Proposition 111. The
program sets a number of transportation monitoring and trip
reduction guidelines. This report provides an update on
the status of the program to date.
STAFF RECOMMENDATION: Accept report; direct Staff to transmit
the recommendation to add projects to the RTIP candidate
projects of a) 1-580/1-680, Measure B project, including the
hook ramps near Dublin Boulevard; b) BART access road parallel
to Dublin Boulevard; and c) Dublin Boulevard widening-San
Ramon Road to Village Parkway.

6. PUBLIC HEARING
6.1 Dougherty Regional Fire Authority Rezone Request @ 7494
Donohue Dr and a Portion of Parcel @ 7601 Amador Valley Blvd
This is the second reading of an Ordinance to rezone two
parcels to the C-1, Retail Business District. The two
parcels will subsequently be combined to provide a building
site for the relocation and rebuilding of DRFA Fire station
#1. The C-1 District allows the establishment of a
community facility, a fire station, with approval of a
Conditional Use Permit. On August 26, 1991, the City
Council adopted Resolutions approving PA91-042 DRFA General
Plan Amendment and CUP and introduced the Ordinance
approving the rezone request.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
waive reading and ADOPT Ordinance.
6.2 General Plan Amendment to Revise the Housing Element
This General Plan Amendment would allow fees to be paid in-
lieu of the Housing Element Policy which requires a
percentage of units in large multi-family projects to be
rented for a specified period of time.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
adopt Resolution certifying the Negative Declaration for GPA
91-001; adopt Resolution approving GPA to revise Strategy
III.E of the Housing Element.
6.3 Rental Availability Ordinance
This Ordinance would allow fees to be paid in-lieu of a
requirement to rent a percentage of units in large multi-
family projects for a specified time period.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
waive reading and INTRODUCE Rental Availability Ordinance.
6.4 JL Construction Planned Development Rezoning of Dublin Meadows
- Appeal of Planning Commission Denial
This Planned Development Rezoning would amend Dublin
Meadows' conditions to allow payment of a fee in-lieu of
maintaining 10% (21) of the multi-family units as rental
units for 5 years. The Planning Commission denied the
request on August 5, 1991, and the Applicant is now
appealing this decision to the City Council.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
introduce Ordinance amending the Zoning Ordinance to permit
the PD Rezoning to amend Condition #54 of Resolution No. 32-89
to allow the option of paying an in-lieu rental fee rather
than providing rental units -OR- adopt Resolution denying JL
Construction Planned Development Rezoning.
6.5 Density Bonus Ordinance
This Ordinance would allow density bonuses and other
incentives to developers providing housing for very low and
lower income households and for senior citizens as required
by state Law.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
waive reading and INTRODUCE Ordinance.
7. UNFINISHED BUSINESS
7.1 Fireworks Report
As a result of concerns expressed by a citizen at the
July 8, 1991 Council meeting, Staff was directed to prepare
a report related to fireworks activities and agendize the
topic for future discussion.
