PLEDGE OF ALLEGIANCE TO THE FLAG DUBLIN LIBRARY Meeting Room 3. ORAL COMMUNICATIONS At this time, mernbers ot the audience are permitted to address the City Council on any item which is not on the City Council Agenda. Comments should not exceed 5 minutes. It any person feels that this is not sufficient time to address their concern, that person should arrange with the City Manager to have their particular concern placed on the agenda for a future meeting. 3.1 Presentation of "Pedestrian Safety Award", by Dan Downey, District Manager of California State Automobile Association 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public input may request the City Council to remove the item from the consent calendar. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes of Regular Meeting of August 22, 1988 STAFF RECOMMENDATION: Approve 4.2 Resolution Supporting State Bond Measure for Library Construction This State bond measure, on the November, 1988 ballot, would provide funds for library construction and renovation. STAFF RECOMMENDATION: ~dopt Resolution 4.3 Award of Bid - Street Sweeping The low bid of $50,915.76 was received from Marc Sweeping Service dba American Environmental Industries. This bid is within the amount budgeted for Fiscal Year 1988-89. STAFF RECOMMENDATION: Adopt Resolution awarding bid to Marc Sweeping Service dba American Environmental Industries and authorize Mayor to execute agreement. 4.4 City Treasurer's Investment Report for period ending August 31, 1988 STAFF RECOMMENDATION: Approve 4.5 Claim received on July 20, 1988 from Pacific Bell This claim alleges that an underground cable was damaged during construction in the area of Alamo Creek Park, which is being developed under the auspices of a Park Development Agreement between the City and Rafanelli & Nahas (Developer). The Developer is required to indemnify the City from liability or damages arising from the construction of the improvements. STAFF RECOMMENDATION: Deny the claim and direct Staff to notify the claimant and the City's Insurance Provider. 4..6 Agreement between the City of Dublin and Alameda County Transportation Authority regarding 1-580/1-680 Interchange Modifications This agreement covers the first phase improvements to the 1-580/1-680 interchange. These improvements include the widening of the ramp connecting westbound 1-580 traffic to northbound 1-680 traffic. Total estimated cost is $2,054,000. The Cities of Dublin, Pleasanton and Livermore have agreed to fund the same amount (approximately $111,667), and Alameda County has agreed to a maximum participation of $45,000. STAFF RECOMMENDATION: Approve Agreement and authorize Mayor to execute same. 4.7 City Manager's Employment Agreement Following the City Council's review of the City Manager's performance, an agreement has been drafted which modifies the City Manager's compensation and fringe benefits. STAFF RECOMMENDATION: Approve agreement and authorize Mayor to execute same. 4.8 NFL Expansion The Mayor of the City of Oakland has requested that the City of Dublin adopt a resolution supporting a National football League Team for the Oakland-Alameda County Coliseum. STAFF RECOMMENDATION: Adopt Resolution 4.9 Acceptance of Improvements - Tract 5511 Villages ~ Willow Creek (Rafanelli & Nahas Subdivision Agreement) Improvements in Tract 5511 have been inspected by the City Engineer and determined to be complete. STAFF KECOMMENDATION: Adopt Resolution accepting work as complete and authorize Staff to accept maintenance bond at a future date. 4.10 Private Vehicle Accessway Easement - Village VII (Woodlands) Villages @ Willow Creek Conditions of Approval for Village VII of the Villages @ Willow Creek require the Developer to submit an agreement which will allow the City to maintain improvements within the tract, should the homeowner's association fail to do so. STAFF RECOMMENDATIUN: Adopt Resolution approving private vehicle accessway agreement and authorize Mayor to execute same. 4.11 Warrant Register dated September 12, 1988 STAFF RECOMMENDATION: Approve 4.12 Abandonment of Parcel A of Tract 4991 Parcel A of Tract 4991 was originally offered for dedication as the City was not sure of the location of the street connection between Creekside Drive and the Dolan School site. The street now has been established (Iglesia Drive), and the City has no further interest in retaining Parcel A. STAFF RECOMMENDATION: Adopt Resolution of intention to vacate a public street and setting a public hearing date of October 10, 1988. 4.13 Authorization for Survey - Dublin Boulevard Extension through Camp Parks This survey is part of a property transfer agreement (under negotiation), between the City, the County, the Army, and the East Bay Regional Park District. STAFF RECOMMENDATION: Authorize the transfer of $5,000 from unallocated reserves for the property survey necessary to establish the alignment of the extension of Dublin Boulevard through the Camp Parks property. 4.14 Acceptance of Work - Contract No. 87-6 - Kolb Park Improvements Improvements constructed under Contract 87-6 have been reviewed by the City Engineer and determined to be complete and in accordance with the approved plans and specifications. STAFF RECOMMENDATION: Accept improvements under Contract 87-6; authorize retention payment in the amount of $33,057.47 to Valley Crest Landscape, Inc.; approve the appropriation of $3,115.63 from unallocated reserves for the 1988-89 Fiscal Year for this project. 5. WRITTEN COMMUNICATIONS 5.1 Lopez/MacDonald request for City Council to initiate Zoning Ordinance Amendment Mr. Peter MacDonald, representing Mr. Henry Lopez, is requesting the City Council to initiate an amendment to the Zoning Ordinance regarding yard modifications for specified existing uses. Issues include: intent of yard requirements; date of completion; lack of inspections; compliance with current building codes; and avoiding property taxes. STAFF RECOMMENDATION: Hear Staff and Applicant presentations; Deny request -OR- give Staff and Applicant direction and adopt Resolution initiating amendment. 5.2 Appointment of Tri-Valley Community Television Corporation Board Representatives The City has been advised that the terrns of the City of Dublin's representatives to the Television Corporation Board of Directors will soon expire. Councilmember Hegarty's term will expire in September, 1988, and Claudia McCormick's term will expire in October, 1988. STAFF RECOMMENDATION: Make appointments to Tri-Valley Community Television Corporation Board. 6. PUBLIC HEARING 6.1 Establishment of Right-of-Way Lines for a new road parallel to and southerly of Dublin Boulevard (between Amador Plaza Road and Regional Street) This item was continued from the August 8, 1988 City Council meeting to allow Staff to further analyze the potential traffic impact. Staff has analyzed a proposal made by several property owners. Staff supports Alternative 1 as the right-of-way alignment for the new parallel roaG. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt resolution adopting Mitigated Negative Declaration; enter names of any additional persons protesting; waive reading and INTRODUCE ordinance establishing right-of-way lines. 6.2 Limited Parking at 6398 Dougherty Road The owner of Pack & Ship at 6398 Dougherty Road has requested a limited parking zone in front of his business. This proposed ordinance would establish a 20-minute parking zone for approximately 8 vehicles. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT ordinance. 6.3 Sign Ordinance Amendments, Second Freestanding Signs (PA 88-055) and Service Station Price Signs (PA 88-056) This Ordinance, which was introduced at the August 22, 1988 Council meeting amends the City's Sign Ordinance relating to 1) Service Station Price Signs; 2) Second Freestanding Signs; 3) Clarification of allowable aggregate sign area, middle 1/3 of street frontage, sign area, alternate types of freestanding signs, variance findings, identification sign, directional tract signs; and 4) reformating to enhance readability. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 7. UNFINISHED BUSINESS - None 8. NEW BUSINESS - None 9. OTHER BUSINESS 10.
