HomeMy WebLinkAbout*CC Agenda 09-13-1993 AGENDA DUBLIN CITY COUNCIL REGULAR MEETING - September 13, 1993 DUBLIN CIVIC CENTER Monday - 7:30 p.m. 100 CIVIC PLAZA A complete packet of information containing all Staff Reports and exhibits related to each agenda item is available for public information and perusal several days prior to a Council meeting in the City Clerk's Office and also at the Dublin Library. 1. CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG COMMUNICATIONS September Customer Director At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City Council Agenda. Cooments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Clerk to have their particular concern placed on the agenda for a future meeting. The City Council CANNOT deliberate or take action on a non-agenda item UNLESS there is factual evidence presented to the Council indicating that the subject brought up falls into one of the exceptions under Government Code Section 54954.2. 3. ORAL 3.1 Service Award to Diane Lowart, Recreation 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approvaL by the City Council with one single action. Members of the audience who would like an item removed from the Consent Calendar for purpose of public input may request the City Council to remove the item. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes: Regular Meeting of August 23, 1993 STAFF RECOMMENDATION: Approve 4.2 city Treasurer's Investment Report as of August 31, 1993 The City's investment portfolio totals $17,736,994.12. STAFF RECOMMENDATION: Receive Report. 4.3 Annual Report of Developer Deposits Held for Construction of Public Improvements: Pursuant to Government Code Section 66001 (AB 1600) State Law authorized a city to require development applicants to contribute fees toward off-site improvements which are needed as a result of new development. For fees collected more than 5 years ago, certain findings must be made by the city Council, or the fees are forfeited. The balance in this account as of June 30th is $101,548.46. STAFF RECOMMENDATION: Receive Report. 4.4 Award of Bid - Pervious Concrete Project, Contract 93-11 This is a pilot project, funded by the Alameda County Urban Runoff Clean Water Program, consisting of a storm water filtering structure in the Shannon Center parking lot. The top will be made of pervious concrete, allowing storm water to be filtered in a sand bedding before exiting to the downstream storm drain system. STAFF RECOMMENDATION: Adopt Resolution overruling protest and awarding bid to Harris & Harris Construction ($25,906.42), and authorize Mayor to execute Agreement. 4.5 Warrant Register Dated September 13, 1993 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATION - None 6. PUBLIC HEARING 6.1 Ordinance Amending Municipal Code Sections 6.04.030 and 6.04.290 and Repealing Section 6.04.050 (Traffic) This proposed ordinance would simplify the procedure for approval of turning movement restrictions and broaden the definition of a time-limited "green" parking zone. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE ordinance. 6.2 Ordinance Amending Chapter 7.04 Article IV of the City of Dublin Municipal Code This proposed ordinance would allow the City to require closure of a hazardous driveway. The ordinance proposes that City Council approval be required for any action to be taken, that other access to the site be available or provided, and that costs be borne by the city. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE ordinance. 6.3 Request for Variance to section 3802(j) of the Dublin Building Code The owner of property located at 7410 Amador Valley Boulevard proposes to enclose a 42 square foot entry. He is requesting a variance to permit the addition without installing fire sprinklers. STAFF RECOMMENDATION: Conduct pUblic hearing; deliberate; adopt Resolution granting variance. 6.4 Abatement of Abandoned Vehicles - Revisions to Chapter 6.80 of the Dublin Municipal Code The California Highway Patrol recently advised Staff of several changes which need to be made to both the Dublin Municipal Code and the Resolution approving establishment of and city of Dublin participation in the Alameda County Abandoned Vehicle Abatement Authority. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution; waive reading and INTRODUCE ordinance. 7. UNFINISHED BUSINESS 7.1 Request for stop Signs on Village Parkway at Wineberry Way This is a follow-up to an item that was discussed at the July 26th meeting. This report provides additional information regarding warrants for an all-way stop intersection. Staff is not recommending installation of stop signs on Village Parkway at Wineberry Way at this time. STAFF RECOMMENDATION: Receive Report. 7.2 Status Report on campaign contribution Limitation Ordinance Amendment to Change Definition of "Election Period" In accordance with Council direction, Staff began preparing a proposed amendment to the Campaign contribution Limitation Ordinance to provide that $300 contributions could be received every fiscal year. The city Attorney concluded that, from a legal standpoint, it would be preferable to include a dollar limitation tied to an election, rather than for a fiscal year. If the Council wishes to prohibit contributions in excess of $300 per year, that would translate to a $600 limitation per election for the office of Mayor and a $1,200 limitation per election for the office of Councilmember. STAFF RECOMMENDATION: Provide policy direction regarding amount of limitation for office of Mayor and office of Councilmember and direct Staff to schedule a public hearing for September 27th, at which time the amended ordinance would be introduced. 8 . NEW BUSINESS 8.1 Acceptance of Gift to city The city has received a check from Ms. Dee Goble to cover one months service charge for the Misheloff phone line. STAFF RECOMMENDATION: Accept gift and direct Staff to prepare formal acknowledgement to the donor. 8.2 Certification for the Purposes of Cable Television Regulation The Federal Communications commission (FCC) has issued regulations regarding the Cable TV Act of 1992 which presents the City with the decision on whether to apply for certification to be a regulating agency. STAFF RECOMMENDATION: Discuss merits of rate regulation of cable television and direct Staff appropriately. 9. OTHER BUSINESS 10.
