CONFERENCE WITH LEGAL COUNSEL -- EXISTING LITIGATION (Government Code section 54956.9, subdivision (a).) Name of case: City of Dublin v. Tejindar P. Singh, et al. (Alameda County Superior Court Case No. VG05228899) 1. CALL TO ORDER & PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT OF CLOSED SESSION ACTION 3. ORAL COMMUNICATIONS 3.1 Proclamation for Fall Prevention Awareness Week (610-50) 3.2 Presentation from East Bay Regional Park District (EBRPD) Regarding Proposed Bond Extension of Regional Open Space, Wildlife, Shoreline and Parks Bond (920-80) The EBRPD Board of Directors has approved placing a bond measure on the November 2008 ballot to extend the Measure AA program. The $500 million bond initiative (Measure WW on the November 2008 ballot) must be approved by two-thirds of voters in Alameda and Contra Costa Counties. A representative from EBRPD will be in attendance to present the particulars of the bond measure. STAFF RECOMMENDATION: Adopt Resolution Endorsing East Bay Regional Park District's Proposed Extension of Regional Open Space, Wildlife, Shoreline and Parks Bond. 3.3 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE t3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of the Special Meeting of August 19, 2008. STAFF RECOMMENDATION: Approve. 4.2 Notice That Amendments to City's Conflict of Interest Code are Required (640-40) The Political Reform Act requires every local government agency to review its Conflict of Interest Code biennially to determine whether amendments to the Code are required. This Staff Report serves as notice to the City Council that amendments to the City's Conflict of Interest Code are necessary. STAFF RECOMMENDATION: Provide direction to Staff to revise the City's Conflict of Interest Code and bring the revised Code back to the City Council for review and approval within ninety (90) days of today's date. 4.3 Acceptance of Work, Citywide Street Storm Drain Condition Assessment, Contract No. 08-03 (600-35) This portion of the project cleaned and recorded the condition of the storm drain system within the City limits. The first year of the five-year project focused on the oldest section of the City. STAFF RECOMMENDATION: Accept the improvements under Contract No. 08-03, 2007- 2008 Citywide Street Storm Drain Condition Assessment, and authorize the release of retention after 35 days, pending the submittal of the solid waste receipt from the contractor. 4.4 Approval of Release of Security for Tract 7283, Verona (Pulte Homes), Rear Yard Landscaping (600-60) The Tract 7283 Rear Yard Landscaping Improvements are complete and the bonds for these improvements may now be released. STAFF RECOMMENDATION: Adopt Resolution Approving the Release of Security for Tract 7283, Verona (Pulte Homes), Rear Yard Landscaping. 4.5 Revisions to Personnel System (700-40/720-60) The Staff Report identifies proposed changes to the City's current Personnel System. The proposed adjustments are based on the need to amend the City's contribution rate to California Public Employees' Retirement System (Ca1PERS) for the provision of health benefits under the Public Employees' Medical and Hospital Care Act. STAFF RECOMMENDATION: Adopt Resolution Fixing the Employer's Contribution Under the Public Employees' Medical and Hospital Care Act; adopt Resolution Fixing the Employer's Contribution Vesting Requirement for Future Retirees Under the Public Employees' Medical and Hospital Care Act; and adopt Resolution Amending the Benefit Plan. 4.6 Acceptance of Work -Contract No. 08-06, 2007-2008 Annual Street Overlay Program (600-35) This program removed and replace failed asphalt concrete pavement, resurfaced the entire street with 1-1/2" of asphalt concrete, and re-striped pavement markings on various City streets. STAFF RECOMMENDATION: Approve a budget change in the amount of $30,185; and accept the improvements under Contract No. 08-06, 2007-2008 Annual Street Overlay Program, and release retention after 35 days if there are no subcontractor claims. September 16, 2008 Dublin City Council Agenda Page 2 of 5 REVISED AGENDA 4.7 Award of Bid for Contract No. 08-13, 2008 Annual Slurry Seal Program (600-350) This project will resurface several City streets with a slurry seal that will prolong the life of the existing pavement surface. In addition, striping and signing of bike lanes for the Citywide Bikeways Master Plan will be incorporated in this project. STAFF RECOMMENDATION: Approve budget change in the amount of $92,742; and adopt Resolution Awarding Contract No. 08-13, 2008 Annual Slurry Seal Program to Graham Contractors, Inc. 4.8 Annual Review of City Investment Policy and Delegation of Authority to Complete Investment Transaction (320-30) Annually, the City Council reviews the Investment Policy at a public meeting. State law also contains a provision for the delegation of authority to complete investment transactions on an annual basis. As a result of the 2008 review, no changes are recommended at this time. STAFF RECOMMENDATION: Adopt Resolution regarding Annual Review of Investment Policy and Delegation of Authority to Complete Investment Transactions. 4.9 Fiscal Year 2008-2009 Goals & Objectives Status Report and CIP Schedule (100-80) Staff has prepared a report apprising the City Council of the status of the Fiscal Year 2008- 2009 Goals & Objectives as of August 31, 2008, as well as schedule of the City's Capital Improvement Program indicating estimated project start and completion dates. STAFF RECOMMENDATION: Receive the report. 4.10 Informational Report: Attainment of 100 Acre General Commercial Property Threshold Under City of Dublin/Alameda County Revenue Sharing Agreement (600-40) The City of Dublin and Alameda County entered into an agreement in 1993, which among other items, had a provision for sharing tax revenues. One element of the revenue sharing formula was based on the development of the first 100 Acres of General Commercial property (excluding certain automobile dealers). The Agreement provided that the City would periodically update the map showing the 100 acres. Now that the full 100 acres is developed, Staff has prepared a report and map of this area. STAFF RECOMMENDATION: Receive and file report. 4.11 Request to Waive Competitive Bid Process and Authorize Staff to Purchase Specialized Police Vehicles Directly from Vendor (350-20) Staff requests the City Council waive the competitive bid process pursuant to Dublin Municipal Code Section 2.36.050(a)(10) and (11) (as amended), and authorize Staff to purchase five (5) replacement Ford Crown Victoria Police Interceptor police patrol vehicles directly from vendor. Adequate funding exists in the Internal Service Fund for purchase of these replacement vehicles. In order to adopt the proposed resolution, the City Council must approve it by a four-fifths (4/5) vote. STAFF RECOMMENDATION: Adopt Resolution Waiving the Competitive Bid Process and Authorizing Staff to Purchase Specialized Police Vehicles Directly from Vendor. 4.12 Acceptance of Work -Contract No. 07-08 ValleyCrest Landscape Development Devany Square (Formally Area G -Neighborhood Square) (600-35) On September 4, 2007, the City Council awarded a contract to Va1leyCrest Landscape Development to complete Devany Square and the Inspection Trailer Relocation. The project is complete, with the exception of a few minor punch list items and will be accepted upon City Manager authorization. STAFF RECOMMENDATION: Authorize City Manager to accept final improvements for Contract No. 07-08; adopt Resolution Accepting Improvements to Devany Square (Formally Area G Neighborhood Square); approve budget change; and authorize Staff to accept a maintenance bond in the amount of $106,315 at a future date. September 16, 2008 Dublin City Council Agenda Page 3 of 5 REVISED AGENDA 4.13 Warrant Register ($5,107,752.31) dated September 16, 2008 (300-40) STAFF RECOMMENDATION: Approve. 5. WRITTEN COMMUNICATIONS 5.1 Report on Street Parking During Street Sweeping Days (820-40) This report describes the position of surrounding cities regarding parking restriction ordinances during street sweeping days and explores options to resolve the ongoing street parking situation. STAFF RECOMMENDATION: Receive presentation and provide direction as appropriate. 5.2 City Participation in Dublin San Ramon Services District (DSRSD) Pharmaceutical Drug Collection Event (1030-30) The City Council will consider the request by the Dublin San Ramon Services District (DSRSD) to participate in the District's October 10, 2008 Pharmaceutical Drug Collection event. STAFF RECOMMENDATION: Receive presentation and provide Staff with direction regarding participation in the DSRSD Pharmaceutical Drug Collection event on October 10, 2008, and pursuing a pharmaceutical drug collection site within the City of Dublin. 6. PUBLIC HEARINGS 6.1 General Plan Community Design and Sustainability Element, PA 07-038 (420-30) The City Council will consider adopting a resolution approving a General Plan Amendment adding a Community Design and Sustainability Element to the General Plan, as Chapter 10. STAFF RECOMMENDATION: Conduct public hearing, deliberate, and adopt Resolution Approving a General Plan Amendment Adding a Community Design and Sustainability Element to the General Plan as Chapter 10.. 7. UNFINISHED BUSINESS 7.1 Update Regarding Parking Designation on Village Parkway Adjacent to the Post Office (570-10) This item was originally presented to City Council in May 2008 in response to a citizen request to implement a limited parking zone on Village Parkway in front of the Post Office. This item provides an update to City Council regarding traffic conditions at and around the Post Office on Village Parkway, especially in light of recent changes to operations at the Post Office. STAFF RECOMMENDATION: Provide direction to Staff regarding further review of traffic conditions associated with the Post Office on Village Parkway. 7.2 Shannon Community Center -Public Art Modification (900-60) The City Council will be asked to consider a modification to the public art project by artist Margarita Soyfertis for the Shannon Community Center. STAFF RECOMMENDATION: Approve public art modification for Shannon Community Center or provide alternative direction to Staff. 7.3 The Alameda County Homeless and Special Needs Housing Plan (~~EveryOne Home Plan") (430-50) The City Council will consider adopting the Alameda County Homeless and Special Needs Housing Plan ("Everyone Home Plan"). STAFF RECOMMENDATION: Adopt Resolution Approving the Alameda Countywide Homeless and Special Needs Housing Plan ("Everyone Home Plan"). NEW BUSINESS 8.1 Consideration of Exercising Option to Purchase Below Market Rate (BMR) Unit at 3245 Dublin Boulevard, #124, and Discussion of City Policy on Responding to Notices of Default Received on BMR Units (430-80) The City Council will consider exercising an Option to Purchase a Below Market Rate unit in foreclosure and provide direction to Staff on the City Council's general preferences for responding to future BMR units in foreclosure. STAFF RECOMMENDATION: Direct Staff to NOT deliver a Notice of Exercise of the Option to Purchase 3245 Dublin Boulevard, #124; and provide direction to Staff on the City Council's general preferences for responding to future Notices of Default involving Below Market Rate units. 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
