ORAL COMMUNICATIONS 3.1 Introduction of New Employees: Deputy Shannon Gann and Deputy Alan Dumatol, Dublin Police Services (700-10) 3.2 Presentation by Alameda County Associated Community Action Program (ACAP) Council (520-40) ACAP will make a presentation about the wide spectrum of services provided by this organization which serves those living in poverty in Alameda County. STAFF RECOMMENDATION: Receive presentation. 3.3 Public Comments At this time, the public is pennitted to address the City Council on non-agendized items. STAFF RECOMMENDATION: Approve September 19, 2006 Dublin City Council Agenda Page 1 of6 4.2 Acceptance of Street Improvements Associated with Tract 7137, Dublin Ranch Area A, Neighborhood A-2 (Toll CA ll, L.P.) (600-60) As part of the development of Tract 7137 (Dublin Ranch Area A, Neighborhood A-2), the Developer completed street improvements for a residential neighborhood located west of Signal Hill Drive and east of the Dublin Ranch Golf Course. Since the improvements have been completed, it is appropriate to accept the streets for maintenance and release the bonds that guaranteed the work. STAFF RECOMMENDATION: Adopt Resolution accepting street improvements for Tract 7137, Dublin Ranch Area A, Neighborhood A-2, and approving traffic control devices. 4.3 Acceptance of Street Improvements Associated with Tract 7138, Dublin Ranch Area A, Neighborhood A-3 (Toll CA ll, L.P.) (600-60) As part of the development of Tract 7138 (Dublin Ranch Area A, Neighborhood A-3), the Developer completed street improvements for a residential neighborhood located west of Signal Hill Drive, south of Tract 7137, and east of the Dublin Ranch Golf Course. Since the improvements have been completed, it is appropriate to accept the streets for maintenance and release the bonds that guaranteed the work. STAFF RECOMMENDATION: Adopt Resolution accepting street improvements for Tract 7138, Dublin Ranch Area A, Neighborhood A-3, and approving traffic control devices. 4.4 Acceptance of Street Improvements Associated with Tract 7139, Dublin Ranch Area A, Neighborhood A-4 (Toll CA IT, L.P.) (600-60) As part of the development of Tract 7139 (Dublin Ranch Area A, Neighborhood A-4), the Developer completed street improvements for a residential neighborhood located east of Signal Hill Drive, south of Tract 7140, and west of the Dublin Ranch Golf Course. Since the improvements have been completed, it is appropriate to accept the streets for maintenance and release the bonds that guaranteed the work. STAFF RECOMMENDATION: Adopt Resolution accepting street improvements for Tract 7139, Dublin Ranch Area A, Neighborhood A-4, and approving traffic control devices. 4.5 Acceptance of Street Improvements Associated with Tract 7140, Dublin Ranch Area A, Neighborhood A-5 (ToO CA IT, L.P.) (600-60) As part of the development of Tract 7140 (Dublin Ranch Area A, Neighborhood A-5), the Developer completed street improvements for a residential neighborhood located east of Signal Hill Drive, south of Tract 7139, and west of the Dublin Ranch Golf Course. Since the improvements have been completed, it is appropriate to accept the streets for maintenance and release the bonds that guaranteed the work. STAFF RECOMMENDATION: Adopt Resolution accepting street improvements for Tract 7140, Dublin Ranch Area A, Neighborhood A-5, and approving traffic control devices. 4.6 Acceptance of Fallon Road Stream Corridor Landscape Improvements for Tract 7135, Dublin Ranch Area A (Toll CA IT, L.P.) The Developer of Tract 7135 has completed Fallon Road Stream Corridor landscape improvements within the open channel along the west side of Fallon Road between Turnberry Drive/Golf Course and Gleason Drive. It is now appropriate for the City to accept these improvements and release the bonds that guaranteed the work. This landscaping will be maintained by the Dublin Ranch Golf Club Homeowner's Association. STAFF RECOMMENDATION: Adopt Resolution accepting the Fallon Road Stream Corridor Landscape Improvements for Tract 7135, Dublin Ranch Area A. September 19,2006 Dublin City Council Agenda Page 2 of6 4.7 Acceptance of Landscape Improvements Associated with Tracts 7137, 7138, 7139 and 7140, Dublin Ranch Area A, Neighborhoods A-2, A-3, A-4 and A-5 (Toll CA ll, L.P.) (600-60) As part of the development of Tracts 7137, 7138, 7139 and 7140 (Dublin Ranch Area A, Neighborhoods A-2, A-3, A-4 and A-5), the Developer completed landscape improvements for the residential neighborhoods located west of Signal Hill Drive and east of the Dublin Ranch Golf Course. Since the landscaping improvements have now been completed, it is appropriate to accept these improvements and release the bonds that guaranteed the work. STAFF RECOMMENDATION: Adopt Resolution accepting the landscape improvements for Tracts 7137, 7138, 7139 and 7140, Dublin Ranch Area A, Neighborhoods A-2, A-3, A-4 and A-5. 4.8 Approval of Parcel Map 8876 (Burlington Coat Factory) (410-40) The owner of the Burlington Coat Factory is seeking City Council approval of Parcel Map 8876. This Parcel Map, which is situated at 7575 Dublin Boulevard, subdivides an existing lot into two parcels for the existing Burlington Coat Factory (Parcell - 7.880 acres), and for the existing Bassett Furniture (Parcel 2 - 1.484 acres). STAFF RECOMMENDATION: Adopt Resolution approving Parcel Map 8876. 4.9 Consultant Services Agreement with RBF ConsultinglUrban Design Studio (RBFIUDS) for Scarlett Court Landscape, Signage and Design Guidelines (600-30) The City Council will consider a Consultant Services Agreement with RBF IUDS to prepare landscape, signage and design guidelines for incorporation in the Scarlett Court Specific Plan Phase I. STAFF RECOMMENDATION: Adopt Resolution approving Consultant Services Agreement with RBFIUDS and authorize City Manager to execute the Agreement. 4.10 Establishment of 3-Hour Parking Zone on Dougherty Road (570-20) The Public Works Department received a request to provide a 3-hour parking zone in front of Kahler's Porsche-Mercedes-BMW Service & Parts, located at 6177 Dougherty Road, to allow for proper usage of on-street parking at this location. The Traffic Safety Committee has reviewed the request and recommends that a 68-foot, 3-hour parking space be approved. STAFF RECOMMENDATION: Adopt Resolution approving establishment of a 68-foot 3 -hour parking zone at 6117 Dougherty Road. 4.11 Dublin Village Historic Area Specific Plan Follow-Up Implementation Actions (PA 02-074) (410-55/420-30/450-30/910-40) This is the second reading of two ordinances related to a City-initiated application to rezone parcels in the Dublin Village Historic Area Specific Plan to be consistent with the Specific Plan and General Plan land use designations and other implementation actions as outlined in the Specific Plan. STAFF RECOMMENDATION: Waive readings and adopt Ordinance approving a Planned Development (Dublin Village Historic Area Specific Plan) Zoning District for six parcels in the project area; and adopt Ordinance to amend Section 8.62 (Historic Overlay Zoning District Site Development Review) of the Zoning Ordinance to remove reference to the "Dublin Village Historic Area Design Guidelines," replace with reference to the "Dublin Village Historic Area Specific Plan," and rescind the Dublin Village Design Guidelines. 4.12 Request from Mount Diablo Rose Society for Renewal of Fee Waiver Under Civic Center Facility Use Policy (200-10) The City Council will consider a request made by the Mount Diablo Rose Society to grant the renewal of the fee waiver for use of the Civic Center for monthly meetings in exchange for caretaking services of the City's rose garden at Emerald Glen Park. STAFF RECOMMENDATION: Consider request and grant request made by Mount Diablo Rose Society. September 19, 2006 Dublin City Council Agenda Page 3 of6 4.13 Approval of Settlement Agreement for Real Property at 6450 Dublin Boulevard for Capital Improvement Program (CIP) Project No. 96582 - Dougherty Road Improvements, Houston Place to 1-580 (600-30) In order to widen and improve the intersection of Dublin Boulevard and Dougherty Road, it is necessary for the City to acquire a portion of 6450 Dublin Boulevard. The City Council will consider approving a Settlement Agreement with the owners of the property to enable the commencement of street widening work. STAFF RECOMMENDATION: Adopt Resolution approving Settlement Agreement for a portion of 6450 Dublin Boulevard; and authorize City Manager to issue check in the amount of $7,050.00 payable to J&E Esperanca Investments, LLC. 4.14 Amendment to Conflict of Interest Code (Dublin Municipal Code Chapter 2.24) (640-40) The Political Reform Act requires cities to adopt a Conflict of Interest Code that designates the Staff positions within the City making governmental decisions that could foreseeably affect a financial interest of the employee. This is the second reading of an Ordinanqe that would make changes to Section 2.24.020 of the existing Ordinance related to designated employees. STAFF RECOMMENDATION: Waive reading and adopt Ordinance amending Chapter 2.24.020 of the Dublin Municipal Code and removing one position as decision making position for the purposes of the California Political Reform Act. 4.15 Amendment to 2006-2011 Capital Improvement Program (CIP) for Dublin Historic Park Acquisition (330-40) The City Council will consider an amendment to the 2006-2011 CIP to include a new project, Dublin Historic Park Acquisition, in order to pursue acquisition of the Dublin Square Shopping Center, The Council will also consider a budget change in the amount of $603,200. STAFF RECOMMENDATION: Approve amendment to 2006-2011 CIP and budget change. 4.16 Fiscal Year 2006-2007 Goals & Objectives Status Report and CIP Schedule (100-80) Staff has prepared a report apprising the City Council of the status of the Fiscal Year 2006- 2007 Goals & Objectives as of August 31, 2006, as well as a schedule of the City's Capital Improvement Program (CIP) including estimated project start and completion dates. STAFF RECOMMENDATION: Receive report. 4.17 Miss Dina's Daycare - Adoption of Resolution Granting Appeal, thereby Reversing the Planning Commission's Decision and Approving a Conditional Use Permit for a Large Family Day Care Home, PA 06-029 (410-30) The City Council will consider the adoption of a Resolution granting approval of an appeal of the Planning Commission Decision for a Large Family Day Care Home for a maximum of 12 children and a parking reduction for one loading space for Miss Dina's Daycare, located at 7956 Crossridge Road, as discussed during a public hearing at the September 5, 2006, City Council meeting. STAFF RECOMMENDATION: Adopt Resolution granting appeal, thereby reversing the Planning Commission's decision and approving a Conditional Use Permit for a Large Family Day Care Home (up to 12 children) and a parking reduction for one loading space for Miss Dina's Daycare. September 19,2006 Dublin City Council Agenda Page 4 of6 4.18 Establishment of Sister City Relationship between the City of Dublin and Jinhua City, Zhejiang Province, the People's Republic of China (140-50) The Dublin Sister City Association has requested that the City of Dublin consider establishing a Sister City relationship with the City of Jinhua City, Zhejiang Province, the People's Republic of China. The purpose of this Sister City relationship would be to enhance mutual understanding and friendship between American and Chinese people. STAFF RECOMMENDATION: Adopt Resolution approving Letter of Intent on the Establishment of Friendly Exchange Relationship with Jinhua City, Zhejiang Province, the People's Republic of China; and authorize use of Senior Center Van to tour Sister City Representatives. 4.19 Warrant Register ($3,360,409.17) dated September 19,2006 (300-40) STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS - None 6. PUBLIC HEARING 6.1 Dublin Ranch Area F North, Neighborhood F-l, Standard Pacific Homes "Sonata" Development Agreement, PA 05-015 (600-60) The City Council will consider the adoption of an Ordinance to enter into a Development Agreement with Standard Pacific Homes for the construction of 119 medium density single family detached homes within Dublin Ranch Area F North, Neighborhood F-l. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance approving a Development Agreement between the City of Dublin and Standard Pacific Homes, for Dublin Ranch Area F North, Neighborhood F-l "Sonata." 7. UNFINISHED BUSINESS 7.1 Art in the Parks - Bray Commons (900-50) The City Council will consider a proposal as part of the" Art in the Parks" program sponsored by the Dublin Fine Arts Foundation for a public art piece by artist Bill Gould, to be located at Bray Commons Park. STAFF RECOMMENDATION: Approve artwork or provide alternate direction. 7.2 City's 25th Anniversary Celebration - Status Report (950-40) The City Council will receive recommendations regarding the City's 25th Anniversary Celebration as recommended by the Council Sub-Committee. The report includes recommendations for banners, commemorative letterhead, a gala dinner and an enhanced 2007 Day on the Glen Festival. STAFF RECOMMENDATION: Receive report and approve: Commemorative City Banner, Commemorative City Letterhead, Commemorative City Envelope Sticker, and budget change in the amount of$12,600. 7.3 First Time Homebuyer Loan Program - Approval of Loan Documents (430-60) At its March 21, 2006 meeting, the City Council approved the First Time Homebuyer Loan Program (FTHLP). The City Council will consider adopting a Resolution authorizing the City Manager to approve the final form of the Loan Agreements, Deeds of Trust and Promissory Notes for the FTIfi.,P and authorizing the City Manager to execute such loan documents on behalf of the City. NEW BUSINESS 8.1 Request by Custom Fireplace, Patio & BBQ to Initiate a Downtown Core Specific Plan Amendment Study (410-55) The City Council will consider request from the owner of Custom Fireplace, Patio & BBQ to initiate a Downtown Core Specific Plan Amendment Study at 7099 Amador Plaza Road. The Applicant proposes to change the Specific Plan Land Use Designation from Retail/Auto to Retail/Office to allow Custom Fireplace, Patio & BBQ, a retail establishment, to increase the size of the existing building on-site by approximately 11,000 square feet and to operate the subject at the subject property. STAFF RECOMMENDATION: Adopt Resolution denying request to initiate a Downtown Core Specific Plan Amendment Study - OR - Adopt Resolution approving request to initiate a Downtown Core Specific Plan Amendment Study. 8.2 Informational Report on Off-Site Signage/Advertising for the Alameda County Fair within City Limits (450-20) The City Council will provide Staff with direction on regulating and controlling off-site signage within City limits. STAFF RECOMMENDATION: Receive report and provide Staff with direction. 8.3 Location of St. Patrick's Day Events (950-40) Due to the limited amount of space available along Amador Valley Boulevard for the St. Patrick's Day Festival, the Council will consider options for downsizing the event or relocating it to Civic Plaza or another location. The Council will also consider alternative routes for the Parade and Fun Run. STAFF RECOMMENDATION: 1) Determine if Festival will remain on Amador Valley Boulevard or be relocated to Civic Plaza QI direct Staff to evaluate other specific locations for Council consideration; 2) If Festival will be at Civic Plaza, select Alternative A as the preferred parade route or provide alternate direction; 3) If Festival will be a Civic Plaza, approve proposed Fun Run route or provide alternate direction. 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
