1. ANTICIPATED LITIGATION - Significant exposure to litigation pursuant to
subdivision (b) of Government Code 54956.9 (ONE potential case) - Facts and
Circumstances: Receipt of Claims dated July 14, August 30, and October 26, 2000
from Goodland Landscape Construction, Inc., related to Emerald Glen Park, Phase I.

3.3 Recognition of Nominees for City of Dublin's 2001 Organization of the Year (File # 610-50)
Nominees include: Dublin 4-H Club, Dublin Lions Club, Dublin Senior Foundation, Friends
of Dublin and Knights of Columbus. The winning Organization will be announced at the
City's first annual Volunteer Celebration being held at the Dublin Monarch Hotel on Friday,
October 5th.
STAFF RECOMMENDATION: Present Certificates of Recognition to all nominees.
3.4 Recognition of Nominees for City of Dublin's 2001 Citizen of the Year (File # 610-50)
Nominees include: Bob Cocilova, Kasie Hildenbrand and Melissa West. The winner will be
announced at the Volunteer Celebration on Friday, October 5th. ·
STAFF RECOMMENDATION: Present Certificates 0fRecognition to all nominees.
3.5 Public Comments
At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for
the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, however, no action or discussion may take place
on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report
back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to
place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing
on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3).
4. CONSENT CALENDAR
Consent Calendar items are typically non-controversial in nature and are considered for approval by the City
Council with one single action. Members of the audience, Staff or the City Council who would like an item
removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item.
4.1 Minutes of Regular Meeting of September 18, 2001
STAFF RECOMMENDATION: Approve
4.2 Award of Bid, City Facilities Lighting Retrofit, Contract 01-11 (File # 600-35)
This project would provide more energy-efficient lighting at the Civic Center, Shannon Community
Center, and thc Donohue Drive Fire Station. The low bid received, $32,760.64, is within funds
budgeted for construction of the project.
STAFF RECOMMENDATION: Adopt Resolution awarding bid to Amtech Lighting Services.
4.3 Acceptance of Gift to City (File # 150-70)
The Dublin Senior Center Foundation has given the Dublin Senior Center a new bingo machine. The
City Council will formally accept the gift.
STAFF RECOMMENDATION: Accept gift and direct Staff to prepare formal acknowledgment
to donor.
4.4 Acceptance of Improvements for the widening of Amador Valley Boulevard associated with
Kindercare Learning Centers (File ~ 600-30)
The Kindercare Learning Center is located at the westerly end of Amador Valley Boulevard. The
widening of Amador Valley Boulevard is now complete within this project's limits and it is
appropriate to accept the improvement for maintenance purposes.
STAFF RECOMMENDATION: Adopt Resolution and authorize Staffto accept Maintenance
Bond.
4.5 Approval of Change Orders No. 7 and 8 for Contract 00-16, Dublin Boulevard Widening-
Dougherty Road to Scarlett Drive (File # 600-35)
This project is the widening of Dublin Boulevard to 6 lanes from Dougherty Road to Scarlett Drive
and the installation ofa DSRSD Recycled Water Pipeline.
STAFF RECOMMENDATION: Approve Change Orders No. 7 and 8:
4.6 Acceptance of Work, Contract 00-09, 1-580/Hacienda Drive Interchange Improvements
(File # 600-35)
RGW Construction, Inc., has completed the construction of the I-580/Hacienda Interchange
Improvement project and the Council is being requested to approve 5 Contract Change Orders and
accept the project as complete.
STAFF RECOMMENDATION: Approve Contract Change Orders No. 5-9; accept
improvements and approve release of retention after 35 days if there are no subcontractor claims;
and approve $181,103 Budget Change.
4.7 Consultant Services - Bus Shelter Art Project (File # 600-30/110-30)
The City Council will consider an agreement with Art Consultant, Lynne Baer to manage the art
design process for the City's Bus Shelter Project. In addition, the Council will consider StafFs
recommendation for an Art Selection Committee.
STAFF RECOMMENDATION: Approve Agreement and authorize Mayor to execute; approve
formation of Art Selection Committee and authorize Staffto solicit representatives.
4.8 Warrant Register ($1,351,878.09) dated October 2, 2001 (File it 300-40)

WRITTEN COMMUNICATIONS - NONE
PUBLIC HEARING
6.1 Approving a Resolution Notifying Developers of a Pending Non-Residential Affordable
Housing Fee for the City of Dublin (File # 430-80)
The proposed Resolution will put developers on notice that the City Council intends to adopt an
Ordinance imposing a Non-Residential Affordable Housing Fee. By notifying developers,
applications for discretionary approvals submitted after the adoption of this resolution, but before
adoption of the fee, will be subject to the Non-Residential Affordable Housing Fee.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution.
6.2 Sprint PCS Site Development Review PA 01-018 (File # 410-30)
The City Council will consider the placement of a new telecommunication facility adjacent to the rear
parking lot of the Shannon Center, located on the northeast portion of the site. The proposed
telecommunication facility would be located within a light standard and would attain a maximum
height of 30 feet above grade. The application also proposes to construct a 230 square foot accessory
structure that would attain a maximum height of 10' 6" above grade.
STAFF RECOMMENDATION: Conduct public hearing; deliberate, adopt Resolution.

Eastern Dublin Properties Planned Development (PD) Prezone (Stage 1 Development Plan)
PA 00-025 (File # 450-30)
The City Council will consider introducing an Ordinance approving a Prezoning/Stage 1
Development Plan for an area 1,120 acres in size that is located in an unincorporated area of
Alameda County bounded by Interstate 580 (I-580) to the south and Fallon Road to the west,
and City's Sphere of Influence line to the east and north.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and
Introduce Ordinance.
UNFINISHED BUSINESS
7.1 Approval of Non-Residential Affordable Housing Task Force (File # 110-30)
In accordance with Council direction, a possible list of participants is being presented to serve
on a Non-Residential Affordable Housing Task Force. The Task Force will meet with Staff
and Cotton/Bridges Housing Consultant to provide input related to a potential Commercial
Linkage Fee. The Task Force will meet several times before the start of the public hearing
process.
STAFF RECOMMENDATION: Authorize Mayor to select Task Force from recommended
candidates and appoint member from the City Council to serve on the Task Force.
7.2 Request for authorization to distribute a Request for Proposal (RFP) for Municipal
Electric Utility Feasibility Study (File # 1020-40/600-30)
The City Council recently directed Staffto prepare an RFP to secure the services of an
independent energy consultant to assist the City in the identification of issues involving the
provision of electric services to the City of Dublin. RFP submissions will be due by October
26th and Staff anticipates that three firms will be interviewed by the City Council Committee.
STAFF RECOMMENDATION: Authorize Staffto distribute RFP.
NEW BUSINESS
8.1 AB 939 Diversion Report for 2000 (File # 810-60)
Livermore Dublin Disposal has contracted with E. Tseng & Associates to assist the City with
establishing a new base year and calculating the City's waste diversion rate for 2000. The
report indicates that the City has achieved a 54% waste diversion rate for 2000. This report
demonstrates that the City of Dublin has complied with the 50% waste diversion required by
State Law.
STAFF REcoMMENDATION: Receive Report.
8.2 Third Amendment to Dougherty Regional Fire Authority (DRFA) Joint Exercise of Powers
Agreement (File # 600-40)
The City Council will consider an amendment to the DRFA JEPA which will designate the
full City Councils of both the Cities of Dublin and San Ramon as the Board of the DRFA.
STAFF RECOMMENDATION: Adopt Resolution.
