DUBLIN CITY COUNCIL
REGULAR MEETING - Tuesday, October 24, 1995, 7:00 p.m.
DUBLIN CIVIC CENTER, 100 Civic Plaza
A complete packet of information containing Staff Reports and exhibits related to each
item is available for public review several days prior to a Council meeting in the City
Clerk’s Office and also at the Dublin Library.

At this time, the public is permitted to address the City Council on non-agendized items. The
Council must, however, comply with all State Laws in regard to items not appearing on the
posted agenda. The Council may respond to statements made or questioned asked, or may
request Staff to report back at a future meeting concerning the matter. Any member of the public
may contact the City Clerk’s Office related to the proper procedure to place an item on a future
City Council agenda. The exceptions under which the City Council MAY discuss and/or take
action on items not appearing on the agenda are contained in Government Code Section
54954.2(b)(1)(2)(3).
4.CONSENT CALENDAR
Consent Calendar items are typically non-controversial in nature and are considered for
approval by the City Council with one single action. Members of the audience, Staff or
the City Council who would like an item removed from the Consent Calendar for purposes
of public input may request the Mayor to remove the item.
4.1Minutes of Regular Meeting of September 26, 1995
STAFF RECOMMENDATION: Approve
4.2City Treasurer’s Investment Report as of September 30, 1995
The City’s investment portfolio totals $21,793,120.38 and funds are invested at an annual
average yield of 5.893%.
STAFF RECOMMENDATION: Receive Report
4.3Annual Report of Developer Capital Improvement Fund Deposits: Pursuant to
Government Code Section 66001 (AB 1600)
State Law authorizes a city to require development applicants to contribute fees toward off-
site improvements which are needed as a result of new development. For fees collected more
than 5 years ago, certain findings must be made by the City council or the fees are forfeited.
Each year the City Council reviews a report on the status of fees collected and expended.
STAFF RECOMMENDATION: Accept Report and adopt Resolution making findings regarding
unexpended impact fees for Fiscal Year 1995-96.
4.4Preliminary Financial Report for the Month of September 1995
STAFF RECOMMENDATION: Receive Report
4.5Award of Contract for the Eastern Dublin Comprehensive Stream Corridor Restoration
Program and Grazing Management Plan
The City Council will consider entering into a consultant contract with Sycamore Associates
LLC to prepare the Eastern Dublin Comprehensive Stream Corridor Restoration Program and
Grazing Management Plan. These are action programs and mitigation measure requirements
of the Eastern Dublin Specific Plan and Environmental Impact Report.
STAFF RECOMMENDATION: Award contract to Sycamore Associates LLC (not to exceed
$40,000), and authorize City Manager to execute agreement
4.6Award of Bid Contract 95-04, Biennial Striping and Marking Contract
Every 2 years the City contracts for the striping and marking of the City streets. Three bids
were received, with Riley Striping being the lowest of the bids received.
STAFF RECOMMENDATION: Adopt Resolution awarding bid to Riley Striping ($49,855) and
authorize Mayor to execute agreement
4.7Informational Report on Dublin Police Services Patrol Beat System
A two-beat and three-beat system has been developed which basically divides the City into
either 2 or 3 sections thereby providing Police Services with an ability to insure all areas of the
City are adequately and consistently served. A Watch Commander makes a determination at
the beginning of each shift regarding which beat system (two-beat vs. three-beat) will be used
based on the needs of the citizenry and of Police Services.
STAFF RECOMMENDATION: Receive Report
4.8Amendment to Agreement for Janitorial Services
The proposed amendment adds two-day-per-week service for the Heritage Center to the
existing contract at a cost of $175 per month.
STAFF RECOMMENDATION: Adopt Resolution
4.9Authorization to Solicit Bids - Landscaping on San Ramon Road at Amador Valley
Boulevard (Northwest and Northeast Corners)
This contract would landscape and irrigate the westerly street frontage of San Ramon Road
just north of Amador Valley Boulevard (True Value Hardware) and the northeast corner of
San Ramon Road and Amador Valley Boulevard (Casa Orosco).
STAFF RECOMMENDATION: Authorize Staff to solicit bids
4.10Resolution of Intention to Form Underground Utility District, Dublin Boulevard from I-680
to a point 600 feet west of Clark Avenue
This is the first priority undergrounding project as identified by the City Council at the
September 26, 1995 Council meeting. Much of the work on this project will be performed
concurrently with or in lieu of utility relocations related to the Dublin Boulevard Widening
project. The cost of the work will be paid by CPUC Rule 20A funds. Private property owners
within the proposed District appear to have no overhead services and will therefore not incur
any costs.
STAFF RECOMMENDATION: Adopt Resolution of intention, setting public hearing dates of
November 14 and 28.
4.11Warrant Registers dated October 10 and October 24, 1995 totaling $940,051.08
STAFF RECOMMENDATION: Approve
5.WRITTEN COMMUNICATIONS
5.1Request from Dublin Unified School District to reconvene the Community Facilities Task
Force (CFTF)
The School District is requesting that this Task Force be reconvened for 2 additional meetings
in order to obtain community input on the masterplans for Dublin High School as well as for
Dublin Elementary School and Nielsen Elementary School so that all facets of potential users
are included in the process.
STAFF RECOMMENDATION: Approve request and direct Staff to notify Task Force members
of additional meetings.
6.PUBLIC HEARING
6.1No Parking Zones on Curb Returns at Sierra Court/Trinity Court Intersection
The California Vehicle Code (CVC) prohibits parking within an intersection, which typically
includes the curb returns (radii). The Sierra Court/Trinity Court intersection has very large
curb radii, and currently, vehicles are parking on the curb returns and causing a visibility
problem for drivers exiting Trinity Court. Engineering Staff is recommending that this area be
red-curbed so that it is clear that parking is not allowed on the curb returns.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution
6.2Two-Hour Parking Zone and No Parking Zone on Donlon Way
Portions of Donlon Way within a commercial area are being used to store boats and other
vehicles. This change to 2 hour parking would allow the businesses to use the parking during
the day and the residents to use the parking in the evening and on weekends.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution -OR-
provide direction as to an alternate solution
6.3Arlen Ness General Plan Amendment, Conditional Use Permit and Site Development
Review PA 95-035
This request is to amend the General Plan to allow indoor retail sales of motorcycle parts and
to allow greater lot coverage; Conditional Use Permit to allow retail sales in the M-1 zone; and
Site Development Review to allow a 44,016 square foot building with 67 parking spaces.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution approving
Arlen Ness Enterprises Negative Declaration of Environmental Impact, GPA, CUP and SDR -
OR- give Staff and Applicant direction and continue the matter
6.4Adoption of Codes: 1994 Edition of the Uniform Building Code, Uniform Plumbing Code;
Uniform Mechanical Code; and 1993 National Electrical Code by Reference
In order for the City Council to adopt new codes, this public hearing was noticed in
accordance with State Law. Staff was unable to complete all the necessary reports and
therefore requests that the item be continued to the next City Council meeting.
STAFF RECOMMENDATION: Continue public hearing to Council meeting of November 14,
1995.
7.UNFINISHED BUSINESS
7.1Proposed Valley High School Community Gymnasium
In July of 1995, the Dublin City Council and the Dublin Unified School District Board of
Trustees held a joint meeting to discuss a proposal developed by the City/School District
Liaison Committee for a 10,000 square foot community gymnasium to be built at Valley High
School with a potential opening date of Fall 1997. The responsibilities of both agencies have
been discussed and agreed upon. On October 18, 1995, the DUSD Board unanimously
approved the agreement.
STAFF RECOMMENDATION: Adopt Resolution approving agreement and direct Mayor to
execute same.
7.2Exchange of Property with Kaufman and Broad
Kaufman and Broad, the developers of the Donlon Canyon Project, have requested that the
City deed them 0.93 acres of excess Dublin Boulevard right-of-way to add to the front of their
project in exchange for a 6.31 acre parcel of land to be used for the future extension of Dublin
Boulevard.
STAFF RECOMMENDATION: Adopt Resolution authorizing exchange of property with
Kaufman and Broad
8.NEW BUSINESS
8.1Designation of City Council 1995 Ad-Hoc Audit Review Subcommittee
As has been done in past years, prior to submitting the annual audit to the entire City Council
for review and approval, a subcommittee of the City Council reviews the report with the
Auditors.
STAFF RECOMMENDATION: Appoint 2 members of the City Council to meet with the City
Auditors to review and discuss the report for the period ending June 30, 1995 (FY 1994-95)
8.2Recommendations from the Teen Task Force
The City Council will review the recommendations of the Teen Task Force and consider a
budget adjustment in order to fund the Task Force recommendations.
STAFF RECOMMENDATION: Approve Budget Change Form
8.3Memorandum of Understanding between the City of Dublin and San Francisco Bay Area
Rapid Transit District for contribution of funds for the parallel road southerly of Dublin
Boulevard and the Dublin Boulevard Improvements
BART’s environmental document and mitigation monitoring program for the
Dublin/Pleasanton Extension requires that a memorandum of understanding be entered into
with Dublin to help pay for improvements for the widening of Dublin Boulevard and for the
construction of the road south of and parallel to Dublin Boulevard. This contribution is to be
24% of the project costs up to a maximum of $1 million.
STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute MOU; and
adopt Resolution for the commitment of funding for the proposed parallel road to and south of
Dublin Boulevard.
