ORAL COMMUNICATIONS 3.1 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE l3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Councii may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may coritact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agentla are containetl in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the autlience, Staff or the City Council who woultl like an item removetl from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of October 19, 2010 STAFF RECOMMENDATION: Approve minutes. 4.2 Amendments to Chapter 8.108 (Temporary Use Permit) of the Zoning Ordinance (450-20) The City Council will hold a second reading of City-initiated amendments to Chapter 8.108 of the Zoning Ordinance (Temporary Use Permit) to create new categories that will facilitate easier approval of Temporary Use Permits. STAFF RECOMMENDATION: Waive the reading and adopt an Ordinance Amending Chapter 8.108 (Temporary Use Permit) of the Zoning Ordinance. 4.3 Amendment to Chapter 8.84 (Sign Regulations) of the Dublin Zoning Ordinance related to Temporary Promotional Banners (400-30) The City Council will hold a second reading of City-initiated amendments to Title 8 of the Dublin Municipal Code (Zoning Ordinance) related to Sign Regulations. The proposed amendments will make permanent those changes related to temporary promotional banners that the City Council approved on a temporary basis in July 2010. STAFF RECOMMENDATION: Waive the reading and adopt an Ordinance Amending Chapter 8.84 (Sign Regulations) of the Zoning Ordinance related to Temporary Promotional Banners. November 2, 2010 Dublin City Council Agenda Page 1 of 3 4.4 Dublin Transit Center Site E-1 (Esprit at Dublin Station) - Planned Development Rezone with a related Stage 1 Development Plan Amendment and Stage 2 Development Plan and an Amendment to the Development Agreement for the Dublin Transit Center Site E-1 Project. (PA 09-002) (450-30/600-60) D.R. Horton, Inc. is proposing to construct a multi-family residential townhouse community with 105 units on + 4.1 net acres of land within the Dublin Transit Center project on Site E-1. A Planned Development Rezone will allow the development of either the 105-unit Esprit at Dublin Station Project (proposed) or the 300-unit Metropolitan at Dublin Station project (previously-approved). The proposed amendment to the existing Development Agreement for the project site relates to the allowed density of~uses (to permit the 105-unit project), an extension of the existing Agreement term by seven years, an amendment to the affordable housing obligations for the property, and a provision on a public art fee. STAFF RECOMMENDATION: Waive the reading and adopt an Ordinance Approving a Planned Development Rezone with a Related Stage 1 Development Plan Amendment and Stage 2 Development Plan for the Esprit at Dublin Station Project; and waive the reading and adopt an Ordinance Approving Amendment 1 to the Development Agreement for Dublin Transit Center Site E-1 (Esprit at Dublin Station). 4.5 Check Issuance Reports and Electronic Funds Transfers (300-40) STAFF RECOMMENDATION: Review and authorize the issuance of payments. 5. WRITTEN COMMUNICATIONS - None. 6. PUBLIC HEARINGS 6.1 Updates to the City's Construction and Fire Codes and Wildfire Management Plan in Accordance with Requirements of State Law (440-10) The 2010 Edition of the California Building Codes Standards (CBCS) was approved by the California Building Standards Commission earlier this year and will go into effect on January 1, 201 L In order to ensure the continuity of the City's building standards, the City must adopt an Ordinance incorporating the new codes which take effect on January l, 2011. The City Council is being asked to review and adopt an Ordinance repealing 2007 California Building Codes Standards and adopting the 2010 California Building Codes Standards. In connection with this action, the City Council is also being asked to adopt a Resolution approving findings relating to the City's amendments to the California Building Code Standards, and a Resolution amending the City Wildfire Management Plan. STAFF RECOMMENDATION: Conduct public hearing, deliberate, and adopt Resolution Approving Findings regarding the Need for Amendments to Provisions in the California Building Standards Code as adopted by the State of California, in the California Code of Regulations, Title 24, to be Adopted by Reference in the Dublin Municipal Code; waive the reading and INTRODUCE an Ordinance Repealing Chapters 5.08 (Fire Code), 7.28 (Building Regulation Administration), 7.32 (Building Code), 7.36 (Electrical Code), 7.40 (Plumbing Code), Chapter 7.44 (Mechanical Code), 7.52 (Abatement of Nuisances), and 7.94 (Green Building Code) of the Dublin Municipal Code; and Adding Chapters 5.08 (Fire Code), 7.28 (Building Regulation Administration), 7.32 (Building Code), 7.34 (Residential Code), 7.36 (Electrical Code), 7.40 (Plumbing Code), Chapter 7.44 (Mechanical Code), 7.52 (Abatement of Nuisances), and 7.94 (Green Building Code) of the Dublin Municipal Code in Order to Adopt by Reference and Amend Provisions of the 2010 Edition of the California Building Standards Code, Title 24, California Code of Regulations; and adopt Resolution Amending the Wildfire Management Plan. NEW BUSINESS 8.1 Appointments to Citizens/Organization of the Year Ad-Hoc Committee (610-50) Each year, the City of Dublin recognizes a citizen, young citizen and organization of the year at its Volunteer Recognition Event. As part of this process, an Ad Hoc Committee comprised of two Dublin City Councilmembers is needed to perform duties including arranging for impartial judging and selection of winners. The City Council will consider appointment of two City Councilmembers to the Ad Hoc Committee. STAFF RECOMMENDATION: Confirm the appointment of Vice Mayor Hildenbrand and Councilmember Hart to the Citizens/Organization of the Year Ad Hoc Committee. 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
