ORAL COMMUNICATIONS 3.1 Introduction of New Employees: Rosalie Cuevas, Part- Time Limited- Term Office Assistant I, City Manager's Office; Laura Correa-Hernandez, Community Safety Assistant, Police Services (700-10) 3.2 Proclamation Declaring November 19 - 25, 2006 as "National Family Week" (610-50) 3.3 Public Comments At this time, the public is pennitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3J MINUTES. In accordance with state Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statemenls made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meetings of October 3, 2006 and October 17, 2006. STAFF RECOMMENDATION: Approve November 7, 2006 Dublin City Council Agenda Page 1 of 4 4.2 Award of Bid - Contract No. 06-11, Demolition of Buildings at 6380 and 6500 Scarlett Court (600-35) As part of the Dougherty Road Improvements - Houston Place to 1-580 Project, two commercial buildings must be demolished at the southeast comer of the Dougherty Road and Dublin Boulevard intersection. This project will also include the preparation of the sites by capping off the utilities and removing asphalt and concrete materials. STAFF RECOMMENDATION: Adopt Resolution awarding Contract No. 06-11, Demolition of Buildings at 6380 and 6500 Scarlett Court, to NICA DMT, Inc. 4.3 Consulting Services Agreement with H.T. Harvey and Associates for Survey of Potential Habitats for Burrowing Owls at the Future Fallon Sports Park Site (600-30) The future 60-acre Fallon Sports Park will be located on a parcel owned by the City within Dublin Ranch. The Council will consider contracting with a Consultant to survey the property for potential habitats for burrowing owls. STAFF RECOMMENDATION: Approve budget change in the amount of $34,900; and adopt Resolution approving agreement with H. T. Harvey and Associates. 4.4 Preliminary Financial Reports for the Month of September 2006 (330-50) STAFF RECOMMENDATION: Receive report. 4.5 Public Art Policy (900-50) The Council will consider adoption of a Resolution rescinding the 1997 Public Art Policy (Resolution No. 121-97), which as been superseded with the adoption of Ordinance No. 14-06 Adding Chapter 8.158 and Amending Chapter 8.104.070 of the Dublin Municipal Code (Zoning Ordinance) Relating to the Public Art Program. STAFF RECOMMENDATION: Adopt Resolution rescinding Resolution No. 121-97. 4.6 Approval of Parcel Map 8734, Dublin Ranch, Area B (410-40) Parcel Map 8734 subdivides 70.9 acres bounded by Central Parkway, Lockhart Street, Fallon Road and Dublin Boulevard into three parcels and dedicates 17.1 acres of right of way for Dublin Boulevard, Fallon Road and Lockhart Street. Parcell (51.2 acres) is planned for open space and residential development, Parcel 2 (2.1 acres) is planned for commercial development and Parcel 3 (0.5 acres) contains the DSRSD pump station. STAFF RECOMMENDATION: Adopt Resolution approving Parcel Map 8734, Dublin Ranch, Area B. 4.7 Acceptance of Donation from Wente Vineyards (150-70) On September 28,2006, the City of Dublin hosted the Tri-Valley Council Meeting at Stacey's Restaurant in Dublin. The Tri- Valley Council is made up of Mayors, City Council members, and City Managers of the Cities of San Ramon, Dublin, Pleasanton, Livermore and the Town of Danville. Livermore-based Wente Vineyards donated a case of wine to the City, which offset the City's portion of the cost of hosting the dinner meeting STAFF RECOMMENDATION: Accept donation and direct Staff to prepare formal acknowledgment to Donor. 4.8 Authorization for City Manager to Execute Agreement with ClientFirst Consulting Group, LLC, for Information Technology Assessment and Master Plan Services (600-30) The City Council will consider entering into an agreement with ClientFirst to complete a Technology Master Plan for City facilities. STAFF RECOMMENDATION: Adopt Resolution authorizing City Manager to execute a Consulting Services Agreement with ClientFirst Consulting Group, LLC, at a total cost of $59,907. November 7, 2006 Dublin City Council Agenda Page 2 of4 4.9 City Manager's Employment Agreement (600-30) The City Council Agency Negotiating Team (Mayor Lockhart and Vice Mayor Oravetz) have met with the City Manager regarding the tenns and conditions of employment and recommended adjustments to the City Manager's employment agreement. STAFF RECOMMENDATION: Approve City Manager's Employment Agreement as recommended by Agency Negotiating Team and adopt Resolution amending Salary Plan. 4.10 Resolution Setting a Public Hearing on the Formation of the Schaefer Ranch Geologic Hazard Abatement District (360-60) This is the first step in the fonnation process of a Geologic Hazard Abatement District in the Schaefer Ranch development. Adoption of the Resolution will set a public hearing and require that a Notice of Public Hearing be transmitted to each owner of real property to be included in the proposed district. STAFF RECOMMENDATION: Adopt Resolution setting a public hearing on the formation of the Schaefer Ranch Geologic Hazard Abatement District. 4.11 Warrant Register ($4,792,877.35) dated November 7,2006 (300-40) STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS - None 6. PUBLIC HEARING 6.1 City of Dublin Zoning Ordinance Amendments (450-20) The City Council will review minor clarifications, removal of inconsistencies, and improvements to the Zoning Ordinance that will aid in a better understanding and interpretation of the Zoning Ordinance. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance amending various Chapters of Title 8 (Zoning Ordinance) of the Dublin Municipal Code. 7. UNFINISHED BUSINESS 7.1 Follow-Up Report on Cross ridge Road Connection between Alamo Creek Bicycle Path and Bent Creek Open Space Trail (930-30) The City Council will consider a report regarding the connection of the Alamo Creek Bicycle Path to the Bent Creek Open Space Trail located at the end of Crossridge Road. STAFF RECOMMENDATION: Direct Staff to complete environmental review, prepare the necessary easement documents and, once both are completed, work with the City of San Ramon to make the necessary improvements to connect the two trails. 8. NEW BUSINESS 8.1 Art in the Parks - Dougherty Hills Dog Park (900-50) The City Council will consider a proposal as part of the "Art in the Parks' program sponsored by the Dublin Fine Arts Foundation for public art pieces by artist Michele Alcantara to be located at the Dougherty Hills Dog Park, located on Amador Valley Boulevard. STAFF RECOMMENDATION: Approve artwork or provide alternate direction. 8.2 Memorandum of Understanding between City of Dublin and Dublin Unified School District for School Resource Officer (600-30) This Memorandum of Understanding identifies the goals of the School Resource Officer (SRO); describes the responsibilities of each entity; and discusses the continued funding agreement. For Fiscal Year 2006-2007, Dublin Unified School District has agreed to continue its $40,000 contribution, as part of a cooperative effort to sustain the SRO position. STAFF RECOMMENDATION: Adopt Resolution authorizing execution of the Memorandum of Understanding. November 7, 2006 Dublin City Council Agenda Page 3 of4 8.3 Request for Proposals for Parks and Community Services Needs Assessment (600-30) The Fiscal Year 2006-2007 City Council Goals includes a high priority objective to conduct an in-depth community needs assessment and opinion survey of Parks and Community Services Department programs, services and facilities, and develop a Strategic Plan for Department programs and services. Staff has developed a Request for Proposal (RFP) for a consultant to conduct the needs assessment. STAFF RECOMMENDATION: Authorize Staff to distribute RFP. 8.4 Amendment to Agreement with Sorrento at Dublin Ranch I L.P., regarding Proposed Neighborhood Square (600M30) At its May 16, 2006 meeting, the City Council approved an agreement with Sorrento at Dublin Ranch I L.P. to perform rough grading and erosion control for the two-acre Neighborhood Square Park. The Developer desires to complete additional improvements. In addition, the Developer will amend the soil with fertilizers and compost, install underground utility sleeves, install sidewalks along north and south side of site, complete the oval-shaped concrete pathway and complete the entry plaza adjacent to the recreation facility. STAFF RECOMMENDATION: Adopt Resolution approving Amendment to Agreement with Sorrento at Dublin Ranch I L.P. 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
