DUBLIN CITY COUNCIL
REGULAR MEETING - November 12, 1991 DUBLIN CIVIC CENTER

A complete packet of information containing all Staff Reports and exhibits related to each agenda item is available
for public information and perusal several days prior to a Council meeting in the City Clerk's Office and also at
the Dublin library.
1. CALL TO ORDER
2. PLEDGE OF ALLEGIANCE TO THE FLAG - JUNIOR GIRL SCOUTS Chara Jay and
Michelle Carter, Troop 1189
3. ORAL COMMUNICATIONS
At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City
Counci l Agenda. Conments should not exceed 5 minutes. If any person feels that this is not sufficient time to
address their concern, that person should arrange with the City Clerk to have their particular concern placed on the
agenda for a future meeting. The City Council CANNOT deliberate or take action on a non-agenda item UNLESS there is
factual evidence presented to the Counci l indicating that the subject brought up falls into one of the exceptions
under Government Code Section 54954.2.
4. CONSENT CALENDAR
Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council
with one single action. Members of the audience who would like an item removed from the Consent Calendar for purpose
of public input may request the City Council to remove the item. The request may be made at the time that the Mayor
asks the audience members if there is anyone interested in removing an item from the Consent Calendar.
4.1 Minutes: Regular Meeting of October 28, 1991
STAFF RECOMMENDATION: Approve.
4.2 Recission of Rejection and Acceptance of Right-of-Way and
Easements, Parcel Map 3000 (U-Haul Property)
This action would rescind the County's rejection of right-
of-way that was offered for dedication in 1981 and accept
the dedication. Parcel Map 3000 is located on Scarlett
Court. The right-of-way is now needed for a connector road
between Scarlett Court and the Dublin Boulevard extension.
STAFF RECOMMENDATION: Adopt Resolution and direct City Clerk
to record Resolution with Alameda County Recorder.
4.3 City Treasurer's Investment Report as of October 31, 1991
STAFF RECOMMENDATION: Receive Report.
4.4 Agreement for Legal Services
This agreement provides for specialized legal services in
relation to the proposed Dublin Boulevard extension
assessment district. The cost of services would be paid by
the assessment district. If the district is not formed,
the City would not incur any costs.
STAFF RECOMMENDATION: Adopt Resolution approving agreement
with Sturgis, Ness, Brunsell & Sperry.
4.5 Authorization to Advertise Contract No. 91-10 for Bids,
Nielsen and Cronin Schools Play Area Renovations
The City Council will review the plans and specifications
for the renovation of the play areas at Nielsen and Cronin
Schools in order that they may be put out to bid.
STAFF RECOMMENDATION: Authorize Staff to advertise for bids.
4.6 Agreement with Wilsey & Ham for Extended Engineering Services
on the Dublin Boulevard Extension Capital Improvement Project
Approval of this proposal would extend the scope of work
for the City'S existing agreement with Wilsey & Ham to
include work on a proposed assessment district and
combining the City'S portion of the project with the Tract
5900 developer's portion of the project. The estimated
amount of increase is $63,600, with the cost to be paid by
the assessment district.
STAFF RECOMMENDATION: Approve extension of Wilsey & Ham
contract with stipulation that the work is not authorized
until after the assessment district petition has been
received.
4.7 Injury and Illness Prevention Program - SB 198 Compliance
In accordance with SB 198, every employer in California,
regardless of size, must establish, implement and maintain
an effective injury prevention program. Required
components of the program include: Implementation, Hazard
Identification, Hazard Correction, Hazard Communication,
Employee Compliance, and Health & Safety Training.
STAFF RECOMMENDATION: Adopt Resolution approving Program and
authorize implementation.
4.8 Finance Report for Period Ending October 31, 1991
STAFF RECOMMENDATION: Receive Report.
4.9 Warrant Register Dated November 12, 1991
STAFF RECOMMENDATION: Approve
5. WRITTEN COMMUNICATION - None
6. PUBLIC HEARING
6.1 Dublin Cinema Freestanding Sign variance Appeal PA 91-046
Dublin Cinema is appealing the Planning Commission's denial
of a variance request for the existing Dublin Cinema
Freestanding Sign. The Applicant requested to exceed the
maximum allowable sign area permitted and to deviate from
freestanding sign setback requirements of the Zoning
Ordinance.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
adopt Resolution upholding the Planning commission action
denying variance request -OR- give Staff and Applicant
direction and continue the matter.
6.2 No Parking Zone on Donlon Way
Staff recommends installing an 80' no parking zone on the
east side of Donlon Way at the driveway of the Kildara
development for visibility purposes.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
adopt Resolution
6.3 Density Bonus Ordinance - Request for continuance
On October 28, 1991, the City Council reintroduced the
Density Bonus Ordinance and directed Staff to report on the
portions of the Ordinance which are required by State Law
and portions which are discretionary to the City.
STAFF RECOMMENDATION: continue to City Council meeting of
November 25, 1991.

8. NEW BUSINESS
8.1 Draft Letter Regarding Tri-Valley Affordable Housing
A draft letter has been proposed by the Tri-Valley
Affordable Housing Committee and revised by the Tri-Valley
Joint Councils to the State Department of Housing and
Community Development requesting a change in State
Legislation to allow cities to provide affordable housing
jointly and still get credit toward their "fair share"
affordable housing allocation. The Tri-Valley Joint
Councils proposed that each city appoint a representative
and alternate representative to the Tri-Valley Affordable
Housing Committee.
STAFF RECOMMENDATION: Authorize Mayor to sign drafted letter
and appoint representative and alternate to Tri-Valley
Affordable Housing Committee.
