PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is not on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Clerk to have their particular concern placed on the agenda for a future meeting. The City Council cannot deliberate or take action on a non-agenda item unless there is factual evidence presented to the Council indicating that the subject brought up falls into one of the exceptions under Government Code Section 54954.2 in that a) there is an emergency situation, or b) the need to take action arose subsequent to the agenda being posted. 3.1 Introduction of new Employees James T. Jukich, Deputy; David J. Nyberg, Deputy; & Charlie Haines, Planning Intern 3.2 Presentation of Civic Center Flag to Harris Koenig of National Medical Enterprise 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public input may request the City Council to remove the item from the consent calendar. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Analysis of Newsrack Locations At the October 9 meeting, the City Council directed Staff to survey newsrack locations and identify any that blocked a sidewalk or were otherwise hazardous. This report describes the result of the survey. STAFF RECOMMENDATION: Receive report; authorize Staff to prepare a draft newsrack ordinance for a future meeting. 4.2 Appointments to the Citizens for a Valley Performing Arts Center (CVPAC) Committee At the City Council meeting of October 9, 1989, Gib Marguth, member of the CVPAC Committee requested the City of Dublin's participation on a valley-wide Performing Arts Center Feasibility Study Committee. In response to the City's request for participants, a number of individuals have expressed interest in representing Dublin on the Committee. STAFF RECOMMENDATION: Appoint representatives to the CVPAC. 4.3 Landscape Architectural Services for the Renovation of Dublin High Football Field & Track Review and award contract to Beals/Lechner Associates. STAFF RECOMMENDATION: 1) retain firm of Beals/Lechner Associates to provide landscape architectural services for the renovation of Dublin High Football Field & Track 2) direct Staff to prepare the documents necessary to execute the contract agreement at a cost not to exceed $47,220. 4.i Authorization to Solicit Bids for the Printing of the 1990 Community Calendar During the City Council Goals & Objectives session, the City Council expressed an interest in continuing to publish a community calendar on an annual basis. Staff is currently working with a local typesetter in the design and formatting of the calendar. The next step will involve the printing of the calendar. Pursuant to the City's Purchasing Ordinance, all purchases of this type which exceed $5,000 must be secured through a formal bid process. It is anticipated that this project will exceed $5,000. Accordingly, Staff has prepared a bid specifications package. STAFF RECOMMENDATION: Authorize Staff to solicit bids. 4.5 Disadvantaged Business Enterprise Program (DBE) At the 10/30/89 City Council meeting, the City Council continued the DBE goal item and requested that Staff investigate whether the City's DBE goal could be adopted on an ongoing basis rather than renewed annually. The State has advised that the period can be open ended. STAFF RECOMMENDATION: Adopt resolution establishing ongoing 10% DBE goal. 4.6 Annual Tree Lighting Ceremony The Council will review the plans made for the annual holiday ceremony scheduled for December 4, 1989. STAFF RECOMMENDATION: Review and approve plans. 4.~7 Budget transfer to fund Mortgage Credit Certificate (MCC) Program During the 1988-89 Fiscal Year, the City Council agreed to participate in the Mortgage Credit Certificate (MCC) Program to assist first time homebuyers. The invoice has recently been received, but the funds for the MCC Program were not budgeted in the 1989-90 Fiscal Year. STAFF RECOMMENDATION: Authorize additional appropriation of $4,000 to Planning Contract Services account. 4.8 Warrant Register dated November 13, 1989 STAFF RECOMMENDATION: Approve 4.9 City Treasurer's Investment Report as of October 31, 1989 STAFF RECOMMENDATION: Approve 4.10 October 1989 Financial Statements STAFF RECOMMENDATION: Review, accept & file the statements. 5. }i~ll.1~H_QQt!t!QHIQ.!!lQH~ 5.1 Request for Funding from Tri-Valley Minor Hockey Association, Tri-Valley Hockey has requested $2,000 to purchase equipment. are Dublin resents. PUBLIC HEARING ----.---------- 6.1 Repeal of Selected Alameda County Ordinances As a result of the City's contract with Book Publishing Company to prepare a Municipal Code, several provisions of the Alameda County Code have been identified which need to be repealed. STAFF RECOMMENDATION: Open public hearing; receive public testimony; close public hearing; deliberate; waive reading & adopt Ordinance. 6.2 Public Hearing: Ordinance which adopts the 1988 Edition of the Uniform Building Code, 1988 Uniform Plumbing Code, 1988 Uniform Mechanical Code and 1988 Uniform Housing Code. This ordinance repeals existing Ordinance No. 58-87. The state law requires the City to adopt new editions of uniform codes within 6 months after the state has adopted the new codes. STAFF RECOMMENDATION: 1) Open public hearing; 2) Receive Staff presentation; 3) Receive public testimony; 4) Close public hearing; 5) Discussion by Council members; 6) Waive the reading & introduce Ordinance which adopts the 1988 Edition of the Uniform Building Code, 1988 Uniform Plumbing Code, 1988 Uniform Mechanical Code, 1988 Uniform Housing Code. 7. QHKIHl~li~~_~Q~lH~~~ 7.1 Selection of Bus Stop Benches "Wheels" will be installing bus shelters at a number of bus stops early in 1990. The City Council requested that Staff investigate replacement of the advertising benches for those stops not getting shelters. This report discusses 3 options for those locations. STAFF RECOMMENDATION: 1) Select bench option A, B, or C; 2) Select color; 3) Either a) authorize Staff to solicit bids for units to be delivered & installed at the time LAVTA's bus shelters are installed; or b) direct Staff to include bus benches in the 1990-91 Annual Budget. If Option 3 is selected, a budget transfer from the Contingent Reserve would be required at the time the bid was awarded. 7.2 Report on the Alameda County Local Agency Formation Commission (LAFCO) Draft Doolan Road Sphere of Influence Study and Environmental Impact Report The Alameda County Local Agency Formation Commission (LAFCO) has had the Draft Doolan Road Sphere of Influence Study and EIR prepared. The Study recommends that LAFCO include the Doolan Road area in the City of Dublin's Sphere of Influence. STAFF RECOMMENDATION: 1) Strongly support the Study recommendation; 2) Direct Staff to submit written comments to LAFCO; and 3) Direct Staff and/or a City Council representative to attend the LAFCO hearing and make a presentation. 8.
