ORAL COMMUNICATIONS 3.1 Introduction of New Employee: Deputy Jeffrey D. Mecchi, Dublin Police Services (700-10) 3.2 Certificate of Recognition for Two Dublin Teachers (610-50) The City Council will present certificates of recognition to Michelle Stanchina and Lisa Pong for their recent achievement of being named two of Alameda County's 2010 Teachers of the Year. STAFF RECOMMENDATION: Present Certificates of Recognition. 3.3 "National Family Week" Proclamation (610-50) The City of Dublin will present a proclamation regarding "National Family Week." STAFF RECOMMENDATION: Present proclamation. 3.4 2010 Business Anniversary Awards (470-70) The City Council will recognize those businesses that have been in Dublin 20, 30, 35 and 40 years. STAFF RECOMMENDATION: Recognize those businesses that have been in Dublin for 20, 30, 35 and 40 years. 3.5 Presentation by Livermore Amador Valley Transit Authority (LAVTA) (1060-20) LAVTA Planning Director Jeff Flynn will update the City Council on the launch of the new Bus Rapid Transit Service. STAFF RECOMMENDATION: Receive nresentation. 3.6 Appointment to a Tri-Valley Human Services Needs Assessment Steering Committee (ll0-30) As part of a three-city collaborative, the City of Dublin has been asked to provide a member to participate in a Tri-Valley Human Services Needs Assessment Steering Committee. This Committee member will represent the Dublin Community and will provide guidance and feedback to this project over the next year. STAFF RECOMMENDATION: Confirm the Mayor's appointment to the Tri-Valley Human Services Needs Assessment Steering Committee. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procetlure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who woultl like an item removed from the Consent Calentlar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of November 2, 2010 STAFF RECOMMENDATION: Approve minutes. 4.2 City Treasurer's Investment Report for lst Quarter 2010-2011 (320-30) The City's investment portfolio totals $90,326,716 (par value). As of September 30, 2010, funds were invested at an average yield of 1.620%. The portfolio includes both discretionary and restricted funds and the balance will fluctuate throughout the year. The report presented provides background on the City investment portfolio as well as the investment results as of September 30, 2010. STAFF RECOMMENDATION: Receive the Quarterly Investment Report. 4.3 Updates to the City's Construction and Fire Codes in Accordance with Requirements of State Law (440-10) The 2010 Edition of the California Building Codes Standards (CBSC) was approved by the California Building Standards Commission earlier this year and will go into effect on January 1, 2011. In order to ensure the continuity of the City's building standards, the City must adopt an Ordinance incorporating the new codes which take effect on January 1, 2011. The City Council is being asked to review and adopt an Ordinance repealing the 2007 California Building Codes Standards and adopting the 2010 California Building Codes Standards. This is the second reading of this Ordinance. STAFF RECOMMENDATION: Waive reading and adopt Ordinance Repealing Chapters 5.08 (Fire Code), 7.28 (Building Regulation Administration), 7.32 (Building Code), 7.36 (Electrical Code), 7.40 (Plumbing Code), Chapter 7.44 (Mechanical Code), 7.52 (Abatement of Nuisances), and 7.94 (Green Building Code) of the Dublin Municipal Code; and Adding Chapters 5.08 (Fire Code), 7.28 (Building Regulation Administration), 7.32 (Building Code), 7.34 (Residential Code), 7.36 (Electrical Code), 7.40 (Plumbing Code), Chapter 7.44 (Mechanical Code), 7.52 (Abatement of Nuisances), and 7.94 (Green Building Code) of the Dublin Municipal Code In Order to Adopt By Reference and Amend Provisions of the 2010 Edition of the California Building Standards Code, Title 24, California Code of Regulations 4.4 Quarterly Financial Report for the Period Ending September 30, 2010 (First Quarter Fiscal Year 2010-2011) (330-50) The City Council will be presented with preliminary information related to the revenues and expenditures through the end of the first quarter of Fiscal Year 2010-2011. Based on the completion of three months of activity the report will include analysis of significant trends and variances between budgets and actual expenditures. STAFF RECOMMENDATION: Receive the reports as authorized by Section 41004 of the California Government Code. 4.5 Request for Authorization to Use ECS Refining for the Recycling of City Electronic Waste and Surplus Computer Equipment (350-40) The City generates electronic waste in the form of computers, monitors, printers and other items that have reached the end of useful life. The City strives to dispose of these items in an environmentally responsible manner. It is proposed to use ECS Refining for the recycling of electronic waste that has accumulated over the past 14 months. November 16, 2010 Dublin City Council Agenda Page 2 of 5 STAFF RECOMMENDATION: Adopt Resolution authorizing the use of ECS Refining far the recycling of City electronic waste and surplus computer equipment. 4.6 Release of Security for the Common Landscape Improvements for Tract 7282 (600-60) Lennar Homes has completed the common landscape improvements for Tract 7282. It is now appropriate for the City to release the security bonds for these common landscape improvements. STAFF RECOMMENDATION: Adopt Resolution regarding Release of Security for the Common Area Landscape Improvements for Tract 7282. 4.7 Approval of Tract Improvement Agreement for Tract 7540, Silvera Ranch Phase 4(KB Homes) (600-60) KB Homes, dba KB Home South Bay, Inc., has purchased Tract 7540, Silvera Ranch Phase 4 from Pinn Brothers Fine Homes, dba Pfeiffer Ranch Investors II, Inc. KB Homes has executed a tract improvement agreement and posted security to guarantee completion of improvements associated with the tract, allowing security previously posted by Pinn Brothers Fine Homes to be released. STAFF RECOMMENDATION: Adopt Resolution Approving Tract Improvement Agreement for Tract 7540, Silvera Ranch Phase 4. 4.8 Acceptance of Traffic Safety Grants and Amendment of the Fiscal Year 2010-2011 Budget to Include Grant Funds (580-40) Dublin Police Services has been awarded grant funds under two programs. 1) "Click it or Ticket" Mini-Grant from the State of California Office of Traffic Safety. The purpose of the grant is to instill the importance of traffic safety laws and seat belt usage through education and enforcement efforts in the community. 2) A grant award for continued participation in the Avoid the 21 DUI Campaign. This is a multi-agency effort to conduct targeted enforcement to reduce the incidence of driving under the influence. STAFF RECOMMENDATION: Adopt Resolution Approving Agreement with the Regents of the University of California and Authorizing Continued Participation in the "Avoid the 21" DUI Campaign Grants Administered by Livermore Police Department; and approve the budget change. 4.9 Acceptance of Work - Contract Number 09-02 (Robert A. Bothman) Fallon Sports Park and Eastern Dublin Arterial Improvement Projects (600-35) Construction Contract No. 09-02 was work performed under a contract awarded to Robert A. Bothman. The work is now complete and ready for City Council acceptance. The improvements constructed included Fallon Sports Park Phase I Improvements and Median Landscaping Improvements (adjacent to the Fallon Sports Park). The balance of retention held by the City will be released after 35 days of acceptance if there are no subcontractor claims. In addition to the acceptance of wark, Staff is also seeking City Council approval on Contract Change Order #38 in the amount of $55,000. STAFF RECOMMENDATION: Approve Change Order #38 in the amount of $55,000; authorize the City Manager to accept the final facility improvements; adopt Resolution Accepting Improvements to Fallon Sports Park Phase I; and authorize Staff to accept a maintenance bond in the amount of $957,036.00 4.10 Check Issuance Reports and Electronic Funds Transfers (300-40) STAFF RECOMMENDATION: Review and authorize the issuance of payments. 5. PUBLIC HEARINGS 6.1 Amendment to Master Development Agreement for the Dublin Ranch Project for Grafton Plaza Project (600-60) The Applicant is requesting approval of an Amendment to the Master Development Agreement between the City of Dublin and the Lin Family for the Dublin Ranch Project (Areas A, B, C, D, E, F, G and H) relating to Grafton Plaza, which is located on 25.33 gross acres within the Eastern Dublin Specific Plan Area. This Amendment incorporates the various land use changes for the Grafton Plaza project into the Master Development Agreement. Action on this item will not result in any development on the property. There will be several future actions on this project that will each be noticed for a public hearing to allow citizen input. STAFF RECOMMENDATION: Conduct public hearing, deliberate, waive the reading and INTRODUCE an Ordinance Approving Amendment No. 2 to the Master Development Agreement between the City of Dublin and the Lin Family for the Dublin Ranch North Project (~lreas A, B, C, D, E, F, G and H), PA 07-006. 6.2 Designation of Parking Restriction on Maguire Way (820-80) The City received a request from the community manager for The Terraces at Dublin Ranch to implement a parking restriction on Maguire Way to help facilitate truck access to the trash compactor area. The proposed parking restriction would prohibit parking for a 59-foot section of Maguire Way on the north side of the street between the hours of 6:00 a.m. and 12:00 p.m. every Thursday morning. STAFF RECOMMENDATION: Conduct public hearing, deliberate, and adopt Resolution Amending the Dublin Traffic Code Approving a Parking Regulation on Maguire Way. 6.3 City of Dublin Climate Action Plan and Negative Declaration (530-50) The proposed City of Dublin Climate Action Plan (CAP) provides policies and measures aimed at reducing greenhouse gas (GHG) emissions within the City. The goal of the CAP is to reduce Dublin's community-wide GHG emissions by 20% below a business-as-usual scenario by 2020. The CAP identifies a variety of ineasures to achieve the City's GHG reduction target. The various GHG reduction measures are organized into three broad categories, which include: 1) transportation and land use measures; 2) energy measures; and 3) solid waste and recycling measures. The City expects to reduce GHG emissions through a combination of reduction measures that are included in the CAP. These include measures that are under the City's control and State initiatives aimed at reducing GHG emissions. STAFF RECOMMENDATION: Conduct public hearing, deliberate, adopt Resolution Adopting a Negative Declaration for the City of Dublin Climate Action Plan; and adopt Resolution Adopting the City of Dublin Climate Action Plan. 7. UNFINISHED BUSINESS - None. 8. NEW BUSINESS 8.1 Feasibility of Public Access Defibrillation Program (540-70) The Dublin City Council established a Fiscal Year 2009-2010 Goal to "study the feasibility of the City establishing a process that would require business participation in the Alameda County Public Access Defibrillation (PAD) program". Staff has researched the topic in an effort to determine if other jurisdictions have required participation in established PAD programs, to what extent state and local laws may impact such PAD program participation in Dublin, and the costs (at a cursory level) associated with a program. Staff is seeking further direction from the City Council on this item. STAFF RECOMMENDATION: Direct Staff to develop an outreach program with the goal of educating new and existing businesses within Dublin of the County's PAD program and to return to the City Council with the results of a comparative review after one year to determine program outcomes.
