3.3 Public Comments
At this time, the public is permitted to address the City Council op non-agendized items. Please step to the podium and clearly state your name
for the record. COMMENTS SHOULD NOT EXCEED THREE /3) MINUTES. In accordance with State Law, no action or discussion may take
place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request
Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the
proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take
action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3).

Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action, Members
of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the
Mayor to remove the item.
4.1 Minutes of Regular Meeting of September 16, 2008 and October 7, 2008
STAFF RECOMMENDATION: Approve minutes.

4.2 Schaefer Ranch South: PD -Planned Development Rezone with Stage 2 Development Plan
for an 81.3+/- acre area, and a Development Agreement, PA 08-005 (600-60/450-30)
The City Council will hold a second reading and consider adopting an Ordinance approving a
Planned Development Rezone with Stage 2 Development Plan for an 81.3+/- acre area and an
Ordinance approving a Development Agreement for the Schaefer Ranch South project located
at the southwest corner of Dublin Boulevard and Schaefer Ranch Road.
STAFF RECOMMENDATION: Waive reading and adopt Ordinance Approving a PD-Planned
Development Rezone with Stage 2 Development Plan for the Project Known as Schaefer Ranch
South; and adopt Ordinance Approving a Development Agreement between the City of Dublin
and Schaefer Ranch Holdings.
4.3 Development Agreement for Fallon Crossing between the City of Dublin and Standard
Pacific Corp. for 106 Single-Family Residential Units on 67.8 acres, PA 04-016 (600-60)
The City Council will consider a Development Agreement between Standard Pacific
Corporation and the City of Dublin. This is the second reading of this ordinance.
STAFF RECOMMENDATION: Waive reading and adopt Ordinance Approving the
Development Agreement for PA 04-016 Fallon Crossing between the City of Dublin and
Standard Pacific Corporation.
4.4 The Green on Park Place -Development Agreement between the City of Dublin and
StockbridgeBHV Emerald Place Land Company for The Green on Park Place Retail
Center Project, PA 07-019 (600-60)
The City Council will consider a Development Agreement between the City of Dublin and
StockbridgeBHV Emerald Place Land Company for The Green on Park Place Retail Center
Project. This is the second reading of this ordinance.
STAFF RECOMMENDATION: Waive reading and adopt Ordinance Approving a
Development Agreement between the City of Dublin and StockbridgeBHV Emerald Place Land
Company for The Green on Park Place Retail Center Project.
4.5 Anderson Development Agreement -Development Agreement for the 108-Unit Apartment
Project on the Northern Seven Acres of the Anderson Property, PA 07-037 (600-60)
The City Council will consider approving a Development Agreement for the 108-unit
residential project on the Anderson property. This is the second reading of this ordinance.
STAFF RECOMMENDATION: Waive reading and adopt Ordinance Approving a
Development Agreement between the City. of Dublin and Dublin RE Investors LLC for the
Northern 7 Acres of the Anderson Property (APN 905-0006-001), PA 07-037.
4.6 Fiscal Year 2008-2009 Goals & Objectives Status Report and CIP Schedule (100-80)
Staff has prepared a report apprising the City Council of the status of the Fiscal Year 2008-
2009 Goals & Objectives as of October 31, 2008, as well as a schedule of the City's Capital
Improvement Program indicating estimated project start and completion dates.
STAFF RECOMMENDATION: Receive the report.
4.7 Consulting Services Agreement for Citywide Street Storm Drain Condition Assessment,
Phase II (600-35)
The City will contract with Post, Buckley, Schuch & Jernigan, Inc. (PBS&J) to generate a
report on the condition of the storm sewer system in the oldest section of Dublin, as well as a
recommended schedule of maintenance. This will complete Year 1 of the Citywide Street
Storm Drain Condition Assessment.
STAFF RECOMMENDATION: Adopt Resolution Approving Agreement with Post, Buckley,
Schuch & Jernigan, Inc., for the Citywide Street Storm Drain Condition Assessment, Phase II.
4.8 Agreement with East Bay Pool Service for Pool Maintenance Services (600-30)
The City Council will consider entering into a new three-year agreement with East Bay Pool
Service to provide pool maintenance services at the Dublin Swim Center.
STAFF RECOMMENDATION: Adopt Resolution Approving Agreement with East Bay Pool
Service for Pool Maintenance Services.

4.9 Approval of Consulting Services Agreement with Fehr & Peers for Traffic Engineering
Services (600-35)
The City Council will consider entering into an agreement for traffic consulting services with
Fehr & Peers to conduct traffic studies for new development; as well as a peer review of other
traffic studies.
STAFF RECOMMENDATION: Adopt Resolution Approving Consulting Engineering Services
Agreement with Fehr & Peers to Perform General Traffic Engineering Services.
4.10 Fiscal Reports for Fiscal Year 2007-2008 (330-50)
This item provides the report of the financial statements as of June 30, 2008. The annual
Audit and Comprehensive Annual Financial Report will be presented at a later date.
STAFF RECOMMENDATION: Receive the reports as authorized by Section 41004 of the
California Government Code.
4.11 Warrant Register ($974,305.38) dated November 18, 2008 (300-40)
STAFF RECOMMENDATION: Approve.
5. WRITTEN COMMUNICATIONS -None
6. PUBLIC HEARINGS
6.1 Amendment of Dublin Municipal Code Chapter 5.56 (Smoking Pollution Control) (560-90)
The City Council will consider amending its Smoking Pollution Control Ordinance to require
that 50% of units in new and existing multi-unit rental residences be designated as non-
smoking within a 24-month period. The proposed ordinance would prohibit smoking within
20 feet of windows, doors, and vents of non-smoking units. The proposed ordinance would
also require that apartment complexes disclose to prospective tenants the number and location
of smoking and non-smoking units within a complex, location of any smoking areas, and any
procedures for addressing smoking-related complaints. The City Council will also consider as
part of the proposed ordinance, prohibiting smoking in common outdoor areas of multi-unit
rental complexes.
STAFF RECOMMENDATION: Conduct public hearing, deliberate, waive reading and
INTRODUCE Ordinance Amending Chapter 5.56 of the Dublin Municipal Code relating to
Smoking Pollution Control.
6.2 Croak and Jordan Medium Density: General Plan and Eastern Dublin Specific Plan
Amendment to Require 50% of the Units within the Medium Density Land Use
Designation on the Croak and Jordan Properties Provide Private Yards, and a PD -
Planned Development Rezone with Amended Stage 1 Development Plan to Establish
Revised Private Yard Standards within the Medium Density Land Use Designation on the
Croak and Jordan Properties, PA 07-056 (420-30/410-55/450-20)
The City Council will hold a Public Hearing to consider the proposed General Plan
Amendment and Eastern Dublin Specific Plan Amendment to require 50% of the units in the
existing Medium Density land use designation on the Croak and Jordan properties to include
private yards, and a PD -Planned Development Rezone with amended Stage 1 Development
Plan to create development standards that require 50% of the Medium Density units on the
Croak and Jordan properties to provide private, flat yards with a minimum dimension of 18' x
18' and a minimum of 400 square feet.
STAFF RECOMMENDATION: Conduct public hearing, deliberate, adopt Resolution
Amending the City of Dublin General Plan and Eastern Dublin Specific Plan to Require that
50% of the Units within the Medium Density Land Use Designation on the Croak and Jordan
Properties Provide Private Yards (APN 985-0027-007, 905-0002-001, and 905-0002-002) PA
07-056; and waive reading and INTRODUCE Ordinance Approving a PD-Planned Development
Rezone with Amended Stage 1 Development Plan to Establish Revised Development Standards
for Private Yards within the Medium Density Land Use Designation on the Croak and Jordan
Properties (APN 905-0002-001, 905-0002-002, and 985-0027-07) PA 07-056.

6.3 Ordinance Adding Chapter 5.66 to Title 5 (Public Welfare) to the Dublin Municipal Code
relating to Maintenance of Foreclosed Residential Properties (600-60)
The City Council will consider adopting an Ordinance adding Chapter 5.66 to the Dublin
Municipal Code which will require maintenance of foreclosed residential properties in the
City of Dublin.
STAFF RECOMMENDATION: Conduct public hearing, deliberate, waive reading and
INTRODUCE Ordinance Adding Chapter 5.66 to Title 5 (Public Welfare) to the Dublin.
Municipal Code Relating to Maintenance of Foreclosed Residential Properties.
6.4 Amendments to the City of Dublin Inclusionary Zoning Regulations and Layperson's
Guide, PA 08-041 (450-20)
The City Council will consider approving Amendments to the City of Dublin's Inclusionary
Zoning Regulations to modify the method by which the sales price is calculated for
inclusionary units from individual household income to fixed income and household-size
assumptions within each of the two income levels (i.e., low and moderate); eliminate the
requirement to build owner-occupied very-low income units; and amend the ratio for
providing inclusionary owner-occupied units to be 60% for moderate units and 40% for low
income units; and amend the Layperson's Guide to be consistent with current market
conditions and the inclusionary regulations.
STAFF RECOMMENDATION: Conduct public hearing, deliberate, waive reading and
INTRODUCE Ordinance Amending Chapter 8.68 of the Dublin Municipal Code (The
Inclusionary Zoning Regulations) relating to Establishing Fixed Sales Prices for Owner-
Occupied Inclusionary Units; Eliminating the Requirements to construct Owner-Occupied Very-
Low Income Units; and, Altering the For-Sale Inclusionary Unit Income Ratios (PA 08-041);
and adopt Resolution Repealing Resolution No. 94-04 and Approving Guidelines to the
Inclusionary Zoning Regulations; Authorizing the City Manager to Subsequently Amend the
Guidelines; and Authorizing the City Manager to Execute Resale Restriction Agreements and all
Legal Documents that are Consistent with the Council-Approved Guidelines.
7. UNFINISHED BUSINESS
7.1 Draft Parks and Community Services Strategic Plan (100-80)
The City Council has a high priority objective to conduct an in-depth needs assessment and
opinion survey of Department programs and services, and develop a Strategic Plan to guide
the expansion of the Department over the next ten years. The needs assessment has been
completed. Staff has prepared a draft Strategic Plan for the City Council's consideration.
STAFF RECOMMENDATION: Receive report and adopt Parks and Community Services
Strategic Plan, or provide direction on modifications.
7.2 Update on Impacts to the Adopted Fiscal Year 2008-2009 City Budget and Financial Plan
from the State Budget and Economic Downturn (330-80)
Current economic conditions as well as the status of the State Budget are likely to impact the
City of Dublin. The adopted Fiscal Year 2008-2009 Budget was prepared with assumptions
that appear to be different than what is known after the first four months of operations. Staff
is offering a preliminary analysis of the impacts.
STAFF RECOMMENDATION: 1) Receive Staff report and any updated information that may
have become available after the report was prepared; 2) Defer the San Ramon Road Landscaping
Project; continue to freeze the vacant Administrative Aide position; and proceed with
replacement of the City Council dais chars, provided a suitable product exists that can utilize
Recycling Funds; or provide Staff with direction on modifications to be enacted at this time; and
3) Direct Staff to update the status as information becomes available and to present amid-year
Budget Adjustment and revised funding plan once adequate information is available.

8. NEW BUSINESS
8.1 Central Parkway Safety Improvements -Tassajara Road to Brannigan Street (820-40)
The City has received citizen requests for safety improvements and no parking restrictions on
Central Parkway and Dublin Boulevard between Tassajara Road and Brannigan Street. The
City Council will receive a presentation .examining a potential temporary project to address
these concerns.
STAFF RECOMMENDATION: 1) Receive report; 2) Establish a new CIP Project -Central
Parkway Safety Improvements -Tassajara Road to Brannigan Street; 3) Adopt Resolution
Approving No Parking Zones on Dublin Boulevard and Central Parkway between Tassajara
Road and Brannigan Street; and 4) Approve a Budget Change in the amount of $19,600 for
completion of this project in Fiscal Year 2008-2009.
8.2 City Treasurer's Investment Report for 1St Quarter 2008-2009 (320-30)
The City's investment portfolio totals $115,358,346 (par value). As of September 30, 2008,
funds were invested at an average yield of 3.740%. Staff will provide a background report on
the City investment portfolio as well as the investment results as of September 30, 2008.
STAFF RECOMMENDATION: Receive report.
9. OTHER BUSINESS
9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee
Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234).
