REPORT OF CLOSED SESSION ACTION ORAL COMMUNICATIONS 3.1 Introduction of New Employees: Police Services Sgt. Randy Skarphol and Public Works Inspector Roehl Barreras (File # 700-10) 3.2 Introduction of Assemblywoman Ellen Corbett (File # 610-50) 3.3 Bus Shelter Art Project (File #110-30) The Bus Shelter Art Project calls for the appointment of an Art Selection Committee. The Council will consider the Mayor's recommended appointments to the Committee. RECOMMENDATION: 1) Confirm Mayor's appointments to Committee: Business Community Representatives - Nancy Feeley and Heather Wolf; Community at Large Representatives - Bernice Bywater, Anita Carr and Tegan McLane; Heritage & Cultural Arts Commission Representative - Judy Lussie; and 2) Consider Committee representation by LAVTA. 3.4 Proclamation declaring November 15, 2001, "America Recycles Day" (File #610-50) 3.5 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent* Calendar items are typically non.controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of November 6, 2001 STAFF RECOMMENDATION: Approve 4.2 Proposition 40, Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Bond Act of 2002 (File #660-40) The City Council will consider a resolution in support of Proposition 40 on the March 5, 2002 ballot which allocates $2.6 billion for parks and historical resources, and land, air and water conservation. STAFF RECOMMENDATION: Adopt Resolution supporting Proposition 40. 4.3 Acceptance of Gift to the City (File #150-70) Soroptimist International of Pleasanton has donated $100 to be used for art in the City. Staff recommends that the donation be used for the Classical Affair at the Civic Art Exhibition. STAFF RECOMMENDATION: Accept gift; prepare formal acknowledgement to the donors; and approve Budget Change. 4.4 Amador Valley Boulevard - Speeding and Traffic Signal Coordination (File #$90-40) This report provides a response to a recent request regarding speeding and traffic signal coordination on Amador Valley Boulevard near Starward Drive. The City's Traffic Engineering and Police Services Staffhave addressed these issues and will continue to monitor the location in the future. STAFF RECOMMENDATION: Receive Report. 4.5 Authorization to Solicit Bids - Contract 01-15, Village Parkway U-Turn Lane at Davona Drive (File #600-35) This project will replace approximately 190 feet of an existing median island on Village Parkway with a southbound U-mm lane at the intersection of Davona Drive and Village Parkway to make room for two exclusive southbound lanes on Village Parkway. STAFF RECOMMENDATION: Authorize Staffto advertise for bids. 4.6 New Capital Improvement Project: Civic Center Electrical Improvements (File #200-30) The proposed improvements include electrical work needed to support the Traffic Operations Center equipment for the 1-580 Smart Corridor project, as well as the installation of a new sub- panel and transformer to provide capacity in the short term for additional office spaces and equipment. The estimated cost of the project is $20,000. No funds have been budgeted in the current fiscal year for the proposed work. STAFF RECOMMENDATION: Approve Budget Change for additional appropriation and authorize ' Staff to advertise for bids. 4.7 Acceptance of Improvements for Scarlett Drive Associated with Dublin Nissan Auto Dealership (File #600-30) The improvements of a new segment of Scarlett Drive extending from existing Scarlett Court along the east side of the Chabot Canal to the northern property line of the Dublin Nissan site have now been completed and it is appropriate to accept these improvements for maintenance. STAFF RECOMMENDATION: Adopt Resolution. accepting work as complete and approving regulatory traffic control devices installed as roadway improvements.. 4.8 Award of Bid, Contract 01-13 Civic Center Fuel Tank Upgrade (File # 600-35) The original project intended to provide a watertight seal for street boxes and install a leak sensor: The scope of work for this project was revised after development of the budget, due to additional requirements imposed by the Alameda County Environmental Health Service. Consequently, the low bid received exceeds the original budget for the project. An additional appropriation in the amount of $17,412 is needed to award the contract. STAFF RECOMMENDATION: Adopt Resolution awarding bid to Paradiso Mechanical, Inc. ($22,193) and approve $17, 412 Budget Change from unallocated reserves. 4.9 4.10 4.11 4.12 4.13 Amendment to Tract Developer Agreement, Tract 6961 (Dublin Ranch Neighborhood L-6, "Highgrove") to Extend Completion Date by One Year (File # 600-60) This amendment would extend the existing Tract Developer Agreement for completion of tract improvements. The public streets have been installed within this Tract; however, the homes are still under construction. Staff recommends that the Tract (and public streets) not be accepted until the use of heavy equipment has been completed STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute amended agreement. Financial Reports for the Month of October 2001 (File #330-$0) RECOMMENDATION: Receive Report. Budget Carryovers from Fiscal Year 2000-2001 to Fiscal Year 2001-2002 (File #330-20) As part of the process of reviewing the Final'Financial Reports for Fiscal Year 2000-2001, Staff noted several Capital Projects and Operating budget line items that were originally anticipated to be completed in Fiscal Year 2000-2001 that are now scheduled for completion in Fiscal Year 200.1~2002. Staff is recommending the adoption of proposed budget changes so that these projects are.fully funded in Fiscal Year 2001-2002. STAFF RECOMMENDATION: Approve Budget Changes. Amendment to Consulting Services Agreement with Washington Infrastructure Services (formerly MI(Centennial) for the Widening of Dublin Boulevard from Village Parkway to Sierra Court (Modification to Scope of Work and Additional Compensation) (File #600-30) The plans, specifications and estimates for ,the Dublin Boulevard Widening Project between Village Parkway and Sierra Court are nearing .completion. This amendment would cover the changes in scope for the project design services, as well as extend the contract to cover engineering services during construction. STAFF RECOMMENDATION: Adopt Resolution approving amendment No. 2 to Washington Infrastructure Services cOntract and approve Budget Change. Warrant Register ($1,778,473.17) dated November 20, 2001 (File #300-40) STAFF RECOMMENDATION: Approve WRITTEN COMMUNICATIONS - None PUBLIC HEARING 6.1 Enforcement of Police Parking Spaces at Hacienda Crossings (File # $90-30) This is the second reading of an Ordinance which would allow parking enforcement in three designated police parking spaces in the Hacienda Crossings shopping center parking lot. The Ordinance was modified from its original version; a section designating the spaces as tow-away zones was deleted, and a clause was added which would allow the shopping center to convert the spaces back to customer parking spaces in the future. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.2 California Vehicle Code (CVC) Enforcement on John Monego Court (File # 590-30) John Monego Court is located south of Dublin Boulevard between Glynnis Rose Drive and Tassajara Creek and serves the General Motors and KoH DeVelopment sites. The street has not been accepted by the City but is open to the public. Adoption of this resolution would allow enforcement of traffic regulations on John Monego Court. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution. 10. UNFINISHED BUSINESS 7.1 City Maintenance Quality Assurance Program (File # 360-20) In response to the City Council's direction, the City's maintenance contractor, MCE, has developed a Quality Assurance Program for the performance of maintenance in the Dougherty Assessment District. MCE will make a presentation of the program, which sets standards of maintenance and provides for monthly inspections to determine areas of emphasis and identify capital improvement needs. STAFF RECOMMENDATION: Receive report and provide appropriate comments. NEW BUSINESS 8.1 A Resolution of the City Council of the City of Dublin Establishing a Compensation Policy for Military Reservists Employed by the City of Dublin and Called to Serve in "Operation Enduring Freedom (File # 700-40) This proposed resolution extends State and Federal Law (beyond the required 30 days), to City employees' in the Reserves or National Guard who are called to serve in "Operation Enduring Freedom," to provide the difference between the amount of an employee's military pay and the amount s/he would have received from the City for performing his/her normal duties, for a period extending up to one year from the start of the military leave. STAFF RECOMMENDATION: Adopt Resolution. 8.2 Status Report on the 20th Anniversary Celebration (File #950-40) In May 2001 the City Council appointed a Sub-Committee to work with Staffto formulate recommendations for celebrating the City's 20~' anniversary of incorporation. Staffwill highlight the Sub-Committee's recommendations. STAFF RECOMMENDATION: Review recommendations and provide direction to Staff with respect to commemorative banners, letterhead, patch, quilt and preferred location; and approve Budget Change. 8.3 Civic Center Library Time Capsule (File # 940-50) The City Council will determine the size and makeup ora Time Capsule to be incorporated as part of the new Library project. RECOMMENDATION: Provide direction to Staff with respect to items to be included and length of time to be sealed; direct Staff to include a "Time Capsule" booth at the St. Patrick's Day Celebration to solicit community input; and authorize Staff to proceed with installing the vault in the proposed location in from of the new Library. 8.4 Council Chambers Live Cablecast System (File #1050.10) The City currently broadcasts its Council meetings on CTV the day following the meeting. Due to a new cable television franchise agreement negotiated with AT&T, the City has the opportunity to provide live transmission of its Council meetings and to equip the Council Chambers with permanent cameras and production equipment. STAFF RECOMMENDATION: Determine whether the City should provide live transmission of its Council meetings and, if so, determine whether the City should purchase in-house cameras and production equipment. 8.5 Code Enforcement Policy Update (File # 450-20) The City Council will review the current Enforcement Policy and direct Staff to make changes deemed appropriate. STAFF RECOMMENDATION: Provide appropriate direction to Staff.
