CALL TO ORDER & CLOSED SESSION (6:30 v.m.) CONFERENCE WITH LEGAL COUNSEL - ANTICIPA TED L1TIGA TION Government Code section 54956.9, subdivision c Initiation of litigation (two potential cases) 1. CALL TO ORDER & PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT OF CLOSED SESSION ACTION 3. ORAL COMMUNICATIONS 3.1 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. . 4.1 Minutes - None 4.2 Fiscal Year 2007-2008 Goals & Objectives Status Report and CIP Schedule (100-80) Staff has prepared a report apprising the Council of the status of the Fiscal Year 2007-2008 Goals & Objectives as of October 31, 2007, as well as a schedule of the City's Capital Improvement Program 'indicating estimated project start and completion dates. STAFF RECOMMENDATION: Receive the Report. November 20, 2007 Dublin City Council Agenda Page 1 of 4 4.3 Adopt an Ordinance Repealing and Adopting New Chapters 5.08, "Fire Code," and 7.32, "Building Code," and Amending Chapters 7.28, "Building Regulation Administration," 7.36, "Electrical Code," 7.40, "Plumbing Code," and 7.44, "Mechanical Code," of the Dublin Municipal Code (610-20) The City Council will consider adopting an Ordinance repealing and adopting new chapters to the Dublin Municipal Code. STAFF RECOMMENDATION: Waive Reading and adopt Ordinance repealing and adopting. new Chapters 5.08, "Fire Code," and 7.32, "Building Code," Adding Chapters 5.08, "Fire Code," and 7.32, "Building Code," and Amending Chapters 7.28, "Building Regulation Administration," 7.36, "Electrical Code," 7.40, "Plumbing Code," and 7.44, "Mechanical Code," of the Dublin Municipal Code; and adopt Resolution approving the revisions to Resolution 49-06 as it pertains to Building Permit Valuations and the Building Codes in effect. 4.4 Approval of Consulting Services Agreement with Associated Right of Way Services, Inc. to Perform Right of Way Negotiation and Acquisition for the Saint Patrick Way - Regional Street to Golden Gate Drive Project (600-30) This action would approve a Consulting Services Agreement with Associated Right of Way Services, Inc., to perform right of way negotiation and acquisition on a parcel for this project, which will extend Saint Patrick Way from Regional Street to Golden Gate Drive. These services are funded through the Downtown Traffic Impact Fee and mitigation contributions. STAFF RECOMMENDATION: Adopt the Resolution approving the Consulting Services Agreement with Associated Right of Way Services, inc., and authorizing the Mayor to execute the Agreement. 4.5 Acceptance of Work - Contract 07-11, Civic Center Roof Repair (600-35) This project repaired worn areas on the roof of the Civic Center and installed protective walk pads to preclude future wear or damage. STAFF RECOMMENDATION: Accept improvements constructed under Contract No. 07-11, Civic Center roof Repair, and authorize final payment to the contractor, less retention in 35 days if no subcontractor or supplier claims are received. 4.6 Acceptance of Work - Contract 07 -08A, San Ramon Road Concrete Soundwall Sealing . (CIP NO. 94601) (600-35) This project cleaned and sealed the vertical face, including hairline concrete cracks, of the concrete barrierlsoundwalllocated along portions of the east side of San Ramon Road. The City Council will consider accepting these improvements and authorizing final payment to the contractor. STAFF RECOMMENDATION: Accept improvements under Contract No. 07-08A, San Ramon Road Concrete Soundwall Sealing (CIP No. 94601), and authorize the release of retention after 35 days if there are no subcontractor claims. 4.7 Waiver of Bid Requirement as Authorized by Municipal Code and Authorization to Purchase Two Lanier Copiers from Shamrock Office Solutions Under the US Communities Purchasing Agreement (350-20) The adopted Fiscal Year 2007/08 budget includes funding for the replacement of two copy machines. The US Communities Government Purchasing Alliance allows public agencies to purchase using a cooperative public bid process. The City Council will consider purchase of the two copiers under the agreement with US Communities at a cost of $34,345. STAFF RECOMMENDATION: Adopt Resolution authorizing purchase of two Lanier Copiers. November 20, 2007 Dublin City Council Agenda Page 2 of 4 4.8 Amendment to the City of DublinlCounty of Alameda Agreement regarding the Enforcement of Conditions of Approval for the East County Hall of Justice (Alameda County Courthouse) (410-30/600-40) Alameda County has submitted a request to extend the agreement for the Site Development Review approval term for the County Courthouse project for an additional 18 months. STAFF RECOMMENDATION: Adopt the Resolution approving an amendment to the Agreement between the City of Dublin and the County of Alameda regarding the enforcement of Conditions of Approval for the East County Hall of Justice. 4.9 Warrant Register ($1,717,527,01) dated November 20, 2007 (300-40) STAFF RECOMMENDATION: Approve. 5. WRITTEN COMMUNICATIONS 5.1 Correspondence from ABAG regarding Priority Conservation Areas (930-30) Correspondence has been received from ABAG informing the City that an area within the City of Dublin has been nominated as a Priority Conservation Area (PCA) for the FOCUS Regional Planning Program. The nomination was made by the East Bay Regional Park District for its Regional Trails System Gaps project and includes trail connections along the Tassajara Creek Trail, the Alamo Canal Trail and the Calaveras Ridge Trail. STAFF RECOMMENDATION: Direct Staff to notify AGAB of the City's support for the nomination. 5.2 Dougherty Hills Dog Park Petition (290-20) On November 5, 2006, the City was presented with a petition seeking "safety and imprQvement revisions" to the Dougherty Hills Dog Park. Staff has prepared an analysis of each requested revision for consideration by the City Council. STAFF RECOMMENDATION: Provide direction to Staff on the safety and improvement revisions requested by petitioners. 6. PUBLIC HEARINGS 6.1 (Continued from 11/06/07) Mitigated Negative Declaration, West Dublin BART Specific Plan Amendment, Stage 1 Development Plan Amendment and Stage 2 Planned Development Rezone for a 309-Unit Residential Community, P A 06-009 Windstar (400-20/410-55/450-30) The City Council will consider a Mitigated Negative Declaration, West Dublin BART Specific Plan Amendment, Stage 1 Development Plan Amendment and Stage 2 Planned Development Rezone to allow the construction of a 309 unit residential development. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution Adopting a Mitigated Negative Declaration and a Mitigation Monitoring and Reporting Program for the Windstar Project (P A 06-009); adopt Resolution Approving Amendments to the West Dublin BART Specific Plan for the Windstar Project, P A 06-009; and waive reading and INTRODUCE Ordinance Approving a PD-Planned Development Rezoning to Amend the Adopted Stage 1 Development Plan and Adopt a Stage 2 Development Plan for the Windstar Project (APN 941-1500-046-01), PA 06-009. UNFINISHED BUSINESS 7.1 Software System Assessment Report and Authorization to Circulate a Request for Proposal (RFP) for Procurement of Accounting & Building Permit Systems (350-20/60030) The City Council will receive an Assessment Report evaluating current Accounting and Permit Systems. The report concludes that the City should proceed with a procurement process by releasing a Request for Proposals from vendors. The. purchasing code allows this procurement method for technical purchases, when authorized by the City Council. STAFF RECOMMENDATION: Receive the Assessment Report and adopt the Resolution which will allow Staff to circulate the Request for Proposal as a means to procure new systems. .8. NEW BUSINESS 8.1 Poet Laureate & Local Historian (910-75) The Council will receive a report outlining two new volunteer positions for the City; a Poet Laureate and Local Historian, and will be asked to authorize the recruitment and selection process. STAFF RECOMMENDATION:. 1) Approve Poet Laureate and Local Historian positions; authorize Staff to advertise the positions. 2) Determine selection process; if a Selection Committee is the preferred process, authorize Staff to solicit representatives. 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from Council andlor Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
