ICATION8 3.1 Selection of Vice Mayor (File # 610-20) F~ch year at its first meeting ~ December, the Cit~ Council selects one of its members to serve as Vice Mayor for a one-year period. STAFF RECOMMENDATION: Select Vice Mayor. 3.2 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS ,SHOULD NOT EXCEE~ THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request St. afl to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City COuncil MAY discuss and/or take action on items not appearing on the agenda are contained in 'Government Code Section 54954.2(b)(!)(2)(3). 4. CONS, ENT CALENDAR Consent Calendar items are typically non.controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.] Minutes of Regular Meeting of November ]8, 200:3 STAFF RECOMMEND^TION: ^pprovc 4.2 Change Order Authorization - Contract No. 01-12,1-580/Tassajara Road interchange improvement Project (File # 600-35) This Change Order would include the h~sta]htion o£ new landscapL~g, i~rigation system, decorative pavers, a~d associated work in thc road medians on Tassajara Road betwee~ thc 1-580 overerossing a~d [Coil Center Drive. STAFF RECOMMENDATION: Approve Ctumgc O~der No. :22 in thc total amount of e ACCeptance of Storm Drain Line B Improvements in Dublin Ranch, Area H (File # 600-60) This 96" diameter reinforced concrete storm drain pipe originates on Dublin Boulevard in Dublin Ranch, Area G development and extends southerly through Area H to Caltmns' triple box culvert at 1-580 to take storm waters under the freeway to channels in Pleasanton. This project has been completed, and it is now appropriate for the City to accept the improvements in Area H for maintenance. The Lin Family, through the Sierra Land Development Coil>oration, has provided a Maintenance Bond in the amount of $121,000 to guarantee against any defects in the storm drain line improvements. STAFF RECOMMENDATION: Adopt Resolution. accepting improvements. 4.4 Amendment to Agreement with Deborah Ungo-McCormick for Planning Services (File # 600-3O) Staff is recommending an amendment to the existing contract with Planning Consultant, Deborah Un#o-McCormick, due to the increase in projects that are being submitted for processing. With several large projects such as Greenbriar Phase III, two large Baneor projects, one at Aleosta Boulevard and one at the old Pak N Save site and other large developments anticipated to begin construction, the need for this type of service continues to be high, therefore requiring Staff to seek additional services in order to keep up with the planning activities. STAFF RECOMMENDATION: Adopt Resolution approving amendment and authorize Community Development Director to sign on behalf of the City. 4.5 City Manager's Employment Agreement (File # 600-30) The Agency Negotiating Team (Vm. McCormick and Cm. Oravetz) have met with the City Manager regarding terms and conditions of employment and recommend adjustments to the City Manager's total compensation package to be effective July 1, 2003. STAFF RECOMMENDATION: Approve third Amendment to Agreement. 4.6 Amendment to Agreement with Page and Turnbull for Historical Resource Identification and Archaeological Assessment within the Donlon Way Area (File # 600-30) The City is proposing to amend the existing Agreement to include the additional scope of work and any future services that the City might require. STAFF RECOMMENDATION: Adopt Resolution approving amendment for on-call Planning Consultant and authorize City Manager to execute amendment. 4.7 Preliminary Financial Reports for the Month of October 2003 (File # 330-50) STAFF RECOMMENDATION: Receive Reports 4.8 Warrant Register ($1,712,743.72) dated December 2, 2003 (File # 300-40) STAFF RECOMMENDATION: Approve ~TTE. N COMMUNICATIONS' None etJm Ic ,a 6.1 Establishment of Speed Limits on Tassajara Road, Glynnis Rose Drive and Amador Plaza Road south of Dublin Boulevard (File # 590-20) This is the second reading of an Ordinance which would establish new speed limits for Tassajara Road, Glynnis Rose' Drive and Amador Plaza Road south of Dublin Boulevard based on recent engineering survey results. The recommendations are: Tassajara Road from 1-580 to Dublin Boulevard- 35 mph; Tassajara Road from Dublin Boulevard to northerly City Limit- 45 mph; Glynnis Rose Drive - 25 mph; and Amador Plaza Road south of Dublin Boulevard- 25 mph. STAFF RECOMMENDATION: Conduct public hearing; deliberate;, waive reading and adopt Ordinan~ establishing speed limits. 6.2 Greenbriar Homes Communities, Inc. - Tassajara Creek Phase III and V (Yarra-Yarra Raneh) PD Rezoning with Stage 1 Development Plan Amendment and Stage 2 Development Plan PA 02.048 (File # 600-60) This is the second reading of an Ordinance which would approve an application allowing the transfer of 85 allowable units on Phase III to Phase IV and to allow the construction of a 108 single.family development and one single-family estate home on approximately 22.3 acres of property located west of Tassajara Road and north of the Casterson property. The approximate 22.3 acres to be developed also includes 11.5 acres of open space. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt Ordinance. 6.3 Establish a Modified Right-of-Way Alignment for St. Patrick Way from Golden Gate Drive to Regional Street (File # 820-90) The City is processing a minor revision to the established fight-of-way alignment for the portion of St. Patrick Way between Golden Gate Drive and Regional Street in order to resolve concerns voiced by adjacent property owners. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance. UNF~ISHED BUSINESS. 7.1 Art in the Parks - Dolan Park (File # 900-50]600-30) The Heritage & Cultural Arts Commission and the Parks & Community Services Commission are recommending approval of the design "Dreams of Longing After Nothing" for Dolan Park. The City Council will hear a report from the Art Consultant and Artist Bryan Tedrick, and consider approval of the design. STAFF RECOMMENDATION: Approve artwork- OR- provide alternate direction. ge m W,l ,V, slm ss 8.1 8.2 Annual Review of Development Agreements for: Emerald Pointe; Costerson PropertY (Tassajara Meadows I); General Motors; Koll Development; Micro Dental; Tassajara Meadows II; Toll Brothers Area 4; Santa Rita Commercial Center (Tri-Valley Crossings/Homart); Dublin Ranch- Supplemental Areas F, G & H; Sybase; SPCA; Emerald Glen Village Center (Waterford); Greenbriar Homes Communities- Phase I; Dublin Ranch Area A, Neighborhoods A6 & A 7; Greenbriar Homes Communities- Phase 1 l; Commerce One; Schaefer Heights; Toll, Dublin Ranch, Area A, Neighborhood A-1; Opus Creekside Business Park; Toll, Dublin Ranch, Area G, Neighborhood H-l; Toll, Dublin Ranch, Area G, Neighborhood H-2; Toll, Dublin' Ranch, Area G, Neighborhood MH-1; Toll, Dublin Ranch, Area G, Neighborhood MH-2; Dublin Ranch Phase I, and Dublin Ranch Area A-H (~ne # 6OO-60) An annual review of Development Agreements (DA) is required by State Law and the City's Municipal Code. 'The City has'reviewed 25 DA's and concluded that the developers for the 25 projects are proceeding in good faith with the terms of the DA's. STAFF RECOMMENDATION: Adopt Resolution finding that the developers of the 25 Development Agreements have complied in good faith with the terms and conditions of the Agreements during the past year and conclude the period of review. Initiation of a General Plan Amendment Study for a 30,000 + sq. ft. site, located on starward Drive (APN 941-0173-002-02 7475 Starward Drive) (File # 420-30) Robert Enea is requesting a General Plan Amendment for this site to redesignate thc property from Retail/Office to Medium-High and High Density Residential. STAFF RECOMMENDATION: Adopt appropriate Res. 0!ution either authorizing or denying request. 8.3 Tri. Valley Regional Performing Arts Collaborative Marketing (File # 900-40) The City Council will cOnsider marketing cultural arts programs collaboratively with Danville, Livermore, San Ramon and Pleasanton by placing a Cultural Arts page in each city's Activity Guide highlighting the regiOn's cultural and performing arts. STAFF RECOMMENDATION: Approve collaborative marketing effort with other Tri-Valley Cities. 8.4 Utility Undergrounding Priorities (Update) (File # 1020-30) PG&E sets aside funds each year for communities to underground overhead utility lines as required by the State Public Utility Commission. This is a proposal to change the priorities for these undergrounding projects based on the City's Street Capital Improvement Program priorities. STAFF RECOMMENDATION: Review and approve recommended priorities - OR- provide direction to Staff regarding any changes in the undergrounding priorities. 8.5 Approval of Loans, Promissory Notes and Deed of Trust for Fairway Family Apartments and Dublin Ranch Senior Apartments and authorization to eXecute documents which make the City's right to payment from the apartment projects and its regulatory agreement subordinate to senior lenders for the projects (File # 600-30) The City Council will consider providing a loan of $2,250,000 for Fairway Family Apartments and $2,250,000 for Dublin Ranch Senior Apartments to support construction of affordable housing in Dublin Ranch. STAFF RECOMMENDATION: AdoPt R~o!uflon. approving two loan Agreements, authorize the Mayor, Mayor Pro Tempore or City Manager to sign the loan agreements in substantially thc form attached, and authorize the City Manager or designee to sign other documents pursuant to which the City's right to receive payment from project cash flow and the City's regulatory agreement (Affordable Housing Agreement) will be subordinate to senior lenders for the two projects.
