Senior Center Advisory Committee Annual Report The Senior Center Advisory Committee will present an Annual Report on the Senior Center's activities and programs offered this year. STAFF RECOMMENDATION: Receive the report. 3.2. Amador Valley Industries Service and Programmatic Overview The City Council will receive a report from the City's franchised solid waste hauler, Amador Valley Industries, on the services and programs offered to the community. STAFF RECOMMENDATION: Receive the presentation. 3.3. Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked,or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1. Minutes of the November 18,2014 Regular City Council Meeting The City Council will consider approval of the minutes of the Regular City Council meeting of November 18, 2014. STAFF RECOMMENDATION: Approve the minutes of the November 18, 2014 Regular City Council meeting. 4.2. Fallon Sports Park Phase II -Consultant Services for Construction Management The City Council will consider a consultant services agreement for construction management services for Fallon Sports Park Phase II. STAFF RECOMMENDATION: Adopt the Resolution Approving an Agreement with E. Majdalani Construction Management, Incorporated for Construction Management Services related to the Fallon Sports Park Phase II. December 2,2014 Dublin City Council Agenda Page 1 of 4 4.3. Zoning Ordinance Amendment to Chapter 8.76 (Off-Street Parking and Loading) related to the Village Parkway Pilot Parking Program (PLPA-2014-00051) The City Council will consider City-initiated amendments to Chapter 8.76 (Off-Street Parking and Loading) of the Dublin Zoning Ordinance to extend the program to temporarily eliminate the parking standards in the Downtown Dublin Specific Plan Village Parkway District for an additional five (5) years. The existing program has been in effect since January 2013 and will expire in January 2015 unless renewed. The proposed amendments will also establish a parking standard for new commercial construction. On November 18, 2014, the City Council waived the reading and introduced an Ordinance adopting the proposed Zoning Ordinance Amendments. The City Council is being asked to waive the second reading and adopt the Ordinance approving the Amendments. STAFF RECOMMENDATION: Waive the reading and adopt the Ordinance Approving a Zoning Ordinance Amendment to Chapter 8.76 (Off-Street Parking and Loading) related to the Village Parkway Pilot Parking Program. 4.4. Adoption of Amendments to Dublin Zoning Ordinance Chapters 8.08 (Definitions), 8.12 (Zoning Districts and Permitted Uses of Land), 8.40 (Accessory Structures and Uses Regulations), 8.64 (Home Occupations Regulations), 8.76 (Off-Street Parking and Loading Regulations), and 8.116 (Zoning Clearance) and the creation of Chapter 8.65 (Cottage Food Operations) (PLPA-2014-00031) Assembly Bill (AB) 1616 allows individuals to prepare and/or package certain foods in private-home kitchens referred to as "cottage food operations." The enactment of AB 1616 provides cottage food operators with the opportunity to operate a small scale food business from their private home and requires that cities and counties allow them. However, AB 1616 also permits the adoption of local ordinances to impose reasonable standards, restrictions and requirements concerning spacing and concentration, traffic control, parking and noise control. AB 1616 also requires that cottage food operators be registered or permitted by the local environmental health agency before commencing business. Staff is proposing that the Zoning Ordinance be amended to allow cottage food operations to be permitted by-right in residential areas subject to certain standards appropriate for a home based business and consistent with State law. Minor amendments to the existing Home Occupations Regulations are also proposed for clarity and internal consistency. At the November 18, 2014 City Council Meeting, the City Council waived the reading and introduced an Ordinance adopting the proposed Zoning Ordinance Amendments. Adoption of Resolution Authorizing Submittal of Applications for all CalRecycle Grants for Which the City of Dublin is Eligible The City Council will consider authorizing the City's participation in the California Department of Resources, Recycling and Recovery's CalRecycle Grants program. STAFF RECOMMENDATION: Adopt the Resolution Authorizing Submittal of Applications for CalRecycle Grants for which the City of Dublin is Eligible. 4.6. Annual Report of Developer Impact Fee Funds Deposits: Pursuant to Government Code Sections 66002, 66006, and 66008 (AB1600) State law requires the City to review and report on an annual basis the status of Development fees collected to finance public improvements. This report covers activity which occurred in these funds during Fiscal Year 2013-14. The analysis has determined that all funds held for more than five years are necessary to complete identified projects. STAFF RECOMMENDATION: Accept the Annual Report of Developer Impact Fee Funds for the Year Ended June 30, 2014; and adopt ;` December 2,2014 Dublin City Council Agenda Page 2 of 4 the Resolution Making Findings Regarding Unexpended Traffic Mitigation Contributions and Downtown Traffic Impact Fees for Fiscal Year 2013-14. 4.7. Adoption of Ordinance Amending Chapter 2.24 of the Dublin Municipal Code Pertaining to the City's Conflict of Interest Code The City Council will consider adoption of an ordinance amending the City of Dublin Conflict of Interest Code. STAFF RECOMMENDATION: Waive the reading and adopt the Ordinance Amending Dublin Municipal Code Chapter 2.24, Pertaining to the City's Conflict of Interest Code. 5. WRITTEN COMMUNICATION—None. 6. PUBLIC HEARINGS—None. 7. UNFINISHED BUSINESS 7.1. Dublin Pioneer Cemetery Renovation and Expansion The City Council will consider approval of the Dublin Pioneer Cemetery Renovation and Expansion Conceptual Design. Staff has been working with Royston Hanamoto Alley & Abey (RHAA) to conduct the cemetery expansion feasibility study and prepare a Master Plan update for the Dublin Pioneer Cemetery. STAFF RECOMMENDATION: Approve the conceptual design. 7.2. Memorandum of Understanding for Heritage Center at Camp Parks The City Council will consider approving a Memorandum of Understanding between the City and Parks Regional Forces Training Area to develop a Heritage Center at the new main gate at Camp Parks. The Heritage Center would be used to exhibit the collection of historical artifacts the City has on permanent loan from the U.S. Army. STAFF RECOMMENDATION: Adopt the Resolution Approving the Heritage Center Usage Memorandum of Understanding between the City of Dublin and Parks Reserve Forces Training Area, and authorize the City Manager to execute an Agreement with a Consultant for an amount not to exceed $85,000 to prepare design and construction documents for the Heritage Center. 8. NEW BUSINESS 8.1. Certification of November 4,2014 Election Results The City has received and will certify the November 4, 2014 election results for the Office of Mayor, two City Councilmembers, and one measure,Measure T, from the Alameda County Registrar of Voters. STAFF RECOMMENDATION: Adopt the Resolution Reciting the Facts of the General Municipal Election held on November 4, 2014, Declaring the Results Thereof, and Such Other Matters as are provided by Law. 8.2. Presentation of Plaque to Outgoing Mayor Tim Sbranti Mayor Tim Sbranti has served on the Dublin City Council as Mayor and Councilmember from 2006 through 2014. The City will present a plaque to him in appreciation of his dedicated service to the City. STAFF RECOMMENDATION: Present the plaque and receive comments from outgoing Mayor Tim Sbranti. 8.3. Administration of Oath of Office to Newly Elected Mayor and City Councilmembers The Oath of Office will be administered to the newly elected Mayor and City Councilmembers. STAFF RECOMMENDATION: Administer the Oath of Office to the newly elected Mayor and City Councilmembers. December 2,2014 Dublin City Council Agenda Page 3 of 4 is 8.4. Selection of Vice Mayor The City Council's policy is to select, in December of each year, a member of the City Council to serve as Vice Mayor for a period of one year. In the absence of the Mayor, the Vice Mayor would become Mayor Pro Tempore and would assume the temporary responsibilities of the Mayor. STAFF RECOMMENDATION: Determine who shall serve as Vice Mayor for a one-year period. 8.5. City Council Vacancy Created by Election of Councilmember Haubert as Mayor at the 2014 General Municipal Election It appears from the preliminary vote count that Councilmember Haubert was elected as the Mayor of Dublin on November 4, 2014. The official results from the Registrar of Voters will be certified by the City Council at the December 2, 2014 City Council Meeting. Councilmember Haubert's term as Mayor would then become effective on December 2, 2014, when he is sworn in to office. Councilmember's current term on the City Council does not expire until December 2016. As a result, upon Councilmember Haubert's swearing in as Mayor, there will be a vacancy on the City Council. The City Council's options to fill the vacant City Council position are as follows: 1) Make an appointment by January 30, 2015; 2) Hold a Special Election on June 2, 2015 (will incur special election costs); or, 3) Adopt an Urgency Ordinance to allow the City Council to Call a Special Election and Appoint a Temporary Successor until a Permanent Successor is elected at the Special Election on June 2, 2015. STAFF RECOMMENDATION: Discuss the following options and provide direction to Staff: Option 1: Make an appointment by January 30, 2015; Option 2: Hold a Special Election on June 2, 2015 (will incur special election costs); or, Option 3: Adopt an Urgency Ordinance to allow the City Council to Call a Special Election and Appoint a Temporary Successor until a Permanent Successor is elected at the Special Election on June 2, 2015. 9.
