CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG - First Class Scout & Patrol Leader viet Nguyen, Troop 922 3. ORAL COMMUNICATIONS 3.1 Introduction of New Employee, Engineering Technician Mark Hicks 3.2 Appointment of Dr. Harvey Scudder to Alameda County Mosquito Abatement District Board of Directors and Informational Report by Dr. Scudder on Board's activities At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Clerk to have their particular concern placed on the agenda for a future meeting. The City Council CANNOT deliberate or take action on a non-agenda item UNLESS there is factual evidence presented to the Council indicating that the subject brought up falls into one of the exceptions under Government Code Section 54954.2. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the Consent Calendar for purpose of public input may request the City Council to remove the item. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes: Regular Meeting of November 25, 1991 STAFF RECOMMENDATION: Approve 4.2 Authorization to Apply for Funding for Transportation Development Act (TDA) Projects This Resolution would authorize City Staff to apply for TDA funds for 2 projects. Phase VI of handicap ramp construction and construction of a bike path parallel to the railroad right-of-way between Dougherty Road and the Dublin Meadows development. The maximum funding the City could receive is $75,000 per project. STAFF RECOMMENDATION: Adopt Resolution. 4.3 City Treasurer's Investment Report as of November 30, 1991 STAFF RECOMMENDATION: Receive Report. 4.4 Finance Report for Period Ending November 30, 1991 STAFF RECOMMENDATION: Receive Report. 4.5 Warrant Register Dated December 9, 1991 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATION 5.1 Site Conditions at Dublin Meadows Project The City Council will discuss establishing a public hearing date to consider abatement of an existing public nuisance on the construction site of the Dublin Meadows project on Amador Valley Boulevard, east of Stagecoach Road. The abatement procedure would follow the provisions of Chapter 7.52 of the Dublin Municipal Code. The options for Council consideration are: 1) utilize the abatement procedure to eliminate the nuisance; 2) institute a civil suit to abate the nuisance through the courts; or 3) wait until construction is reactivated. STAFF RECOMMENDATION: Receive Staff presentation on project status; receive testimony from Heritage Commons Homeowners Association; set hearing date for January 27, 1992 and direct Staff to send out notices as required. 5.2 Initiation of Amendment to Sign Ordinance - Request from Almond Plaza, David Malcolm - PA 91-081 The Applicant is requesting the City Council to initiate an amendment to the Sign Ordinance to allow permanent decorative flags and banners within commercial retail centers. STAFF RECOMMENDATION: Initiate Sign Ordinance amendment and provide Staff direction concerning planning and zoning issues. 5.3 Association of Bay Area Government's (ABAG) position on Regional Government Prior to ABAG's General Assembly meeting to be held in March, 1992, local communities and subregional organizations have been given time to consider the issues and present recommendations regarding a regional government concept. STAFF RECOMMENDATION: Consider calling meeting of Tri-Valley Joint Council to discuss what position the Tri-Valley Council will take on the recent action of the ABAG General Assembly and set a date to meet prior to December 25, 1991. 6. PUBLIC HEARING 6.1 Density Bonus Ordinance This Ordinance would allow density bonuses and other incentives to developers providing housing for very low and low income households and for senior citizens as required by Law. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 7. UNFINISHED BUSINESS 7.1 Award of Bid - Nielsen and Cronin School Play Area Improvements, Contract 91-10 The low bid received, $48,421.37, is within funds budgeted for construction. STAFF RECOMMENDATION: Adopt Resolution awarding bid to A-1 Fencing and Playgrounds, including Alternates 1 and 2, and authorize Mayor to execute agreement. 8. NEW BUSINESS 8.1 Report on Directly Elected Mayor Councilmember Burton requested that a report be prepared for Council consideration related to the possibility of placing the issue of a directly elected Mayor on the June, 1992 ballot. STAFF RECOMMENDATION: Receive report. 8.2 Amendment to Agreement dated March 11, 1991 between Dublin, Pleasanton, Alameda County and the Surplus Property Authority of Alameda County regarding Construction of a Two-Lane Access Road Parallel to I-580 This agreement provides for construction and financing of a road connection between Dougherty Road and Tassajara Road. The amendment concerns a proposed change in road alignment through the County's property. STAFF RECOMMENDATION: Adopt Resolution approving amendment to agreement. 8.3 Annual Report on Status of General Plan Progress Government Code Section 65400(b) requires that an annual report be made to the City Council on the status of the General Plan and progress in its implementation, including the progress in meeting its share of regional housing needs. STAFF RECOMMENDATION: Receive Report. 8.4 Annual st. Patrick's Day Celebration The City Council will review the plans made to date for the annual st. Patrick's Day celebration and take action on: the parade route; sidewalk sales; promotional signs; and site for community celebration. STAFF RECOMMENDATION: Determine parade route, approve site for celebration and adopt Resolution. 8.5 Proposed Draft Joint Exercise of Powers Agreement (JPA) for Waste Management In 1990, the City Council adopted a Joint Powers Agreement for Waste Management. At that time, there were several concerns raised by member agencies and the Waste Management Authority supported a review of the JPA following its adoption. The Authority Staff have requested input from agencies on a revised agreement. STAFF RECOMMENDATION: Review proposed draft agreement and provide input. 9. OTHER BUSINESS 10. CLOSED SESSION - None 11.
