PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is not on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Clerk to have their particular concern placed on the agenda for a future meeting. 3.1 Presentation by Representative of Emergency Service Network 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public input may request the City Council to remove the item from the consent calendar. The request may be rnade at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes of Adjourned Regular Meeting - November 27, 1988 Regular iVleeting - November 28, 1988 Adjourned Regular Meeting - November 29, 1988 STAFF RECOMMENDATION: Approve 4.2 City Treasurer's Investment Report for Period Ending November 30, 1988 STAFF l{ECOMlvlENDA T ION: Approve 4.3 Rescind Rejectioll of Storm Drain Easement, Lot 17, Tract 4749 (11550 Fenwick Court) and Acceptance of Easement; Acceptance of Grant Easement from Property Owner In October 1987, the City Council conditionally accepted maintenance of a large drainage structure located on private property in the Foothill Estates development. The developer has made the required conditional improvements, and these actions provide easements so that the maintenance can be carried out by the City. STAFF KECOMMENDATION: Adopt Resolutions 4.4 Financial Statements for Period Ending November 30, 1988 STAFF RECOMMENDATION: Approve 4.5 Intent to Abandon Western Terminus of Betlen Drive Adoption of this Resolution sets a public hearing date of February 13, 1989 for the abandonment of excess right-of-way at the westernmost end of Betlen Drive. STAFF RECOMMENDATION: Adopt Resolution 4.6 Award of Bid - Contract No. 8~-8 Wood Soundwalls - West Side of San Ramon Road This project provides for construction of a wood sound attenuation fence along the west side of San Ramon Road. The low bid received is in excess of funds budgeted for the project. STAFF RECOMMENDATION: Award bid to Gateway Landscape; authorize Mayor to execute agreement; authorize budget transfer in the amount of $86,764 from the San Ramon Road Phase III project budget. 4.7 Dougherty Regional Fire Authority Fire Impact Fee The Fire Authority presently collects a Fire Impact Fee for new development. This fee has historically been collected at the time building permits are issued by the City. As a result of the passage of Assembly Bill 1600, the City Attorney's Office has recommended that tIle City adopt a resolution which requires that the Fire Impact Fee be paid to the Authority prior to building permit issuance. The Fire Authority Joint Powers Agreement requires that Fire Impact Fees be spent on acquisition of capital assets for the Fire Department. The Fire Chief has indicated that new development could also impact the ability of existing fire facilities to provide service and therefore recornmends that the Joint Powers Agreement be amended to permit use of Fire Impact Fees for equipment replacement in addition to capital acquisition. STAFF RECOMMENDATION: Adopt Resolutions 4.8 Warrant Register dated December 12, 1988 STAFF RECOMMENDATION: Approve 4.9 Development of Dublin Municipal Code A municipal code would incorporate nearly all of the City's Ordinances into one volurne which would rnake it easier for City Officials, as well as the public to use. STAFF RECOMMENDATION: Approve Agreenlent with Book Publishing Company and authorize Mayor to execute same. 5. WKITTEN COMMUNICATIONS - None 6. PUBLIC HEARING 6.1 Appeal of PA ~7-122 Hucke Signs Conditional Use Permit and Site Development Review, 7016-7150 Village Parkway Appeal of Planning Commission action approving a Conditional Use Permit request for C-2-B-40 Special Easement Sign and Site Development Review for Sign Program for wall signs and approval of C-2-B-40 Directory Signs. This item was continued from the November 14, 1988 City Council meeting. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolutions 1) denying the Applicant's request for a CUP for a Special Easement Sign as the Applicant's request does not comply with the Zoning Ordinance requirements for Special Easement Signs, and 2) approving the SUR for a maximum of four C-2-B-40 directory signs (one per legally subdivided lot) which would apply to existing legally subdivided lots or any future lot line adjustments which may be approved. Approval of the SDR includes conditions to require clean up of the site and upgrading of the front landscaping to include 50% living plant material (turf, shrubs and trees), -OR- give Staff and Applicant direction and continue the matter. 6.2 Appeal of Order to Abate Vehicles at 8326 Davona Drive, William Lopachuk A violation of the City of Dublin Abandoned Vehicle Ordinance has been processed by City Staff. The owner of the vehicles has requested an appeal of the Order to Abate the Public Nuisance. STAFF RECOMMENDATION: Conduct public hearing; deliberate; determine effective date for abatement and adopt resolution 6.3 Dougherty Road @ Amador Valley Boulevard - Designation of Signalized Intersection and Prohibition of U-Turns for Northbound Traffic The City's Traffic Ordinance requires that signalized intersections be designated by resolution and u-turns be prohibited by ordinance. A signal is currently under construction at this intersection. U-turns roust be prohibited for northbound traffic due to lack of sufficient space. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance prohibiting u-turns on an urgency basis; adopt Resolution designatiIlg signalized intersection. 7. UNFINISHED BUSINESS - None 8. NEW BUSINESS 8.1 West Dublin General Plan Amendment Study and Specific Plan Study Requests PA 88-144 Eden Development Group and Schaefer Heights Incorporated have requested General Plan Amendment Studies and Specific Plan Studies covering a total of approximately 4,000 acres in the West Dublin area. The applicants intend to develop upscale country club type communities with an 18 hole championship golf course and other substantial amenities. STAFF RECOMMENDATION: Determine whether or not to authorize studies. If studies are authorized, direct Staff to hire Contract Planner, initiate discussions with other agencies, assemble consultant team, bring contract and other associated documents to City Council for action. 8.2 ABAG Housing Needs Determinations ABAG has prepared a report identifying each locality's share of the regional housing needs. The report gives a 50% discount to the number of housing units needed for new workers rather than fully accounting for the region's jobs/housing needs. STAFF RECOMMENDATION: Adopt Resolution revising Dublin's share of the regional housing needs. 9. OTHER BUSINESS 9.1 Status Keports on Council Committee Assignments The Mayor has requested that members of the Council be given an opportunity at the City Council meeting to report to the Council regarding any activities being undertaken by committees or other bodies to which the individual Councilmembers are appointed. STAFF RECOMMENDATION: Provide Council with a status report on committee assignments and activities, if appropriate. 10. CLOSED SESSION - None 11. AUJOU~NMENT - Adjourn to Special Adjourned Regular Meeting for continuation of consideration of Hansen Hills Ranch project, Tuesday, December 13, 1988, 7:00 p.m., Dublin School District Board Meeting Room, 7471 Larkdale Avenue. NOTICE: The Regular City Council meeting scheduled for Monday, December 26, 1988 has been cancelled.
