PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is not on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Manager to have their particular concern placed on the agenda for a future meeting. 3.1 Endorsement of the Alameda County Senior Housing Programs Proposal This item requests endorsement and participation by the City in a Countywide program for the development, construction and acquisition of multi-family rental housing projects for very low income seniors and disabled persons, including calling for a Countywide election to authorize implementation of the program. STAFF RECOMMENDATION: Receive Staff presentation; adopt resolutions endorsing the City of Dublin's participation in a Countywide program for the development, construction and acquisition of multi-family rental housing developments for very low income elderly and disabled persons and calling by the County of a Countywide election to authorize the implementation of the program. 3.2 Proclamation "Drunk and Drugged Driving Awareness Week" December 13-19, 1987 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public input may request the City Council to remove the item from the consent calendar. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes of Regular Meeting of November 23rd, and Adjourned Regular Meeting of November 30, 1987 STAFF RECOMMENDATION: Approve 4.2 Warrant Register dated December 14, 1987 STAFF RECOMMENDATION: Approve 4.3 East Dougherty Hills Park Landscape Architectural Services The firm of Singer & Hodges has prepared park plans consistent with an agreement approved on June 20, 1986. The remaining work involves monitoring of the construction activities as provided for in the proposed addendum. STAFF RECOMMENDATION: Authorize Mayor to execute addendum. 4.4 City Treasurer's Investment Report as of November 30, 1987 STAFF RECOMMENDATION: Accept report 4.5 Replacement of Subdivision Agreement and Securities, Tract 5388 (Kildara Properties) Kildara Properties has purchased Tract 5388 from Morrison Homes and is requesting substitution of developer agreement and bonds. STAFF RECOMMENDATION: Adopt resolution approving substitution of agreement and bonds. 4.6 Request to Install Banner - American Cancer Society The American Cancer Society is requesting approval to install a banner on the City's banner poles. STAFF RECOMMENDATION: Authorize Staff to issue permit and install banner upon receipt of Certificate of Insurance. 4.7 Award of Bid - Senior Center Remodeling - Contract No. 87-10 A total of 8 bids were received. The low bidder is Lawrence Johnson Construction, with a bid of $86,532. This bid is within the amount budgeted for construction of this project. STAFF RECOMMENDATION: Adopt Resolution awarding bid to Lawrence Johnson Construction and authorize the Mayor to execute the agreement. 5. WRITTEN COMMUNICATIONS - None 6. PUBLIC HEARING 6.1 Crest Enterprises & The New Ewe - Planned Development Rezoning Request A Planned Development Rezoning request to expand the permitted uses on the Green Store site (APA 941-1550-4), 11873 Dublin Boulevard to allow medical offices, health club/fitness center and beauty and tanning salon in addition to the bank, savings & loan and restaurant uses currently permitted. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt resolution regarding Negative Declaration; adopt resolution regarding PD Rezoning; waive reading and introduce ordinance amending Zoning Ordinance; bring ordinance back for second reading at December 21, 1987 Special Council meeting; OR continue item and give Staff direction. 6.2 Ordinance Establishing Minimum Standards and Providing Regulations for Grading, Construction, and Maintenance of Landfills and Excavation and for Control of Erosion and Sediment and Repealing City of Dublin Ordinance 82-19 This Ordinance was introduced at the City Council meeting of November 23rd, and is essentially the same as the Alameda County Grading Ordinance which the City adopted by reference in 1982. Portions of the Building Code relating to grading have been included as well as insurance requirements for grading permits. STAFF RECOMMENDATION: Conduct Public Hearing; deliberate; waive reading and adopt ordinance. 6.3 Ordinance Relating to Bingo Games This Ordinance was introduced at the City Council meeting of November 23rd, and establishes eligibility and application procedures for the operation of bingo games within the City limits of Dublin. STAFF RECOMMENDATION: Conduct Public Hearing; deliberate; waive reading and adopt ordinance. 6.4 Ordinance which adopts the 1985 Edition of the Uniform Building Code, 1985 Uniform Plumbing Code, 1985 Uniform Mechanical Code, 1985 Uniform Housing Code and 1987 National Electrical Code This Ordinance, which was introduced at the November 23, 1987, City Council meeting, will repeal Ordinance No. 2-84, which was the original Ordinance adopting the 1982 Uniform Code. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt ordinance. 6.5 Ordinance Providing A Procedure for Abatement of Abandoned Vehicles This Ordinance would provide a program for the abatement and removal of abandoned vehicles from public and private property. The program would be administered by the City Manager and enforced by any duly authorized representative. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and introduce ordinance. 6.6 Ordinance Regulating Public Dances This Ordinance, which is part of the comprehensive Municipal Code revision process, regulates public dances and requires the issuance of a dance permit for the event to be lawful. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and introduce ordinance. 7. UNFINISHED BUSINESS 7.1 Eastbound Dublin Boulevard @ Village Parkway, Second Left Turn Lane Restriping and signalization improvements to allow a second eastbound left turn lane would significantly upgrade the service level at this intersection. Estimated cost of the improvements is $20,000. STAFF RECOMMENDATION: Approve 80' of striping for westbound right turn lane onto northbound Village Parkway and direct Staff to proceed with one of the following options: 1) include the full scope of work within the 1988-89 proposed CIP, or 2) begin the design process at this time and include the construction cost in the 1988-89 proposed CIP, which will require a budget transfer in the amount of $5,000. 8. NEW BUSINESS 8.1 Assumption of Aquatic Programs and Scheduling Responsibility for Aquatic and Park & Recreation Facilities from the Dublin San Ramon Services District The Council will consider approving a memorandum of understanding which transfers the responsibility for aquatics programs and facility scheduling from DSRSD to the City. STAFF RECOMMENDATION: Adopt Resolution approving memorandum of understanding. 8.2 Park Names - East Dougherty Hills Park & Dougherty Hills Park The Council will consider names for the 8 acre park site known as East dougherty Hills Park and the 90 acre park site known as Dougherty Hills Park. STAFF RECOMMENDATION: Determine a name for the 8 acre park site. 8.3 Fifth Annual St. patrick's Celebration This celebration is scheduled for Saturday, March 19, 1988. The Council will review the tentative plans which include a parade, community celebration and dinner/dance. STAFF RECOMMENDATION: Approve St. patrick's Celebration. 9. RECESS TO CLOSED SESSION-Pending Litigation, Government Code Section 54956.9(a), City of Dublin vs. 1) John & Sal Enea 2) The Sawmill 3) McCartney 10. OTHER BUSINESS 10.1 Consideration of a resolution amending Resolution No. 41-87 related to Approving and Establishing Findings and General provisions for a PD, Planned Development Rezoning concerning PA87-0l8, Enea Plaza PD and other actions related to closed session discussion of Enea vs. City of Dublin. 11. ADJOURNMENT - Adjourn to Special Meeting on Monday, December 21, 1987, 7:30 p.m., Dublin Library. NOTICE: Regularly scheduled meeting of December 28, 1987 has been cancelled.
