CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Clerk to have their particular concern placed on the agenda for a future meeting. The city Council CANNOT deliberate or take action on a non-agenda item UNLESS there is factual evidence presented to the Council indicating that the subject brought up falls into one of the exceptions under Government Code section 54954.2. 3.1 Proclamation honoring Elizabeth Schmitt for her service on the Park & Recreation Commission 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the Consent Calendar for purpose of public input may request the City Council to remove the item. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes of Regular Meeting of December 11, 1989 STAFF RECOMMENDATION: Approve 4.2 Authorization to Apply for Funding for Transportation Development Act Projects City Staff is proposing to apply for funding for two projects: Phase II of the Catch Basin Grate Replacement Program and Phase II of the Dougherty Road bike path at $75,000 per project. STAFF RECOMMENDATION: Adopt Resolution 4.3 Agreement to Install Underground Facilities on Dougherty Road This agreement authorizes PG&E to underground utilities on Dougherty Road between the SPRR and Amador Valley Boulevard at a net cost to the City of $125,501. This net amount is within funds budgeted; however, as there is a $50,680.57 pass through of developer funds in addition to the City payment, both the revenue and expenditure budgets must be increased by this amount. STAFF RECOMMENDATION: Adopt Resolution; authorize additional appropriation of $50,680.57; and authorize payment to PG&E in the amount of $176,181.57 under this agreement. 4.4 Application for Leave to Present a Late Claim - Ed Longhorn, Claim #0049DU A "Late Claim" has been presented to the City of Dublin. Pursuant to State Law, a claimant has 6 months from the date of the incident to present a claim. A late claim applica- tion may be submitted up to one year after the incident. STAFF RECOMMENDATION: Reject the Application to Present a Late Claim and direct Staff to provide the appropriate response. 4.5 Exception to Competitive Bidding Requirement - Senior Center Roof Repair The low bid received from Dolin and Son Roofing is $13,250 plus dry rot repair, if needed. STAFF RECOMMENDATION: Waive competitive bidding requirement of purchasing ordinance and authorize Staff to negotiate a contract with Dolin and Son Roofing; approve transfer of funds from unallocated reserves in the amount of $14,000. 4.6 Warrant Register Dated December 21, 1989 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATION - None 6. PUBLIC HEARING 6.1 Hansen Hill Ranch/Bren Company Annexation, PA 89-062 At the November 27 and December 11 City Council meetings, the Council approved the Tentative Map and PD Prezoning Ordinance for the Hansen Hill Ranch site. In order for the project site to come under the City of Dublin's jurisdiction, the area must be annexed to the City. State Law requires the City Council to pass a resolution of Application to LAFCO and approve an agreement with the County for the exchange of property tax. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolutions 7. UNFINISHED BUSINESS 7.1 Dublin Swim Center Pool Renovation Bid results will not be available in time to include with the posted agenda, but will be presented orally at the City Council meeting. STAFF RECOMMENDATION: Receive oral presentation and take appropriate action with regard to awarding bid. 8. NEW BUSINESS 8.1 Review of Service Changes Required to Meet State Requirements for Recycling and Household Hazardous Waste (HHW) State Legislation which takes effect January 1, 1990 requires the City to implement Recycling and Household Hazardous Waste Collection. Both programs were under review prior to the development of the State Law. Staff has evaluated the program options and costs associated with the service. STAFF RECOMMENDATION: 1) Receive Staff Report; 2) Provide input on desired components of a Residential Recycling Program and select method of pursuing a Residential Recycling Program; 3) Review and provide input on the current program plans for the Household Hazardous Waste collection; 4) Select a method of funding the Household Hazardous Waste Collection. 8.2 1990 Garbage Collection Service and Rates Waste Management is the company that presently provides garbage collection services to the City of Dublin under an existing franchise agreement which expires in 1995. There has not been a garbage rate increase since 1983. The Joint Refuse Rate Review Committee, of which the City is a member, is recommending that each member agency adopt a garbage collection rate increase of 16% effective January 1, 1990. STAFF RECOMMENDATION: Receive presentation from Staff and Consultant; discuss service options; maintain current backyard service arrangement with Waste Management Inc., and approve in concept an across-the-board garbage rate increase for basic garbage service; if the Council concurs with Staff's recommendation and is interested in pursuing the inclusion of recycling and/or household hazardous waste programs as part of the rate base, direct Staff to prepare the appropriate resolution modifying the rates for Council consideration at its meeting of January 8, 1990. 9. OTHER BUSINESS 10. CLOSED SESSION - Personnel, Government Code Section 54957.6 11. ADJOURNMENT - The December 26, 1989 meeting has been cancelled. The next Regular Meeting will be on Monday, January 8, 1990, at 7:30 p.m.
