Initiation of litigation pursuant to (File 640-30) Government Code Section 54956.9, subdivision c: One Case REPORT OF CLOSED SESSION ACTION 3.ORAL COMMUNICATIONS 3.1Introduction of New Employees: Vivian Lau, Recreation Technician and Regina Adams, Assistant Planner (Code Enforcement) (File 700-10) 3.2Youth Advisory Committee Appointments (File 110-30) The City Council will consider the Mayor's recommendations to fill the vacancies on the Youth Advisory Committee. STAFF RECOMMENDATION: Confirm Mayor's appointments. 3.3City Council Organization/Committee Appointments/Assignments (File 110-30) The Council will review the list of committees on which Councilmembers currently serve. STAFF RECOMMENDATION: Review list and provide appropriate direction to Staff. 3.4Selection of Vice Mayor (File 610-20) The position of Vice Mayor is filled on an annual basis. The Council will discuss and determine who will serve in the position of Vice Mayor until December, 2000. STAFF RECOMMENDATION: Elect and Install Vice Mayor. 3.5Appointment to Alameda County Mosquito Abatement District (File 110-30) Members of this Board serve as an interface between the District and the appointing City Council. Mayor Houston recommends the reappointment of Harvey I. Scudder, Ph.D., who has served on this Board since 1983. Resolution STAFF RECOMMENDATION: Adopt reappointing Dr. Scudder to a term ending January 2, 2002. COMMENTS SHOULD NOT EXCEED At this time, the public is permitted to address the City Council on non-agendized items. THREE (3)MINUTES . In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4.CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes STAFF RECOMMENDATION: Approve 4.2Acceptance of Grant from the Altamont Cruisers (File 150-70) The Altamont Cruisers Car Club has donated $1,000 to the Dublin Police Services Drug Education Program. The Car Club has membership throughout the Tri-Valley and is based out of Livermore. The Car Club holds various fundraisers with the majority of the proceeds going to local organizations. STAFF RECOMMENDATION: Accept Grant; approve Budget Change Form; and direct Staff to prepare formal acknowledgment to donor. 4.3Acceptance of Gift from Valley Community Health Center (File 150-70) The Valley Community Health Center has donated $1,000 to Dublin Police Services. This donation is a direct result of work DPS Staff performed to reduce tobacco sales to minors. The funds will be used to purchase equipment and supplies related to drug education programs. STAFF RECOMMENDATION: Accept gift; approve Budget Change Form; and direct Staff to prepare a formal acknowledgment to donor. 4.4Authorization to Advertise for Bids - Downtown Street Light Additions, Contract 00-01 (File 600-35) This project wouldinstall street lighting on 3 commercial streets: Sierra Court just north of Dublin Boulevard, Sierra Lane just west of Dougherty Road, and Dublin Boulevard just west of Golden Gate Drive. The cost of the project is proposed to be paid through Street Light Assessment District reserve funds. STAFF RECOMMENDATION: Authorize Staff to advertise for bids. 4.5Annual Report of Developer Impact Fee Funds Deposits: Pursuant to Government Code Sections 66001, 66006 and 66008 (AB 1600) (File 390-20) The City is required to review and report on an annual basis, the status of Development Mitigation fees collected. This includes Park Dedication Funds, Public Facility Fees, Fire Impact Fees, Affordable Housing Fees and Traffic Impact Fees. The report describes balances available, as well as activity which occurred in these funds during FY 1998-99. The analysis has determined that all funds held for more than 5 years are necessary to complete identified mitigation projects. Resolution STAFF RECOMMENDATION: Accept Report and adopt . 4.6Amendment to Agreements for the Temporary Displays of Sculpture at the Dublin Civic Center (File 600-30) Two large scale sculptures are on loan to the City and the agreements have expired. The parties to the agreements desire to extend the loans for an additional year. STAFF RECOMMENDATION: Authorize Mayor to execute amendments to agreements. 4.7Award of Bid – Street Banner Replacements (File 350-20) This purchase includes replacements for older St. Patrick’s Day and patriotic holiday banners. The low bid received from Dekra-Lite ($7,725.60), is within funds budgeted for this purchase. Resolution. STAFF RECOMMENDATION: Adopt 4.8Acceptance of Gift to City (File 150-70) The Parks & Community Services Department received a grant of $6,228 from the Tri-Valley Community Fund to purchase a portable roller hockey rink. STAFF RECOMMENDATION: Accept gift; direct Staff to prepare formal acknowledgment to donor; and approve Budget Change Form. 4.9Award of Bid, Contract 99-14, Median Paver Repair (File 600-35) This project will re-level median paver stones that have been offset due to settlement or tree root intrusion. Resolution STAFF RECOMMENDATION: Adopt awarding bid to WSP Trucking, Inc. ($84,262.50). 4.10Authorization to Solicit Bids - Arterial Landscaping Improvements (File 600-35) This contract would upgrade and enhance median landscaping along sections of San Ramon Road, Village Parkway, Dublin Boulevard and Amador Valley Boulevard. STAFF RECOMMENDATION: Authorize Staff to solicit bids. 4.11Approval of Master Agreement with Caltrans for Federal-Aid/State Funding Projects within the City of Dublin (File 600-50) This agreement between Dublin and Caltrans is a necessary step in the processing of Federal monies to the City for Street improvement and maintenance projects. Resolution STAFF RECOMMENDATION: Adopt approving Master Agreement with Caltrans and authorize the Public Works Director to execute the agreement and any subsequent project related supplemental agreements/forms. 4.12Preliminary Financial Report for the Month of November 1999 (File 330-50) STAFF RECOMMENDATION: Receive Report. 4.13Contract Change Order - Contract 99-04, Goodland Landscape Construction, Inc., for Emerald Glen Park, Phase I (File 600-35) Goodland Landscape Construction has submitted a change order for $48,070 for additional costs associated with the artificial rock play mound in the children's play area. The additional costs are because of increased structural requirements resulting from the soil conditions on the site as well as increases in the load requirements of the rock. STAFF RECOMMENDATION: Approve Change Order #27. 4.14Acceptance of Work, Contract 99-09 (File 600-35) This project replaced an outdated heating and air conditioning system at the City's Shannon Community Center. STAFF RECOMMENDATION: Accept improvements and authorize $5,599 payment to Breeze Air Systems. 4.15Dublin Swim Center Waterslide Installation, Contract 99-15 (File 600-35) The 1998-2003 CIP includes funding for the installation of a new waterslide. Plans and specifications have been prepared and the project is ready to bid. STAFF RECOMMENDATION: Authorize Staff to advertise for bids. 4.16Heritage and Cultural Arts Programming Assessment Agreements (File 600-30) In order to conduct an assessment of cultural arts and heritage programming in the community, it is recommended that the City enter into agreements with AMS Planning and Research and Lynne Baer. STAFF RECOMMENDATION: Approve Agreements and Budget Change Form. 4.17Warrant Register ($2,597,720.76) dated December 21, 1999 (File 300-40) STAFF RECOMMENDATION: Approve 5.WRITTEN COMMUNICATIONS - None 6.PUBLIC HEARING 6.1Repeal of 20-Minute Parking Zone on Village Parkway (File 570-20) This is the second reading of a proposed ordinance to repeal a 20-minute parking zone on Village Parkway in front of the Post Office in order to allow unrestricted parking. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.2Trumark Townhomes (Scarlett Place) Mitigated Negative Declaration, Site Development Review, and Planned Development Rezone for a 4-acre site east side of Dougherty Road, immediately southeast of the Park Sierra apartment complex PA 99-030 (File 450-30) The City Council will be considering Mitigated Negative Declaration, PD Rezone and SDR requests by Trumark Companies for a residential project consisting of 71 Townhomes with floor plans ranging in size between 1,225 to 2,034 square feet. STAFF RECOMMENDATION: The Applicant has requested to remove the item from the agenda and to continue it indefinitely. 6.3Zoning Ordinance Amendment to Chapter 8.76, Off-Street Parking and Loading Regulations, of the Dublin Municipal Code (Zoning Ordinance) PA 99-018 (File 570-20) This is the second reading of an Ordinance which would make changes to DMC Chapter 8.76, Off-Street Parking and Loading Regulations. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT OrdinanceResolution ; and adopt establishing the enforcement policy for the Zoning Ordinance, Building code, Housing Code, and Property Maintenance Ordinance, and rescinding Resolution No. 134-97. 6.4Amendment to the Dublin Municipal Code, Title 5 to add Chapter 5.60 Heritage Tree Ordinance PA 99-045 (File 530-80) This is the second reading of an Ordinance to add a Heritage Tree Ordinance to the Dublin Municipal Code which identifies the species and size of trees that are considered heritage trees and which establishes regulations for the protection and removal of heritage trees within the City. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.5Tri-Valley SPCA Development Agreement PA 99-004 (File 600-60) This is the second reading of an Ordinance approving a DA between the City of Dublin and the Oakland SPCA for the Tri-Valley SPCA project. The DA is required by the Eastern Dublin Specific Plan. Items contained in the DA include, but are not limited to, the financing and timing of infrastructure; payment of traffic, noise and public facilities impact fees; and general provisions. Additional City Council direction was given to return final colors for Council review before the Certificate of Occupancy is issued for the building. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.6Zoning Ordinance Amendment to Chapter 8.84 Sign Regulations of the Dublin Municipal Code pertaining to vehicle signs and temporary promotional signage related to balloons, pennants and streamers PA 98-058 (File 400-30) This proposed Ordinance would amend Chapter 8.84 of the DMC (Zoning Ordinance) to revise that portion relating to Temporary Promotional Signs, Vehicular signs, and to include provisions for Balloons, Pennants and Streamers. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance; and continue public hearing to January 18, 2000 Council meeting. 6.7Consideration of adoption of a Resolution of Necessity directing the filing of Eminent Domain Proceedings to acquire Real Property for the widening of portions of Dublin Boulevard, Central Parkway, Gleason Drive and Tassajara Road (File 670-20) The property within this eminent domain proceeding is just west of Tassajara Road in Eastern Dublin and generally between I-580 and Gleason Drive. Portions of these streets are needed to provide traffic mitigation street improvements within the Eastern Dublin Specific Plan. Resolution STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt . 7.UNFINISHED BUSINESS 7.1Alternate Street name for Previously Proposed Street Name of "Park Street" in Eastern Dublin (File 820-60) The City Council rejected the name of a street connecting Dublin Boulevard and Central Parkway in Eastern Dublin. The Mayor has suggested allowing the Dublin Partners in Education to name the street to raise money for the Dublin School District Technology project. STAFF RECOMMENDATION: Authorize DPIE to name the street through a fund-raising event to aid the Dublin School District/City of Dublin Technology Project, with the provision that the naming of the street is subject to the standard procedures that the City must follow in naming a street, including approval by the City Council. 8.NEW BUSINESS 8.1Review of 1999 Farmers' Market and proposed Farmers' Market Survey (File 470-50) The City Council will review a report on the 1999 Dublin Certified Farmers' Market and a proposed survey to solicit community input to improve the Farmers' Market. STAFF RECOMMENDATION: Provide appropriate direction to Staff. 8.2Renaming of the Dublin Swim Center (File 250-20) The City Council will consider a suggestion by the Mayor that the Dublin Swim Center be renamed the Peter W. Snyder Swim Center. STAFF RECOMMENDATION: Consider. 8.3Donation of Electronic Marquee Sign (File 150-70) Professional Sports Marketing of Dublin has offered to donate to the City an electronic marquee sign. Staff has identified potential locations and uses for the sign for review by the City Council. STAFF RECOMMENDATION: Determine whether to accept the gift and provide appropriate direction to Staff. 8.4Final Financial Report for Fiscal Year 1998-99 and Annual Audit Report (File 310-30) The City of Dublin has compiled and published its Comprehensive Annual financial Report (CAFR), for the FY ending June 30, 1999. This report includes financial statements prepared by Vavrinek, Trine, Day & Co., (VTD), the independent auditors selected by the City Council. STAFF RECOMMENDATION: Receive Report; confirm the designations of Fund Balances for the Non-Residential Recycling Program and Authorized Expenditures for FY 1998-99; and designate $2.4 million of the General Fund fund balance as part of the budget for FY 2000-2001 to cover the unfunded liability for Post Retirement Medical Costs. 8.5U. S. Census 2000 - Complete Count Committee and Outreach Program (File 420-60) The City Council will consider adopting a Resolution supporting the upcoming Census 2000 and forming a complete count committee for purposes of promoting the Census. The Council will consider approving a draft Census 2000 outreach program and budget for the project. Resolution, STAFF RECOMMENDATION: Adopt approve Draft Census 2000 Outreach Program, and approve Budget Change Form. 8.62000 Goals & Objectives Meeting & Budget Study Session (File 100-80) On an annual basis, the City Council holds a special meeting to define the City's Goals & Objectives for the upcoming year, and to review the status of goals for the past year. A Budget Study Session is also held and used as a means for the Council to provide Staff with guidelines for development of the City's Annual Budget for the upcoming year. STAFF RECOMMENDATION: Provide appropriate direction to Staff with regard to approach to use in establishing the City's Goals & Objectives; establish a date for the G&O meeting during the week of February 28, 2000; and determine if Budget Study Session should be held on the same date or at a separate meeting. 9.OTHER BUSINESS - Brief INFORMATIONAL ONLY reports from Councilmembers and/or Staff 10CLOSED SESSION - ( .Held at beginning of meeting) 11ADJOURNMENT - The Regular City Council Meeting of January 4, 2000 has been canceled. .
